Transitional Equality, Suzanne A. Kim May 2019

Transitional Equality, Suzanne A. Kim

University of Richmond Law Review

Legal discussions of inequality often focus on the virtues of one legal status or regulatory structure over another, but a guarantee of the right to a particular legal status does not ensure a lived experience of equality in that status. In moments of legal change, when a person or class of persons obtain a new status or gain rights that had previously been denied to them, the path from one legal status to another becomes critically important and may itself be impacted by race, gender, age, and other factors. The process of transitioning to a new status can be complex …

Believe In Creativity, Iecha Samantha Bermudez May 2019

Believe In Creativity, Iecha Samantha Bermudez

Creativity and Change Leadership Graduate Student Master's Projects

The purpose of Believe in Creativity is to provide an afterschool program implementing skills used in creativity to help develop leaders of tomorrow and removing the negative persona other generations have on today’s youth. Some may argue that the advancement of technology benefits the youth because it is a form of entertainment, resources are accessible, and they have different forms of travel. Others believe that the advancement of technology is not beneficial because it causes the youths to be antisocial, aggressive, and non-creative. Though the advancement of technology has both pros and cons in the lives of the youth, I …

Catholic Social Teaching And Neo-Abolitionism: Tearing Down The House Of The Rising Sun, Elizabeth M. Donovan May 2019

Catholic Social Teaching And Neo-Abolitionism: Tearing Down The House Of The Rising Sun, Elizabeth M. Donovan

Cleveland State Law Review

Catholic Social Teaching (“CST”) is the body of literature written in the modern era by papal and episcopal teachers in response to current political, economic, and social issues. CST views individuals in the sex trade as victims, however they arrived in the trade. Prostitution abolitionists, called neo-abolitionists, because their current efforts to wipe out sex trafficking and prostitution mirror similar efforts by reformers in the early twentieth century, also view individuals in the sex trade as victims. A coalition of feminists and Christians developed neo-abolitionist social policy during the late twentieth and early twenty-first century. CST and neo-abolitionist social policy …

U.S. Surveillance Of Citizens: The Prevention Of Domestic Terrorism, David Rogers

Senior Honors Theses

The United States drastically increased the powers given to the federal government following the terrorist attacks of September 11, 2001, as the sheer number of casualties and shock that struck the nation called for an immediate response. The fear of another mass attack is still within the minds of the American people, and the U.S. government has taken measures to attempt to prevent such a tragedy. This thesis will analyze the topic of domestic surveillance, as well as ethical concerns for the criminal justice field, and will explore the future of homeland security and anti-terrorism for this country if this …

Faith And The Death Penalty: Attitudes Of Students At Christian Colleges On Religious Belief And Capital Punishment In The United States, Sarah Conley May 2019

Faith And The Death Penalty: Attitudes Of Students At Christian Colleges On Religious Belief And Capital Punishment In The United States, Sarah Conley

Honors College

American Christians are not in complete agreement on the legality and morality of capital punishment. Recent surveys show that between 61 and 66 percent of the general population of Christians are in support of the death penalty (Barna, 2017; Jones, 2016). Christians use scripture and religious traditions as the basis for many arguments both in support and opposition of the death penalty. Official positions on capital punishment also vary across denomination. These arguments and statistics are presented in a literature review. Existing surveys have also found that support for the death penalty is lower among younger people and the college-educated …

When Saliva Is A Crime: Reforming Mississippi’S Hiv Criminalization Law Utilizing The Center For Disease Control And Prevention’S Policy Analytical Framework, Anastasia Walrod May 2019

When Saliva Is A Crime: Reforming Mississippi’S Hiv Criminalization Law Utilizing The Center For Disease Control And Prevention’S Policy Analytical Framework, Anastasia Walrod

Honors Theses

Mississippi is currently experiencing an HIV/AIDS crisis. The state is ranked in the top 10 for diagnoses of HIV infection, with Jackson, Mississippi ranked sixth in the nation for HIV diagnoses and fourth in the nation for AIDS diagnoses. Despite antiretroviral treatment allowing for persons with HIV to lead healthy lives, Mississippians continue to die from AIDS in large part because of stigma, misinformation, and lack of resources. This is furthered by Mississippi’s HIV criminalization law. HIV criminalization laws are used to penalize HIV exposure, but HIV-specific criminal laws are considered largely ineffective public health policies because these statutes further …

