The End Of Intuition-Based High-Crime Areas, Ben Grunwald, Jeffrey A. Fagan

In 2000, the Supreme Court held in Illinois v. Wardlow that a suspect’s presence in a “high-crime area” is relevant in determining whether an officer has reasonable suspicion to conduct an investigative stop. Despite the importance of the decision, the Court provided no guidance about what that standard means, and over fifteen years later, we still have no idea how police officers understand and apply it in practice. This Article conducts the first empirical analysis of Wardlow by examining data on over two million investigative stops conducted by the New York Police Department from 2007 to 2012.

Limiting future temperature increases and associated climate change requires immediate action to prevent additional carbon dioxide being released into the atmosphere and to lower the existing atmospheric carbon dioxide load. This could be advanced through carbon capture and storage (CCS), which involves collecting carbon dioxide that would otherwise be released by power plants or similar facilities and injecting it into underground geologic formations, where it will remain permanently sequestered. The techniques developed for CCS can also be used to sequester carbon dioxide that has been removed from the atmosphere using direct air capture or other negative emission technologies. Past CCS …

Are the Due Process and Equal Protection clauses interconnected? Justice Kennedy in Obergefell v. Hodges, the Supreme Court case holding the fundamental right to marry includes the right to a same-sex marriage, stated that they are profoundly connected in that each clause “may be instructive as to the meaning and reach of the other.” But exactly what instruction each doctrine might afford the other, Justice Kennedy did not say. An Examination Of The Lethality Assessment Program (Lap): Perspectives On Implementation, Helpseeking, And Victim Empowerment, Margaret E. Johnson

The Lethality Assessment Program (LAP) aims to empower law enforcement officers to screen victims of domestic violence for potential lethality and connect them to service providers. This research surveyed domestic violence victims seeking legal services (n = 141) to assess whether LAP receipt is associated with greater rates of self-protective measures, service use, or empowerment, and to examine victims’ perspectives on the LAP process. Findings indicate no relationship between receipt of the LAP and use of self-protective measures or victim empowerment, mixed evidence between receipt of the LAP and service utilization, and room for improvement regarding how law enforcement …

