The Necessity, Public Interest, And Proportionality In International Investment Law: A Comparative Analysis, Abdulkadir Gülçür Jan 2019

The Necessity, Public Interest, And Proportionality In International Investment Law: A Comparative Analysis, Abdulkadir Gülçür

University of Baltimore Journal of International Law

This article deals with relations of the three concepts of international investment law which can be enumerated as “necessity,” “public interest,” and “proportionality.” These three concepts have been reviewed in the light of the relevant investment tribunals’ decisions and judgments of other international judicial bodies. In democratic governments, legal acts and actions must be based on the “public interest.” However, the “public interest” does not constitute by itself a determinative factor for lawfulness. The proportionality principle has a significant role in the investment arbitrations concerning whether the “public interest” aim is met. Albeit those inferences, the “public interest” claim is …

A People So Different From Themselves: British Attitudes Towards India And The Power Dynamics Of The East India Company, Eric Gray Jan 2019

A People So Different From Themselves: British Attitudes Towards India And The Power Dynamics Of The East India Company, Eric Gray

Murray State Theses and Dissertations

Gray, Eric, A People So Different from Themselves: British Attitudes Towards India and the Power Dynamics of the East India Company. Master of Arts (History), April, 2019, Murray State University, Murray, Kentucky.

Today, many characteristics of the nineteenth- and twentieth-century British Raj are well ingrained in the public consciousness, particularly Victorian Era Britons’ general disdain for numerous aspects of the many cultures found on the Indian Subcontinent. Moreover, while many characteristics of the preceding East India Company’s rule in India were no less exploitative of Indian peoples, evidence shows a much different relationship between British and Indian cultures during the …

American Bolsheviki: The First Red Scare In The United States, 1917 To 1920, Jonathan Dunning Jan 2019

American Bolsheviki: The First Red Scare In The United States, 1917 To 1920, Jonathan Dunning

Murray State Theses and Dissertations

This thesis looks to reframe the timeline of the First Red Scare in United States History. Historians of this period have consistently viewed the First Red Scare as occurring from 1919 to 1920. However, by viewing the First Red Scare as beginning in 1919, historians missed the fear of communism that developed in the US government and the American press and society throughout 1917 and 1918, starting immediately after the Bolshevik Revolution. Moreover, in the past, historians have done little to detail the connections between the Allied Intervention in Russia from 1918 to 1920 and the First Red Scare, despite …

Nucleophilic Phosphine Addition: Exploration Of Novel Alkyne Transformations, Brett Pierce Jan 2019

Nucleophilic Phosphine Addition: Exploration Of Novel Alkyne Transformations, Brett Pierce

Murray State Theses and Dissertations

Nucleophilic phosphine catalysis has demonstrated its value in synthetic chemistry by allowing for mild carbon-carbon bond formation. Many phosphine-catalyzed reactions with electron-deficient alkynes have been reported in recent years, leading to an array of valuable products. Stemming from this field of study, phosphines can also be utilized as mild chemoselective reductants for alkynes, resulting in the corresponding alkenes. Herein, a mild, stereoselective, phosphine-mediated partial reduction of alkynes to (E)- and (Z)-alkenes is described. Specifically, a general method for the partial reduction of ynoates to the corresponding (E)- and (Z)-enoate, …

The Impact Of Content Mastery On Sequential Standards, Michael Newman, Michael Newman Jan 2019

The Impact Of Content Mastery On Sequential Standards, Michael Newman, Michael Newman

Murray State Theses and Dissertations

Mastery of P-12 academic standards is based on a learning process that is sequential and that can be broken into key components for varying students. Key ideas need to be learned before others can be mastered and it is important to know which key ideas are needed before others can be presented. The common problem for students in mathematics is that the content scaffolds and for the teacher, it can be a difficult decision of when to proceed and when not to. Yet, high stakes testing mandates a fast pace of instruction which leaves many students chronically behind. The purpose …

Faculty & Staff Research and Creative Activity

This catalog contains information about the exhibition High + Low, a 45-year retrospective curated by T. Michael Martin, featuring 20 distinct chapters of the art career of D. Dominick Lombardi. The common thread throughout his work is his interest in blending together qualities of highbrow and lowbrow art, and experimentation with various media. His life-long journey began with his exposure to modern art when he first saw a reproduction of Picasso’s Guernica(1939) at the age of 3 or 4, and continued with his introduction to the seductive world of Zapcomix in 1968.

