การวิจัยครั้งนี้เป็นวิจัยกึ่งทดลองมีวัตถุประสงค์เพื่อศึกษาผลของการจัดการเรียนรู้วิชาพลศึกษาตามแนวคิดห้องเรียนกลับด้านที่มีต่อคุณลักษณะอันพึงประสงค์ด้านใฝ่เรียนรู้และผลสัมฤทธิ์ทางการเรียนของนักเรียนมัธยมศึกษาตอนต้น จํานวน 56 คน แบ่งกลุ่มตัวอย่างออกเป็น 3 กลุ่ม คัดเลือกแบบเจาะจงโดยใช้คะแนนคุณลักษณะอันพึงประสงค์ด้านใฝ่เรียนรู้และผลสัมฤทธิ์ทางการเรียนด้านทักษะ ได้แก่กลุ่มทดลองกลุ่มที่ 1 (19 คน) ได้รับวิดีโอการเรียนรู้ แหล่งข้อมูลเพื่อการสืบค้น และสร้างองค์ความรู้ด้วยตนเองก่อนมีกิจกรรมในห้องเรียน กลุ่มทดลองกลุ่มที่ 2 (19 คน) ได้รับกิจกรรมในห้องเรียน จากนั้นศึกษาวีดิโอการเรียนรู้ แหล่งข้อมูลเพื่อการสืบค้น และสร้างองค์ความรู้ด้วยตนเอง และกลุ่มควบคุม (18 คน) ได้รับการจัดการเรียนรู้พลศึกษาแบบปกติ เครื่องมือที่ใช้ คือ แผนการจัดการเรียนรู้พลศึกษา จํานวน 3 แผน เป็นเวลา 8 สัปดาห์ สื่อการจัดการเรียนรู้ออนไลน์ แบบประเมินคุณลักษณะอันพึงประสงค์ด้านใฝ่เรียนรู้ และแบบวัดผลสัมฤทธิ์ทางการเรียน วิเคราะห์ข้อมูลโดยใช้สถิติเชิงพรรณา การทดสอบความแตกต่างก่อนและหลังด้วยวิธีวิลคอกซัน การทดสอบด้วยวิธีแบบครัสคาล วอลลิส การวิเคราะห์ความแปรปรวนร่วม และทดสอบความแตกต่างเป็นรายคู่โดยวิธีการบอนเฟอโรนี
ผลการวิจัยพบว่า (1) กลุ่มทดลองกลุ่มที่ 1 และ 2 มีคะแนนเฉลี่ยคุณลักษณะอันพึงประสงค์ด้านใฝ่เรียนรู้และผลสัมฤทธิ์ทางการเรียน หลังการทดลองแตกต่างกับก่อนการทดลอง อย่างมีนัยสําคัญทางสถิติที่ระดับ .05 (2) กลุ่มควบคุม มีคะแนนผลสัมฤทธิ์ทางการเรียน หลังการทดลองแตกต่างกับก่อนการทดลองอย่างมีนัยสําคัญทางสถิติที่ระดับ .05 (3) หลังการทดลอง เป็นเวลา 8 สัปดาห์ กลุ่มทดลองกลุ่มที่ 1 และ 2 มีคะแนนเฉลี่ยคุณลักษณะอันพึงประสงค์ด้านใฝ่เรียนรู้และผลสัมฤทธิ์ทางการเรียนด้านทักษะ แตกต่างกับกลุ่มควบคุมอย่างมีนัยสําคัญทางสถิติที่ระดับ .05 (4) หลังการทดลอง เป็นเวลา 8 สัปดาห์ ระหว่างกลุ่มทดลองกลุ่มที่ 1 และ 2 มีคะแนนเฉลี่ยคุณลักษณะอันพึงประสงค์ด้านใฝ่เรียนรู้และผลสัมฤทธิ์ทางการเรียนด้านทักษะไม่แตกต่างกันอย่างมีนัยสำคัญทางสถิติที่ระดับ .05

