A Euclid Dissent, Michael Lewyn Jan 2019

A Euclid Dissent, Michael Lewyn

Scholarly Works

In Euclid v. Ambler Realty, the Supreme Court upheld the constitutionality of zoning, including zoning that excluded apartment houses and retail businesses. Although the decision was not unanimous, the Euclid minority did not write a formal dissent. The purpose of this article is to show what such a dissent should have looked like.

Consequences Of Pathogen Lists: Why Some Diseases May Continue To Plague Us, David Brett-Major, Trina Racine, Gary P. Kobinger Jan 2019

Consequences Of Pathogen Lists: Why Some Diseases May Continue To Plague Us, David Brett-Major, Trina Racine, Gary P. Kobinger

Journal Articles: Epidemiology

The current strategy used by many funding agencies for determining how money is spent on research to help prevent infectious disease outbreaks is based on pathogen-specific priority lists. Listing disease threats provides focus for business and research planning conducive to specific goals of developing a drug, or a vaccine, or other particular product. But, this singular type of focus has consequences. This perspective explores the consequences of lists, and describes how parallel programming independent of disease lists that address what we need to do to prevent and mitigate emerging disease risks may provide benefits out of reach of a singular …

Anti-Competition Regulation, Anne Fleming Jan 2019

Anti-Competition Regulation, Anne Fleming

Georgetown Law Faculty Publications and Other Works

Looking across the long twentieth century, this article tracks the rise and fall of one form of anti-competition regulation: the certificate of public convenience. Designed to curb “destructive competition” in certain industries, such as transportation and banking, certificate laws prevented firms from entering those industries unless they could convince regulators that they would satisfy an unmet public demand for goods or services. This history highlights how lawmakers used similar techniques in governing infrastructure and finance—two fields that are not often studied together. It also shows that state regulation both prefigured legal change at the federal level and then lagged behind …

Factors That Influence Maternal Feeding Decisions For Toddlers: Extending The Theory Of Planned Behavior, Elizabeth Lucas Combs Jan 2019

Factors That Influence Maternal Feeding Decisions For Toddlers: Extending The Theory Of Planned Behavior, Elizabeth Lucas Combs

Theses and Dissertations--Kinesiology and Health Promotion

Establishing healthy eating behaviors is vital in the early years to help combat the development of obesity and other chronic diseases. Mothers play an invaluable role in shaping their children's eating habits through controlling what and when children eat as well as the overall food environment, which is why a better understanding of what influences mothers’ decisions about these behaviors is important.

The purpose of the dissertation was to gain a better understanding of what impacts maternal feeding decisions regarding toddler nutrition behaviors. This was a two-phased mixed methods study. The aim of the initial study was to explore, using …

The Effects Of The Usda Summer Food Service Program On Rural Adolescents’ Nutrition Attitudes, Knowledge, Behavioral Intentions And Nutrition Behaviors, Mary Rachel Harrington Jan 2019

The Effects Of The Usda Summer Food Service Program On Rural Adolescents’ Nutrition Attitudes, Knowledge, Behavioral Intentions And Nutrition Behaviors, Mary Rachel Harrington

Theses and Dissertations--Kinesiology and Health Promotion

Rural adolescents suffer from poor nutrition, increasing their risk for obesity and other chronic diseases. The Summer Food Service Program (SFSP), an off-shoot of the National School Lunch Program, provides meals to qualifying children, including low-income, rural adolescents, under the age of 18. The purpose of this study was to: 1) examine the impact of the SFSP on the nutrition–related knowledge, self-reported fruit and vegetable (SRFV) consumption, and the constructs of the Theory of Planned Behavior (attitudes, subjective norms, perceived behavioral control, and behavioral intentions) of rural, low-income adolescents; and 2) examine the relationship between nutrition behaviors (quality food selection …

Chronic Low Intensity Continuous And Interval Training Prevent Heart Failure-Related Coronary Artery Stiffness, An Ouyang Jan 2019

Chronic Low Intensity Continuous And Interval Training Prevent Heart Failure-Related Coronary Artery Stiffness, An Ouyang

