Neotropical Biodiversity
Amphibians and reptiles are diversified in the Cerrado biome but have been threatened by habitat loss and fragmentation, as well as lack of understanding of their distribution. Therefore, collection and organization of information about species in natural environments are essential for conservation, especially in Protected areas (PAs) and their adjacent zones. We present information about the composition and structure of the herpetofauna from Parque Estadual da Serra de Caldas Novas (PESCAN) and its representativeness in comparison to other PAs in the Cerrado. Fieldwork was conducted in 12 sampling sites from February 2009 to February 2010, using active search and pitfall …

Thailand was one of the potential causes of the 1997 East Asian economic recession due to its lack of readiness in dealing with globalization. In fact, globalization can generate double-edged effects on a country’s economic condition. While it can mitigate global inequality and poverty, it can also be considered as the determinant of trade imbalances, income inequality, and deterioration of natural resources. In order to enhance a balanced and sustainable development at society and country level, we believe that the well-being of each individual should be taken into consideration. This article introduces the concept of Philosophy of Sufficiency Economy (PSE) …
Clown Eggs, David Fagundes, Aaron Perzanowski
Clown Eggs, David Fagundes, Aaron Perzanowski
Faculty Articles
Since 1946, many clowns have recorded their makeup by having it painted on eggs that are kept in a central registry in Wookey Hole, England. This tradition, which continues today, has been referred to alternately as a form of informal copyright registration and a means of protecting clowns’ property in their personae. This Article explores the Clown Egg Register and its surrounding practices from the perspective of law and social norms. In so doing, it makes several contributions. First, it contributes another chapter to the growing literature on the norms-based governance of intellectual property, showing how clowns—like comedians, roller derby …

Law And Neighborhood Names, Nestor M. Davidson, David Fagundes

This Article provides a novel investigation of how law both enables and constrains the ability of city residents to claim, name, and often rename their neighborhoods. A rich interdisciplinary dialogue in fields such as geography and sociology has emerged on the significance of place names, but this literature has largely ignored the legal dimensions of the phenomenon and its implications for urban governance, belonging, and community conflict. This Article’s empirical exploration of the role of law in change and conflict regarding neighborhood identity thus advances the discourse both for legal scholars focused on urban dynamics and across disciplines.
From gentrification …
Deputizing Family: Loved Ones As A Regulatory Tool In The “Drug War” And Beyond, Matthew B. Lawrence
Deputizing Family: Loved Ones As A Regulatory Tool In The “Drug War” And Beyond, Matthew B. Lawrence
Faculty Articles
Many laws use family members as a regulatory tool to influence the decisions or behavior of their loved ones, i.e., they deputize family. Involuntary treatment laws for substance use disorder are a clear example; such laws empower family members to use information shared by their loved ones to petition to force their loved ones into treatment without consent. Whether such deputization is helpful or harmful for a patient’s health is a crucial and dubious question discussed in existing literature, but use of family members as a regulatory tool implicates important considerations beyond direct medical impacts that have not been as …
Vulnerability And Social Justice, Martha Albertson Fineman
Vulnerability And Social Justice, Martha Albertson Fineman
Faculty Articles
This Article briefly considers the origins of the term social justice and its evolution beside our understandings of human rights and liberalism, which are two other significant justice categories. After this reflection on the contemporary meaning of social justice, I suggest that vulnerability theory, which seeks to replace the rational man of liberal legal thought with the vulnerable subject, should be used to define the contours of the term. Recognition of fundamental, universal, and perpetual human vulnerability reveals the fallacies inherent in the ideals of autonomy, independence, and individual responsibility that have supplanted an appreciation of the social. I suggest …

“Country Faggots” Are Everywhere: Gay And Lesbian Life In Rural America, Katie Taylor
Undergraduate Honors Theses
This thesis will challenge many scholarly works that define being “out” and visibility as the ultimate expression of gay resistance. To define outness as the ultimate expression of resistance is to erase a group of people who did not have the privilege of always being able to be out and any contributions they made towards LGBT resistance. When studying LGBT resistance, it is important to acknowledge the necessity of political resistance, but that does not mean that other forms of resistance should be ignored. To analyze the importance of LGBT resistance outside of the public sphere means to re-examine the …
Injury-Related Fear In Patients After Anterior Cruciate Ligament Reconstruction, Shelby Elyse Baez
Injury-Related Fear In Patients After Anterior Cruciate Ligament Reconstruction, Shelby Elyse Baez
Theses and Dissertations--Rehabilitation Sciences
Approximately 200,000 anterior cruciate ligament (ACL) injuries occur each year with about 100,000 of these injuries undergoing reconstruction (ACLR). The impetus of ACLR is to allow previously high functioning, physically active individuals to return to desired levels of sports participation and to engage in recommended levels of physical activity. However, 1 out of 3 patients after ACLR fail to return to competitive levels of sport and meet recommended levels of physical activity. Injury-related fear has been cited as the primary barrier for failure to return to sport. However, the research has been primarily qualitative in nature and limited research has …

