The Ferguson Effect In Contemporary Policing: Assessing Police Officer Willingness To Engage The Public, Christopher Mercado Sep 2019

The Ferguson Effect In Contemporary Policing: Assessing Police Officer Willingness To Engage The Public, Christopher Mercado

Dissertations, Theses, and Capstone Projects

Researchers suggest that as public scrutiny and video recording of violent/tumultuous police encounters increase, police would back away from proactive enforcement, resulting in an increase in crime—the Ferguson Effect. Recent scholarship refined these concerns over police disengagement with the study of de-policing, while other scholars explored police self-legitimacy, in order to explain law enforcement behavior, given the immediacy and ubiquity of social media and digital communication. This study surveyed 792 law enforcement officers from 10 different police agencies in the United States, to ascertain if police officers’ personal and contextual characteristics influence their decision to either take enforcement action (i.e., …

Neural Correlates Of Automatic Emotional Processing And Emotion Regulation In Empathy And Psychopathy-Related Coldheartedness, Danielle Difilipo Sep 2019

Neural Correlates Of Automatic Emotional Processing And Emotion Regulation In Empathy And Psychopathy-Related Coldheartedness, Danielle Difilipo

Dissertations, Theses, and Capstone Projects

Psychopathy is a personality disorder that is defined, in part, by a lack of empathy. Psychopathy-related empathic deficits have been associated with atypical behavioral and neural responses to emotional facial expressions. Although the mirror neuron system (MNS) has been implicated in empathy, very few studies have examined the role of MNS functioning as it pertains to empathy impairments in psychopathy. Moreover, there is very little empirical research regarding emotion regulation in psychopathy, and specifically whether emotional responses can be intentionally upregulated. The present study sought to clarify whether the MNS is functionally intact in adults with subclinical psychopathic traits, particularly …

The Evolution Of Mara Salvatrucha 13 And Barrio 18: Violence, Extortion, And Drug Trafficking In The Northern Triangle Of Central America, Pamela Ruiz Sep 2019

The Evolution Of Mara Salvatrucha 13 And Barrio 18: Violence, Extortion, And Drug Trafficking In The Northern Triangle Of Central America, Pamela Ruiz

Dissertations, Theses, and Capstone Projects

The Mara Salvatrucha 13 (mara) and Barrio 18 (pandilla) gangs have become a major concern for the governments of the Northern Triangle of Central America (Guatemala, El Salvador, and Honduras) and the United States. In recent years, government officials have attributed violence and the exodus of Central Americans to the developing capacities of gangs. The Mara Salvatrucha 13(MS-13) and Barrio 18 have been identified to strategically implement violence and extortion rackets which have led to transformations in their organizational structures and increased participation in drug trafficking. Furthermore, officials insinuate that gangs have developed capacities to confront security forces that enter …

Categorically Redeeming Graham V Florida And Miller V Alabama: Why The Eighth Amendment Guarantees All Juvenile Defendants A Constitutional Right To A Parole Hearing, Parag Dharmavarapu Sep 2019

Categorically Redeeming Graham V Florida And Miller V Alabama: Why The Eighth Amendment Guarantees All Juvenile Defendants A Constitutional Right To A Parole Hearing, Parag Dharmavarapu

University of Chicago Law Review

The Supreme Court has held that life without parole is an unconstitutional sentence for nearly all juvenile defendants—except for a select few that the criminal justice system deems irredeemable. Though this represents a positive development in the Court’s juvenile sentencing jurisprudence, it has left the case law deeply unsettled. For instance, the Court has held that redeemable juveniles are all entitled to a “meaningful opportunity to obtain release,” but it has failed to explicitly define what that constitutional mandate means in practice. On top of that, the Court has concluded that not even expert psychologists can determine at sentencing whether …

Passive Embezzlement Schemes As Continuing Offenses, William Admussen Sep 2019

Passive Embezzlement Schemes As Continuing Offenses, William Admussen

University of Chicago Law Review

For most offenses, the statute of limitations begins to run when the elements of an offense are satisfied. For continuing offenses, however, the statute of limitations begins to run when the crime stops, extending the amount of time the government has to bring charges. This Comment considers the circuit split over whether passive embezzlement schemes are continuing offenses. Typically charged under the federal embezzlement statute, 18 USC § 641, passive embezzlement schemes continue automatically once set in motion. They are distinguished from active embezzlement schemes in that active schemes require some affirmative act by the embezzler for the scheme to …

Criminal Law In A Civil Guise: The Evolution Of Family Courts And Support Laws, Elizabeth D. Katz Sep 2019

Criminal Law In A Civil Guise: The Evolution Of Family Courts And Support Laws, Elizabeth D. Katz

University of Chicago Law Review

Each year family courts incarcerate thousands of Americans for nonpayment of child support. The vast majority of these parents are not accorded criminal procedure protections because courts have characterized routine child support enforcement as a “civil” matter. The United States Supreme Court has endorsed this approach. In Turner v Rogers, the Court began from a premise it regarded as both legally significant and unquestionably true: that child support proceedings are civil On that basis, the Court determined that an indigent father facing a year in jail was not entitled to a public defender. The Court’s analysis reflects a broader and …