Preventing Drunk Flying: A Legislative Solution, John Sivils

Drunk flying poses a serious safety risk to airline passengers. The current system of detecting pilot intoxication and preventing drunk flying relies on the vigilance of coworkers, and statutes prohibiting “operating” an airplane while intoxicated. Courts have stretched the meaning of “operating” to criminalize pre-flight conduct, such as fueling and visual airplane checks. When viewed in conjunction with courts’ inconsistent and varied application of preemption doctrine to federal and state regulations of flying, it is evident that courts are tightening control over flight and pre-flight activities through complex judicial interpretation of facially simple statutes. วิทยานิพนธ์ฉบับนี้มีวัตถุประสงค์เพื่อศึกษาเปรียบเทียบหลักเกณฑ์การปล่อยชั่วคราวตามกฎหมายที่เกี่ยวข้องของประเทศไทยและต่างประเทศ เพื่อแสวงหาแนวทางในการปรับปรุงแก้ไขหลักเกณฑ์การพิจารณาคำร้องขอปล่อยชั่วคราวที่เหมาะสมในการนำมาใช้กับการปล่อยชั่วคราวในประเทศไทยเพื่อสร้างหลักประกันด้านความปลอดภัยแก่ผู้เสียหายและสังคม จากการศึกษาพบว่า หลักเกณฑ์ในการพิจารณาคำร้องขอปล่อยชั่วคราวตามประมวลกฎหมายวิธีพิจารณาความอาญานั้นไม่สามารถที่จะประเมินความเสี่ยงได้ว่าผู้ต้องหาหรือจำเลยนั้นจะไปกระทำความผิดซ้ำหรือจะก่อเหตุร้ายประการอื่นหรือไม่ เนื่องจากศาลต้องพิจารณาคำร้องขอปล่อยชั่วคราวโดยเร็วอันเป็นเหตุให้ศาลไม่อาจรวบรวมข้อมูลของผู้ต้องหาหรือจำเลยได้อย่างครบถ้วน คงมีเพียงเหตุตามข้อหาที่ปรากฎอยู่ในคำร้องขอปล่อยชั่วคราว คำฟ้อง และคำร้องขอฝากขังเท่านั้น เมื่อพิจารณาจากหลักเกณฑ์การพิจารณาคำร้องขอปล่อยชั่วคราวและเหตุที่จะไม่อนุญาตให้ปล่อยชั่วคราว รวมถึงรูปแบบการพิจารณาคำร้องขอปล่อยชั่วคราวของประเทศสกอตแลนด์ ประเทศอังกฤษ ประเทศสวีเดน สหรัฐอเมริกา และ ประเทศออสเตรเลีย แล้วจะเห็นได้ว่าประเทศเหล่านี้มีการกำหนดหลักเกณฑ์ในการพิจารณาคำร้องขอปล่อยชั่วคราวที่หลากหลาย เช่น การกำหนดความผิดที่จะไม่ให้ปล่อยชั่วคราว และการแสดงเหตุที่ไม่ควรถูกคุมขัง เป็นต้น ข้อเสนอแนะของการศึกษานี้ คือ ควรมีการแก้ไขเพิ่มเติมหลักเกณฑ์ในการพิจารณาคำร้องขอปล่อยชั่วคราว เช่น ลักษณะและอุปนิสัยของผู้ต้องหาหรือจำเลย เป็นต้น และเหตุที่ไม่ควรให้ปล่อยชั่วคราวคือ ผู้ต้องหาหรือจำเลยอยู่ระหว่างการพิจารณาคดีอื่น นอกจากนี้ควรมีการกำหนดความผิดที่จะไม่ให้ปล่อยชั่วคราวได้ คือ ความผิดต่อชีวิต และความผิดเกี่ยวกับเพศ รวมถึงมีการกำหนดรูปแบบการพิจารณาคำร้องขอปล่อยชั่วคราว โดยกำหนดให้ผู้ต้องหาหรือจำเลยมีหน้าที่ต้องแสดงเหตุอันควรที่ศาลควรมีคำสั่งอนุญาตให้ปล่อยชั่วคราว จากนั้นศาลจึงจะพิจารณาคำร้องขอปล่อยชั่วคราวตามหลักเกณฑ์ที่กำหนดต่อไป ในขณะเดียวกันพนักงานสอบสวนหรือพนักงานอัยการจะต้องแสดงข้อมูลให้ศาลเห็นว่าผู้ต้องหาหรือจำเลยนั้นมีความเสี่ยงที่จะหลบหนีหรือก่อเหตุร้ายประการอื่นด้วย

