Georgetown Law Faculty Publications and Other Works

Amici curiae are a group of philosophically and politically diverse law school professors and scholars in the fields of criminal law and mental health from a variety of disciplines who have been teaching and writing about the insanity defense and related issues throughout their careers. They include the authors of leading criminal law and mental health law treatises and casebooks and numerous important scholarly books and articles.

Amici believe this case raises important questions about principles of criminal responsibility, the integral role of the insanity defense in Anglo-American law, and the inadequacy of the “mens rea alternative” to the traditional …

Supporting Lgbtq+ Survivors On Campus, Molly Sapia, Ethan Levine Jun 2019

Supporting Lgbtq+ Survivors On Campus, Molly Sapia, Ethan Levine

Title IX Summit

Back by popular demand, last year's Supporting LGBTQ+ Survivors on Campus has been revamped for the new state of Title IX. Historically, Title IX protections have provided a much-needed resource for addressing sexual violence on campus. However, the benefits of Title IX may not apply equally to all students in practice. This workshop will discuss how the history of Title IX raises questions about its applicability for all sexual violence, and ultimately explore strategies for addressing sexual violence in lesbian, gay, bisexual, trans, and queer (LGBTQ+) communities. How effectively does Title IX address same-sex violence? What other policy and programmatic …

Trifecta Of Student Engagement: A Framework For An Online Teaching Professional Development Course For Faculty In Higher Education, Heather J. Leslie Phd

Learning Design Center: Staff Scholarship

Purpose

The purpose of this paper is to describe an online faculty development pilot course on how to engage students online. A framework was used, referred to as the Trifecta of Student Engagement, for the design of the course. The Trifecta of Student Engagement proposes that students, in order to be fully engaged in a course, need to be engaged with their course content, with their peers and with their instructor. The course has three units of content that each correspond to the Trifecta of Student Engagement. This course has gone through one pilot with faculty and has impacted students …

"Our criminal justice system is like the silt layer at the bottom of the ocean. If a problem isn’t taken care of higher up in society, it will eventually find its way down to the criminal justice system."

#Whyididntreport: Using Social Media Analysis To Inform Issues With Sexual Assault Reporting, Jordyn Warren Jun 2019

#Whyididntreport: Using Social Media Analysis To Inform Issues With Sexual Assault Reporting, Jordyn Warren

LSU Master's Theses

The #MeToo movement allowed victims of sexual assault to go public with their stories. When Dr. Christine Blasey Ford came forward with allegations against Supreme Court nominee Brett Kavanaugh in September of 2018, she was scrutinized by President Trump for not reporting the incident to authorities “when it happened nearly 30 years ago.” Promptly, #WhyIDidntReport came to fruition on Twitter, uncovering the shame victims feel and the complexities behind why so many individuals didn’t and still don’t report their assaults. Victim-service agencies “provide victims with support and services to facilitate their physical and emotional recovery, offer protection from future victimizations, …

Public Libraries As Engines Of Democracy: A Research And Pedagogical Case Study On Design For Re-Entry, Lara Penin, Eduardo Staszowski, John Bruce, Barbara Adams, Mariana Amatulllo

Nordes Conference Series

Founded with principles of equity, freedom and access, public libraries have always served as a cornerstone of democratic values and civic participation. In the context of 21st century transformational forces of globalization and digitization, libraries are also evolving their role from repositories of information and learning, to critical contributors of a culture of care in their communities. In this paper, we present insights from an ongoing collaboration with the Brooklyn Public Library that focused on the library’s current re-entry services directed to formerly incarcerated patrons and their families. Drawing from participatory design and visual ethnographic approaches to inquiry, this study …

Navigating Care In Social Design: A Provisional Model, Eva Knutz, Thomas Markussen, Tau Lenskjold Jun 2019

Navigating Care In Social Design: A Provisional Model, Eva Knutz, Thomas Markussen, Tau Lenskjold

Nordes Conference Series

The aim of this paper is to show how the value of social design lies in the approach’s ability as a caring practice to foster change for vulnerable groups in society. Yet, to achieve such change, social designers must have a navigational tool that allows them to identify and steer through some of the value conflicts that are typically involved in public service care provision. To substantiate this claim, we rapport from two recent social design projects in the public sector dealing with care within criminal justice and healthcare. Building on these two projects we propose a provisional model for …

