Determining Climate Responsibility: Government Liability For Hurricane Katrina?, Teresa Chan, Michael Burger, Vincent Colatriano, John Echeverria
Sabin Center for Climate Change Law
In St. Bernard Parish Government v. United States, Louisiana property owners argued that the U.S. government was liable under takings law for flood damage to their properties caused by Hurricane Katrina and other hurricanes. The U.S. Court of Appeals for the Federal Circuit disagreed, however, noting that the government cannot be liable on a takings theory for inaction, and that the government action was not shown to have been the cause of the flooding. On September 6, 2018, the Environmental Law Institute hosted an expert panel to explore this ruling and its potential implications for future litigation in a …

U.S. Climate Change Litigation In The Age Of Trump: Year Two, Dena P. Adler
Sabin Center for Climate Change Law
More than two and a half years into the Trump Administration, no climate change-related regulatory rollback brought before the courts has yet survived legal challenge. Nevertheless, climate change is one arena where the Trump Administration’s regulatory rollbacks have been both visible and real. The Administration has delayed and initiated the reversal of rules that reduce greenhouse gas (GHG) emissions from stationary and mobile sources; sought to expedite fossil fuel development, including in previously protected areas; delayed or reversed energy efficiency standards; undermined consideration of climate change in environmental review and other decisionmaking; and hindered adaptation to the impacts of climate …
Automated Deployment Of Cybersecurity Labs In Cloud Computing Environments, Christopher Simpson, Omar El-Gayar, Dave Bishop
Automated Deployment Of Cybersecurity Labs In Cloud Computing Environments, Christopher Simpson, Omar El-Gayar, Dave Bishop
Research & Publications
Government and private sector reports continue to highlight the shortage of qualified cybersecurity professionals. Hands-on cybersecurity labs can enhance student learning and augment the gap in qualified teachers. While there is a large body of research on cybersecurity labs, it is challenging to recreate these labs due to the use of proprietary software, significant hardware requirements, or large data transfer requirements. The automated deployment of IT infrastructure allows for the easy deployment and sharing of lab environments. This research proposes a framework for the use of DevOps tools to automate the deployment of cybersecurity labs that maps to specific learning …

A Socio-Technical-Based Process For Questionnaire Development In Requirements Elicitation Via Interviews, Abdullah Wahbeh, Surendra Sarnikar, Omar F. El-Gayar
Research & Publications
Software development is the process of building systems that solve users’ need and satisfy stakeholders’ objectives. Such needs are determined through requirements elicitation, which is considered an intensive, complex, and multi-disciplinary process. Traditional methods of elicitation often fail to uncover requirements that are critical for successful and wide-scale user adoption because these methods primarily focus on the technical aspects and constraints of the systems rather than considering a socio-technical perspective. The success of information system development involves the identification of the social, organizational and technical features of the systems, which in turn can result in a more acceptable system by …

ICHRIE Research Reports
This report compares hotel reservation website load times to best practice. Long load times can cause users to abandon websites, resulting in lost revenue. Results from our research indicate load times for hotel reservation websites exceed best practice times for both desktop and mobile devices. Site design must consider load time with competing design requirements.
Developing In Situ Dissolved Inorganic Carbon Dioxide Instrumentation, Beckett Colson
Developing In Situ Dissolved Inorganic Carbon Dioxide Instrumentation, Beckett Colson
Link Foundation Ocean Engineering and Instrumentation Fellowship Reports
The ocean carbon system plays a critical role in regulating carbon dioxide content in the atmosphere. With increased anthropogenic carbon input, it is even more important to understand the system through measurements, models, and predictions. Unfortunately, the spatiotemporal resolution of ocean carbon system measurements is limited by a lack of in situ instrumentation. The support of the Link Foundation Ocean Engineering and Instrumentation Fellowship has enabled me to make significant progress in developing an in situ carbon system instrument for the deep sea. The instrument will measure both total dissolved inorganic carbon (DIC) and the partial pressure of carbon dioxide …
Antitrust In Digital Markets, John M. Newman
Antitrust In Digital Markets, John M. Newman
Articles
Antitrust law has largely failed to address the challenges posed by digital markets. At the turn of the millennium, the antitrust enterprise engaged in intense debate over whether antitrust doctrine, much of it developed during a bygone era of smokestack industries, could or should evolve to address digital markets. Eventually, a consensus emerged: although the basic doctrine is supple enough to apply to new technologies, courts and enforcers should adopt a defendant-friendly, hands-off approach.
But this pro-defendant position is deeply- and dangerously- flawed. Economic theory, empirical research, and extant judicial and regulatory authority all contradict the prevailing views regarding power, …

Teach-Back Process As A Best Practice In Patient Education, Laura Hoffman
Teach-Back Process As A Best Practice In Patient Education, Laura Hoffman
Walden Dissertations and Doctoral Studies
Limited health literacy is a national problem. Nurses are in a position to address patients' limited health literacy skills using a universal precautions approach through the teach-back process. The purpose of this project was to plan a program to educate nurses on best practices in patient education. The theoretical framework informing this work was Bandura's social cognitive theory, which asserts that increases in knowledge and self-efficacy are precursors to affecting behavior change. The logic model was used to guide the project planning processes. Evidentiary sources included literature obtained online and through database searches, input from a team of experts and …

The Nurse And Certified Nursing Assistant Perception Of Person-Centered Care, Latonya Dickerson Hughes
Walden Dissertations and Doctoral Studies
Over the last decade, long-term care facilities have transitioned from institutional care models that focus on person-centered care, in which the resident is the center of the care. The purpose of this study is to explore the nurse and certified nursing assistant perception of the person-centered care services they deliver. Jean Watson's theory of human caring is the theoretical framework that guided this study. The theory focusing on the human caring experiences and person-centered care is being characterized as a caring feeling. The carative factors of Watson's theory, the fundamental concept of caring, has been associated with improved outcomes for …
