Investigation Of Sexual Offences Against Women In India – A Review Of Legal Procedural Mandates And Directives, Dr Nagarathna A Jul 2019

Investigation Of Sexual Offences Against Women In India – A Review Of Legal Procedural Mandates And Directives, Dr Nagarathna A

National Law School Journal

While the number of reported cases of sexual offences against women in India is increasing, as per official records, including that of the recently published report of the NCRB, the number of cases that result in timely and successful investigation which is crucial for successful prosecution are very few. A victim of such offence often faces difficulties, including getting the FIR registered on time and getting the criminal process initiated. This not only affects the following criminal process, but also curtails her access to justice, including legal remedies available in the form of medical treatment, counselling and compensation. Additionally, criminal …

"...Make Them Disappear With A Piece Of Paper": Understanding The Lived Realities Of Federally Unrecognized Indigenous Women In The Southeast, Brian A. Pitman

Sociology & Criminal Justice Theses & Dissertations

Indigenous women experience some of the highest rates of violence and negative health outcomes of any racial/ethnic group yet are largely ignored in social science research. This dissertation explores the lived realities of Indigenous women who are members of federally unrecognized nations and how their tribal membership impacts their experiences with a variety of criminal justice and social issues. Unrecognized nations do not have access to potential benefits, opportunities, and legitimacy that comes with federal recognition thereby creating an additional intersection to consider for some Indigenous women. Essentially, federal recognition policies seek to place further constraints on Indigenous identity, while …

Residential Mobility And The Underclass: Impact Of Moving In The 'Hood, Michael A. Hollingsworth Jul 2019

Residential Mobility And The Underclass: Impact Of Moving In The 'Hood, Michael A. Hollingsworth

Sociology & Criminal Justice Theses & Dissertations

Studies of residential mobility amongst disadvantaged populations and juveniles in particular have attracted a great deal of attention with projects such as the Moving to Opportunity Study and policies aimed at reducing concentrated disadvantage by providing alternative housing assistance to low-income families. The results of these studies, however, have been inconclusive and have often not concentrated on the effects of this mobility on a broad spectrum of delinquent behaviors. Previous studies have found that residential mobility negatively affects juveniles, while other studies find that there is little effect after controlling for a wide variety of variables with scant theoretical considerations …

A Cure Worse Than The Disease? The Impact Of Removal On Children And Their Families, Vivek Sankaran, Christopher Church, Monique Mitchell Jul 2019

A Cure Worse Than The Disease? The Impact Of Removal On Children And Their Families, Vivek Sankaran, Christopher Church, Monique Mitchell

Articles

Removing children from their parents is child welfare's most drastic intervention. Research clearly establishes the profound and irreparable damage family separation can inflict on children and their parents. To ensure that this intervention is only used when necessary, a complex web of state and federal constitutional principles, statutes, administrative regulations, judicial decisions, and agency policies govern the removal decision. Central to these authorities is the presumption that a healthy and robust child welfare system keeps families together, protects children from harm, and centers on the needs of children and their parents. Yet, research and practice-supported by administrative data-paint a different …

Forensic Science Evidence And The Limits Of Cross-Examination, Gary Edmond, Emma Cunliffe, Kristy Martire, Mehera San Roque Jul 2019

Forensic Science Evidence And The Limits Of Cross-Examination, Gary Edmond, Emma Cunliffe, Kristy Martire, Mehera San Roque

All Faculty Publications

The ability to confront witnesses through cross-examination is conventionally understood as the most powerful means of testing evidence, and one of the most important features of the adversarial trial. Popularly feted, cross-examination was immortalised in John Henry Wigmore’s (1863–1943) famous dictum that it is ‘the greatest legal engine ever invented for the discovery of truth’. Through a detailed review of the cross-examination of a forensic scientist, in the first scientifically-informed challenge to latent fingerprint evidence in Australia, this article offers a more modest assessment of its value. Drawing upon mainstream scientific research and advice, and contrasting scientific knowledge with answers …

Consequences Of Public/Private Selves On The Stigmatized Individual In The Workplace, Dinah Miriam Camilleri Jul 2019

Consequences Of Public/Private Selves On The Stigmatized Individual In The Workplace, Dinah Miriam Camilleri

