From Cast-Out To Community: Identifying Barriers In Design That Keep Lgbtq+ Youth From Accessing Homeless Shelters, Leah Przybylski Nov 2019

From Cast-Out To Community: Identifying Barriers In Design That Keep Lgbtq+ Youth From Accessing Homeless Shelters, Leah Przybylski

Theses

There is a gap in homeless youth services in the United States. A vulnerable population, LGBTQ+ individuals comprise nearly 40% of all homeless youth and are particularly susceptible to repeated victimization, trauma, and violence from their community. Current shelters re-traumatize and fail to address the needs of this unique population triggering an extreme aversion to the institutional design aesthetic that many of these services inhabit. LGBTQ+ youth enter a cycle of homelessness and disengagement that perpetuates into adulthood as a result. Why do existing shelters fail to meet the needs of LBGTQ+ homeless youth?

Utilizing a series of diverse theories …

Plea Decision-Making: The Influence Of Attorney Expertise, Trustworthiness, And Recommendation, Kelsey S. Henderson, Reveka Shteynberg Nov 2019

Plea Decision-Making: The Influence Of Attorney Expertise, Trustworthiness, And Recommendation, Kelsey S. Henderson, Reveka Shteynberg

Criminology and Criminal Justice Faculty Publications and Presentations

Attorney recommendations influence defendant plea decisions; and the degree of influence likely rests on the perceived trustworthiness and level of expertise of the attorney (factors of source credibility). We explored attorney source credibility factors and how these characteristics influence defendants’ plea decision-making. MTurk participants read a hypothetical plea scenario and were asked to imagine themselves as the defendant in a DWI/DUI case making a plea decision; in the scenario, we manipulated the defense attorney’s level of trustworthiness, expertise, and plea recommendation. There was a significant interaction between attorney recommendation and trustworthiness on defendants’ plea decisions; participants who were advised to …

A Political Interpretation Of Vagueness Doctrine, Brenner M. Fissell, Guyora Binder Nov 2019

A Political Interpretation Of Vagueness Doctrine, Brenner M. Fissell, Guyora Binder

Faculty Publications

The “void-for-vagueness” doctrine requires the specific definition of criminal offenses. In this Article, though, we claim it does more: it largely restricts criminalization decisions to legislatures, which are unlikely to criminalize conduct they see as both harmless and widespread. Thus, rather than constitutionalizing the harm principle and thereby assuming a judicial obligation to define harm, the Supreme Court has used the vagueness doctrine to constrain majorities to make their own assessments of harmfulness. While American law has no explicit requirements that criminal liability be created by legislation or conditioned on harm, the vagueness doctrine achieves those ends indirectly

Indonesia Legal Analysis Of Iuu Fishing And Transnational Organized Fisheries Crimes: Loopholes And Proposed Measures, Zaki Mubarok Oct 2019

Indonesia Legal Analysis Of Iuu Fishing And Transnational Organized Fisheries Crimes: Loopholes And Proposed Measures, Zaki Mubarok

Indonesian Journal of International Law

The fight against illegal fishing by the Ministry of Marine Affairs and Fisheries has taken off. When investigating Illegal, Unreported and Unregulated (IUU) fishing, related transnational crimes activities such as trafficking in persons, slavery and drugs are also uncovered. In spite of the robust efforts and prompt responses, some challenges persist in terms of the inadequacy of legal frameworks governing these problems. Thus, the adequacy of the legal domain is a significant factor in pursuing the Ministry’s mission. The legal framework plays a pivotal role in addressing IUU fishing and transnational organized fisheries crimes and in setting a mechanism to …

The Aesthetics Of Terrorism And The Temporalities Of Representation, Robert Appelbaum Oct 2019

The Aesthetics Of Terrorism And The Temporalities Of Representation, Robert Appelbaum

Contemporary Aesthetics (Journal Archive)

Representations of terrorism, in fiction and non-fiction, summon their readers and viewers to examine terrorism in any of at least four modes of temporality: the past, the past perfect, the continuous present, and the simple present. This essay explains those modalities and shows how they work with reference to novels, a film documentary, and contemporary American television, including the documentary Black September and the series NCIS. The modalities are ideological as well as narratological functions and are sometimes employed to occlude the historical and pragmatic dimensions of terrorist violence. Terrorism is always already aesthetic and “hyperreal,” in Jean Baudrillard’s …

Lone Wolf Riots: Social Frustration & U.S. Mass Violence, Heather E. Rosso Oct 2019

Lone Wolf Riots: Social Frustration & U.S. Mass Violence, Heather E. Rosso

International Journal on Responsibility

Through various life events and circumstances, some individuals find themselves at a disconnect with their surroundings—unable to relate to peers, socially awkward, and socially isolated and outcast. As a result, socially constructed basic human needs (BHNs) of meaning, recognition, and justice can seem even more difficult if not impossible to satisfy. The resulting relative deprivation becomes more problematic for these individuals as they navigate pursuit of these BHNs absent the value opportunities provided by social bonds, such as shared experience, collaborative problem solving, emotional outlets, networking, and alternate perspectives. Simultaneously, empathy and bonding toward their communities are damaged or erased. …

Facial Recognition And Drivers’ Licenses: Should The Dmv Share Your Photo?, Daniel Bromberg, Étienne Charbonneau, Andrew Smith

Carsey Publications

In this brief, authors Daniel Bromberg, Étienne Charbonneau, and Andrew Smith present the findings of a 2017 Granite State Poll asking New Hampshire residents how they feel about the Department of Motor Vehicles (DMV) sharing their driver’s license photos with the Federal Bureau of Investigations (FBI). Currently 21 states, though not New Hampshire, share DMV data with the FBI in support of its effort to build a massive database of over 400 million photos to which it applies facial recognition technology. The authors report that about 70 percent of Granite Staters support the state DMV sharing photos with the FBI …
