The Supreme Court has long said that “the extension of First Amendment protection to commercial speech is justified principally by the value to consumers of the information such speech provides.” In other words, consumers—the recipients or listeners of commercial speech—are the ones the doctrine is meant to protect. In previous work, I explored the implications of taking this view seriously in three contexts: compelled speech, speech among commercial entities, and unwanted marketing. In each of those contexts, adopting a listener-oriented approach leads to the conclusion that many forms of commercial speech regulation should receive far less First Amendment scrutiny than …

The purpose of this study was to examine the effects of a ballistic or non-ballistic concentric-only bench press (COBP) on subsequent plyometric push-up performance. Fourteen resistance trained men completed two separate one-repetition-maximum (1RM) testing sessions followed by three randomized experimental explosive push-up sessions. These sessions combined a heavy concentric bench press with plyometric push-ups. Using a series of 3 × 10 (condition × time) repeated measures ANOVA, comparisons were made between the effects of ballistic and non-ballistic bench presses on performance of plyometric push-ups to investigate push-up performance variables. The purpose of the present study was to investigate the influence of intermittent pneumatic compression (IPC) boot use between submaximal cycling trials on heart rate (HR) and blood lactate concentrations. Ten healthy participants (9M; 1F) performed two consecutive 60 minute rides at 60% of functional threshold power with a 30 minute rest between rides. The rest period was spent in a supine position using IPC boots (BOOT) or sitting in a similar position without boots (CON). HRs were collected every 15 minutes during cycling rides, and lactate was measured at the 30-minute mark during both rides. An identical trial was …

Women returning to work after giving birth, and who wish to breastfeed their child often need modest adjustments to their job or workplace that allow them to pump breast milk at work, such as break time and a clean, private room. But what if an employer denies this request or fires a woman for asking? The federal Pregnancy Discrimination Act ("PDA") prohibits employers from discriminating against workers based on their pregnancy, childbirth, or "related medical conditions." Under the PDA, as interpreted by the Supreme Court in Young v. UPS, employers must grant pregnant workers accommodations only if they grant similar …

In his forthcoming article in the Texas Law Review, Compelled Decryption and the Privilege Against Self-Incrimination, Orin S. Kerr addresses a common question confronting courts. If a court orders a suspect or defendant to enter her password to open a smartphone or other device as part of a law enforcement investigation, does that order violate the Fifth Amendment right against self-incrimination?

Paternity leave policies, important tools for promoting gender equality that give men an opportunity to care for their newborn children, are becoming increasingly popular and legislated worldwide. However, there has been little research on how paternity leaves impact men’s careers and the research that exists has been inconclusive. This is problematic because, while men are increasingly being encouraged to take paternity leaves, they fear that such leaves may undermine their careers. The experience of death-related loss is almost universal, which makes it an important area of study. The experience of death-related loss can cause a re-evaluation of identity (Hibberd, 2013), but this has not been widely studied in emerging adults. The lack of research into bereavement experiences in emerging adulthood leaves many questions unanswered, in particular regarding identity. This is the case, despite identity consolidation being considered an important task of emerging adulthood (Arnett, 2006; Erikson, 1959). Cuscuta is a genus of nearly 200 obligate stem parasites with a nearly cosmopolitan distribution and considerable agricultural and ecological significance. Dodder seeds are considered “unspecialized”, with no morphological adaptations towards particular dispersal vectors; however, the seed coat anatomy has recently suggested an adaptation to endozoochory. This is the first attempt to provide a genus-wide overview of the diversity in morphology and anatomy of Cuscuta seeds, together with an assessment of the water gap and exploration of various form-function relationships. Commonly associated with severe inflammation and destruction of the tooth-supporting tissue is bacterial consortia Treponema denticola, Tannerella forsythia, and Porphyromonas gingivalis, collectively referred to as the red complex. The red complex uses the common bacterial strategy of producing and embedding itself in extracellular polymeric substance, which contributes to the recalcitrance of periodontitis and was therefore of interest in this study. The red complex static cultures were grown in combination with different chemicals in order to establish what changes accompany these chemical challenges. Corticospinal excitability as measured via transcranial magnetic stimulation (TMS) is highly dependent on the task being performed at the time of stimulation. As such, this study sought out to measure corticospinal excitability during the relevant, daily task of writing and compare it to the conventional abduction task often utilized. We used single-pulse motor evoked potentials (MEPs) to provide a measure of corticospinal excitability and cortical silent period (CSP) duration, and paired-pulse conditioned MEPs to assess short-interval intracortical inhibition (SICI) and intracortical facilitation (ICF) recorded from the right first dorsal interosseous (FDI) of 19 participants on two randomized and counter-balanced days. …

This study examines how museums build relationships with audiences to gain financial contributions and volunteer support. Financial support to museums has been dwindling in recent years and new revenue streams are needed for low-resource museums to survive. A content analysis of 485 Facebook posts of four small and large sized museums along with a survey of 131 respondents were conducted within the theoretical lens of organization-public relations. This framing analysis focuses on the portrayal of women leaders in popular business magazines. Framing theory was used to examine how women leaders were portrayed in Forbes, Fortune, Entrepreneur, and Bloomberg Businessweek magazines from 2010-2018. The study identified three key frames, which include the minority frame, asset and fixer frame, and the work-life balance frame. Further findings from the study suggested that the portrayals of women have changed following the women's movement in the 1970's and that women are indeed beneficial to organizations in senior-level positions, although there is still a low percentage of women in these roles.

This concept is illustrated through low representation of female leadership in the U.S. Women are overrepresented in roles that are communal, which causes backlash when they display agentic traits (Arnold & Loughlin, 2019). The subject of this study is the effect of in-cylinder selective non-catalytic reduction (SNCR) of NO_x emissions in diesel exhaust gas by means of direct injection of aqueous urea ((NH₂)₂CO) into the combustion chamber. A single cylinder diesel test engine was modified to accept an electronically controlled secondary common rail injection system to deliver the aqueous urea directly into the cylinder during engine operation.

False memories happen when someone mis-remembers a past event that occurred. The study of false memories is commonly done using the DRM paradigm which can form false memories through semantic list learning. The current study is evaluating false memory, deception, and truth-telling using the DRM paradigm while measuring cortical activation with fNIRS. Results indicated no interactions between specific condition responses and brain regions in the prefrontal cortex. A main effect of condition was found indicating that correct responses have the lowest level of activation.