Theses and Dissertations

Although workplace discrimination based on group membership has been studied, there is little research focused on the experience of stigmatized individuals and the organizational outcomes of perceived stigmatization. This study aimed to determine whether perceived stigmatization leads to negative consequences such as emotional exhaustion, counterproductive work behaviors (CWBs), and reduced job satisfaction through the process of public/private self-schematization. A sample of 302 employees identifying as religious minorities were surveyed three times over a period of four months. Findings indicate that self-schematization mediated the relationship between perceived stigmatization and emotional exhaustion while partially mediating the relationships between perceived stigmatization, job satisfaction, …

Forging Taiwan’S Legal Identity, Margaret K. Lewis Jul 2019

Forging Taiwan’S Legal Identity, Margaret K. Lewis

Brooklyn Journal of International Law

The legal system in Taiwan is undergoing a transformation. Over a hundred years since the founding of the Republic of China and over thirty years since the end of martial law on Taiwan, a new legal identity is being forged. Public criticism of “dinosaur” judges and esoteric debates among law-trained elites have galvanized efforts to create a more inclusive discussion surrounding legal reforms. Taiwan is facing the challenge of moving from dinosaurs to dynamism. This Article argues that transparency, clarity, and participation both are animating principles of the current reform debate and are beginning to emerge as characteristics of Taiwan’s …

The Effects Of Class-Wide Function-Related Intervention Teams In Two Middle School Art Classrooms, Kimberly Davis Monson Jul 2019

The Effects Of Class-Wide Function-Related Intervention Teams In Two Middle School Art Classrooms, Kimberly Davis Monson

Theses and Dissertations

Classroom management is a common challenge in middle schools. Class-wide Function-Related Intervention Teams (CW-FIT) is a multi-tiered intervention designed to decrease problem behaviors at the classroom level (Wills et al., 2010). It is comprised of evidence-based practices such as teaching classroom expectations, increasing teacher praise, and using positive reinforcement in an interdependent group contingency. CW-FIT has shown promise in a variety of school settings, but it has not been tested in middle school art classrooms. This was initial investigation examining the effects of CW-FIT using a single-subject ABAB design in two middle school art classrooms. Results indicated that class on-task …

Longitudinal Prediction Of Delinquent Behavior In Early Adolescence, Kathleen Watson Macdonell Jul 2019

Longitudinal Prediction Of Delinquent Behavior In Early Adolescence, Kathleen Watson Macdonell

Theses and Dissertations

Childhood behavioral problems have consistently been reported as an antecedent for later problem behavior, including delinquency in adolescence and into adulthood. Parenting behaviors are an important influence on the potentially negative behavioral trajectory from childhood behavior problems to delinquency in early adolescence. The current study sought to provide further understanding of the relationship between teacher-reported third grade childhood behavior problems and two outcomes: ninth grade teacher-reported and ninth grade self-reported delinquency. Additionally, the moderating impact of parental monitoring and parental school involvement, assessed in fifth grade, was explored. Using a longitudinal sample of 556 participants, hypotheses were assessed separately for …

Trends In The Prevalence Of Arrest For Intimate Partner Violence Using The National Crime Victimization Survey, Tara E. Martin Jul 2019

Trends In The Prevalence Of Arrest For Intimate Partner Violence Using The National Crime Victimization Survey, Tara E. Martin

Theses and Dissertations

Average annual reporting and arrest victimization rates, or the probability that an intimate partner violence (IPV) victimization is reported or ends in arrest, are estimated to be 56% and 23%, respectively, according to the National Crime Victimization Survey (NCVS; Reaves, 2017). These estimates are based on the number of victimizations that occur annually, but certain repetitive reporting or arrest patterns for a household may mask an offender’s individual probability of being reported or arrested. To address this problem, the current study examines prevalence rates, which examine the number of unique victims who report an offender or experience an incident that …

Fostering Agency In Single-Gender, Middle Level Ela Classrooms: A Descriptive Multiple-Case Study, Jennifer V. Stowe Jul 2019

Fostering Agency In Single-Gender, Middle Level Ela Classrooms: A Descriptive Multiple-Case Study, Jennifer V. Stowe

