Bringing The Court Into The Classroom: Suggestions For How To Craft Exercises For Upper-Level Courses Using Real Practitioners' Briefs, Benjamin Halasz Jan 2019

Bringing The Court Into The Classroom: Suggestions For How To Craft Exercises For Upper-Level Courses Using Real Practitioners' Briefs, Benjamin Halasz

Articles

When I came to teach after practicing for over a decade, I wanted my students to learn to write by using materials from real clients and cases. I quickly found that’s easier said than done. But through experimentation and discussions with experienced colleagues, I found several successful ways to put students into the role of writing parts of a “real” brief—one that uses a real case and real facts—for short, in-class exercises in upper-level courses.

Several articles tout the benefits of using briefs as examples, an enthusiasm I join. But this article focuses on using cases, and especially briefs, as …

Janus As A Client: Ethical Obligations When Your Client Plays Two Roles In One Fiduciary Estate, Karen Boxx, Philip N. Jones Jan 2019

Janus As A Client: Ethical Obligations When Your Client Plays Two Roles In One Fiduciary Estate, Karen Boxx, Philip N. Jones

Articles

Is it possible for an attorney to have a conflict of interest when the attorney represents a trustee who is also a beneficiary of the trust? Is that situation similar to having two clients? What if the trustee is not only a beneficiary, but also a claimant against the trust? Since the trustee has three roles to play, is that situation similar to an attorney having three clients? The issue presented by these potential conflicts was one of the most vexing for the drafters of the Fifth Edition of the ACTEC Commentaries. The range of possible approaches goes from a …

Risk Domains And Adolescent Depression, Nathan Kawczynski Jan 2019

Risk Domains And Adolescent Depression, Nathan Kawczynski

UNF Graduate Theses and Dissertations

Adolescence and young adulthood are the periods of development associated with the highest amount of risk-taking. One theory, the Dual-Systems model, suggests that this could be due to an imbalance in the maturation of two brain systems: reward appraisal, which matures first, and cognitive control, which matures later. This imbalance may be the cause of adolescents’ tendency to favor immediate rewards, disregarding consequences. Depressed adolescents, however, behave differently. While it is not exactly clear whether they take more risks or fewer risks, depressed adolescents display different interactions and decision making with their peers than non-depressed adolescents. This study attempted to …

Generation Z'S Positive And Negative Attributes And The Impact On Empathy After A Community-Based Learning Experience, Amanda Nicole Moscrip Jan 2019

Generation Z'S Positive And Negative Attributes And The Impact On Empathy After A Community-Based Learning Experience, Amanda Nicole Moscrip

UNF Graduate Theses and Dissertations

Generation Z, also known as the iGeneration, iGenners, GenZ, and Generation Now, consists of those born in the mid-1990s through the late 2010s. Historical events important for this generation have influenced their perception of safety as well as how they interact with others. As compared to previous generations, technological advances (i.e., Smartphones, social media) changed how GenZ communicates, socializes, and receives information. Unique experiences and attributes influenced Generation Z’s empathy because living through these events and seeing their impact changes how they can understand and take the perspective of others. The relation between three factors was examined across University students …

Research Opinion: A Storyteller’S Guide To Problem-Based Learning For Information Systems Management Education, David Michael Hull, Paul Benjamin Lowry, James Eric Gaskin, Kristijan Mirkovski Jan 2019

Research Opinion: A Storyteller’S Guide To Problem-Based Learning For Information Systems Management Education, David Michael Hull, Paul Benjamin Lowry, James Eric Gaskin, Kristijan Mirkovski

Faculty Publications

More than a decade ago, Lowry & Turner (2005) provided evidence-based recommendations regarding what students of information systems (IS) management education should learn and how should they learn it. Although their recommendations for how IS management should be taught remain valid, these recommendations need to be updated to account for recent advances in technologies that enable multimedia learning. Promoters of such technologies promise enhanced cognitive and behavioural outcomes, but this promise remains unreached, reflecting the underdeveloped literature of multimedia-enabled learning. To help attain this promise and rejuvenate the multimedia-learning literature, we offer a roadmap for new areas of research that …

How Online Patient–Physician Interaction Influences Service Satisfaction, Yi Wu, Joseph S. Valacich, Jeffrey L. Jenkins, Kai Li Jan 2019

How Online Patient–Physician Interaction Influences Service Satisfaction, Yi Wu, Joseph S. Valacich, Jeffrey L. Jenkins, Kai Li

Faculty Publications

Online health interaction (OHI) is an effective and increasingly popular method for patients to access health information. Extant literature overlooks such service users’ satisfaction derived from online interactions and the measurement of OHI processes. Based on the relational communication literature and the features of OHI, the present study proposes three dimensions to conceptualize the success of OHI processes (i.e., interaction depth, information intensity, and time breadth) and explores the association between these interaction processes and service satisfaction. Further, two characteristics of OHI, namely information richness and indirect interaction, are identified as contingent factors on those proposed linkages. The research model …

