Key Points: The achievement of SDG 3 depends on many other SDGs; some SDGs are logically inconsistent, especially in the attempt to increase conventionally defined GDP while preserving natural capital. Any short-term gains for human health from further forest conversion (e.g. food production) creates short- and long-term, direct and indirect health risks for humans, as well as for other biota. Failure to ensure universal access to sexual and reproductive healthcare services (including family planning) will increase pressure on forests at local, regional and global scales. The burning and clearing of forests cause significant harm to health via impaired quality of …

SARS-CoV-2 is a new member of the coronavirus family and caused the pandemic of coronavirus disease 2019 (COVID-19) in 2020. It is crucial to design and produce an effective vaccine for the prevention of rapid transmission and possible deaths wcaused by the disease. Although intensive work and research are being carried out all over the world to develop a vaccine, an effective and approved formulation that can prevent the infection and limit the outbreak has not been announced yet. Among all types of vaccines, epitope-based peptide vaccines outshine with their low-cost production, easy modification in the structure, and safety. In …

Religious Freedom And The Churches: Contemporary Challenges In The United States Today, Richard W. Garnett
Religious Freedom And The Churches: Contemporary Challenges In The United States Today, Richard W. Garnett
Journal Articles
A crucial, but often overlooked, dimension of the human and constitutional right to religious freedom is the autonomy of religious institutions, associations and societies with respect to matters of governance, doctrine, formation and membership. Although the Supreme Court of the United States has affirmed this autonomy in the context of American constitutional law, it is vulnerable, and even under threat, for a variety of reasons, including a general decline in the health of civil society and mediating associations and a crisis of confidence and authority caused by clerical sexual abuse and churches’ failure to respond to it.
Conscience And Justice In Equity: Comments On Equity: Conscience Goes To Market, Paul B. Miller
Conscience And Justice In Equity: Comments On Equity: Conscience Goes To Market, Paul B. Miller
Journal Articles
This short essay introduces and engages several philosophical questions raised by Irit Samet’s Equity: Conscience Goes to Market. Amongst other things, it addresses questions going to: the proper scope of equity; the relationship between equity’s remedial and supplemental functions; whether, and if so, to what extent equity promotes compliance with moral obligations; what, if any, moral aims animate equitable intervention; and whether, and if so, how, equity is distinctively concerned with matters of conscience and “particular” justice. All the while, I express appreciation for Samet’s project while raising some doubts about her views on how law and equity divide labor …
Against Fiduciary Constitutionalism, Samuel L. Bray, Paul B. Miller
Against Fiduciary Constitutionalism, Samuel L. Bray, Paul B. Miller
Journal Articles
A growing body of scholarship draws connections between fiduciary law and the Constitution. In much of this literature, the Constitution is described as a fiduciary instrument that establishes fiduciary duties, not least for the President of the United States. This Article examines and critiques the claims of fiduciary constitutionalism. Although a range of arguments are made in this literature, there are common failings. Some of these involve a literalistic misreading of the works of leading political philosophers (e.g., Plato and Locke). Other failings involve fiduciary law—mistakes about how to identify fiduciary relationships, about the content and enforcement of fiduciary duties, …
Drillpad: A Marching Band Drill Writing Web Application, Justin Wickenheiser
Drillpad: A Marching Band Drill Writing Web Application, Justin Wickenheiser
Technical Library
The idea for this project came as a friend going through the Music Education program lamented how difficult it is to write drill for marching band. There is one primary application that is used for writing marching band drill, and it comes with two major pitfalls: It is complex, and it is expensive. DrillPad is designed with the goal of addressing those pitfalls. Creating a web-based drill writing application makes it available for free, or a low cost. The different features that DrillPad provides revolve around adding and moving performers easily and quickly.
This project makes heavy use of the …

Exploring Seasonal Trends And Episodic Weather In The Muskegon Lake Ecosystem, Elijah Smith
Technical Library
Over the last 10 years, the Robert B. Annis Water Resources Institute (AWRI) at Grand Valley State University has collected buoy sensor data from Muskegon Lake. This sensor data, captured every 15 minutes, records a variety of physical and biological characteristics important to the regional biome. Ranging from wind speed to dissolved oxygen to chlorophyll, the 21 distinct metrics reveal details about the intertwined processes and seasonal variations in the ecosystem. Previous research from AWRI has shown that “episodic weather events” play a role in water column mixing and algal blooms. For example, a strong storm system will mix up …