Making The Invisible Visible: Exploring Implicit Bias, Judicial Diversity, And The Bench Trial, Melissa L. Breger May 2019

Making The Invisible Visible: Exploring Implicit Bias, Judicial Diversity, And The Bench Trial, Melissa L. Breger

University of Richmond Law Review

All people harbor implicit biases—which by definition, are not always consciously recognized. Although trial judges are specifically trained to compartmentalize and shield their decisions from their own biases, implicit biases nonetheless seep into judicial decision making. This article explores various strategies to decrease implicit bias in bench trials. Questions are then raised about whether a judge who has faced bias personally would be more amenable and more open to curbing implicit bias professionally. Ultimately, does diversifying the trial court judiciary minimize implicit bias, while also creating a varied, multidimensional judicial voice comprised of multiple perspectives? This article will explore this …

Improving Lawyers’ Health By Addressing The Impact Of Adverse Childhood Experiences, Karen Oehme, Nat Stern May 2019

Improving Lawyers’ Health By Addressing The Impact Of Adverse Childhood Experiences, Karen Oehme, Nat Stern

University of Richmond Law Review

Although the legal profession has recognized the importance of improving attorneys’ mental health, it has largely ignored recent social and scientific research on how adverse childhood experiences (“ACEs”) can harm attorneys’ long-term well-being. This article reviews the science of ACEs and argues that law schools and the legal profession should educate law students and attorneys about the impact of prior trauma on behavioral health. Without such education, law schools and the legal system are missing a crucial opportunity to help lawyers prevent and alleviate the maladaptive coping mechanisms that are associated with ACEs. Until such knowledge is widespread, many lawyers …

A Better Economy By "Design", Lawrence Chong May 2019

A Better Economy By "Design", Lawrence Chong

Asian Management Insights

The air was still, and I was going nowhere with the session until I asked the participants about their kids instead of talking more about the bank. The conversations soon turned chirpy as the mothers in the group spoke over one another, sharing their hearts out about their children and their hopes for them. I felt I had unlocked something new, even though this should have been obvious as this is a very family-oriented country. This experience was part of our transformation project for a Southeast Asian bank that would reshape its digital, brand and customer engagement strategy through a …

Dental Age Estimation Of A Southern Nevada Hispanic Non-Adult Population Employing The London Atlas To Evaluate Archival Orthodontic Cone Beam Computed Tomography (Cbct) Images, Haley Buchanan

UNLV Theses, Dissertations, Professional Papers, and Capstones

Age estimation is of societal importance for legal, forensic, and clinical reasons. The London Atlas of Human Tooth Development and Eruption, hereafter referred to as the London Atlas, was introduced as an improved method for determining dental age estimation. The London Atlas was developed from panoramic images of 528 living British Caucasian and Bangladeshi males and females aged 2 to 24 years and panoramic images of 176 archival human skeletal remains, aged 32 in utero to 2 years old, from two specimen collections (AlQahtani, Hector, & Liversidge, 2010). Further investigation is warranted to determine validity of the atlas’s use in …

The Relationship Between Aggression And Depression: Testing The Moderating Effects Of Age And Gender, Benjamin P. Comer

Boise State University Theses and Dissertations

The purpose of this thesis is to a) explore the research related to aggression and depression and b) test hypotheses that focus on the relationship between aggression and depression in relation to age and gender over time. Aggression and depression are discussed extensively by examining a broad range of literature that points to environmental, social, individual, psychological, and biophysiological influences. First, aggression and depression are discussed separately in terms of their underlying theory, biosocial perspectives, typologies, behavioral and personality abnormalities, brain structures related to each, and neurochemical/neurological influences. The final sections of the literature review discuss how aggression and depression …

For the past 11 years, the Boise State University’s Center for Health Policy has partnered with the Idaho Department of Juvenile Corrections to analyze data on juveniles entering detention at 13 Juvenile Detention Centers in Idaho. The Alaska Screening Tool (AST) is used to screen juveniles who may or may not meet the criteria for having a mental health problem, substance abuse problem, or both types of problems. The current study explores prevalence rates and gender differences as indicated by the AST for fiscal years 2008-2017. Across nine years of data (fiscal years 2008-2017), on average, 61% of all detained …