การวิจัยครั้งนี้เป็นการวิจัยกึ่งทดลอง มีวัตถุประสงค์เพื่อศึกษาผลของโปรแกรมปรับเปลี่ยนพฤติกรรมโดยใช้รูปแบบฟิตส์เพื่อลดอาการปวดคอ ไหล่ และหลังของบุคลากรทางการศึกษา กลุ่มตัวอย่างคือ บุคลากรทางการศึกษา 50 คน ในเขตกรุงเทพมหานคร ระยะเวลาในการดําเนินการวิจัย 6 สัปดาห์ เครื่องมือที่ใช้ในการวิจัยได้แก่ 1) โปรแกรมปรับเปลี่ยนพฤติกรรมโดยใช้รูปแบบฟิตส์ 2) แบบสอบถามการปฏิบัติเพื่อลดอาการปวดคอ ไหล่ และหลัง และ 3) แบบสอบถามอาการปวดคอ ไหล่ และหลัง วิเคราะห์ข้อมูลโดยใช้ค่าเฉลี่ย ส่วนเบี่ยงเบนมาตรฐาน และเปรียบเทียบค่าเฉลี่ยของคะแนนการปฏิบัติและอาการปวดคอ ไหล่ และหลัง โดยการทดสอบค่าที่
ผลการวิจัยพบว่า 1) ค่าเฉลี่ยของคะแนนการปฏิบัติตนเพื่อลดอาการปวดคอ ไหล่ และหลังของกลุ่มทดลอง ก่อนและหลังการทดลอง และระหว่างกลุ่มทดลองกับกลุ่มควบคุม แตกต่างกันอย่างมีนัยสําคัญทางสถิติที่ระดับ .05 และ 2) ค่าเฉลี่ยของคะแนนอาการปวดคอ ไหล่ และหลังของกลุ่มทดลองก่อนและหลังการทดลอง และระหว่างกลุ่มทดลองกับกลุ่มควบคุม แตกต่างกันอย่างมีนัยสําคัญทางสถิติที่ระดับ .05

การพัฒนาผลลัพธ์การเรียนรู้ของผู้เรียนโดยการสร้างสภาวะแวดล้อมการเรียนด้วยการทำงานในสภาพจริง, อลงกต ยะไวทย์, ณัฐวัฒน์ วงษ์ชวลิตกุล

งานวิจัยนี้มีวัตถุประสงค์เพื่อ 1) เพื่อศึกษาและสร้างสภาวะแวดล้อมการเรียนด้วยการทํางานในสภาพจริง และ 2) เพื่อเปรียบเทียบผลลัพธ์การเรียนรู้ของผู้เรียนก่อนเรียนกับหลังเรียน กลุ่มตัวอย่างคือ นักศึกษาระดับ ปวส. สาขาวิชาเทคนิคการผลิต 20 คน พี่เลี้ยง 20 คน และนักศึกษาระดับปริญญาตรีสาขาวิชาการจัดการ 16 คน พี่เลี้ยง 16 คน ในสถานประกอบการ 6 แห่ง เครื่องมือในการวิจัย ได้แก่แบบประเมินผลลัพธ์การเรียนรู้ และระบบการจัดสภาวะแวดล้อมการเรียนในสภาพจริง ทําการวิเคราะห์ค่าเฉลี่ย ส่วนเบี่ยงเบนมาตรฐาน และเปรียบเทียบความแตกต่างระหว่างคะแนนเฉลี่ยก่อนและหลังเรียนด้วยค่าที
ผลการวิจัย เป็นดังนี้
1. ผลการศึกษาและสร้างสภาวะแวดล้อมการเรียนด้วยการทํางานในสภาพจริง ได้ระบบซึ่งประกอบด้วย 6 องค์ประกอบ ได้แก่ 1) การเตรียมการ 2) การเรียนการสอนในสภาพจริง 3) การให้คําปรึกษา 4) พัฒนาการของผู้เรียนตามผลลัพธ์การเรียนรู้ 5) ประเมินผลและปรับปรุงอย่างต่อเนื่อง และ 6) ผลลัพธ์การเรียนรู้ของผู้เรียน มีผลการประเมินอยู่ในระดับมาก
2. ผลการเปรียบเทียบค่าเฉลี่ยระดับคะแนนผลลัพธ์การเรียนรู้ของผู้เรียนที่ศึกษาอยู่ในสภาวะ แวดล้อมการเรียนด้วยการทํางานในสภาพจริงหลังเรียนสูงกว่าก่อนเรียนอย่างมีนัยสําคัญทางสถิติที่ระดับ .01