Recent advances in viral vector engineering, as well as an increased understanding of the cellular and molecular mechanism of retinal diseases, have led to the development of novel gene therapy approaches. Furthermore, ease of accessibility and ocular immune privilege makes the retina an ideal target for gene therapies. In this study, the nuclear hormone receptor gene Nr2e3 was evaluated for efficacy as broad-spectrum therapy to attenuate early to intermediate stages of retinal degeneration in five unique mouse models of retinitis pigmentosa (RP). RP is a group of heterogenic inherited retinal diseases associated with over 150 gene mutations, affecting over 1.5 …

Making Sense Of Customary International Law, Monica Hakimi
Making Sense Of Customary International Law, Monica Hakimi
Faculty Scholarship
This Article addresses a longstanding puzzle about customary international law (CIL): How can it be, at once, so central to the practice of international law — routinely invoked and applied in a broad range of settings — and the source of such persistent confusion and derision? The centrality of CIL suggests that, for the many people who use it, it is not only comprehensible but worthwhile. They presumably use it for a reason. But then, what accounts for all the muddle and disdain?
The Article argues that the problem lies less in the everyday operation of CIL than in the …
The Economics Of Leasing, Thomas W. Merrill
The Economics Of Leasing, Thomas W. Merrill

Leasing may be the most important legal institution that has received virtually no systematic scholarly attention. Real property leasing is familiar in the context of residential tenancies. But it is also widely used in commercial contexts, including office buildings and shopping centers. Personal property leasing, which was rarely encountered before World War II, has more recently exploded on a world-wide basis, with everything from autos to farm equipment to airplanes being leased. This article seeks to develop a composite picture of the defining features of leases and why leasing is such a widespread and highly successful economic institution. The reasons …

For Coöperation And The Abolition Of Capital, Or, How To Get Beyond Our Extractive Punitive Society And Achieve A Just Society, Bernard E. Harcourt
Faculty Scholarship
In hindsight, the term "capitalism" was always a misnomer, coined paradoxically by its critics in the nineteenth century. The term misleadingly suggests that the existence of capital produces a unique economic system or that capital itself is governed by economic laws. But that's an illusion. In truth, we do not live today in a system in which capital dictates our economic circumstances. Instead, we live under the tyranny of what I would call "tournament dirigisme": a type of state-directed gladiator sport where our political leaders bestow spoils on the wealthy, privileged elite.
We need to displace this tournament dirigisme with …

Coordinating Injunctions, Bert I. Huang

Consider this scenario: Two judges with parallel cases are each ready to issue an injunction. But their injunctions may clash, ordering incompatible actions by the defendant. Each judge has written an opinion justifying her own intended relief, but the need to avoid conflicting injunctions presses her to make a further choice – “Should I issue the injunction or should I stay it for now?” Each must make this decision in anticipation of what the other will do.
This Article analyzes such a judicial coordination problem, drawing on recent examples including the DACA cases and the “sanctuary cities” cases. It then …
The Dual Origin Of The Duty To Disclose In Roman Law, Barbara Abatino, Giuseppe Dari-Mattiacci
The Dual Origin Of The Duty To Disclose In Roman Law, Barbara Abatino, Giuseppe Dari-Mattiacci
Faculty Scholarship
The Roman law remedies for failure to disclose in sales contracts were developed by two different institutions: that of the aediles, with jurisdiction on market transactions effected through auctions, and that of the praetor, with general jurisdiction including private transactions. The aedilician remedies — the actiones redhibitoria and quanti minoris — allowed for rapid transactions and inexpensive litigation but generated some allocative losses ex post, as they did not incentivize the parties to exchange information about idiosyncratic characteristics of the goods for sale. In contrast, the remedy developed by the praetor — the actio ex empto — implied …

The Handmaid Of Justice: Power And Procedure In The Inferior Courts, Kellen R. Funk
Faculty Scholarship
Summing up the history of procedure from the codification movement of the nineteenth century to the Federal Rules practice of today, Robert Bone observed, “Each generation of procedure reformers, it seems, diagnoses the malady and proposes a cure only to have the succeeding generation’s diagnosis treat the cure as a cause of the malady.” While playfully highlighting the contingencies and unexpected consequences of procedural history, Professor Bone was not advocating a cyclical view of history, in which “cost and delay” continually recur as the bugaboos of procedural reformers who can’t quite figure out how to solve the problem. Instead, Bone …
How To Fix The Climate, David G. Victor, Charles F. Sabel
How To Fix The Climate, David G. Victor, Charles F. Sabel
Faculty Scholarship
Can the world meet the challenge of climate change? After more than three decades of global negotiations, the prognosis looks bleak. The most ambitious diplomatic efforts have focused on a series of virtually global agreements such as the Kyoto Protocol of 1997 and the Paris Agreement of 2015. With so many diverse interests across so many countries, it has been hard to get global agreement simply on the need for action; meaningful consensus has been even more elusive. Profound uncertainty about the effectiveness of various mitigation measures has made it difficult to estimate the cost of deep cuts in emissions.

