Arriving At A Better Answer: A Decision Matrix For Science Lab Course Format, Emily K. Faulconer, Laura S. Faulconer, James R. Hanamean
Publications
At first glance, scientific laboratory experiences might appear to be challenging to move to the cloud. Skeptics may point to sensory feedback limitations and inequivalence of student outcomes. However, emerging data increasingly provide evidence that scientific laboratory courses are not only amenable to online learning, but also can deliver student outcomes at or above traditional in-person courses. In identifying a science lab format, each institution weighs factors like lab course goals, budget, program growth, access, and safety. This article presents a single case study and a decision matrix for how one institution informed their choice for the modality of a …

A Design Of A Material Assembly In Space-Time Generating And Storing Energy, Mihhail Berezovski, Stan Elektrov, Konstantin Lurie
Publications
The paper introduces a theoretical background of the mechanism of electromagnetic energy and power accumulation and its focusing in narrow pulses travelling along a transmission line with material parameters variable in 1D-space and time. This mechanism may be implemented due to a special material geometry- a distribution of two different dielectrics in a spatio-temporal checkerboard. We concentrate on the practically reasonable means to bring this mechanism into action in a device that may work both as energy generator and energy storage. The basic ideas discussed below appear to be fairly general; we have chosen their electromagnetic implementation as an excellent …

A Systematic Review Of Observational Studies, Demonstrating Smoking Among School Going Adolescents, Shafquat Rozi, Gillian Lancaster, Sadia Mahmud, Zahid Ahmad Butt, Talat Roome, Nida Zahid
Community Health Sciences
Objective: To characterize the methods of design and analysis currently adopted in survey research of school-based observational studies for smoking, and to identify the common pitfalls made by researchers.
Methods: The systematic review was conducted in 2009 and consisted of observational studies in school settings published between January 2005 and January 2009. Smoking status was the main outcome of interest. Following Cochrane style, five steps were followed: setting selection criteria for studies and conducting a literature search; review of abstracts; review of complete articles; data extraction and quality assessment of included studies; and, finally, synthesis of studies.
Results: Of the …

In their new book, "A Great Power of Attorney": Understanding the Fiduciary Constitution, Gary Lawson and Guy Seidman argue that, as a matter of original meaning, the Constitution should be understood as analogous to a power of attorney, that interpretive devices applicable to powers of attorney should therefore be used in constitutional interpretation, and that interpreting the Constitution that way would produce results congenial to modern libertarian preferences, such as the unconstitutionality of the Affordable Care Act and the invalidity, on nondelegation grounds, of much of the federal administrative state. But the book fails to carry any of its central …
Publicity Rights And The Estate Tax, Mitchell M. Gans
Publicity Rights And The Estate Tax, Mitchell M. Gans
Hofstra Law Faculty Scholarship
The estate tax treatment of publicity rights has played a role in the debate about the state law question whether such rights should be transferable at death. Some point to the estate tax as a reason for making publicity rights non-transferable. For if they are transferable, estate-tax inclusion could result. And, the argument goes, the estate or the beneficiaries could well be coerced into commercializing the rights in order to raise the money to pay the tax. Making them non-transferable would eliminate this possibility. This article considers some of the connections between the federal estate tax and the state law …

Knitting 101: Why Law Professors Should Share Their Hobbies With Their Students, Susan Greene
Hofstra Law Faculty Scholarship
For many students, adrift in a sea of outlines and anxiety over the pressures of being a law student, cultivating a hobby or even developing a new one seems a luxury in time and energy that they cannot afford. Therefore, it is incumbent upon law professors to lead by example.
A Real-Property Model Of Privacy, G. Alex Sinha
A Real-Property Model Of Privacy, G. Alex Sinha
Hofstra Law Faculty Scholarship
Privacy has been a significant subject of scholarly attention for decades, but it has never been more confusing than it is today. As myriad social pressures inexorably corral an ever-growing share of the world’s population down the digital rabbit hole, more and more people become both users and targets of new technologies. The complexity of these technologies and their unprecedented interactions with one another have completely outstripped the ability of the populace as a whole to understand the privacy implications of our new and shifting reality. Confronting privacy questions in this context is all but paralyzing.