การวิจัยนี้มีวัตถุประสงค์เพื่อสังเคราะห์แนวทางการจัดกิจกรรมที่ผู้ปกครองต้นแบบใช้เสริมสร้างการคิดวิเคราะห์ของเด็กช่วงปฐมวัย กลุ่มตัวอย่าง คือ ผู้ปกครองในจังหวัดสุราษฎร์ธานีที่มีประสบการณ์เลี้ยงลูกให้ประสบผลสําเร็จในชีวิตและหน้าที่การงาน จํานวน 19 คน เครื่องมือที่ใช้ คือ การสัมภาษณ์เชิงลึกวิเคราะห์ข้อมูลด้วยการสรุปอุปนัย
ผลการวิจัย พบว่า แนวทางการจัดกิจกรรมที่ผู้ปกครองต้นแบบใช้เสริมสร้างการคิดวิเคราะห์ของเด็กปฐมวัยที่ให้ทําให้ประสบผลสําเร็จในชีวิตเกิดจากแนวคิด ความเชื่อ ความรู้สึกยอมรับจากประสบการณ์ตรง 5 ประการ ได้แก่ 1) การฝึกให้รู้จักรับผิดชอบด้วยการทํางาน 2) การใช้เหตุผลอยู่เหนืออารมณ์ 3) การกํากับติดตามอย่างต่อเนื่อง 4) การเป็นโค้ช 5) การใช้หลักธรรมทางศาสนา ภายใต้ความเชื่อเรื่องธรรมชาติการเรียนรู้ตามวัย การจัดสภาพแวดล้อมเอื้อต่อการเรียนรู้ การให้อิสระทางความคิดและเวลา ความเสมอต้นเสมอปลายในความรักและเอาใจใส่ และใช้กิจกรรมในหมวดงานบ้าน 10 กิจกรรม หมวดงานครัว 10 กิจกรรม หมวดกิจวัตรประจําวัน 12 กิจกรรม หมวดงานอดิเรกและนันทนาการ 13 กิจกรรม จากการให้ลูกทํากิจกรรมดังกล่าว พบว่า ปัจจัยที่ส่งผลต่อการคิดวิเคราะห์ของเด็กปฐมวัย ได้แก่ ชนิดของกิจกรรม ลักษณะของสื่ออุปกรณ์ วิธีการขั้นตอนที่เด็กมีส่วนร่วม บทบาทของผู้ปกครองในการกระตุ้นคิด จูงใจให้สังเกต ใช้คําถามชวนคิดการตอบข้อสงสัย ยอมรับการกระทําของเด็ก และเป็นแบบอย่าง

การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อ 1) เปรียบเทียบความรู้ทางคณิตศาสตร์และความสามารถในการแก้ปัญหาทางคณิตศาสตร์หลังเรียนระหว่างนักเรียนกลุ่มทดลองกับนักเรียนกลุ่มปกติ 2) เปรียบเทียบความสามารถในการแก้ปัญหาทางคณิตศาสตร์ของนักเรียนกลุ่มทดลองก่อนเรียนและหลังเรียน และ 3) ศึกษาพัฒนาการของความรู้ทางคณิตศาสตร์และความสามารถในการแก้ปัญหาทางคณิตศาสตร์ของนักเรียนกลุ่มทดลอง กลุ่มตัวอย่างเป็นนักเรียนชั้นมัธยมศึกษาปีที่ 5 โรงเรียนศรีอยุธยา ในพระอุปถัมภ์ฯ ภาคเรียนที่ 1 ปีการศึกษา 2560 จํานวน 90 คน แบ่งเป็น 2 กลุ่ม คือ กลุ่มทดลอง จํานวน 44 คน และกลุ่มควบคุม จํานวน 46 คน เครื่องมือที่ใช้ในการเก็บรวบรวมข้อมูล คือ แบบวัดความรู้ทางคณิตศาสตร์และแบบวัดความสามารถในการแก้ปัญหาทางคณิตศาสตร์ และใบงาน วิเคราะห์ข้อมูลโดยหาค่าเฉลี่ยเลขคณิต ส่วนเบี่ยงเบนมาตรฐาน และการทดสอบค่าที และการวิเคราะห์เชิงเนื้อหา
ผลการวิจัยพบว่า 1) นักเรียนกลุ่มทดลองมีความรู้ทางคณิตศาสตร์และความสามารถใน การแก้ปัญหาทางคณิตศาสตร์สูงกว่านักเรียนกลุ่มควบคุม อย่างมีนัยสําคัญทางสถิติที่ระดับ .05 2) นักเรียน กลุ่มทดลองมีความสามารถในการแก้ปัญหาทางคณิตศาสตร์หลังเรียนสูงกว่าก่อนเรียน อย่างมีนัยสําคัญทางสถิติที่ระดับ .05 และ 3) นักเรียนกลุ่มทดลองมีพัฒนาการของความรู้ทางคณิตศาสตร์และความสามารถในการแก้ปัญหาทางคณิตศาสตร์ดีขึ้นเมื่อเปรียบเทียบเป็นระยะจากก่อนเรียน ระหว่างเรียน และหลังเรียน

