Competition Enforcement, Trade And Global Governance: A Few Comments, Petros C. Mavroidis, Damien J. Neven
Competition Enforcement, Trade And Global Governance: A Few Comments, Petros C. Mavroidis, Damien J. Neven
Faculty Scholarship
The debate on international antitrust has come from two perspectives. On the one hand, the trade community has emphasised the interface between trade policy and competition (policy and) enforcement. This interface, which was recognised from the outset of multilateral efforts to liberalise trade in what would become the GATT and eventually the WTO, focuses on the prospect that trade liberalisation through border instruments should not be undone by restrictive business practices (RBPs), placing a particular responsibility in this respect on competition enforcement. On the other hand, the antitrust community has emphasised the risk of inefficient enforcement when several jurisdictions can …
Why We Need Police, Justin Mccrary, Deepak Premkumar
Why We Need Police, Justin Mccrary, Deepak Premkumar
Faculty Scholarship
This chapter discusses the essential role that the police have in deterring and reducing crimes, particularly the most violent and costly ones to society, such as murder. We begin by providing a brief overview of deterrence theory before discussing the empirical evidence on the efficacy of police staffing and various policing strategies on crime reduction. Using a framework developed in Weisburd and Eck (2004), we quickly evaluate the model of standard policing and then mainly focus on evidence behind three current policing practices: hot spots, problem- oriented, and proactive. Finally, we use the empirical evidence of police staffing to provide …
Regulating Financial Markets – An Ltf Perspective, Katharina Pistor
Regulating Financial Markets – An Ltf Perspective, Katharina Pistor
Faculty Scholarship
This chapter applies the “Legal Theory of Finance” (LTF) I developed in a paper, which was published in the Journal of Comparative Economics in 2013. Together with other research projects, conferences, and workshops conducted in the intervening period, this chapter illustrates the explanatory powers of the theory and its ramifications for the regulation of financial systems. I am grateful for the conference and this volume, and to the other authors in it who have tested LTF in application to new circumstances as they offer a good opportunity to step back and ask more basic questions about LTF:
- What is the …
Sovereignty And Complex Interdependence: Some Surprising Indications Of Their Compatibility, Charles F. Sabel
Sovereignty And Complex Interdependence: Some Surprising Indications Of Their Compatibility, Charles F. Sabel
Faculty Scholarship
Even as democratic sovereignty and globalization are increasingly seen as incompatible in theory, this chapter argues that, in some important realms, they are proving compatible in practice. As tariffs have fallen to negligible levels, trade agreements among rich countries have come to focus on reconciling regulatory differences. In many sectors, novel forms of cooperation have emerged that allow trade partners deliberately to investigate and learn from one another’s practices, eventually recognizing the equivalence of regimes that are not strictly identical — and in the process extending domestic political oversight to relations among states while often heightening domestic accountability. The emergent …

On Constructing A Knowledge Base Of Chinese Criminal Cases, Xiaohan Wu, Benjamin L. Liebman, Rachel E. Stern, Margaret Roberts, Amarnath Gupta
Faculty Scholarship
We are developing a knowledge base over Chinese judicial decision documents to facilitate landscape analyses of Chinese Criminal Cases. We view judicial decision documents as a mixed-granularity semi-structured text where different levels of the text carry different semantic constructs and entailments. We use a combination of context-sensitive grammar, dependency parsing and discourse analysis to extract a formal and interpretable representation of these documents. Our knowledge base is developed by constructing associations between different elements of these documents. The interpretability is contributed in part by our formal representation of the Chinese criminal laws, also as semi-structured documents. The landscape analyses utilizes these …

Dark Trading At The Midpoint: Does Sec Enforcement Policy Encourage Direct Feed Arbitrage?, Robert P. Bartlett Iii, Justin Mccrary
Dark Trading At The Midpoint: Does Sec Enforcement Policy Encourage Direct Feed Arbitrage?, Robert P. Bartlett Iii, Justin Mccrary
Faculty Scholarship
Prevailing research in market microstructure posits that liquidity providers bypass queue lines on exchanges by offering liquidity in dark venues with de minimis sub-penny price improvement, thus exploiting an exception to the penny quote rule. We show that (a) the SEC enforces the quote rule to prevent sub-penny queuejumping in dark pools unless trades are “pegged” to the NBBO midpoint and (b) the documented increase in dark trading due to investor queue-jumping stems from increased midpoint trading. Although encouraging pegged midpoint orders can subject traders to direct feed arbitrage, we estimate that less than 2% of shares traded per year …
Comment On Daniel A. Crane: A Premature Postmortem On The Chicago School Of Antitrust, Lina M. Khan
Comment On Daniel A. Crane: A Premature Postmortem On The Chicago School Of Antitrust, Lina M. Khan
Faculty Scholarship
A central question raised by the recent surge of neo-Brandeisian scholarship and advocacy is whether the nascent movement will deliver any form of lasting change to antitrust. In his essay for this issue of Business History Review, Daniel Crane is doubtful. He argues that critiques of the Chicago School are often simplistic and misunderstand its legacy, which includes institutionalizing economic theory in antitrust analysis in ways that even its post-Chicago critics absorbed and built on. The “consumer welfare” standard, Crane notes, still draws wide support across the ideological spectrum and may be capacious enough to accommodate a variety of approaches …
Beyond The Counterinsurgency Paradigm Of Governing: Letting Go Of Prediction And The Illusion Of An Internal Enemy, Bernard E. Harcourt
Beyond The Counterinsurgency Paradigm Of Governing: Letting Go Of Prediction And The Illusion Of An Internal Enemy, Bernard E. Harcourt
Faculty Scholarship
Bernard E. Harcourt expands the thesis about the illusion of insurgency in the United States to the current day. What, he asks, could alter fraudulent and overblown perceptions about the sanctity and importance of the national security state? He suggests that the way forward might begin with relinquishing the institutionalized practice of predicting danger. How to do this and what the consequences might be for his three-pronged analysis of state counterinsurgency strategy provides fresh thinking for future analysis and policymaking.
Corporate Control And The Regulation Of Controlling Shareholders, Zohar Goshen, Assaf Hamdani
Corporate Control And The Regulation Of Controlling Shareholders, Zohar Goshen, Assaf Hamdani
Faculty Scholarship
In this chapter, we outline the theory of idiosyncratic vision and explored its implications. Our theory can be summarized as follows: First, while investors value control because it offers them protection from agency costs, entrepreneurs value control because it allows them to pursue their idiosyncratic vision. Second, any contract between entrepreneurs and investors represents a balance between the entrepreneurs’ freedom to secure their idiosyncratic vision and the investors’ protection against agency costs. Third, the investors and entrepreneurs will allocate cash-flow and control rights through the bargaining process to achieve this balance.
In addition, this chapter demonstrates that ownership structures are …

