The Fight For Footprint: Energy Development And Competing Surface Use Issues, James D. Bradbury
The Fight For Footprint: Energy Development And Competing Surface Use Issues, James D. Bradbury
Texas A&M Journal of Property Law
The laws surrounding energy development in Texas have evolved over the past century, as Texas has been at the epicenter of the energy industry—and thereby, the center of energy law—since oil was discovered in Corsicana in 1894. Domestic, and even some international choice-of-law clauses, choose Texas law due to the Lone Star State’s dominance in the energy sector.
While Texas is often closely tied to oil and gas, its strong position in the energy market is not limited just to this industry. Texas is now the largest producer of wind energy and the seventh largest producer of solar energy in …
Political Philosophy As Love Of Wisdom, Bas Van Der Vossen
Political Philosophy As Love Of Wisdom, Bas Van Der Vossen
Philosophy Faculty Articles and Research
The traditional view holds that political philosophy should aim at the truth. By contrast, Avner de Shalit argues that political philosophers should do something different. According to him, they should work in direct consultation with “the people” in order to think through their theories about political institutions. This article defends the traditional aim of truth-seeking and shows the mistakes in De Shalit’s alternative approach

The modified Friedreich Ataxia Rating Scale (mFARS) is a disease specific, exam-based neurological rating scale commonly used as a outcome measure in clinical trials. While extensive clinimetric testing indicates it’s validity in measuring disease progression, formal test–retest reliability was lacking. To fill this gap, we acquired results from screening and baseline visits of several large clinical trials and calculated intraclass correlation coefficients, coefficients of variance, standard error, and the minimally detectable changes. This study demonstrated excellent test–retest reliability of the mFARS, and it’s upright stability subscore.

Using Technology To Support Student Learning In An Integrated Stem Learning Environment, Dazhi Yang, Sally J. Baldwin
Educational Technology Faculty Publications and Presentations
This paper provides the first review and illustration of technology-use strategies for supporting student learning in different integrated science, technology, engineering, and mathematics (STEM) learning environments. An integrated STEM learning environment may focus on integrating and learning science and mathematics or integrating and learning engineering and technology simultaneously for multiple levels of learners. An integrated STEM learning environment breaks down disciplinary boundaries and allows students to apply multidisciplinary knowledge in solving problems. This study illustrates four technology-use strategies to support student learning in an integrated STEM learning environment: a) providing authentic learning contexts, b) offering web-based inquiry environments, c) expanding …

Conchostracans (Crustacea) from the Induan deposits of the Tiryakh-Kobyume section (southern Verkhoyansk region) were studied. We identified the following seven conchostracan species belonging to five genera: Pseudestheria Raymond, 1946; Euestheria Deperet et Mezeran, 1912; Sphaerestheria Novojilov, 1954; Lioestheria Deperet et Mezeran, 1912; Wetlugites Novojilov, 1958. Most of the previously identified species in the Tiryakh-Kobyume region (“Pseudestheria sibirica”, “Ps. tumaryana”, “Ps. kashirtzevi”, and “Sphaerestheria aldanensis”) were described in the middle of the 20th century from the basal Triassic in the western Verkhoyansk region (Balbuk section). Revision of these species with the use …

Do Legal Origins Predict Legal Substance?, Anu Bradford, Yun-Chien Chang, Adam Chilton, Nuno Garoupa
Coase-Sandor Institute for Law & Economics Research Paper Series
There is a large body of research in economics and law suggesting that the legal origins of a country—that is, whether its legal regime is based on English common law or French, German, or Nordic civil law—profoundly impacts a range of outcomes. However, the exact relationship between legal origins and legal substance has been disputed in the literature, and not fully explored with nuanced legal coding. We revisit this debate while leveraging novel cross-country datasets that provide detailed coding of two areas of laws: property and antitrust. We find that having shared legal origins strongly predicts whether countries have similar …