การพัฒนาคู่มือฝึกอบรมภาวะผู้นำการเปลี่ยนแปลงของครูแกนนำสู่ชุมชนการเรียนรู้ทางวิชาชีพ, ทนงศักดิ์ จันทบุรี, ณัฐิยา ตันตรานนท์, เกตุมณี มากมี, สุเทพ พงศ์ศรีวัฒน์

การวิจัยนี้ มีวัตถุประสงค์เพื่อพัฒนาและประเมินคู่มือฝึกอบรมภาวะผู้นําการเปลี่ยนแปลงของครูแกนนําสู่ชุมชนการเรียนรู้ทางวิชาชีพ ผู้วิจัยเก็บรวบรวมข้อมูลจากการสอบถามครูแกนนําที่คัดเลือกตามคุณสมบัติที่กําหนดไว้ 19 คน โดยผู้วิจัยได้พัฒนาคู่มือฝึกอบรมจากนั้นทําการอบรมครูแกนนําและประเมินผลการพัฒนาภาวะผู้นําของครูแกนนํา ผลการวิจัย พบว่า คู่มือมีความเหมาะสมและมีส่วนประกอบที่สําคัญ 4 ส่วน ได้แก่ 1) แนวทางการดําเนินการ 2) การพัฒนาภาวะผู้นําการเปลี่ยนแปลง 3) การพัฒนาครูแกนนําสู่ชุมชนการเรียนรู้ทางวิชาชีพ และ 4) การติดตามประเมินผลภายหลังการฝึกอบรม ผู้วิจัยทําการประเมินผลการอบรมภาวะผู้นําการเปลี่ยนแปลงโดยใช้แนวคิดของ KIRKPATRICK'S พบว่า ครูมีความพึงพอใจต่อการฝึกอบรมมีความรู้ความเข้าใจและแสดงพฤติกรรมกระตือรือร้นในการเรียนรู้ มีประสิทธิภาพการจัดกิจกรรมการเรียนการสอนเพิ่มมากขึ้น และมีความสามารถในการสร้างเครือข่ายการเรียนรู้ของครูและความร่วมมือทางวิชาการ โดยการฝึกอบรมภาวะผู้นําการเปลี่ยนแปลงมีองค์ประกอบของเนื้อหาใน 5 มิติ ได้แก่การมีอิทธิพลอย่างมีอุดมการณ์ การสร้างแรงบันดาลใจ การกระตุ้นทางปัญญา การบ่งชี้และให้ความชัดเจนทางวิสัยทัศน์ และการคํานึงถึงความเป็นปัจเจกบุคคล ผลการวิจัยสามารถสรุปได้ว่า การพัฒนาภาวะผู้นําการเปลี่ยนแปลงสู่ชุมชนการเรียนรู้ทางวิชาชีพจากการอบรมส่งผลต่อการปรับเปลี่ยนพฤติกรรม และมีความสําคัญต่อการขับเคลื่อนโรงเรียนสู่การเป็นชุมชนการเรียนรู้ทางวิชาชีพเพื่อคุณภาพผู้เรียนเป็นสําคัญ

