Reconsidering Missouri’S Warrant Suppression Standard, James Sanders Apr 2019

Reconsidering Missouri’S Warrant Suppression Standard, James Sanders

Missouri Law Review

The search warrant is a foundational component of the American criminal justice process. Designed to limit and prevent overreach by police and other law enforcement entities, the framers of the Fourth Amendment of the United States Constitution sought to use warrants as a tool to control the scope and breadth of searches and seizures of private property. The Fourth Amendment’s warrant requirements are a vital check on the proactive and ever-growing police efforts of state and federal authorities.

Reducing High School Dropout: An Instrumental Case Study Of Successful High School Dropout Prevention, Sasha Davila Crocker Apr 2019

Reducing High School Dropout: An Instrumental Case Study Of Successful High School Dropout Prevention, Sasha Davila Crocker

Doctoral Dissertations and Projects

The purpose of this instrumental case study was to understand the dramatic reduction in dropouts in a rural high school in central North Carolina. Dramatic reduction in dropouts is generally defined by having reduced the school’s dropout rate by at least 50% in less than three years. The theories guiding this study were social learning theory and the stage theory of organizational change. The research questions were as follows: (1) How did the high school drastically reduce the dropout rate? (2) What was the role of each key informant in reducing the dropout rate? The data collection processes included individual …

Studying The Gang Through Critical Ethnography, David C. Brotherton Apr 2019

Studying The Gang Through Critical Ethnography, David C. Brotherton

Publications and Research

Added to the paucity of critical lenses through which the gang has been viewed criminologically is the increasing influence of the US criminal justice system on the global gang discourse. Such a lens has increased in importance as many nation states have followed the example of US repressive gang policies in thinking about crime and deviance, essentially mirroring its adoption of neo-liberalism in thinking about the political economy. In such an approach it is assumed that a coercive social control system is required to discipline and warehouse those “problem populations” excluded by the concentration of wealth and power. Across the …

Toward A Just System For Juveniles, Karl A. Racine, Elizabeth Wilkins Mar 2019

Toward A Just System For Juveniles, Karl A. Racine, Elizabeth Wilkins

University of the District of Columbia Law Review

Each year as a nation we prosecute over 800,000 children-nearly three percent of the juvenile population2 and detain over 200,000 of them.3 That is, we saddle almost three percent of our youth with the experience of being a defendant in court, with the label of delinquency. And we separate over a quarter of those youth from family and community for some period of time. The overwhelming majority of these children have experienced life-altering trauma in their young lives, and these experiences with the juvenile justice system can exacerbate that trauma.4 Yet,while we are affecting our young people on this massive …

The Intersection Of Race, Bond, And "Crimmigration" In The United States Immigration Detention System, Tremaine Hemans Mar 2019

The Intersection Of Race, Bond, And "Crimmigration" In The United States Immigration Detention System, Tremaine Hemans

University of the District of Columbia Law Review

The United States ("U.S.") Supreme Court's recent decision in Jennings v. Rodriguez' has potentially opened another avenue for people of color to become entangled in the U.S.' predatory immigration system, through the denial of bail hearings. Denial of periodic bond hearings ensures that many detainees in immigration facilities will be held indefinitely until these detainees' cases are adjudicated. In Jennings, the Court held that detained aliens do not have a right to periodic bond hearings even if they are detained for prolonged periods of time, due to the language of the mandatory and discretionary detention statutes at §§ 1225(b)(1)-(2) and …

Taxation And Reducing Recidivism: A Legal Comparative Analysis Of Reducing Recidivism In States And A Federal Solution For The Future, Israel X. Nery, Scott B. Astrada Mar 2019

Taxation And Reducing Recidivism: A Legal Comparative Analysis Of Reducing Recidivism In States And A Federal Solution For The Future, Israel X. Nery, Scott B. Astrada

University of the District of Columbia Law Review

In this article, we will focus on employer-based tax incentives for hiring ex-offenders. Central to the discussion will be the Work Opportunity Tax Credit ("WOTC"), which provides a tax credit to employers who hire qualified employees/ex-offenders under the program. Additionally, we will explore various state programs modeled on a tax-based incentive and conduct a comparative assessment of where federal and state programs are effective and where there is potential for reform. Without targeted policy solutions to address employment obstacles, ex-offenders are left facing persistent employment barriers as they attempt to return to their communities and start a new life after …

Digital Forensics, A Need For Credentials And Standards, Nima Zahadat Mar 2019

Digital Forensics, A Need For Credentials And Standards, Nima Zahadat

Journal of Digital Forensics, Security and Law

The purpose of the conducted study was to explore the credentialing of digital forensic investigators, drawing from applicable literature. A qualitative, descriptive research design was adopted which entailed searching across Google Scholar and ProQuest databases for peer reviewed articles on the subject matter. The resulting scholarship was vetted for timeliness and relevance prior to identification of key ideas on credentialing. The findings of the study indicated that though credentialing was a major issue in digital forensics with an attentive audience of stakeholders, it had been largely overshadowed by the fundamental curricula problems in the discipline. A large portion of research …