A Model For Developing Interdisciplinary Research Theoretical Frameworks, A. S. Cohenmiller, Elizabeth Pate Jun 2019

A Model For Developing Interdisciplinary Research Theoretical Frameworks, A. S. Cohenmiller, Elizabeth Pate

The Qualitative Report

Embedded in interdisciplinary research, just as in disciplinary research, are statements of purpose, theoretical frameworks, research questions, reviews of literature, methodology, findings, recommendations, and more However, one of the least understood aspects of interdisciplinary research is the interdisciplinary research (IDR) theoretical framework. This article is intended to serve as a platform for dialogue within and across disciplines about interdisciplinary research and interdisciplinary theoretical frameworks. In addition, it provides a model for developing an IDR theoretical framework through an illustrative example of how an IDR theoretical framework was created and used within a dissertation study. We conclude the article noting critical …

Determining The Level Of Cultural Competence Of College Police Departments: A Study Of Three Different Campuses, Michelle Fletcher, Randolph Burnside, Stephanie Pink-Harper Jun 2019

Determining The Level Of Cultural Competence Of College Police Departments: A Study Of Three Different Campuses, Michelle Fletcher, Randolph Burnside, Stephanie Pink-Harper

Journal of Public Management & Social Policy

This research examines the understanding that police chiefs on three college campuses have about cultural competence and determines how organizationally integrated cultural competence is in their police departments. This article uses semi-structured interviews and surveys to determine the levels and organizational integration of cultural competence. The findings indicate that there are varying degrees of cultural competence across the three departments. This was primarily based on three factors: the level of understanding of cultural competence, the emphasis placed on promoting cultural competence by departmental leadership, and administrative or legal barriers. Given the complexity of cultural competence, the article concludes by offering …

Assessment Of Public Sector Service Quality: Gauging Experiences And Perceptions Of Racial Profiling, Aaron C. Rollins Jr. Jun 2019

Assessment Of Public Sector Service Quality: Gauging Experiences And Perceptions Of Racial Profiling, Aaron C. Rollins Jr.

Journal of Public Management & Social Policy

The absence of a culturally competent public sector workforce has led to increased public scrutiny and heightened levels of distrust. In the field of public safety, this is particularly important due to the sensitive nature of the task performed and the historically strained relationships that exist between racial minorities and law enforcement. Using national survey data to gauge the prevalence of citizen’s experiences and perceptions of racial profiling, this research reveals significant discrepancies amongst minorities and their white counterparts. In response, this research encourages public officials and agencies to eliminate inconsistencies in their interactions with the citizenry as a whole. …

Municipal Diverging From “Bureaucracy:” A Case Study Of Organizational Image In Housing Services, Shawn T. Flanigan Ph.D. Jun 2019

Municipal Diverging From “Bureaucracy:” A Case Study Of Organizational Image In Housing Services, Shawn T. Flanigan Ph.D.

Journal of Public Management & Social Policy

This article presents a case study of efforts of a workforce development unit within a local public housing authority to recraft its image as separate from the larger housing authority, in order to better attract participants to its optional supportive services. Using qualitative interview data with Section 8 voucher recipients and public housing authority staff, and descriptive quantitative data from a larger dataset, and drawing on theories of street-level bureaucracies and agency-client interactions, the case study finds that service recipients perceive the housing authority as a largely compliance-oriented organization that is overly bureaucratic, excessively regulating of private spheres of family …

Critical Race Theory In Education: Analyzing African American Students’ Experience With Epistemological Racism And Eurocentric Curriculum, Sana Bell Jun 2019

Critical Race Theory In Education: Analyzing African American Students’ Experience With Epistemological Racism And Eurocentric Curriculum, Sana Bell

College of Liberal Arts & Social Sciences Theses and Dissertations

This literature review presents an analysis of race ideology within U.S. society and schools in order to understand how such ideologies are transmitted to African American students through Eurocentric curricula and thus can perpetuate racism. Recognizing that American curricula originates from social control elements and that schools are institutions responsible for preparing students for the world they live in (Apple, 2004; Apple & King, 1983; Giroux, 2001; and Giroux & Penna, 1979); I focus on African American students’ experience with a Eurocentric curriculum and how this curriculum influences their social identity and ability to successfully navigate society. Essentially, the literature …