The exhibition begins with the …

Evidence On Fire, Valena Beety, Jennifer Oliva Jan 2019

Evidence On Fire, Valena Beety, Jennifer Oliva

Articles by Maurer Faculty

Fire science, a field largely developed by lay “arson investigators,” police officers, or similar first responders untrained in chemistry and physics, has been historically dominated by unreliable methodology, demonstrably false conclusions, and concomitant miscarriages of justice. Fire investigators are neither subject to proficiency testing nor required to obtain more than a high school education. Perhaps surprisingly, courts have largely spared many of the now debunked tenets of fire investigation any serious scientific scrutiny in criminal arson cases. This Article contrasts the courts’ ongoing lax admissibility of unreliable fire-science evidence in criminal cases with their strict exclusion of the same flimsy …

United States Department of Agriculture Wildlife Services: Staff Publications

Invasive rodents have significant negative impacts on island biodiversity. All but the smallest of rodent eradications currently rely on island-wide rodenticide applications. Although significant advances have been made in mitigating unintended impacts, rodent eradication on inhabited islands remains extremely challenging. Current tools restrict eradication eff orts to fewer than 15% of islands with critically endangered or endangered species threatened by invasive rodents. The Genetic Biocontrol of Invasive Rodents partnership is an interdisciplinary collaboration to develop and evaluate gene drive technology for eradicating invasive rodent populations on islands. Technological approaches currently being investigated include the production of multiple strains of Mus …

A Bioeconomic Model For The Optimization Of Local Canine Rabies Control, Aaron Anderson, Johann Kotze, Stephanie A. Shwiff, Brody Hatch, Chris Slootmaker, Anne Conan, Darryn Knobel, Louis H. Nel

United States Department of Agriculture Wildlife Services: Staff Publications

We present a new modeling tool that can be used to maximize the impact of canine rabies management resources that are available at the local level. The model is accessible through a web-based interface that allows for flexibility in the management strategies that can be investigated. Rabies vaccination, sterilization, chemo-contraception, and euthanasia can be specified and limited to specific demographic groups. Additionally, we allowed for considerable complexity in the specification of management costs. In many areas, the costs of contacting additional dogs increases as management effort increases, and this can have important strategic implications. We illustrated the application of the …

Greater Uniformity And Centralization: The Regulatory Development Of Chinese Food And Product Safety Under The Wto, Nga Kit (Christy) Tang

Washington International Law Journal

The WTO Agreements emphasize free trade, which links with diversity, deregulation, and decentralization. China, on the other hand, emphasizes uniformity and centralization, especially regarding the political control and the one-party system of “democratic dictatorship.” China’s joining the WTO, therefore, may be considered as a development that changes the regulatory structure to become more diverse, deregulated, and decentralized. This paper, however, finds the opposite. Under the WTO law, China is encouraged to move towards greater uniformity and centralization with its decentralized and non-uniform settings under the market policy. Moreover, the WTO’s uniform and centralized encouragements can be integrated into the rule-by-man …

Community Law Practice, Luz E. Herrera Jan 2019

Community Law Practice, Luz E. Herrera

Faculty Scholarship

Community-embedded law practices are small businesses that are crucial in addressing the legal needs that arise in neighborhoods. Lawyers in these practices attend to recurring legal needs, contribute to building a diverse profession, and spur community development of modest-income communities through legal education and services. Solo practitioners and small firm lawyers represent the largest segment of the lawyer population in the United States, yet their contributions to addressing the legal needs of modest-income clients are rarely recognized or studied. This essay sheds light on the characteristics, motivations, and challenges these law practices face in providing access to justice to modest-means …

Department of Agronomy and Horticulture: Faculty Publications

Disturbance legacies structure communities and ecological memory, but due to increasing changes in disturbance regimes, it is becoming more difficult to characterize disturbance legacies or determine how long they persist. We sought to quantify the characteristics and persistence of material legacies (e.g., biotic residuals of disturbance) that arise from variation in fire severity in an eastern ponderosa pine forest in North America. We compared forest stand structure and understory woody plant and bird community composition and species richness across unburned, low‐, moderate‐, and high‐severity burn patches in a 27‐year‐old mixed‐severity wildfire that had received minimal post‐fire management. We identified distinct …