A Qualitative Analysis Of Men’S Intended Bystander Behaviors In Response To A Sexual Assault Vignette, Evelyn Day May 2019

A Qualitative Analysis Of Men’S Intended Bystander Behaviors In Response To A Sexual Assault Vignette, Evelyn Day

Health, Human Performance and Recreation Undergraduate Honors Theses

Sexual assault is a pervasive problem; there are myriad negative consequences associated with sexual assault victimization. Given the commonality and consequences associated with victimization, preventing sexual assault is paramount. One mechanism thought to reduce rates of sexual assault is bystander intervention, in which third parties are encouraged to intervene when witnessing sexual assault risk factors and to challenge cultural norms regarding rape and assault. Despite the benefits of bystanding, not everyone intervenes. Previous research indicates that compared with women, men are less likely to intervene. Although some men intervene, researchers’ understanding of how men bystand is limited. The goal of …

Themes In Global Terrorism From 2010 To 2016, Rafael Sholomov

Student Theses

Over the past decade, there has been an increase in the amount of global terrorism incidents. There has also been an increase in the amount of organizations that commit these acts of terror. Specifically, the attacks seem to have increased drastically since 2010 because the year signifies the beginning of the downfall of Osama bin Laden, leader of al-Qaeda at the time. The current study explores and analyzes the pattern of non-U.S. global terrorism between 2010 and 2016. Between the timeframe, the Islamic State of Iraq and Syria (ISIS) began to gain tremendous ground and territory globally and would later …

Population Movement And State Building: A Case Study Of Migratory Policies In Italy, Julia Pagnamenta May 2019

Population Movement And State Building: A Case Study Of Migratory Policies In Italy, Julia Pagnamenta

Student Theses

The current study examines Italian laws and policies around migratory movements since Italy first became a modern nation state in 1861 up until April 2019, when the research was concluded. This paper is a case study of Italian migratory policies. It first looks at the way Italy’s early efforts at nation building coincided with the mass emigration of its citizens, informing its policies on emigration and colonial expansion. The study then analyzes the way in which Italy developed a policy response to the growing immigrant and refugee population in the late 1980s following geo-political transformations in Europe. The evolution of …

Isolation And Support Dynamics Among Concurrent Victims Of Sex Trafficking, Leslie Unger, Chitra Raghavan May 2019

Isolation And Support Dynamics Among Concurrent Victims Of Sex Trafficking, Leslie Unger, Chitra Raghavan

Student Theses

The present study analyzed wiretap data to determine the characteristics of social support among concurrent victims of sex trafficking. Using a grounded theory approach to determine prevalent elements and themes that characterize interactions, conversations between women and conversations between pimps and women that involve concurrent victims as a topic of conversation were examined. A coding scheme was created based on the derived elements, and network patterns were analyzed. Finally, temporal patterns of conflict were examined to determine whether periods of heightened threat were used to punctuate periods of seeming calm, similar to that seen in research on coercive control and …

The Forensic Analysis Of Skin-Safe Stamp Pad Inks, Swetha Rajagopal May 2019

The Forensic Analysis Of Skin-Safe Stamp Pad Inks, Swetha Rajagopal

Student Theses

Skin-safe stamp pad inks are currently being used at locations such as clubs, zoos and other events with the purpose of stamping individuals that visit the location. This is done in an attempt to monitor the number and activity of visitors. Ink manufacturing companies generally tend to experiment with a number of different combinations of the different components of ink, in order to obtain desirable properties. The combinations are usually proprietary and that very nature of the inks ends up making them, possibly unique and individual. The analysis, identification and possible individualization of the chemical composition of these inks could …

Perceptions Of Male Rape Victims: Examining Rape Myth Acceptance And Victim Blaming Attitudes Among A Sample Of College Students, Katelyn Hancock May 2019

Perceptions Of Male Rape Victims: Examining Rape Myth Acceptance And Victim Blaming Attitudes Among A Sample Of College Students, Katelyn Hancock