การวิจัยในครั้งนี้มีวัตถุประสงค์เพื่อ (1) พัฒนาโปรแกรมการออกกําลังกายโดยใช้ทฤษฎีบูรณาการประสาทความรู้สึกร่วมกับภูมิปัญญาไทยเพื่อพัฒนาสมรรถภาพทางกายที่สัมพันธ์กับสุขภาพและทักษะทางสังคมของเด็กออทิสติก และ (2) ประเมินประสิทธิภาพของโปรแกรมการออกกําลังกายโดยใช้ทฤษฎีบูรณาการประสาทความรู้สึกร่วมกับภูมิปัญญาไทยเพื่อพัฒนาสมรรถภาพทางกายที่สัมพันธ์กับสุขภาพและทักษะทางสังคมของเด็กออทิสติก กลุ่มตัวอย่าง คือ เด็กออทิสติกที่ได้รับการวินิจฉัยจากแพทย์ว่ามีภาวะออทิสซึ่มอยู่ในระดับปานกลาง อายุ 12-18 ปี จํานวน 8 คน จากการเลือกแบบเฉพาะเจาะจงดําเนินการทดลอง 8 สัปดาห์ ๆ ละ 3 ครั้ง ครั้ง ๆ 45 นาที ทําการเก็บรวบรวมข้อมูลก่อนการทดลองหลังการทดลอง และหลังเสร็จสิ้นการทดลอง 2 สัปดาห์ นําผลที่ได้มาวิเคราะห์ข้อมูลโดยใช้สถิติเชิงบรรยาย การทดสอบความแปรปรวนทางเดียวชนิดวัดซ้ํา Repeated One-way ANOVA Measurementการทดสอบค่าที
ผลการวิจัยพบว่า 1) โปรแกรมที่ได้พัฒนาขึ้น ประกอบด้วย 3 กิจกรรม คือ กิจกรรมการละเล่นพื้นบ้านไทยโดยใช้ผ้าขาวม้า การออกกําลังกายแบบเดี่ยว การออกกําลังกายแบบเป็นคู่และการออกกําลังกาย แบบเป็นกลุ่ม จํานวน 26 ท่า และ 5 ขั้นตอนการออกกําลังกาย โดยมีดัชนีความสอดคล้อง 0.94 2) สมรรถภาพทางกายที่สัมพันธ์กับสุขภาพของเด็กออทิสติกหลังการทดลองและหลังเสร็จสิ้นการทดลอง 2 สัปดาห์สูงกว่าก่อนการทดลองอย่างมีนัยสําคัญทางสถิติที่ระดับ .05 3) ด้านทักษะทางสังคมของเด็กออทิสติกหลังการทดลองสูงกว่าก่อนการทดลองอย่างมีนัยสําคัญทางสถิติที่ระดับ .05 ทั้งในด้านปฏิสัมพันธ์ทางสังคม ด้านการสื่อสารทางสังคมและด้านการทํางานร่วมกับบุคคลอื่น

การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อ 1) ศึกษากรอบแนวคิดการบริหารสถานศึกษาอาชีวศึกษาเอกชนตามแนวคิดการมีส่วนร่วมของพ่อแม่ ผู้ปกครอง และความต้องการของสถานประกอบการ และ 2) ศึกษาสภาพปัจจุบัน และสภาพที่พึงประสงค์ของการบริหารสถานศึกษาอาชีวศึกษาเอกชนตามแนวคิดการมีส่วนร่วมของพ่อแม่ ผู้ปกครอง และความต้องการของสถานประกอบการ ดําเนินการวิจัยโดยใช้วิธีแบบผสมผสาน เก็บข้อมูลจากสถานศึกษาอาชีวศึกษาเอกชน จํานวน 143 แห่ง ผู้ให้ข้อมูล คือ ผู้บริหาร อาจารย์ และนักเรียน เครื่องมือที่ใช้ในการวิจัย ได้แก่ แบบสอบถาม แบบประเมิน สถิติที่ใช้การวิเคราะห์ข้อมูล คือ ค่าเฉลี่ย ส่วนเบี่ยงเบนมาตรฐาน
ผลการวิจัยในครั้งนี้ พบว่า กรอบแนวคิดการบริหารสถานศึกษาอาชีวศึกษาเอกชนตามแนวคิดการมีส่วนร่วมของพ่อแม่ ผู้ปกครอง และความต้องการของสถานประกอบการ ประกอบด้วยการบริหารสถานศึกษาอาชีวศึกษาด้านหลัก 2 ด้าน และด้านย่อย 4 ด้าน การมีส่วนร่วมของพ่อแม่ ผู้ปกครอง 3 รูปแบบ และ ความต้องการของสถานประกอบการ 3 ด้านและสภาพปัจจุบันของการบริหารสถานศึกษาอาชีวศึกษาเอกชนตามแนวคิดการมีส่วนร่วมของพ่อแม่ ผู้ปกครอง และความต้องการของสถานประกอบการด้านบริหารวิชาการอยู่ในระดับปานกลาง ด้านบริหารกิจการนักเรียนอยู่ในระดับมาก และสภาพที่พึงประสงค์ด้านการบริหารวิชาการและด้านบริหารกิจการนักเรียน อยู่ในระดับมาก