Theses and Dissertations

Students’ sense of agency or self-efficacy has been linked to student achievement levels (Goodman & Eren, 2013; Johnston, 2004; Skinner, Wellborne, & Connell, 1990). Research has also established that teachers position their students as having agency in the context of the classroom, frequently by the ways that they use language (Johnston, 2004; Paulson & Theado, 2014). However, little, if any, extant research describes teacher language as it relates to agency within the middle level English Language Arts (ELA) classroom. Additionally, studies concerning agency rarely address the ways in which gender may influence the ways in which teachers position their students …

Media Influence On College Students' Perceptions Of The Police, Matilda Foster Jul 2019

Media Influence On College Students' Perceptions Of The Police, Matilda Foster

Theses and Dissertations

The first of Sir Robert Peel’s nine principles of law enforcement (1829) tells us that the police exist to prevent crime. However, the next six principles address the police’s need to develop a relationship with the public and maintain the publics’ approval, favor, respect, and voluntary cooperation. Although these principles were written in 1829, they still apply to police organizations today. This paper addresses the struggles policing organizations in the United States of America had over the years in maintaining these principles of law enforcement, the strategies the police have used to increase public approval, and factors associated with how …

Teacher And Child Interaction: The Effects Of Familial Distress, Child Behavior, And Teacher Perceptions, Jessekah R. Ennis

Sociology & Criminal Justice Theses & Dissertations

There has been a significant amount of research that has studied the ecological conditions that create behavioral problems for children from families that are female headed, in poverty, and live in areas where there is violent crime. There has also been evidence that revealed statistically significant associations between the way teachers perceive students from low socioeconomic backgrounds and their beliefs of the capacity of the children to learn. Studies have also examined how teachers interact with children that are exhibiting behavioral problems that are from low socio-economic status. However, to date there has been no study that has combined these …

Concealment Of Birth: Time To Repeal A 200-Year-Old “Convenient Stop-Gap”?, E Milne

School of Law, Humanities and Social Sciences

Feminists have long argued that women who offend are judged by who they are, not what they do, with idealised images of femininity and motherhood used as measures of culpability. The ability to meet the expectations of motherhood and femininity are particularly difficult for women who experience a crisis pregnancy, as evident in cases where women have been convicted of concealment of birth. The offence prohibits the secret disposal of the dead body of a child, to conceal knowledge of its birth. Traditionally used to prosecute women suspected of killing their newborn children, analysis of court transcripts suggests the offence …

Toward Christian-Identity Response Theory: Exploring Identity, Spirituality, And Response To Adversity Among African American Males Placed At Risk, Charity Hannah Garcia Jul 2019

Toward Christian-Identity Response Theory: Exploring Identity, Spirituality, And Response To Adversity Among African American Males Placed At Risk, Charity Hannah Garcia

Faculty Publications

Christian-Identity Response Theory (C-IRT) adds to limited research integrating spiritual development as a central component of human development across the life span and provides a substantive theory for how spiritual development may lead to transformative practice. Thirty-four African American males in three age groups (13-17; 18-25; 26+), placed at risk during adolescence and connected with Christian Community Development Association (CCDA) organizations at the time of data collection, engaged in the research process. Focus group discussions or initial interviews were followed by in-depth interviews. Line-by-line and incident-by-incident coding led to the formation of tentative categories and themes. Data was compared to …

Singapore, Tan K. B. Eugene

Research Collection Yong Pung How School Of Law

The Singapore Government recognises and is committed to legal aid as an integral part of access to justice. Sixty years ago in 1958, Singapore was the first country in Southeast Asia to enact a legal aid scheme, which provided for the establishment of the Legal Aid Bureau (LAB) to provide civil legal aid to persons of limited means. Over the course of independent Singapore’s history, legal aid as part of the overall access to justice has broadened significantly. Members of Parliament make regular calls for more people to qualify and receive government-funded legal aid. The government regards access to justice …

Agony Of Delayed Justice, Ahmed Saeed Jun 2019

Agony Of Delayed Justice, Ahmed Saeed

MSJ Capstone Projects

Martin Luther King Jr in his famous letter from a Birmingham jail wrote that justice too long delayed is justice denied. King said so to highlight that justice for African-Americans had been delayed for far too long. (King, 1963) According to ancient Latin maxim, ‘to delay justice is injustice’ but in the land of pure, delayed justice is a new normal. Courts in Pakistan have a backlog of 1.9 million pending cases to be adjudicated. Some of these cases have been pending for three or four decades.