Theses and Dissertations--Kinesiology and Health Promotion

Heart failure (HF) induced by aortic pressure over-load is associated with increased coronary artery stiffness. Perivascular adipose tissue (PVAT) and advanced glycation end products (AGE) both promote arterial stiffness. However, the mechanisms by which coronary PVAT promotes arterial stiffness and the efficacy of exercise to prevent coronary stiffness are unknown. The present study hypothesized both chronic continuous and interval exercise training would prevent coronary artery stiffness associated with inhibition of PVAT secreted AGE. Yucatan mininature swine were divided into four groups: control-sedentary (CON), aortic-banded sedentary heart failure (HF), aortic-banded HF continuous exercise trained (HF+CONT), and aortic-banded HF interval exercise trained …

Reflecting On Straight Talk On Trade, Alvaro Santos Jan 2019

Reflecting On Straight Talk On Trade, Alvaro Santos

Georgetown Law Faculty Publications and Other Works

A question that motivates this essay is: What insights can we offer from legal scholarship that Dani Rodrik could take on board and put to good use?

Rodrik is an economist, but he might as well have been a lawyer in the way he builds his argument and anticipates counterarguments. I mean that as a compliment. As a bonus, he delivers the punch line with humor and grace. In his book I recognized several of the many contributions Rodrik has made: his argument for policy space and revitalization of industrial policy, the globalization trilemma, the idea and process of growth …

Heart Rate Dynamics During And After Simulated Fire Ground Tasks: Effects Of Physical Fitness And Training, Anssi Ilmari Saari Jan 2019

Heart Rate Dynamics During And After Simulated Fire Ground Tasks: Effects Of Physical Fitness And Training, Anssi Ilmari Saari

Theses and Dissertations--Kinesiology and Health Promotion

Firefighting is a strenuous occupation that increases the risk of cardiovascular events. Greater levels of physical fitness and training improve firefighters’ occupational performance, but little is known whether they are related to lower physiological stress and recovery from fire ground tasks. Heart rate, heart rate recovery and heart rate variability have been used to evaluate physical stress in association with exercise and fire ground tasks. However, there is a paucity of research evaluating the effects of physical fitness and training on heart rate dynamics during a simulated fire ground test (SFGT). Therefore, the primary purposes of this study were to …

Circadian Rhythm Phase Shifts Caused By Timed Exercise Vary With Chronotype In Young Adults, J. Matthew Thomas Jan 2019

Circadian Rhythm Phase Shifts Caused By Timed Exercise Vary With Chronotype In Young Adults, J. Matthew Thomas

Theses and Dissertations--Kinesiology and Health Promotion

The circadian system controls 24-hour cycles of behavior and physiology, such as rest-activity and feeding rhythms. The human circadian system synchronizes with, or entrains to, the light/dark cycle (sunrise/sunset) to promote activity and food consumption during the day and rest at night. However, strict work schedules and nighttime light exposure impair proper entrainment of the circadian system, resulting in chronic circadian misalignment. Numerous studies have shown that chronic circadian misalignment results in poor health. Therefore, therapeutic interventions that could shift circadian rhythms and alleviate circadian misalignment could broadly impact public health. Although light is the most salient time cue for …

Examining Attitudes, Perceptions, And Observations Of Tobacco Use And Compliance At A Small Private Liberal Arts College In Kentucky With A Designated Area Tobacco Policy, Michael Dalessio

Theses and Dissertations--Kinesiology and Health Promotion

A multitude of higher education institutions have adopted comprehensive smoke- and tobacco-free policies to minimize tobacco use, increase quit attempts, and reduce exposure to secondhand smoke on campus. However, the majority of campuses across the U.S. still have non-comprehensive policies and/or designated tobacco use areas. Given the limited research in this area, the purpose of this dissertation was to assess the attitudes, perceptions, tobacco use behaviors, and actual observational compliance of students, faculty, and staff on a college campus that possesses a designated area tobacco policy.