Examining The Nexus Of Obesity, Mental Health And Rural County Level Food Access: Testing The Enduring Role Of Persistent Poverty, Margaret Ralston, Kecia Johnson, Leslie Hossfeld, Bettina Beech
The Journal of Sociology & Social Welfare
This study investigates the nexus between obesity, mental health, and food access across counties in the state of Mississippi. Recent research suggests that food access and poor nutrition may not only lead to poor physical health, but may also increase depression. Data from the USDA and the CDC were used to estimate obesity and mental health rates across counties. Analyses revealed that poverty was the key factor influencing on obesity and mental health at the county level. More specifically, county level per capita SNAP benefits and status of persistent poverty were predictors of obesity and mental health. Findings are discussed …
Building A Diverse Curriculum: The Role Of Diversity Across Communication Coursework, Martin Jason, Deborah Sellnow-Richmond, Michael Strawser
Building A Diverse Curriculum: The Role Of Diversity Across Communication Coursework, Martin Jason, Deborah Sellnow-Richmond, Michael Strawser
SIUE Faculty Research, Scholarship, and Creative Activity
The present study utilizes student essays about diversity to examine ways in which students are exposed to diversity as communication majors throughout their coursework. Four themes emerged from this analysis. First, students became more aware and open-minded. Second, their understanding of different viewpoints and cultural differences increased. Third, they learned about diversity in an array of courses. Finally, their communication curriculum became more connected and relevant to their use and evaluation of media, journalism, and film.
Black Curativeness: Understanding Black Voter Selection Through An Assessment Of Racially-Charged Districts, Timothy E. Lewis
Black Curativeness: Understanding Black Voter Selection Through An Assessment Of Racially-Charged Districts, Timothy E. Lewis
SIUE Faculty Research, Scholarship, and Creative Activity
Since the passage of the Voting Rights Act of 1965 most scholarship on Black voter selection explains who Black voters select as opposed to why they select them. This study seeks to deepen understandings of Black voter selection beyond descriptive explanations through an assessment of a racially-charged district. Racially-charged districts can be used as microcosms for understanding political thought and behavior of racial minorities, particularly Black voter selection. These locales, where proven racial inequity propels race and racism as the overarching themes for all political and social concerns, are important in understanding why Black voters show positive affect towards viable …

Capital And Punishment: Resource Scarcity Increases Endorsement Of The Death Penalty, Keelah E. G. Williams, Ashley M. Votruba, Steven L. Neuberg, Michael J. Saks
Department of Psychology: Faculty Publications
Faced with punishing severe offenders, why do some prefer imprisonment whereas others impose death? Previous research exploring death penalty attitudes has primarily focused on individual and cultural factors. Adopting a functional perspective, we propose that environmental features may also shape our punishment strategies. Individuals are attuned to the availability of resources within their environments. Due to heightened concerns with the costliness of repeated offending, we hypothesize that individuals tend toward elimination-focused punishments during times of perceived scarcity. Using global and United States data sets (studies 1 and 2), we find that indicators of resource scarcity predict the presence of capital …

Articles & Book Chapters
Community currencies are means of payment issued other than by the State, for voluntary use side by side with State-issued (that is, national) currency, either in a particular geographical area or by a group of users. This chapter deals with them as their media have been transforming from paper to digital. Discussing legal aspects of digital community currencies as monetary objects, this chapter combines an analysis general to the law of community currencies, as applied to community currencies regardless of the media in which they are embodied, with an analysis of the general law governing digital currencies as applied to …
Law As A Social Construction And Conceptual Legal Theory, Dan Priel
Law As A Social Construction And Conceptual Legal Theory, Dan Priel
Articles & Book Chapters
A currently popular view among legal positivists is that law is a social construction. Many of the same legal philosophers also argue that before one can study law empirically, one needs to know what it is. At the heart of this paper is the claim that these two propositions are inconsistent. It presents the following dilemma: if law is a social construction like all other social constructions, then legal philosophers have to explain what philosophers have to contribute to understanding it. Studies of social constructions are typically conducted by historians, sociologists, and others, who explain them (and what they are) …

Of Tails And Dogs: Standards, Standardisation And Innovation In Assessment, Paul Maharg, Julian Webb
Articles & Book Chapters
The title of the conference from which some of the chapters in this book spring was '50 Years of Assessment in Legal Education'. The conference was an opportunity to look back, but also to look forward and think about how our legacy was formed in the last half century, and what of it we wanted to carry forward and shape differently in the future. In this chapter, we shall begin by giving a brief snapshot of legal education reform movements currently taking place in the Common Law world. We shall take one example of a recent consultation project in England …