วิทยานิพนธ์ฉบับนี้มีวัตถุประสงค์เพื่อศึกษาขอบเขตของความผิดฐานเหยียดหยามศาสนาตามประมวลกฎหมายอาญา โดยมุ่งศึกษาถึงอิทธิพลและแนวคิดในการบัญญัติกฎหมายดังกล่าว นอกจากนั้นยังศึกษาเชิงเปรียบเทียบความผิดฐานดังกล่าวกับบทบัญญัติของกฎหมายที่เกี่ยวข้องกับการเหยียดหยามศาสนาในต่างประเทศ เพื่อนำมาวิเคราะห์เปรียบเทียบ และเสนอแนะแนวทางที่เหมาะสมในการปรับปรุงกฎหมายในความผิดฐานเหยียดหยามศาสนา จากการศึกษาพบว่า ความผิดฐานเหยียดหยามศาสนาที่ปรากฏอยู่ในประมวลกฎหมาย อาญานั้น ส่วนหนึ่งได้รับอิทธิพลมาจากประมวลกฎหมายอาญาของสาธารณรัฐอินเดีย เนื่องจากเป็นต้นร่างของความผิดฐานดังกล่าวในยุคที่มีการพิจารณาร่างประมวลกฎหมายลักษณะอาญา ร.ศ. 127 อีกส่วนหนึ่งนั้นได้รับอิทธิพลมาจากทางสังคม ไม่ว่าจะเป็นในเรื่องของศาสนาและวัฒนธรรม โดยเฉพาะศาสนาพราหมณ์-ฮินดู และศาสนาพุทธ ส่งผลให้ขอบเขตของวัตถุแห่งการกระทำในความผิดฐานเหยียดหยามศาสนาจำกัดอยู่ที่วัตถุและสถานที่ในทางศาสนาเท่านั้น นอกจากนั้นแล้ว ความผิดฐานดังกล่าวโดยเฉพาะในส่วนของพฤติการณ์ประกอบการกระทำเป็นส่วนที่ก่อให้เกิดความไม่ชัดเจนแน่นอนในตัวบทกฎหมาย อันเป็นการขัดต่อหลักการพื้นฐานของกฎหมายอาญาที่ต้องมีความชัดเจนและแน่นอน อีกทั้งความผิดฐานดังกล่าวในกฎหมายของต่างประเทศมุ่งที่จะเอาผิดแก่ผู้กระทำที่มีเจตนาพิเศษในความผิดฐานดังกล่าวทั้งสิ้น ในส่วนของบทกำหนดโทษตามความผิดฐานดังกล่าว ประเทศไทยมีการกำหนดอัตราโทษขั้นต่ำไว้ ซึ่งเป็นการจำกัดดุลพินิจของผู้พิพากษาที่จะพิพากษาความผิดดังกล่าวให้เกิดความเหมาะสมระหว่างการกระทำกับโทษที่ผู้กระทำควรจะได้รับ ซึ่งแตกต่างกับกฎหมายของต่างประเทศที่ไม่มีการกำหนดอัตราโทษขั้นต่ำไว้ ด้วยเหตุดังที่กล่าวมาข้างต้น ผู้วิจัยจึงทำการเสนอให้มีการแก้ไขเพิ่มเติมบทบัญญัติในส่วนของความผิดฐานเหยียดหยามศาสนาตามประมวลกฎหมายอาญา โดยแก้ไขเปลี่ยนแปลงในส่วนของพฤติการณ์ประกอบการกระทำ โดยเปลี่ยนมาเป็นเจตนาพิเศษเพื่อให้เกิดความชัดเจนในตัวบทบัญญัติ อีกทั้งยังแก้ไขในส่วนของอัตราโทษขั้นต่ำในความผิดฐานดังกล่าวให้มีความเหมาะสมยิ่งขึ้น