By offering a sweeping account of religious liberty activism being undertaken by numerous progressive humanitarian and social justice movements, and uncovering how right-wing activists have fought for conservative Christian hegemony rather than “religious liberty” more generally, this report challenges the leading popular narrative of religious freedom.
Real-Time Path Planning In Constrained, Uncertain Environments, Randall Christensen, Robert C. Leishman
Real-Time Path Planning In Constrained, Uncertain Environments, Randall Christensen, Robert C. Leishman
Faculty Publications
A key enabler of autonomous vehicles is the ability to plan the path of the vehicle to accomplish mission objectives. To be robust to realistic environments, path planners must account for uncertainty in the trajectory of the vehicle as well as uncertainty in the location of obstacles. The uncertainty in the trajectory of the vehicle is a difficult quantity to estimate, and is influenced by coupling between the vehicle dynamics, guidance, navigation, and control system as well as any disturbances acting on the vehicle. Monte Carlo analysis is the conventional approach to determine vehicle dispersion, while accounting for the coupled …

Examining Organizational Learning Culture (Olc) In Schools Adopting Trauma-Informed Practices, Constance Grimm-Grason
Examining Organizational Learning Culture (Olc) In Schools Adopting Trauma-Informed Practices, Constance Grimm-Grason
All Capstone Projects
Trauma-informed practices represent a departure from the status-quo disciplinary practices originating from zero-tolerance approaches. This departure from the status-quo represents a transformative change in schools. Teachers are often the initial responders to student struggles or misbehaviors, and the teacher’s response is conditioned by their belief system, their self-efficacy, and the norms of the school where they teach. The shift to supportive school discipline approaches, such as trauma-informed practices, may alter the formal discipline norms of the school, but the shift may not transfer to the teacher’s belief systems, their sense of self-efficacy with trauma, or the informal norms of the …

The study began with a historical review of students with disabilities and the current requirements of the Individuals with Disabilities Reauthorization Act of 2004. Educational systems within the United States are required to provide services to students with diverse learning needs in the least restrictive environment. These supports are most commonly referred to as inclusive practices. …

An Anti-Deficit Approach To The Study Of Persistence: Factors Influencing Persistence Among Black Males Attending Community College, Donna K. Williams
All Capstone Projects
The vast majority of literature on postsecondary Black males emphasizes the lack of academic success for this segment. Research reports that Black males have lower levels of academic achievement, ranking at or near the bottom of most success indicators, which include enrollment, persistence, engagement, and attainment. However, in examining the discourse on postsecondary Black males, a great deal of research is deficit-based.
Providing a counter-narrative to the plethora of deficit-based literature on postsecondary Black males, this study is guided by an anti-deficit approach that seeks to highlight factors that influence persistence among Black men attending community college. This mixed method …
The Impact On Policy And Procedure Changes In Law Enforcement Due To The Black Lives Matter Movement In Cook County, Illinois, Shari Payne
All Capstone Projects
The research topic focuses on the Black Lives Matter Movement. This topic is worth researching because African-Americans have been brutally victimized by their non-minority slave owners and law enforcement since they were brought to American from Africa. Although there have been African-American leaders that have fought for equality and fair treatment within the legal system; the plight of African-Americans has not progressed as much as one would expect. This study attempted to determine if the Black Lives Matter Movement has an effect on policy and procedure changes within law enforcement at their place of employment. The sample population consisted of …

The topic selected for this research is Teen Court, also referred to as Peer Court or Youth Court. The researcher attempts to determine the effects teen diversion programs, such as Teen Court, have on reducing the rate of recidivism during one’s adolescent years. This approach uses a peer court system to hold them accountable for their actions. Teen court works, because it has peers influencing peers, versus another adult telling youths what they should do” (Garrett, 2009, p. 50). With a focus on past Teen Court participants and Teen Court personnel in Kankakee County, Illinois, the results from this study …
