Comparing The Effects Of Swimming Exercise And Dissolved Oxygen On Important Performance Parameters Of Early-Rearing Atlantic Salmon Salmo Salar And Rainbow Trout Oncorhynchus Mykiss., Thomas B. Waldrop Jan 2019

Comparing The Effects Of Swimming Exercise And Dissolved Oxygen On Important Performance Parameters Of Early-Rearing Atlantic Salmon Salmo Salar And Rainbow Trout Oncorhynchus Mykiss., Thomas B. Waldrop

Graduate Theses, Dissertations, and Problem Reports (ETD)

Swimming exercise (bodylenghts/sec), and dissolved oxygen (DO), are important environmental variables in aquaculture. While there is an obvious physiological association between these two parameters, their interaction has not been adequately studied in Atlantic salmon, Salmo salar and Rainbow trout, Oncorhynchus mykiss. Since both variables can be easily manipulated in modern aquaculture systems, we sought to assess the impact of these parameters, alone and in combination, on the performance, health, and welfare parameters of the two species. Atlantic salmon and Rainbow trout were stocked into twelve circular 0.5 m3 tanks and exposed to either high (1.5-2 BL/s) or low …

X-Ray Fluorescence Applications In Mudrock Characterization: Investigations Into Middle Devonian Stratigraphy, Appalachian Basin, Usa, Keithan Garrett Martin Jan 2019

X-Ray Fluorescence Applications In Mudrock Characterization: Investigations Into Middle Devonian Stratigraphy, Appalachian Basin, Usa, Keithan Garrett Martin

Graduate Theses, Dissertations, and Problem Reports (ETD)

Mudrocks are characterized by nanometer-scale pore sizes and nano-darcy permeability, which plays a significant role in hydrocarbon flow during production. Resulting from these characteristics, mudrocks were exclusively considered a source rock, which charged overlying, more porous mediums. Hydraulic fracturing, a technology used to create artificial fractures to liberate hydrocarbons from the reservoir, enabled natural gas to be produced from mudrock reservoirs economically. Over the last fifteen years, this technology motivated research efforts to understand reservoir characteristics of mudrock. These investigations significantly improved our knowledge of mudrock systems, but have also highlighted key areas that are undeveloped and/or where conflicting hypotheses …

Graduate Theses, Dissertations, and Problem Reports (ETD)

This dissertation examines the improvisational stylings of Curtis Fuller, Locksley “Slide” Hampton, Julian Priester and Grachan Moncur III from 1955 through 1964. In part one of this study, each musician is presented through their improvisational connections to J.J. Johnson, the leading trombonist of the Bebop era. His improvisational signatures are then traced through to the musical innovations of the Hard-Bop Trombone Era. Source material for this part of the study includes published books, dissertations, articles, online sources, discographies and personal interviews. Part two of this paper analyzes selected solos from each of the four subjects to identify the defining characteristics …

Evaluating The Potential Of Methyl Jasmonate Application As An Agricultural Practice On Phytochemicals In Brassica Vegetables: Sensory Quality, Cooking, And Cost-Benefit Analysis, Yu-Chun Chiu

Graduate Theses, Dissertations, and Problem Reports (ETD)

In the United States, Brassica vegetables, including broccoli (Brassica oleracea var. italica) and kale (Brassica oleracea var. acephala or Brassicae napus var. pabularia), are widely consumed and are easily accessible in farmer’s market or grocery stores with increasing interest of their health-promoting properties. For example, the consumption of broccoli has been associated with anti-cancer activity in in vitro and in vivo trails due to the high content of phytochemicals, minerals, vitamins, and fibers. Application of methyl jasmonate (MeJA) has been reported to enhance the potential health-promoting compounds in Brassica vegetables, glucosinolates (GS), especially indolyl GS neoglucobrassicin …

Folk-Song To Formal Performance: Interpreting The Songs Of Jean Ritchie For Voice Recital, Julianne E. Laird

Graduate Theses, Dissertations, and Problem Reports (ETD)

The purpose of this study was to identify the value of incorporating American folk-song into a formal voice recital program, specifically the collections and compositions of Jean Ritchie. This qualitative study identified criteria for choosing specific folk-songs to include in formal recital, assessed quality in a folk-song arrangement, discussed suitable instrumentation for accompaniment, and suggested appropriate performance practices for concert performance. New folk-song literature was discovered through accessing original unpublished sources in the American Folklife Center of the Library of Congress. Finally, a format and program for incorporating the collected and composed folk-songs of Jean Ritchie in formal recital was …

Detecting Balsam Woolly Adelgid Infestations Using Tree Rings, Morgan Lane Leef Jan 2019

Detecting Balsam Woolly Adelgid Infestations Using Tree Rings, Morgan Lane Leef

Graduate Theses, Dissertations, and Problem Reports (ETD)

Balsam woolly adelgid (BWA), Adelges piceae(Ratzeburg), is a sap-sucking, exotic invasive insect that arrived in North America from central Europe around 1900. Since then, its range has expanded from New Brunswick, Canada to the southern Appalachian Mountains. It is a threat to all North American true-fir species, but populations can be controlled by cold continental winters. Adelgid feeding leaves noticeable traces on the wood tissue (“rotholz”) and causes a temporary positive radial growth response among affected trees. The purpose of this research was to determine dates of initial outbreaks, balsam fir radial growth change during outbreaks, and the relationship …