Overlapping Copyright And Trademark Protection In The United States: More Protection And More Fair Use?, Jane C. Ginsburg, Irene Caboli

This chapter addresses the phenomenon of overlapping rights under US law and complements Chapter 25 authored by Professors Derclay and Ng-Loy on the overlap of trademark, copyright, and design protection under several other Common Law and Civil Law jurisdictions. Because the United States does not provide sui generis protection for industrial design, but instead protects design through trademark law (notably by protecting trade dress) and design patents, this chapter focuses on the overlap between trademark and copyright protection. The Lalique bottles created for Nina Ricci perfumes, for example, may enjoy both trademark and copyright protection in the United States. Similarly, …

Religious liberty rights have been immeasurably damaged over the past several years — often in the name of protecting religious liberty.
Government officials have embraced Islamophobic policies and rhetoric; shut the door on refugees fleeing religious persecution; elevated the religious rights of their political allies over the rights — religious and otherwise — of other communities; used religion as a tool of economic deregulation; and denigrated the beliefs of religious minorities, atheists, and religious progressives.
To achieve true freedom for those of all faiths and none, a complete overhaul of religious liberty policy, and a new understanding of what this …

On The Rhetorical Grotesque: A Mode For Strange Times, Richard Benjamin Crosby

This essay argues that the successful political careers of certain populist leaders rhetorically enact what scholars have long recognized in art, literature, and entertainment as the grotesque. The grotesque provides a theoretically rich means for describing the vulgar and chaotic public behaviors that take strong hold among anti-elite audiences at certain points in history. By closely reading comments from political leaders cast in the grotesque mold, including Silvio Berlusconi, Hugo Chavez, and Donald Trump, this essay explains not only what the grotesque is, but also when and how it is likely to find traction in a political culture ripe for …

This Article evaluates three interpretations of the Takings Clause capable of generating a regulatory takings doctrine. The first, the Epstein interpretation, puts primary emphasis on what it means to provide “just compensation” for takings; the second, the Penn Central interpretation, centers on what it means to “take” property; the third, which I call the Eagle theory, in honor of Steven Eagle, this year’s Brigham-Kanner prize recipient, focuses on when the government has taken “private property.” The Article argues that the Eagle theory has the most plausible basis in the original understanding of the Takings Clause, rests on a theory about …

Journal Articles: Internal Medicine
Agricultural workers are at risk for the development of acute and chronic lung diseases due to their exposure to organic agricultural dusts. A diet intervention using the omega-3 fatty acid docosahexaenoic acid (DHA) has been shown to be an effective therapeutic approach for alleviating a dust-induced inflammatory response. We thus hypothesized a high-DHA diet would alter the dust-induced inflammatory response through the increased production of specialized pro-resolving mediators (SPMs). Mice were pre-treated with a DHA-rich diet 4 weeks before being intranasally challenged with a single dose of an extract made from dust collected from a concentrated swine feeding operation (HDE). …

BACKGROUND: Environmental organic dust exposures enriched in Toll-like receptor (TLR) agonists can reduce allergic asthma development but are associated with occupational asthma and chronic bronchitis. The TLR adaptor protein myeloid differentiation factor88 (MyD88) is fundamental in regulating acute inflammatory responses to organic dust extract (ODE), yet its role in repetitive exposures is unknown and could inform future strategies.
METHODS: Wild-type (WT) and MyD88 knockout (KO) mice were exposed intranasally to ODE or saline daily for 3 weeks (repetitive exposure). Repetitively exposed animals were also subsequently rested with no treatments for 4 weeks followed by single rechallenge with saline/ODE.
RESULTS: Repetitive …
A Genomic Investigation Of The Stomach Phenotype In Teleosts, Louis Pfeifer
A Genomic Investigation Of The Stomach Phenotype In Teleosts, Louis Pfeifer
Theses and Dissertations (Comprehensive)
The stomach, which is physiologically defined in vertebrates by its function in acid-peptic digestion, has been lost independently multiple times during the evolution of the teleost fishes. The function of the stomach is facilitated by the proton pump H+/K+-ATPase, which acidifies the stomach, and pepsinogens, which are converted to proteolytic pepsins in this acidic environment. It is well documented that in agastric (stomachless) fish, the genes what code for the expression of this proton pump (atp4a and atp4b) and the pepsinogens (pga, pgb, pgf, pgc and cym,) are absent from the genome …