Native American Cultural Dissonance & Dark Heritage Solutions, Victoria Parker Mar 2019

Native American Cultural Dissonance & Dark Heritage Solutions, Victoria Parker

Student Scholarship

This paper argues that public institutions have an obligation to consider the weight of their responsibility to educate and inform the public about all forms of American history and heritage. Moreover, public institutions should embrace controversy, engage discourse and proactively work on exhibiting balanced representations by re-working or removing antiquated and false narratives surrounding Native American history. In this paper, I proffer solutions from case studies, examples, models, and my own perspective as a Native American tribal member, as to what public institutions and curators can do in the future to deal with cultural dissonance and creating awareness of (Native) …

Cashless Societies And The Rise Of The Independent Cryptocurrencies: How Governments Can Use Privacy Laws To Compete With Independent Cryptocurrencies, Matla Garcia Chavolla Mar 2019

Cashless Societies And The Rise Of The Independent Cryptocurrencies: How Governments Can Use Privacy Laws To Compete With Independent Cryptocurrencies, Matla Garcia Chavolla

Pace International Law Review

Many individuals (including governments) envision living in a future world where physical currency is a thing of the past. Many countries have made great strides in their efforts to go cashless. At the same time, there is increasing awareness among citizens of the decreasing amount of privacy in their lives. The potential hazards cashless societies pose to financial privacy may incentivize citizens to hold some of their money in independent cryptocurrencies. This article argues that in order for governments in cashless societies to keep firm control over their money supply, they should enact stronger privacy law protections for its citizens …

Campus-Based Sexual Assault: The #Metoo Movement And Students' Understanding Of Issues Around Consent, Genevieve Hampson

LSU Master's Theses

College students who have experienced sexual assault are at higher risk for negative impacts involving physical and mental heath. In addition, appropriate resources and positive systematic response to disclosure are pivotal in the recovery process of survivors. Empirically relevant research has focused on campus-based sexual assault and interrelationships among variables surrounding students’ attitudes towards explicit sexual consent. This cross-sectional descriptive study of 110 students enrolled in two freshman sociology classes contributes to the emerging body of research regarding the use of social media platforms to raise awareness of sexual assault by examining students’ sociodemographic characteristics, literacy using technology, rape myth …

On-Duty Police Shootings: Officers Charged With Murder Or Manslaughter 2005-2018, Philip M. Stinson, Chloe A. Wentzlof, Megan L. Swinehart

Criminal Justice Faculty Publications

There were 97 nonfederal sworn law enforcement officers with the general powers of arrest (e.g., police officers, deputy sheriffs, state troopers) arrested in years 2005-2018 for murder or manslaughter resulting from an on-duty shooting where the officer shot and killed someone at incidents throughout the United States. Of those 97 officers, to date, only 35 have been convicted of a crime resulting from the on-duty shooting. This poster presents data on the arrested officers, criminal case dispositions, race of arrested officers and their victims, weapons possessed by victims who were shot and killed by police, and related variables.

The Security Field: Forming And Expanding A Bourdieusian Criminology, Matt Bowden Mar 2019

The Security Field: Forming And Expanding A Bourdieusian Criminology, Matt Bowden

Articles

Recent scholarly contributions have sought to integrate Bourdieusian sociology with criminology, centring for example, on the ‘street’ field as a symbolic and narrative space occupied by players within criminal justice. This article complements this broad objective by focusing on the changes in contemporary police and security governance that are pointing towards an emerging security field. Such a change can be read from the literature on plural policing and crime control, and involves the morphology of policing into nodes or assemblages of security producers. While there has been some attention to the formation of security networks, further empirical work is required …

A Comparative Study Of Prevalence Of Jungle Justice In Developing And Developed Countries: A Case Study Of Nigeria And Usa, Taiwo Oguntuyo, Oge Agim

College of Business (Strome) Posters

The research presents a comparative case study of the prevalence of Jungle Justice (also known as vigilante justice) in developing and developed countries, using Nigeria and the United States of America as a comparative case study. In many countries in West Africa, and highly prevalent in Nigeria, jungle justice is categorized as a major social vice that militates against national growth and development. The act of a group of people (usually a mob) taking laws into their own hands by beating an alleged criminal to the point of death (or even to death) without following due process; this arbitrary method …

Determination Of Vehicle Speed From Recorded Video Using Reverse Projection Photogrammetry And File Metadata, Brandon Epstein, Bryce Westlake Mar 2019

Determination Of Vehicle Speed From Recorded Video Using Reverse Projection Photogrammetry And File Metadata, Brandon Epstein, Bryce Westlake

Faculty Publications

The prevalence of security and in‐car video has increased the number of motor vehicle accidents captured on digital video. However, inconsistencies in how to accurately determine time and distance for vehicle speed has led to examinations with varying results. A potential solution for calculating time intervals is to use frame timing contained within many digital video file's metadata, recorded with 0.000001 sec precision. This paper examines a fatal motor vehicle accident where frame timing information was used with distance measurements from reverse projection photogrammetry to calculate vehicle speed. A margin of error was then calculated based on the accuracy in …