For fecal sludge from households in low- and middle-income countries to be treated offsite it needs to be removed, which can be greatly affected by the pit latrine floor design. However, it is unclear whether precast pit latrine concrete floors (latrine slabs) can withstand emptiers and their equipment. To investigate this issue, 28 prefabricated latrine slabs were purchased in two cities of Malawi. They were first visually evaluated, and then their compression strength was tested. Additionally, each seller was asked a series of questions to better understand their business, training, and construction practices. Results showed that households should perform due …

Early in the debate over abortion, opposition to the procedure was primarily described in terms that reflected moral concerns about the protection of “the unborn.” Indeed, much of the media coverage and public discourse describing opposition to abortion since the time of Roe characterizes the movement as focused on securing rights for all human beings from the moment of conception (Huff 2014, 39). Handwritten newspapers appeared in a variety of social contexts in the 19th-century U.S.1 The largest extant portion of 19th-century handwritten newspapers emerged from home and school settings. More far-flung examples include those written aboard ships during exploratory and military voyages. Others were produced within institutions such as hospitals and asylums. Such works were written during times of privation, including life in an army regiment or a prisoner-of-war camp during the Civil War. At other times, handwritten newspapers accompanied efforts at westward settlement and transcontinental railway journeys. After a mudslide accident where student and faculty travelers may have been nearby, the President of the university called Clevenger's office to find out traveler locations. Extant research indicates that there continues to be a gap between employer expectations and the oral presentation skills of B-school graduate students. In order to address this gap, the authors undertook a three-year effort to research, develop, and administer a public speaking workshop focused on preparing new business graduate students to meet industry demands for presentation skills and strategies. Survey and focus group data informed several revisions to the workshop plan. In previous studies, narcissism has been found to relate to social media behaviors, such as how often one posts and how many friends or followers one has (McCain & Campbell, 2016; Singh, Farley, and Donahue, 2018). The present study attempted to create a model of social media use predicted by narcissism and selfconsciousness. A sample of 397 adults with a mean age of 29 years was collected using MTurk. Participants completed a social media use survey, the Narcissistic Personality Inventory (Raskin & Hall, 1979) and the Self-Consciousness Scale (Scheier & Carver, 1985). The goal of this new investigation is to better understand gravity waves and their interactions as they propagate from the mesosphere into the lower thermosphere, to characterize the mesoscale wind field, and to identify regions of divergence, vorticity, and stratified turbulence. The Vorticity Experiment (VortEx) will comprise two salvoes of each two sounding rockets scheduled to be launched from Andøya Space Center, Norway in February 2022. The rockets will observe horizontally spaced wind profiles, neutral density and temperature profiles, and plasma densities. The paper introduces a theoretical background of the mechanism of electromagnetic energy and power accumulation and its focusing in narrow pulses travelling along a transmission line with material parameters variable in 1D-space and time. This mechanism may be implemented due to a special material geometry- a distribution of two different dielectrics in a spatio-temporal checkerboard. Objective: To characterize the methods of design and analysis currently adopted in survey research of school-based observational studies for smoking, and to identify the common pitfalls made by researchers.
Methods: The systematic review was conducted in 2009 and consisted of observational studies in school settings published between January 2005 and January 2009. Smoking status was the main outcome of interest. Following Cochrane style, five steps were followed: setting selection criteria for studies and conducting a literature search; review of abstracts; review of complete articles; data extraction and quality assessment of included studies; and, finally, synthesis of studies.

The estate tax treatment of publicity rights has played a role in the debate about the state law question whether such rights should be transferable at death. Some point to the estate tax as a reason for making publicity rights non-transferable. For if they are transferable, estate-tax inclusion could result. And, the argument goes, the estate or the beneficiaries could well be coerced into commercializing the rights in order to raise the money to pay the tax. This symposium contribution analyzes the relationship between intellectual property and tangible property, focusing on four types of intellectual property: copyrights, trademarks, patents, and trade secrets. It posits that—contrary to popular conceptions—the question of rivalrousness should be viewed as central both to owners’ use of IP-protected goods and to others’ infringement of the underlying IP rights (just as that attribute lies at the heart of the concept of real and other tangible property). We are so used to Congressional gibberish that we take it for granted as though it were caused by nature. Congress doesn’t know how to create logically coherent statutes.

An example is the Vacancies Reform Act of 1998. If, while violating the Act, a President purportedly appoints a person — perhaps to be an Acting Attorney General or Acting Deputy Attorney General — every decision and action of that person is void because the person does not actually hold the office.