This two-phased cross-sectional study included both direct observations and online survey data collection. For …

Internet Utopianism And The Practical Inevitability Of Law, Julie E. Cohen Jan 2019

Internet Utopianism And The Practical Inevitability Of Law, Julie E. Cohen

Georgetown Law Faculty Publications and Other Works

"Writing at the dawn of the digital era, John Perry Barlow proclaimed cyberspace to be a new domain of pure freedom. Addressing the nations of the world, he cautioned that their laws, which were “based on matter,” simply did not speak to conduct in the new virtual realm. As both Barlow and the cyberlaw scholars who took up his call recognized, that was not so much a statement of fact as it was an exercise in deliberate utopianism. But it has proved prescient in a way that they certainly did not intend. The “laws” that increasingly have no meaning in …

Turning Privacy Inside Out, Julie E. Cohen Jan 2019

Turning Privacy Inside Out, Julie E. Cohen

Georgetown Law Faculty Publications and Other Works

The problem of theorizing privacy moves on two levels, the first consisting of an inadequate conceptual vocabulary and the second consisting of an inadequate institutional grammar. Privacy rights are supposed to protect individual subjects, and so conventional ways of understanding privacy are subject-centered, but subject-centered approaches to theorizing privacy also wrestle with deeply embedded contradictions. And privacy’s most enduring institutional failure modes flow from its insistence on placing the individual and individualized control at the center. Strategies for rescuing privacy from irrelevance involve inverting both established ways of talking about privacy rights and established conventions for designing institutions to protect …

Race Ipsa Loquitur, Girardeau A. Spann

Georgetown Law Faculty Publications and Other Works

The goal of this Article is to make the existence of invidious racial discrimination in the United States so palpable that it can no longer be denied. Part I argues that racial inequality is so pervasive, unconscious, and structural that it has simply become an assumed fixture of United States and is rarely even noticed. Section I.A describes the history of racial subordination in the United States. Section I.B invokes the concept of disparate impact to illustrate the continuing manifestations of invidious discrimination in contemporary culture. Part II describes the manner in which the culture nevertheless chooses to deny the …

This study was designed to understand whether projects funded through development window of finance in Bangladesh like the Annual Development Programme(ADP) is different or similar to that of climate window of finance like Bangladesh Climate Change Trust Fund (BCCTF). The BCCTF is managed primarily by the Ministry of Environment, Forests and Climate Change whereas the ADP is managed by the Ministry of Planning and Ministry of Finance. It was, therefore, studied also to understand whether the new window of financing climate projects is more efficient, effective and sustainable. On the contrary, if they are both similar in nature then a …

An Asian View On The Ceta Investment Chapter, Locknie Hsu Jan 2019

An Asian View On The Ceta Investment Chapter, Locknie Hsu

Research Collection Yong Pung How School Of Law

The Canada-EU Free Trade Agreement (CETA) has been completed and awaits ratification against a backdrop of global economic uncertainty. The Trans-Pacific Partnership Agreement (TPP), which includes five Asian parties among its signatories, has lost the support of the United States and its fate is uncertain as well. The CETA is significant for Asian countries given that one of its parties -- the EU -- has signalled strongly that it wishes to negotiate a number of free trade agreements in the Asian region. The agreement offers valuable insight into the thinking of the EU in terms of investment protection guarantees, its …

Tackling Elder Abuse: State Intervention Under Singapore's Vulnerable Adults Act, Wing Cheong Chan Jan 2019

Tackling Elder Abuse: State Intervention Under Singapore's Vulnerable Adults Act, Wing Cheong Chan

Research Collection Yong Pung How School Of Law

Abuse and neglect of adults raise complex issues on the freedom of the individual to choose for themselves versus the powers of the State to intervene. The law has traditionally limited the scope of compulsory intervention to extreme situations only which can frustrate social workers who deal with such cases. On the other hand, it would be unacceptable to allow intervention simply because it is assessed to be in the adults' best interests. A balance therefore has to be struck between autonomy and protection. This paper examines how Singapore's Vulnerable Adults Act identifies the point for intervention and embodies safeguards …

This year (2018) the Model Law on Cross-BorderInsolvency comes of age and celebrates its 21st birthday. It has been something of a successinternationally. The major common lawjurisdictions including the United Kingdom (UK), the United States (US), Canadaand Australia have changed their domestic laws on cross-border insolvencycooperation based on the model law provisions and so too has Japan and Korea. But theemerging global super powers of China and India have remained resistant and sotoo have most of the European Union (EU) member states including the economicpower houses of France and Germany. Nevertheless, the number of international acceptances is growing slowlyincluding most …