In the first component of the study, books, journal articles, and papers pertaining to log grading are sorted and broached chronologically by the publication date and then separated into …

The Effects Of Coal Capacity Retirement On Wholesale Electricity Prices: A Demand Side Analysis, Michael C. O'Conor Jan 2019

The Effects Of Coal Capacity Retirement On Wholesale Electricity Prices: A Demand Side Analysis, Michael C. O'Conor

Graduate Theses, Dissertations, and Problem Reports (ETD)

U.S. electric utilities retired 47% of their coal-fired generation capacity between 2008-2017 and have plans to continue decreasing this capacity through 2020. This means that areas of the U.S., like the Pennsylvania-New Jersey-Maryland Interconnection (PJM) Regional Transmission Organization, not only have experienced, but will continue to experience major shifts in its energy fuel mix and available electricity generation capacity. On June 1, 2015, the American Electric Power (AEP) zone experienced the retirement of 5,408 MW of coal-fired generation capacity from the wholesale electricity market. This research analyzes the impacts of this retirement on wholesale prices, i.e., locational marginal price (LMP) …

Direct Determination Of The Dynamic Elastic Modulus And Poisson's Ratio Of Timoshenko Prisms And Rods, Guadalupe Leon Jan 2019

Direct Determination Of The Dynamic Elastic Modulus And Poisson's Ratio Of Timoshenko Prisms And Rods, Guadalupe Leon

Graduate Theses, Dissertations, and Problem Reports (ETD)

In this study, the exact solution of the Timoshenko beam vibration frequency equation under free-free boundary conditions was determined with an accurate shear shape factor. The exact solution was compared with a 3-D finite element calculation using ABAQUS program, and the difference between the exact solution and the 3-D FEM was within 0.15% for both the transverse and torsional modes. Furthermore, relationships between the resonance frequencies and Poisson’s ratio were proposed that can directly determine the elastic constants, unlike the equations provided by ASTM C215. The frequency ratio between the 1st bending mode and the 1st torsional mode, …

Peatlands And Histosols In Canaan Valley National Wildlife Refuge, West Virginia, Mitzy Leigh Schaney Jan 2019

Peatlands And Histosols In Canaan Valley National Wildlife Refuge, West Virginia, Mitzy Leigh Schaney

Graduate Theses, Dissertations, and Problem Reports (ETD)

Canaan Valley in West Virginia contains a greater area of peatlands than any other locality in the mid-Atlantic Highlands. Extensive fieldwork focused on peat stratigraphy and pedology, combined with high-resolution radiocarbon dating, was used to evaluate five peatlands within Canaan Valley National Wildlife Refuge (CVNWR) in the central Appalachian Mountains. One hundred soil cores were profiled and described, 30 with laboratory data, including 52 radiocarbon dates. Calibrated basal peat dates among the five mapped peatlands indicate a late Pleistocene timeframe for the onset of peat genesis, ranging from ~18,600 to ~15,200 cal yr BP. The dates for peat initiation are …

Crocodylian Head Width Allometry And Phylogenetic Prediction Of Body Size In Extinct Crocodyliforms, Haley D O'Brien, Leigha M Lynch, Kent A Vliet, John Brueggen, Gregory M Erickson, Paul M Gignac Jan 2019

Crocodylian Head Width Allometry And Phylogenetic Prediction Of Body Size In Extinct Crocodyliforms, Haley D O'Brien, Leigha M Lynch, Kent A Vliet, John Brueggen, Gregory M Erickson, Paul M Gignac

2010-2019 OA Pubs

Body size and body-size shifts broadly impact life-history parameters of all animals, which has made accurate body-size estimates for extinct taxa an important component of understanding their paleobiology. Among extinct crocodylians and their precursors (e.g., suchians), several methods have been developed to predict body size from suites of hard-tissue proxies. Nevertheless, many have limited applications due to the disparity of some major suchian groups and biases in the fossil record. Here, we test the utility of head width (HW) as a broadly applicable body-size estimator in living and fossil suchians. We use a dataset of sexually mature male and female …

Forensic Border Searches After Carpenter Require Probable Cause And A Warrant, Christopher I. Pryby Jan 2019

Forensic Border Searches After Carpenter Require Probable Cause And A Warrant, Christopher I. Pryby

Michigan Law Review

Under the border search doctrine, courts have upheld the federal government's practice of searching people and their possessions upon entry into or exit from the United States, without any requirement of suspicion, as reasonable under the Fourth Amendment. Since the advent of electronic devices with large storage capacities, courts have grappled with whether this definition of reasonableness continues to apply. So far, courts have consistently characterized “nonforensic” border inspections of electronic devices (for example, paging through photos on a phone) as “routine” searches that, like inspecting luggage brought across international lines, require no suspicion. But there is a circuit split …