The human ovulatory cycle lasts an average of 28 days and is highly variable both within and among women, making ovulation and the fertile window difficult to estimate in humans. Commonly used methods for estimating fertility assume length consistency during various cycle phases, an assumption that often miscategorizes women as fertile when not and vice versa. This experiment analyzes several of the common methods used to estimate fertility, including forwards and backwards-counting methods and actuarial methods, and compares them against hormonal testing to determine the most accurate method for fertility identification. Additionally, we used hormonal ovulation tests combined with daily …

Problematic Authority: The Beginning And The End As An Edition Of Robinson Jeffers' Last Poems, Tim Hunt
Jeffers Studies
The Beginning and the End (1963) gathers poems Robinson Jeffers wrote following the publication of Hungerfield in 1954 until his death in 1962. His biographer, Melba Berry Bennett, prepared the collection from Jeffers’ handwritten drafts and a few typescripts left on his desk. Comparing her versions of the material with the actual manuscripts shows that she at times misread the sources, at times, mixed and matched units from different poems, and in a few instances treated fragments as completed works. This article assesses the nature and implications of the differences between the manuscripts and the collection Bennett constructed from them. …

Myth, Mother, Monster:Jeffers' Medea As A Teaching Text, Kathryn Chew
Jeffers Studies
This article was written by a Classicist with the idea in mind that many English professors teach Jeffers’ play Medea and may not be aware of that play’s affinities with its Euripidean model. The first part of this study explores the cultural and political contexts that inform Euripides’ play, which enrich the significance of the original play and can be illuminating for those teaching Jeffers’ version. Next, six ways in which Jeffers’ adaptation differs from Euripides’ play are explored, all of which contribute to articulating Jeffers’ unique take on the story, including (1) Medea’s character arc, (2) references to barbarity …

Wine Journey: Tasting Dwelling Learning at The Kitchen Table
It happened on a weekday evening. Dinner was Pasta e Fagioli and I would have chosen a wine from Tuscany. But, in my cellar a thought arose to explore, and a 19-year-old 1999 Paitin di Pasquero-Elia Barbaresco Sorì Paitin ended up on the table. A new pairing 1 plus a wine from a new-to-me producer I had waited 15 years for it to mature provided opportunities. Pasta e Fagioli should be a fine accompanist to the wonderful softening taste of a maturing Barbaresco from the good 1999 vintage. The pairing worked well enough to repeat. That was merely the prelude.

Developing A Watershed-Scale Baseline For Tidal Wetlands, Nicholas A. Procopio, Robert Hazen, Michael P. Weinstein, Meiyin Wu, Danlin Yu
New Jersey Center for Water Science & Technology Reports
Tidal wetlands are critical habitat for the maintenance of secondary production of nekton. This study addresses two key factors: the specific structural and functional traits of coastal wetlands that make them conducive to supporting the secondary production of nekton and how individual components of the marsh are inter-connected to form a functional whole. Structural characteristics of relatively undisturbed tidal wetlands have been determined by meta-analysis from more than 500 papers and in-situ measurements and remote sensing of New Jersey wetland sites. Meta-analysis (Hedges’ d values and 95% confidence intervals) has shown that restored sites compare favorably with undisturbed sites in …
The Mechanical And Scientific Significance Of The Ships Of Nemi, Troy Frazier
The Mechanical And Scientific Significance Of The Ships Of Nemi, Troy Frazier
Classics Ancient Science Fair
In 1929 the first of the two Nemi ships breached the waters of lake Nemi, seeing the surface of the lake for the first time in centuries. To recover the two ships, a pair of pleasure ships created under the rule of Caligula, an attempt was made to drain lake Nemi. This proceeded and in 1931 the second ship exceeded the water level as well. Over the course of this recovery of these sunken ships and prior attempts and findings a treasure trove of information was uncovered, expanding the understanding of the mechanical feats accomplished during the Roman Empire.