Masters Theses and Doctoral Dissertations

The extant literature indicates that women comprise the majority of sexual assault victims. Emerging research suggests that although men are less likely than women to be sexually victimized, a sizeable minority of men experience sexual assault in their lifetimes and a growing body of literature has begun to consider societal attitudes towards male rape victims. The current study adds to the literature by exploring undergraduate students’ assignment of indirect blame and justification in sexual assault incidents involving male victims. More specifically, data based on vignettes where situational characteristics were manipulated are used to determine how various incident, offender, and victim-level …

Shootings, Strain, And Safety On A College Campus: An Analysis Of Perceptions Of Safety And Concealed Carry, Amanda S. Bishop

Electronic Theses and Dissertations

School and campus shootings are a contemporary problem in the United States. Because of these shootings, colleges have enacted new policies to ensure safety on their campuses, including concealed carry on campus. The State of Tennessee has a unique law in place that allows colleges to create their own policies regarding concealed carry on campus, with the stipulation that only full-time faculty and staff can carry concealed weapons. East Tennessee State University is one campus with this policy. East Tennessee State University students, faculty, and staff were questioned via email survey about their perceptions of safety on campus and opinions …

Toxic Misogyny And The Limits Of Counterspeech, Lynne Tirrell May 2019

Toxic Misogyny And The Limits Of Counterspeech, Lynne Tirrell

Fordham Law Review

Gender equality, across all the ways that we humans are engendered, is an unrealized ideal of many contemporary Americans. It is not enshrined in the U.S. Constitution, unless one interprets “men” to include women, which the Framers did not. Although passed by Congress in 1972, the Equal Rights Amendment (ERA) failed to gain the necessary thirty-eight state ratifications, and it has never become law. Thirty-five states initially ratified it between 1972 and 1977, then two more in 2017 and 2018. It remains one state short. These ratifications indicate significant social progress for women, but the progress is uneven, even within …

Mobilising Dissent In A Digital Age: The Curious Case Of Amos Yee, Orlando Woods May 2019

Mobilising Dissent In A Digital Age: The Curious Case Of Amos Yee, Orlando Woods

Research Collection School of Social Sciences

Political containers frame opinions. They play a formative role in establishing the terms ofinterpretation, in distinguishing between assent and dissent, and in determining the extent towhich dissent is publicly tolerated. Whilst it is by now widely acknowledged that the powerand influence of political containers has been relativised by interconnection, the effects ofmoving within and between containers – and thus mediating between different framings ofopinion – is undertheorised. Also, the enabling role of digital media in disseminating dissent, and in bringing about disproportionate reach and impact, remains understudied. Addressingthese lacunae, this paper explores the ways in which dissent can be reproduced, reframed, …

Beyond The Witness: Bringing A Process Perspective, Edward K. Cheng, G. Alexander Nunn May 2019

Beyond The Witness: Bringing A Process Perspective, Edward K. Cheng, G. Alexander Nunn

Vanderbilt Law School Faculty Publications

For centuries, the foundation of the Anglo-American trial has been the witness.' Witnesses report on their personal observations, provide opinions of character, offer scientific explanations, and in the case of parties, narrate their own story. Indeed, even for documentary and other physical evidence, witnesses often provide the conduit through which such evidence reaches the factfinder. Documentary or physical evidence rarely stands on its own. The law of evidence has thus unsurprisingly focused on-or perhaps obsessed over-witnesses. The hearsay rule and the Confrontation Clause demand that declarants be available witnesses at trial so that they may be subject to cross-examination.' Expert …

The Power Of Prosecutors, Jeffrey Bellin May 2019

The Power Of Prosecutors, Jeffrey Bellin

Vanderbilt Law School Faculty Publications

One of the predominant themes in the criminal justice literature is that prosecutors dominate the justice system. Over seventy-five years ago, Attorney General Robert Jackson famously proclaimed that the "prosecutor has more control over life, liberty, and reputation than any other person in America." In one of the most cited law review articles of all time, Bill Stuntz added that prosecutors-not legislators, judges, or police-"are the criminal justice system's real lawmakers." And an unchallenged modern consensus holds that prosecutors "rule the criminal justice system." This Article applies a critical lens to longstanding claims of prosecutorial preemi- nence. It reveals a …