This symposium contribution analyzes the relationship between intellectual property and tangible property, focusing on four types of intellectual property: copyrights, trademarks, patents, and trade secrets. It posits that—contrary to popular conceptions—the question of rivalrousness should be viewed as central both to owners’ use of IP-protected goods and to others’ infringement of the underlying IP rights (just as that attribute lies at the heart of the concept of real and other tangible property). Rivalrousness typically arises where consumption of a good by a consumer prevents simultaneous consumption of that good by other consumers or, in the tangible property context, where simultaneous …
Why Congress Drafts Gibberish, Richard K. Neumann Jr.
Why Congress Drafts Gibberish, Richard K. Neumann Jr.
Hofstra Law Faculty Scholarship
We are so used to Congressional gibberish that we take it for granted as though it were caused by nature. Congress doesn’t know how to create logically coherent statutes.
An example is the Vacancies Reform Act of 1998. If, while violating the Act, a President purportedly appoints a person — perhaps to be an Acting Attorney General or Acting Deputy Attorney General — every decision and action of that person is void because the person does not actually hold the office. The Act is crystal-clear that such a person would have no power, for example, to fire a Special Counsel. …

Testing Coulwave For Use In Modeling Cross-Shore Sand Transport And Beach Profile Evolution, Patrick Michael Cooper
Testing Coulwave For Use In Modeling Cross-Shore Sand Transport And Beach Profile Evolution, Patrick Michael Cooper
UNF Graduate Theses and Dissertations
Realistic, reliable, and effective modeling of cross-shore sediment transport is not present in the current literature. Building that model requires the accurate recreation of breaking wave processes in the nearshore. To develop that first step for an as-yet-to-be-designed model, multiple phase-resolving wave transformation algorithms are reviewed for in-depth investigation. The COULWAVE model is selected for robust testing. Testing of the COULWAVE model shows that, although capable of recreating realistic results, it does not adequately describe major wave characteristics in the surf zone, across a wide range of conditions, to warrant use in a future cross-shore sediment transport model.
Conceptual Metaphors Of "The Chinese Dream" And President Xi Jinping's Strategy For The Governance Of China(อุปลักษณ์เชิงมโนทัศน์ "ความฝันจีน" กับยุทธศาสตร์การบริหารประเทศของประธานาธิบดีจีนสีจิ้นผิง), Yao Siqi
Journal of Letters
This article examines conceptual metaphors relating to "the Chinese Dream", a term popularized after 2013 within Chinese socialist thought that describes a set of personal and national ideals in the People's Republic of China and the Communist Party of China. A semantic analysis was made of the linguistic data of this phrase associated with Xi Jinping, General Secretary of the Communist Party of China, President of the People's Republic of China, and Chairman of the Central Military Commission. Conceptual Metaphor Theory (CMT), within the field of cognitive linguistics, as investigated by George Lakoff and Mark Johnson (1980), as well as …

Politeness Judgment From Responding To Blame Utterances In Thai : Perspectives From Two Generations(การตัดสินความสุภาพจากถ้อยคําการตอบกลับการตําหนิในภาษาไทย : มุมมองจากคนสองวัย), Sirawat Thaithae
Journal of Letters
To determine whether any action or utterance is polite or impolite is at the discretion of the listener; a speaker may employ utterances that seem disrespectful to an outside audience, but if their immediate listeners did not feel those utterances were impolite, the utterances cannot be regarded as such. However, personal politeness perspectives vary according to the participants' age range. For this reason, an awareness of the participants' view of politeness is important. If people from different generations realize each other's politeness perspectives, it makes their communication smooth. This article aims to comparatively study the politeness judgment levels of utterances …

This article analyzesthe meaning of Khachapura City in the novels Khachapura and Nakorn Aiyaraby Pongsakorn who is a famous fantasy novel writer. The key theoretical approach of this article is based on ecocriticism. The article has three topics: Khachapura City as the purification of space, Khachapura City as a mythof ecocentric space and Khachapura City as a space that is other. Analysis shows that Khachapura City is the purification of space through a barrier to access; people must have four magical objects for access. Moreover, the purification of space is connected to patriarchy. Khachapura City is a myth of ecocentric …

The Reception Of Western Political Thought On The Forms Of Government In Siam(การรับ ความคิดทางการเมืองตะวันตกว่าด้วยเรื่องรูปแบบการปกครอง), Akekalak Chaiyapumee
Journal of Letters
This article outlines the reception of western political thought on the forms of government in Siam, which subsequently engendered political articulations and forced Siamese elites to adjust the structure of the government after the western model. This process can be categorized into two separate courses of action, which are the internal and external necessities laying conditions for Siamese elites to improve the political structure in order to survive by meeting the standard of civilization set by the European model, which itself has changed over time. The constraints from the western world during the colonization period, however, have forced the related …