Spatial Variability Of Soil Properties Under Different Land Use In The Dang District Of Nepal, Dinesh Panday, Roshan Babu Ojha, Devraj Chalise, Saurav Das, Bikesh Twanabasu

Department of Agronomy and Horticulture: Faculty Publications

Increased nutrient mining, soil erosion, and limited nutrient management has led to declines in soil quality and reduced productivity in many parts of Nepal. A study was conducted in the eastern part of the Dang district of Nepal in 2015 to assess the variability of selected soil properties of three different land use types (agricultural, agroforestry, and grassland) and to map their spatial distribution. A total of 120 soil samples were collected from 0–15 cm depth and analyzed for soil fertility parameters: pH, organic matter (OM), nitrogen (N), phosphorus (P), potassium (K), boron (B), and zinc (Zn). Results revealed that …

Response Surface Analysis Of Genomic Prediction Accuracy Values Using Quality Control Covariates In Soybean, Diego Jarquin, Reka Howard, George L. Graef, Aaron Lorenz

Department of Agronomy and Horticulture: Faculty Publications

An important and broadly used tool for selection purposes and to increase yield and genetic gain in plant breeding programs is genomic prediction (GP). Genomic prediction is a technique where molecular marker information and phenotypic data are used to predict the phenotype (eg, yield) of individuals for which only marker data are available. Higher prediction accuracy can be achieved not only by using efficient models but also by using quality molecular marker and phenotypic data. The steps of a typical quality control (QC) of marker data include the elimination of markers with certain level of minor allele frequency (MAF) and …

Ponderosa Pine Regeneration,Wildland Fuels Management, And Habitat Conservation: Identifying Trade-Offs Following Wildfire, Victoria M. Donovan, Caleb P. Roberts, Carissa L. Wonkka, David A. Wedin, Dirac L. Twidwell Jan 2019

Ponderosa Pine Regeneration,Wildland Fuels Management, And Habitat Conservation: Identifying Trade-Offs Following Wildfire, Victoria M. Donovan, Caleb P. Roberts, Carissa L. Wonkka, David A. Wedin, Dirac L. Twidwell

Department of Agronomy and Horticulture: Faculty Publications

Increasing wildfires in western North American conifer forests have led to debates surrounding the application of post-fire management practices. There is a lack of consensus on whether (and to what extent) post-fire management assists or hinders managers in achieving goals, particularly in under-studied regions like eastern ponderosa pine forests. This makes it difficult for forest managers to balance among competing interests. We contrast structural and community characteristics across unburned ponderosa pine forest, severely burned ponderosa pine forest, and severely burned ponderosa pine forest treated with post-fire management with respect to three management objectives: ponderosa pine regeneration, wildland fuels control, and …

The North Central Education and Research Activity Committee (NCERA-59) was formed in 1952 to address how soil organic matter formation and management practices affect soil structure and productivity. It is in this capacity that we comment on the science supporting soil quality and associated soil health assessment for agricultural lands with the goal of hastening progress in this important field. Even though the suite of soil quality indicators being applied by U.S. soil health efforts closely mirrors the “minimum data set” we developed and recommended in the mid-1990s, we question whether the methods or means for their selection and development …

Selection Of Bread Wheat For Low Grain Cadmium Concentration At The Seedling Stage Using Hydroponics Versus Molecular Markers, Caixia Liu, Mary J. Guttieri, Brian M. Waters, Kent M. Eskridge, P. Stephen Baenziger Jan 2019

Selection Of Bread Wheat For Low Grain Cadmium Concentration At The Seedling Stage Using Hydroponics Versus Molecular Markers, Caixia Liu, Mary J. Guttieri, Brian M. Waters, Kent M. Eskridge, P. Stephen Baenziger

Department of Agronomy and Horticulture: Faculty Publications

The excessive accumulation of Cd in harvested crops grown on high-Cd soils has increased public concerns for food safety. Due to the high consumption of bread wheat (Triticum aestivum L.) per capita, high concentrations of Cd in wheat grain can significantly affect human health. Breeding is a promising way to reduce grain Cd concentration. However, a lack of efficient selection methods impedes breeding for low grain Cd concentration in bread wheat. In this study, a recombinant inbred population segregating for grain Cd concentration was used to assess the efficacy of two selection methods for decreasing grain Cd concentration in …