The Procedure Fetish, Nicholas Bagley Jan 2019

The Procedure Fetish, Nicholas Bagley

Michigan Law Review

The strict procedural rules that characterize modern administrative law are said to be necessary to sustain the fragile legitimacy of a powerful and constitutionally suspect administrative state. We are likewise told that they are essential to public accountability because they prevent factional interests from capturing agencies. Yet the legitimacy-and-accountability narrative at the heart of administrative law is both overdrawn and harmful. Procedural rules have a role to play in preserving legitimacy and discouraging capture, but they advance those goals more obliquely than is commonly assumed and may exacerbate the very problems they aim to fix. This Article aims to draw …

A Post-Spokeo Taxonomy Of Intangible Harms, Jackson Erpenbach Jan 2019

A Post-Spokeo Taxonomy Of Intangible Harms, Jackson Erpenbach

Michigan Law Review

Article III standing is a central requirement in federal litigation. The Supreme Court’s Spokeo decision marked a significant development in the doctrine, dividing the concrete injury-in-fact requirement into two subsets: tangible and intangible harms. While tangible harms are easily cognizable, plaintiffs alleging intangible harms can face a perilous path to court. This raises particular concern for the system of federal consumer protection laws where enforcement relies on consumers vindicating their own rights by filing suit when companies violate federal law. These plaintiffs must often allege intangible harms arising out of their statutorily guaranteed rights. This Note demonstrates that Spokeo’s …

Mdl As Public Administration, David L. Noll Jan 2019

Mdl As Public Administration, David L. Noll

Michigan Law Review

From the Deepwater Horizon disaster to the opioid crisis, multidistrict litigation—or simply MDL—has become the preeminent forum for devising solutions to the most difficult problems in the federal courts. MDL works by refusing to follow a regular procedural playbook. Its solutions are case specific, evolving, and ad hoc. This very flexibility, however, provokes charges that MDL violates basic requirements of the rule of law.

At the heart of these charges is the assumption that MDL is simply a larger version of the litigation that takes place every day in federal district courts. But MDL is not just different in scale …

Policing, Danger Narratives, And Routine Traffic Stops, Jordan Blair Woods Jan 2019

Policing, Danger Narratives, And Routine Traffic Stops, Jordan Blair Woods

Michigan Law Review

This Article presents findings from the largest and most comprehensive study to date on violence against the police during traffic stops. Every year, police officers conduct tens of millions of traffic stops. Many of these stops are entirely unremarkable—so much so that they may be fairly described as routine. Nonetheless, the narrative that routine traffic stops are fraught with grave and unpredictable danger to the police permeates police training and animates Fourth Amendment doctrine. This Article challenges this dominant danger narrative and its centrality within key institutions that regulate the police.

The presented study is the first to offer an …

The New Impartial Jury Mandate, Richard Lorren Jolly Jan 2019

The New Impartial Jury Mandate, Richard Lorren Jolly

Michigan Law Review

Impartiality is the cornerstone of the Constitution’s jury trial protections. Courts have historically treated impartiality as procedural in nature, meaning that the Constitution requires certain prophylactic procedures that secure a jury that is more likely to reach verdicts impartially. But in Peña- Rodriguez v. Colorado, 137 S. Ct. 855 (2017), the Supreme Court recognized for the first time an enforceable, substantive component to the mandate. There, the Court held that criminal litigants have a Sixth Amendment right to jury decisions made without reliance on extreme bias, specifically on the basis of race or national origin. The Court did not …

Shots Fired: Digging The Uniformed Services Employment And Reemployment Rights Act Out Of The Trenches Of Arbitration, Lisa Limb Jan 2019

Shots Fired: Digging The Uniformed Services Employment And Reemployment Rights Act Out Of The Trenches Of Arbitration, Lisa Limb

Michigan Law Review

The Uniformed Services Employment and Reemployment Rights Act (USERRA) was enacted to protect servicemembers from discrimination by civilian employers and to provide servicemembers with reemployment rights. Recent circuit court decisions, however, have maimed these protections by ruling that mandatory arbitration is permissible under USERRA. This Note argues that such rulings conflict with USERRA’s plain language, statutory structure, and purpose. Ultimately, in light of strong public policy considerations, this Note contends that mandatory arbitration should not be permissible under USERRA and proposes that Congress amend the Act to explicitly prohibit arbitration.

More Than Birds: Developing A New Environmental Jurisprudence Through The Migratory Bird Treaty Act, Patrick G. Maroun Jan 2019

More Than Birds: Developing A New Environmental Jurisprudence Through The Migratory Bird Treaty Act, Patrick G. Maroun

Michigan Law Review

This year marks the centennial of the Migratory Bird Treaty Act, one of the oldest environmental regulatory statutes in the United States. It is illegal to “take” or “kill” any migratory bird covered by the Act. But many of the economic and industrial assumptions that undergirded the Act in 1918 have changed dramatically. Although it is undisputed that hunting protected birds is prohibited, circuit courts split on whether so-called “incidental takings” fall within the scope of the Act. The uncertainty inherent in this disagreement harms public and private interests alike—not to mention migratory birds. Many of the most important environmental …