Critical Perspectives On The Scholarship Of Assessment And Learning In Law: Introduction - Legal Education Assessment In England, Alison Bone, Paul Maharg
Articles & Book Chapters
In this Introduction, we set out some of the innovative practices and themes arising from assessment in legal education in England. It is fair to say that assessment theory has not attracted the same rigorous analysis and implementation that has attended the subject in other disciplines such as medical education. Much of the theoretical innovations tend to be syncretic, adaptations from other disciplines. Nevertheless, there are examples of genuine innovations when England is viewed alongside other jurisdictions, and where it has occurred we have noted it in this Introduction. Needless to say, but we shall say it anyway the field …

Employment Standards (es) legislation sets minimum terms and conditions of employment in areas such as wages, working time, vacations and leaves, and termination and severance. es legislation is designed to provide minimum workplace protections, particularly for those with little bargaining power in the labour market. In practice, however, es legislation includes ways in which legislated standards may be avoided, including through exemptions that exclude specified employee groups, fully or partially, from legislative coverage. With a focus on the Ontario Employment Standards Act, this article develops a case study of exemptions to the overtime pay provision of the act and regulations …

Carrying Little Sticks: Is There A ‘Deterrence Gap’ In Employment Standards Enforcement In Ontario, Canada?, Eric Tucker, Leah F. Vosko, Rebecca Casey, Mark Thomas, John Grundy, Andrea M. Noack
Articles & Book Chapters
This article assesses whether a deterrence gap exists in the enforcement of the Ontario Employment Standards Act (ESA), which sets minimum conditions of employment in areas such as minimum wage, overtime pay and leaves. Drawing on a unique administrative data set, the article measures the use of deterrence in Ontario’s ESA enforcement regime against the role of deterrence within two influential models of enforcement: responsive regulation and strategic enforcement. The article finds that the use of deterrence is below its prescribed role in either model of enforcement. We conclude that there is a deterrence gap in Ontario.

The Theological Significance Of The Relations Of Freedom And Time In The Sciences And Humanities: An Evaluation Of The Contributions Of David Bohm And Pauli Pylkko, Michael F. Younker
Dissertations
The concepts of freedom and time underlay all other philosophical and theological questions. This dissertation addresses the natures and relations of freedom and time and their impact upon theological reflection, primarily through the works of the philosopher of science, David Bohm and the philosopher of the humanities, Pauli Pylkkö. These two representatives come from the two competing cultures of the sciences and humanities, which illustrate the deep philosophical conflict that has emerged between these cultures concerning the natures of freedom and time. Specifically, the paradigmatic contributions of Albert Einstein's four-dimensional 'timeless space-time' (with timeless freedom) alongside Bohm, on the one …

[First paragraph]
The question structuring this chapter begins with the presumption that we should define and measure student success. The perspective missing from this question is: What possibilities exist for versions of student success in excess of its definition and measurement? Measurements ask us to standardize definitions of success—say, four-year graduation—and work to produce all students in this image. As a former academic adviser, I can read a university catalog and tell you the quickest pathways to graduation a university has to offer. This makes me an asset to institutions that place a value on student success as measured by …

Stakeholders at institutions across the United States are continuously looking for ways to improve the academic success and retention of students. We used logistical regression in an examination of noncognitive, cognitive, and demographic factors as predictors of academic success and retention of Division I first-year student-athletes. The results indicated that high school GPA is the best predictor for academic success. The Transition to College Inventory index, self-confidence, institutional commitment, and independent activity focus can be used in the prediction of academic success. Retention was most accurately predicted by students' first-year cumulative GPA. University advisors can use the results of this …

"I Heard It Through The Grapevine": A Randomized Controlled Trial On The Direct And Vicarious Effects Of Preventative Specific Deterrence Initiatives In Criminal Networks, Barak Ariel, Ashley Englefield, John Denley
Journal of Criminal Law and Criminology
A rich body of literature exists on deterrence, yet little is known about how deterrence messages are communicated through social networks. This is an important gap in our understanding, because such communication gives rise to the possibility that social institutions can utilize the vicarious effect of the threat of punishment against one individual to reduce the rate of reoffending amongst their criminal associates. To test this, we identified criminals with an extensive offending history (prolific offenders) and their co-offenders using social network analysis and then conducted a randomized controlled trial to measure the effect on both prolific offenders and their …

Older Adult Caregivers’ Lived Experiences With Debilitated Chronically Ill Relatives In A Rural Southern County, Nancy J. Dameron
Theses and Dissertations
By 2030, the last of the baby boomer generation will reach the age of 65, which will expand the older adult population to more than 70 million in the United States. Based on the inflated numbers of the older adult population and the noted decreased birth rate in the younger population, fewer health-care providers will be available to teach, prepare, train, and assist caregivers in the ongoing care of their ill relatives.
The problem investigated in the study involved the present upsurge of the older adult population living longer and contributing to a shortage of health-care providers for older adults. …