Rural Social Work And Environmental Justice, Pamela C. Twiss Jan 2019

Rural Social Work And Environmental Justice, Pamela C. Twiss

Contemporary Rural Social Work Journal

While social work education and literature includes a growing body of work focused on environmental justice and the role of social work in addressing environmental injustices, limited attention has been paid to the disproportionate impact of these issues in rural areas. Many rural places can be more accurately described as rural-industrial in character. They produce the world’s food through highly mechanized agro-businesses, its timber, and much of its fossil fuels through large mining and drilling operations, each presenting threats to the surrounding environment and local peoples. This work describes environmental issues and injustices common to select large-scale rural industries, discusses …

Privacy-Preserving Attribute-Based Keyword Search In Shared Multi-Owner Setting, Yibin Miao, Ximeng Liu, Robert H. Deng, Robert H. Deng, Jjguo Li, Hongwei Li, Jianfeng Ma

Research Collection Yong Pung How School Of Law

Ciphertext-Policy Attribute-Based Keyword Search (CP-ABKS) facilitates search queries and supports fine-grained access control over encrypted data in the cloud. However, prior CP-ABKS schemes were designed to support unshared multi-owner setting, and cannot be directly applied in the shared multi-owner setting (where each record is accredited by a fixed number of data owners), without incurring high computational and storage costs. In addition, due to privacy concerns on access policies, most existing schemes are vulnerable to off-line keyword-guessing attacks if the keyword space is of polynomial size. Furthermore, it is difficult to identify malicious users who leak the secret keys when more …

Higher-Order Differential Cross Section Calculation For The Associated Production Ofa W Boson And Jets In The Electron Decay Channel At A Center-Of-Mass Energy Of 13tev In Proton-Proton Collisions, Kadi̇r Öcalan

Turkish Journal of Physics

Higher-order cross sections for the production of a W boson in association with jets in the electron decay channel are presented in this study. Cross sections were calculated in a fully differential way using a computational framework based on proton-proton collisions at a center-of-mass energy of 13 TeV. The differential cross section predictions in the fiducial phase-space were compared at next-to-leading order (NLO) and next-to-NLO (NNLO) in perturbative quantum chromodynamics (pQCD). The differential results are reported for the variables including the jet multiplicity, the invariant mass of the W boson, transverse momentum, the jet rapidity, and the electron pseudorapidity that …

Dispersive Parameters Of Oxidized Pva-Pvp Blend Films, Goputta Veena, Blaise Lobo

Turkish Journal of Physics

Oxidized (ox) polyvinyl alcohol (PVA)-polyvinyl pyrrolidone (PVP) blend films were prepared by solution casting technique, with doping levels of the oxidizer, potassium permanganate (KMnO4) , varying from 0.01 up to 4.70 weight percent (wt.%). Optical (UV-Vis) spectral measurements in the wavelength range varying from 190 nm to 1000 nm were used to extract the band gap information and to calculate various optical parameters of the ox-PVA-PVP blend films. The electronic transitions on absorption of photons of suitable energy are of indirect allowed type. The corresponding optical band gap (Eg) has been determined. Optical dispersion parameters for ox-PVA-PVP films were determined …

The Behaviour Of The Diamagnetic Current Modified Mri In Different Rotationprofiles, Suzan Doğan Jan 2019

The Behaviour Of The Diamagnetic Current Modified Mri In Different Rotationprofiles, Suzan Doğan

Turkish Journal of Physics

Magnetohydrodynamic turbulence driven by magnetorotational instability (MRI) has been widely accepted as an efficient mechanism for transporting angular momentum radially outward in the discs. Previously, we have shown the triggering effect of the magnetization currents and the gradients produced by these currents on MRI for Keplerian discs. In this work, we examine the properties of the diamagnetic current modified MRI for the discs where the epicyclic frequencies deviate from Keplerian behaviour. We show that the diamagnetic effect modifies the instability both for an increasing and for a decreasing angular momentum with radius. The novel unstable region produced by magnetization effects …