Introducing A Virtual Emergency Operations Center Into A Higher Education Curriculum, Harry Hueston, "Chip" George K. Orton Iii Jun 2019

Introducing A Virtual Emergency Operations Center Into A Higher Education Curriculum, Harry Hueston, "Chip" George K. Orton Iii

Administrative Issues Journal

At West Texas A&M University, faculty members in the Criminal Justice and Emergency Management programs teach students how to deal with man-made and natural disasters. These program courses require students to learn about the National Incident Management Systems (NIMS) in addition to passing certain requirements. Each student must pass NIMS courses 100 and 200 as part of their coursework where students are given the opportunity to work through a table-top exercise involving a natural or man-made disaster. Over the past several years, due to the success of these exercises, one of the criminal justice professors proposed a funding project to …

”Cyberworld” As A Theme For A University-Wide First-Year Common Course, Kristen Przyborski, Frank Breitinger, Lauren Beck, Ronald S. Harichandran

Engineering and Applied Science Education Faculty Publications

Nowadays we all live in a cyber world and use the internet for emailing, banking, streaming video, shopping, reading news, or other activities. Given all the time people spend online, it is important that all students (regardless of their major) learn some basics about living in a cyber world, e.g., strategies for online safety, impact of artificial intelligence, digital forensics or ancestry.com. To facilitate students from many majors to learn about important issues related to the internet, eight faculty from a variety of disciplines at the University of New Haven integrated the theme of Cyber World into our team-taught, first-year …

Backdoor Balancing, Elizabeth Earle Beske Jun 2019

Backdoor Balancing, Elizabeth Earle Beske

Washington Law Review

The U.S. Supreme Court has employed various mechanisms to blunt the systemic impact of legal change. The Warren Court balanced the interests advanced by new rules against the disruption of their retroactive application and frequently limited new rules to prospective effect. The Rehnquist Court decisively rejected this approach in the mid-1990s and committed itself to full adjudicative retroactivity as to pending cases. This Article argues that, although the Court slammed a door, it subsequently opened a window. The Court has spent the intervening decades devising ostensibly independent and unrelated doctrines to mitigate disruption. Despite the Rehnquist Court’s insistence that these …

From The State Of Emergency To The Rule Of Law: The Evolution Of Repressive Legality In The Nineteenth Century British Empire, Christopher M. Roberts Jun 2019

From The State Of Emergency To The Rule Of Law: The Evolution Of Repressive Legality In The Nineteenth Century British Empire, Christopher M. Roberts

Chicago Journal of International Law

Why are contemporary laws and techniques that state authorities use to crack down on political dissent so similar across countries? This Article argues that at least part of the answer may be found by turning to colonial history. The Article has two Parts. In the first Part, the Article explores the manner in which, over the course of the nineteenth century, the British deployed various different legal and institutional approaches in response to an Irish polity that consistently refused to submit to British authority. In the second Part, the Article examines the manner in which the approaches developed in Ireland …

Chitown Loves Youhip Hop’S Alternative Spatializing Narratives And Activism To Trump’S Hatefulcampaign Rhetoric About Chicago, George Villanueva Jun 2019

Chitown Loves Youhip Hop’S Alternative Spatializing Narratives And Activism To Trump’S Hatefulcampaign Rhetoric About Chicago, George Villanueva

School of Communication: Faculty Publications and Other Works

Donald Trump’s 2016 presidential campaign rhetoric about violence in Chicago spatialized a narrative that branded the city as the poster child of urban disarray. His bombast lacked any contextual understanding of the issue and offered no productive pathways for collective solutions. Alternatively, I argue in this paper that a rising collection of Chicago hip hop artists were producing musical discourses in 2016 that not only challenged Trump’s negative rants, but also spatialized a multilayered narrative of the intersections between hip hop and activism in the city. Through textual analysis of three tracks from three breakout artists in 2016, my goal …