Seeking Insurance Parity During The Opioid Epidemic, Valarie K. Blake Sep 2019

Seeking Insurance Parity During The Opioid Epidemic, Valarie K. Blake

Utah Law Review

Private insurance covers almost 40 percent of people with opioid addiction. Yet, amid an epidemic with profound consequences for individual and public health, private insurers continue to fuel addiction by favoring addictive but affordable pain therapies over nonaddictive ones and by placing unreasonable, sometimes unlawful, hurdles and delays in the ways of addiction treatment. Action must be taken now to address these harms. Laws like the ACA and the MHPAEA need greater enforcement, while gaps in these laws can and should be addressed through broader federal and state initiatives. Private insurers must be regulated, and swiftly, to ensure that people …

America’S Favorite Antidote: Drug-Induced Homicide In The Age Of The Overdose Crisis, Leo Beletsky Sep 2019

America’S Favorite Antidote: Drug-Induced Homicide In The Age Of The Overdose Crisis, Leo Beletsky

Utah Law Review

Nearing the end of its second decade, the overdose crisis in the United States continues to claim tens of thousands of lives. Despite the rhetorical emphasis on a “public health” approach, criminal law and its enforcement continue to play a central role among policy responses to this crisis. A legacy of the 1980s War on Drugs, statutory provisions that implicate drug distributors in overdose fatalities are on the books in many U.S. jurisdictions and federally. This Article articulates an interdisciplinary critique of these “drug-induced homicide” laws at a time of their increased popularity, expanding scope, and aggressive prosecution. That these …

Hot Spots Policing Of Small Geographic Areas Effects On Crime, David M. Hureau, Anthony A. Braga, Brandon Turchan, Andrew V. Papachristos Sep 2019

Hot Spots Policing Of Small Geographic Areas Effects On Crime, David M. Hureau, Anthony A. Braga, Brandon Turchan, Andrew V. Papachristos

School of Criminal Justice Faculty Scholarship

Background

In recent years, crime scholars and practitioners have pointed to the potential benefits of focusing crime prevention efforts on crime places. A number of studies suggest that there is significant clustering of crime in small places, or “hot spots,” that generate half of all criminal events. Researchers have argued that many crime problems can be reduced more efficiently if police officers focused their attention to these deviant places. The appeal of focusing limited resources on a small number of high-activity crime places is straightforward. If crime can be prevented at these hot spots, then citywide crime totals could be …

Reintegration Experiences Of Post-Incarcerated Fathers In Southern California, Sheldon Smith Sep 2019

Reintegration Experiences Of Post-Incarcerated Fathers In Southern California, Sheldon Smith

Loma Linda University Electronic Theses, Dissertations & Projects

The detention of fathers in penal institutions can challenge their involvement in the lives of their children and this experience can impact these relationships as well as the socio-emotional development of their children in the short and long term. Upon release, the reintegration experiences can be difficult, clumsy, and sometimes lost altogether. This present study explored the experiences of nineteen fathers as they sought to reconnect with their children after incarceration. Through the use of grounded theory and qualitative interviews, three major themes emerged from the data, which provided an explanation of participants’ reintegration experiences. These themes were participants’ ideology …

Keeping Up With A Kardashian: Shedding Legal Educations' Vestigial Trade School Anxiety And Replacing The Dated Casebook Method With Modern Case-Based Learning, Jason G. Dykstra Sep 2019

Keeping Up With A Kardashian: Shedding Legal Educations' Vestigial Trade School Anxiety And Replacing The Dated Casebook Method With Modern Case-Based Learning, Jason G. Dykstra

Hofstra Law Review

Kim Kardashian West's choice to pursue her legal studies via a modernized version of apprenticeship rather than by attending law school represents an alarming vote of no-confidence in the efficacy of current legal education. Simply, legal education remains surprisingly and needlessly static despite decades of harsh criticism and the heightened velocity of change that has enveloped the legal industry. From big law to rural practitioners, the traditional law firm model proved ripe for disruption. This disruption is fueled by several discrete changes in how legal services are provided that cumulatively generated a substantial disruption across the board. They include technological …

Navigating The Shadows: Intersecting The Undocumented And Undocuqueer Identities, Iriana Balbian Sep 2019

Navigating The Shadows: Intersecting The Undocumented And Undocuqueer Identities, Iriana Balbian

Electronic Theses, Projects, and Dissertations

This project analyzes the navigation of social experiences of Undocumented and Queer individuals amidst broad anti-queer and anti-immigration sentiment prevalent throughout American society. To achieve this goal, this project seeks to resolve three questions. First, what are the social services that Undocuqueer and Undocumented adults need? Second, are their needs fundamentally distinct? Finally, to what extent have they been able to access those services? Crenshaw’s (1994) theory of intersectionality will serve as the overarching theoretical framework of this project, in order to better understand the multifaceted marginalization that Undocumented and Undocuqueer individuals face with everyday institutions.

In this research, I …

How Can Foundations Promote Impactful Collaboration?, Douglas Easterling, Laura Mcduffee Sep 2019

How Can Foundations Promote Impactful Collaboration?, Douglas Easterling, Laura Mcduffee

The Foundation Review

Funders are increasingly looking to interagency and cross-sector collaboration as a strategy to solve complex, large-scale issues, but many collaborative groups fail to generate an impact with their work. This is due in part to funders’ own practices, such as pre-specifying the problem to be solved or limiting their grantees’ ability to adjust their strategy.

The Health Foundation of Central Massachusetts has been intentional about facilitating the effectiveness of the collaborative groups it supports. Its Health Care & Health Promotion Synergy Initiative provides long-term funding and assistance with planning, evaluation and sustainability to groups that define the problems they want …
