New Look Constitutionalism: The Cold War Critique Of Military Manpower Administration, Jeremy K. Kessler

By reconstructing the anxious, constitutional dialogue that shaped the administration of military manpower under President Eisenhower’s New Look, this Article explores the role that administrative constitutionalism played in the development of the American national-security state, a state that became both more powerful and more legalistic during the pivotal years of the Cold War. The Article also questions the frequent identification of administrative constitutionalism with the relative autonomy and opacity of the federal bureaucracy. The back-and-forth of administrative constitutionalism continually recalibrated the degree of autonomy and opacity that characterized the draft apparatus. Abstract. The purpose of this investigation was to assess user preferences for controlling an autonomous system. A comparison using a virtual environment (VE) was made between a joystick based, game controller and a gesture-based system using the leap motion controller. Command functions included basic flight maneuvers and switching between the operator and drone view. Comparisons were made between the control approaches using a representative quadcopter drone. The VE was designed to minimize the cognitive loading and focus on the flight control. It is a physics-based flight simulator built in Unity3D. We present a case study of the Magnetospheric Multiscale (MMS) observations of the Southern Hemispheric dayside magnetospheric boundaries under southward interplanetary magnetic field direction with strong By component. During this event MMS encountered several magnetic field depressions characterized by enhanced plasma beta and high fluxes of high‐energy electrons and ions at the dusk sector of the southern cusp region that resemble previous Cluster and Polar observations of cusp diamagnetic cavities. Based on the expected maximum magnetic shear model and magnetohydrodynamic simulations, we show that for the present event the diamagnetic cavity‐like structures were formed in an unusual location. Sprinting Toward Genre Knowledge: Scaffolding Graduate Student Communication Through "Sprints" In Finance And Engineering Courses, Lindsey Ives, Jayendra Gokhale, William C. Barott, Michael V. Perez

This article evaluates the use of biweekly deadlines called “Sprints” to scaffold the development of conference papers in graduate-level courses in econometric modeling and electrical engineering through analysis of faculty assessment reports, observation notes, and transcripts of two audio-recorded class sessions. Data were analyzed to identify Tardy’s (2009) four dimensions of genre knowledge: subject-matter, rhetorical, process, and formal knowledge. We found that Sprints provide consistent opportunities for students to provide and receive helpful formative feedback that builds disciplinary genre knowledge in each of the four dimensions. This infographic includes five word clouds containing the perceived career competencies of student-athletes at Embry-Riddle Aeronautical University (ERAU). Embry-Riddle is a mid-sized private Southeastern university that competes in the Sunshine State Conference of the National Collegiate Athletic Association's (NCAA) Division II. Findings from one-on-one interviews with 16 current or past ERAU student-athletes led to the creation of the infographic's five word clouds. Among ERAU student-athletes, the most commonly perceived career competencies are a) career preparation, b) professionalism, c) communication and d) collaboration.

Organized interest groups and federal administrative agencies have historically been influential in defining problem drug use during nationwide crisis. As such, the manner in which these pressure groups defined the problem may have influenced or, at least, provided support for legislators’ decisions to shy away from a criminal justice approach and towards acceptance of a more “health-oriented” — one that did not comprehensively address demand factors or demonstrate a commitment to reforming U.S. drug policy to meet international standards of best practice. Recent Delaware jurisprudence establishes a disinterested vote of shareholders as the pathway out of heightened judicial scrutiny. The stated rationale for this policy is that shareholders, the real party at interest, are better protected by the ballot box than by the courtroom. As long as informed, disinterested shareholders with an economic stake in the outcome of the vote can effectively express their preferences through voting — the court need not scrutinize the underlying transaction. Rather, it can defer to the outcome under the business judgment rule.

But shareholder voting is not always as direct as this reasoning implies. Instead, voting …

David Dudley Field was the architect of the union – or fusion or merger – of equity and law in New York state, and the Field Code was widely adopted in other states. Field’s vision of the union of law and equity has prevailed in the United States, including at the federal level, at least in theory. However, the practise of law and acts of the courts indicate that the reality is rather different. We are developing a knowledge base over Chinese judicial decision documents to facilitate landscape analyses of Chinese Criminal Cases. We view judicial decision documents as a mixed-granularity semi-structured text where different levels of the text carry different semantic constructs and entailments.We use a combination of context-sensitive grammar, dependency parsing and discourse analysis to extract a formal and interpretable representation of these documents. Our knowledge base is developed by constructing associations between different elements of these documents. A central question raised by the recent surge of neo-Brandeisian scholarship and advocacy is whether the nascent movement will deliver any form of lasting change to antitrust. In his essay for this issue of Business History Review, Daniel Crane is doubtful. He argues that critiques of the Chicago School are often simplistic and misunderstand its legacy, which includes institutionalizing economic theory in antitrust analysis in ways that even its post-Chicago critics absorbed and built on. Many studies have examined the bereavement patterns and development of anxiety or mood disorders in suicide loss; however, few have looked at the development of posttraumatic stress disorder (PTSD) or the impact of resilience factors on the development of PTSD or posttraumatic growth (PTG) in suicide loss survivors. National legislation has led to an increasing need for school districts to demonstrate student reading progress using performance on statewide achievement tests as indicators of growth. This study added to previous research on the effectiveness of curriculum-based measurement (CBM) in predicting success on statewide reading achievement tests and determining whether a student is at-risk for poor performance on statewide tests. The theory of social comparison suggests that all individuals are naturally driven to evaluate and compare their opinions and abilities with those of similar others to varying degrees. Social comparison behavior is associated with negative outcomes impacting mental health and relationship satisfaction, with the prevalence of social-media use providing an increased opportunity to engage in social comparisons. Most of the research on the impact of this behavior has been conducted with young-adult populations, overlooking other populations, such as parents. Platy-1 elements are Platyrrhine-specific, short interspersed elements (SINEs) originally discovered in the Callithrix jacchus (common marmoset) genome. To date, only the marmoset genome has been analyzed for Platy-1 repeat content. Here, we report full-length Platy-1 insertions in other New World monkey (NWM) genomes (Saimiri boliviensis, squirrel monkey; Cebus imitator, capuchin monkey; and Aotus nancymaae, owl monkey) and analyze the amplification dynamics of lineage-specific Platy-1 insertions. A relatively small number of full-length and lineage-specific Platy-1 elements were found in the squirrel, capuchin, and owl monkey genomes compared to the marmoset genome.