Review Of Exiled In Modernity: Delacroix, Civilization, And Barbarity By David O’Brien, Heather Belnap Jan 2019

Review Of Exiled In Modernity: Delacroix, Civilization, And Barbarity By David O’Brien, Heather Belnap

Faculty Publications

Hailed as both one of the last of the Old Masters (“je suis un pur classique”) and as the quintessential Romantic rebel (“the Victor Hugo of painting”), Eugène Delacroix stands as a towering but liminal figure in the history of art. In Exiled in Modernity: Delacroix, Civilization, and Barbarism, David O’Brien explores how Delacroix’s later artistic period is deeply engaged with pressing issues of the age, including the development of civilization, the processes of modernity, the conceptualization of the Other, the place of nature, and so on. While acknowledging the place for political interpretations of Delacroix’s work, the author is …

An Fmri Exploration Of Information Processing In Electronic Networks Of Practice, Thomas O. Meservy, Kelly J. Fadel, C. Brock Kirwan, Rayman D. Meservy Jan 2019

An Fmri Exploration Of Information Processing In Electronic Networks Of Practice, Thomas O. Meservy, Kelly J. Fadel, C. Brock Kirwan, Rayman D. Meservy

Faculty Publications

Online forums sponsored by electronic networks of practice have become an important source of information for individuals seeking solutions to problems online. However, not all information available in a forum is helpful or accurate, requiring knowledge seekers to evaluate and filter the solutions they encounter. Most forums offer contextual cues to help knowledge seekers make evaluation decisions, yet little is understood about the cognitive processes and neural mechanisms that underlie how information on these forums is filtered and evaluated. This paper draws on literature in cognitive neuroscience and NeuroIS to develop exploratory research questions about the role of both content …

A Strategy Of Truth: Andreas Feininger And The Creation Of Propaganda For The Office Of War Information, 1942, James Swensen Jan 2019

A Strategy Of Truth: Andreas Feininger And The Creation Of Propaganda For The Office Of War Information, 1942, James Swensen

Faculty Publications

In 1942 photographer Andreas Feininger travelled across the United States documenting war industries for the Office of War Information, a New Deal agency. In the midst of world war, Feininger’s straightforward photographs of plane production, copper mining, and other key industries were carefully crafted propaganda designed to combat German rhetoric and bolster public support and confidence in the war effort. Feininger’s style, an admixture of modernist ideas and social detachment, found resonance within US ideological efforts that stressed data and facts, and became known as the ‘Strategy of Truth’.

Moral Development In Business Ethics: An Examination And Critique, Kristen Bell Detienne, Carol Frogley Ellertson, Marc-Charles Ingerson, William R. Dudley Jan 2019

Moral Development In Business Ethics: An Examination And Critique, Kristen Bell Detienne, Carol Frogley Ellertson, Marc-Charles Ingerson, William R. Dudley

Faculty Publications

The field of behavioral ethics has seen considerable growth over the last few decades. One of the most significant concerns facing this interdisciplinary field of research is the moral judgment-action gap. The moral judgment-action gap is the inconsistency people display when they know what is right but do what they know is wrong. Much of the research in the field of behavioral ethics is based on (or in response to) early work in moral psychology and American psychologist Lawrence Kohlberg’s foundational cognitive model of moral development. However, Kohlberg’s model of moral development lacks a compelling explanation for the judgment-action gap. …

A New Extension Of Lindley Distribution: Modified Validation Test, Characterizations And Different Methods Of Estimation, Mohamed Ibrahim, Abhimanyu Singh Yadav, Haitham M. Yousof, Hafida Goual, Gholamhossein Hamedani Jan 2019

A New Extension Of Lindley Distribution: Modified Validation Test, Characterizations And Different Methods Of Estimation, Mohamed Ibrahim, Abhimanyu Singh Yadav, Haitham M. Yousof, Hafida Goual, Gholamhossein Hamedani

Mathematical and Statistical Science Faculty Research and Publications

In this paper, a new extension of Lindley distribution has been introduced. Certain characterizations based on truncated moments, hazard and reverse hazard function, conditional expectation of the proposed distribution are presented. Besides, these characterizations, other statistical/mathematical properties of the proposed model are also discussed. The estimation of the parameters is performed through different classical methods of estimation. Bayes estimation is computed under gamma informative prior under the squared error loss function. The performances of all estimation methods are studied via Monte Carlo simulations in mean square error sense. The potential of the proposed model is analyzed through two data sets. …

Mathematical and Statistical Science Faculty Research and Publications

The goal of this work is to introduce a new family of continuous distributions with a strong physical application. Some statistical properties are derived, and certain useful characterizations of the proposed family distributions are presented. Five applications are provided to illustrate the importance of the new family. A modified goodness-of-fit test for the new family in complete data case are investigated via two examples. We propose, as a first step, the construction of Nikulin-Rao-Robson statistic based on chi-squared fit tests for the new family in the case of complete data. The new test is based on the Nikulin-Rao-Robson statistic separately …