Browse all Theses and Dissertations
Illicitly manufactured fentanyls (IMFs) have become a global and local epidemic and have recently caused an increase in the number of accidental exposures and overdoses in first responders and the community. The aim of the research is to explore a method to discriminate between IMFs and cutting agents in mock street samples using Raman Spectroscopy. Predominant Raman bands corresponding to the structural moieties of each individual illicit, licit drugs, and cutting agents were tracked, then used to discriminate between varying components in a mock street sample. In conclusion, discrimination between the components in the mixture was obtained using Raman Spectroscopy. …

In its fifth season, the American Excavations at Morgantina: Contrada Agnese Project (CAP) continued archaeological investigations inside the Southeast Building, a modestly-appointed house of Hellenistic date located near the western edge of the city. The 2016 CAP season had revealed the full extent of the property’s boundary walls and allowed us to propose a cohesive phasing scheme for the building’s construction, occupation, and abandonment. We suggested that the house was occupied for approximately 60-75 years, beginning in the second quarter of the third century BCE. The 2017 CAP excavations resolved a number of remaining questions, particularly those concerning the phasing …

Effects Of Slope Upon Hind Limb Kinematics In Chukar Partridge (Alectoris Chukar), Anna T. Kenney
Effects Of Slope Upon Hind Limb Kinematics In Chukar Partridge (Alectoris Chukar), Anna T. Kenney
Undergraduate Theses, Professional Papers, and Capstone Artifacts
Ground dwelling birds must scale all kinds of complex terrain in order to survive in their natural environments. For instance, Alectoris chukar live on steep hillsides with slopes of up to 60° or 172.3% slope. We undertook the present study to improve understanding of how birds successfully traverse such complex terrain. Using a high speed camera, we analyzed the hind limb kinematics of chukars during normal locomotion on a 10° and 35° incline, decline, and level slope. We compared the data collected from the video recordings, which we had used to identify and digitize the bony landmarks, between all conditions. …

Plumb Beach, Brooklyn, New York in USA is an important horseshoe crab breeding and nursery ground that has experienced substantial anthropogenic influence, including pollution, erosion and subsequent restoration. Since little is known about the relationship between sediment microbial communities and juvenile horseshoe crab survival, next generation sequencing was used to characterize and compare the sediment microbiome of three distinct areas of Plumb Beach:- a tidal creek with abundant juveniles, East Beach with moderate number of juveniles, and West Beach- a highly disturbed area where juvenile crabs are rarely seen. The microbiome of juvenile crab intestinal content (both dissected gut content …

Eighteen Is Not A Magic Number: Why The Eighth Amendment Requires Protection For Youth Aged Eighteen To Twenty-Five, Tirza A. Mullin
University of Michigan Journal of Law Reform
The Eighth Amendment protects a criminal defendant’s right to be free from cruel and unusual punishment. This Note argues that any punishment of eighteen- to twenty-five-year-olds is cruel and unusual without considering their youthfulness at every stage of the criminal process, and that it is unconstitutional under the Eighth Amendment for these youths to be automatically treated as fully-developed adults. This Note will explore in depth how juveniles differ from adults, both socially and scientifically, and how the criminal justice system fails every youth aged eighteen- to twenty-five by subjecting them to criminal, rather than juvenile, court without considering their …

Flipping The Script: Developing An Intertextual Dialogue For Dolphin Advocacy In The Cove, Katherine D. Lind
Communication Studies Faculty Works
Dolphins and other cetaceans (marine mammals) have seen a surge of environmental advocacy in the decade since The Cove (2009) emerged. Drawing upon Western popular culture texts such as the popular film and television series, Flipper (1963), The Cove seeks to flip or reframe our cultural understanding of dolphins from friends to victims in need of help. In this essay, I argue that The Cove is an exemplar eco-doc that employs an intertextual dialogue to facilitate a multi-media outreach campaign that changed public perception of dolphins and lead to dolphin advocacy efforts. By analyzing how The Cove incorporates and challenges …