วิทยานิพนธ์ฉบับนี้มุ่งศึกษาถึงแนวคิด ทฤษฎี การคุ้มครองข้อมูลส่วนบุคคลของบุคคลที่เสียชีวิต และหลักเกณฑ์การคุ้มครองข้อมูลส่วนบุคคลของบุคคลที่เสียชีวิตในต่างประเทศ ทั้งในกลุ่มประเทศที่กฎหมายคุ้มครองข้อมูลส่วนบุคคลไม่มีบทบัญญัติคุ้มครองถึงบุคคลที่เสียชีวิต และประเทศที่กฎหมายคุ้มครองข้อมูลส่วนบุคคลมีบทบัญญัติคุ้มครองถึงบุคคลที่เสียชีวิต เพื่อนำมาศึกษาเปรียบเทียบกับกฎหมายคุ้มครองข้อมูลส่วนบุคคลในประเทศไทยและกฎหมายอื่น ๆ ที่เกี่ยวข้องเพื่อชี้ให้เห็นถึงปัญหาเกี่ยวกับการคุ้มครองข้อมูลส่วนบุคคลของบุคคลที่เสียชีวิตในประเทศไทย จากการศึกษาพบว่าในทางทฤษฎีนั้น ข้อมูลส่วนบุคคลของผู้เสียชีวิตได้รับการรับรองอย่างมั่นคงโดยเฉพาะอย่างยิ่งภายใต้แนวคิดว่าด้วยศักดิ์ศรีความเป็นมนุษย์สำหรับในประเทศที่กฎหมายว่าด้วยข้อมูลส่วนบุคคลไม่ได้รับรองและคุ้มครองข้อมูลส่วนบุคคลของผู้ที่เสียชีวิตโดยตรงนั้น ปรากฏว่าศาลใช้วิธีการนำเอาศักดิ์ศรีความเป็นมนุษย์มาตีความรวมกับกฎหมายที่เกี่ยวข้องเพื่อคุ้มครองข้อมูลส่วนบุคคลของบุคคลที่เสียชีวิต นอกจากนี้ ยังปรากฏว่ามีกฎหมายที่เกี่ยวข้องบางฉบับคุ้มครองข้อมูลของผู้เสียชีวิตโดยตรงด้วยได้แก่ พระราชบัญญัติลิขสิทธิ์และงานจิตกรรม ค.ศ. 1907 (Kunsturhebergesetz 1907: KUG) ประมวลกฎหมายอาญาว่าด้วยความลับทางวิชาชีพ และสำหรับประเทศที่กฎหมายคุ้มครองข้อมูลส่วนบุคคลมีบทบัญญัติคุ้มครองถึงบุคคลที่เสียชีวิต บทบัญญัติดังกล่าวมีความเป็นเอกลักษณ์แตกต่างกันไปในแต่ละประเทศ แต่ก็สามารถให้ความคุ้มครองข้อมูลส่วนบุคคลของผู้ที่เสียชีวิตได้อย่างมีประสิทธิภาพ นอกจากนี้ ในบรรดาประเทศเหล่านี้ยังกำหนดบุคคลผู้สามารถฟ้องคดีหรือดำเนินการร้องขอความคุ้มครองแก่ข้อมูลของบุคคลผู้เสียชีวิตเอาไว้อย่างชัดเจนด้วย อย่างไรก็ตาม ในกรณีของประเทศไทยนั้น พระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 ซึ่งเป็นกฎหมายแม่แบบกลับไม่ให้ความคุ้มครองข้อมูลส่วนบุคคลของบุคคลที่เสียชีวิต นอกจากนี้ กฎหมายอื่น ๆ ที่เกี่ยวข้องยังไม่สามารถถูกนำมาใช้เพื่อคุ้มครองข้อมูลของบุคคลที่เสียชีวิตโดยตรงได้ ดังนั้นวิทยานิพนธ์ฉบับนี้จึงขอเสนอแนวทางแก้ไขสองแนวทางที่จะทำให้สิทธิในข้อมูลส่วนบุคคลของบุคคลที่เสียชีวิตได้รับการคุ้มครองในประเทศไทย ประการแรก ในช่วงที่ยังไม่มีการแก้ไขกฎหมายหรือในระหว่างที่มีการแก้ไขกฎหมาย ควรจะนำเอาแนวคิดว่าด้วยศักดิ์ศรีความเป็นมนุษย์มาใช้เพื่อเป็นเครื่องมือหลักในการตีความกฎหมายที่เกี่ยวข้องเพื่อคุ้มครองข้อมูลส่วนบุคคลของบุคคลที่เสียชีวิต ในขณะที่ข้อเสนอประการที่สองนั้น คือการเสนอให้มีการแก้ไขพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 และพระราชบัญญัติข้อมูลข่าวสารของราชการ พ.ศ. 2540 เพื่อให้การคุ้มครองครอบคลุมถึงข้อมูลของบุคคลที่เสียชีวิต และกำหนดตัวบุคคลที่สามารถดำเนินการเรียกร้องการคุ้มครองข้อมูลของผู้เสียชีวิตแทนผู้เสียชีวิตเอาไว้ด้วย

This work aims to develop the treatment process for the removal of total petroleum hydrocarbons (TPH) from DC by using the combination of air floatation and stirring processes, called Flotation Enhanced Stirred Tank (FEST). Initially, stirring, induced air flotation (IAF), and dissolved air flotation (DAF) are individually investigated over DC washing. Afterward, the combination process between “stirring-DAF” and “stirring-IAF-DAF” are continuously observed for finding the better conditions of TPH removal efficiency. To optimize the operational terms of the treatment process, the Design of Experiment (DOE) is applied to design the experimental conditions within the central composite design-response surface methodology (CCD-RSM). …

“EGAT Eco Plus” เป็นโครงการเมืองอัจฉริยะโดยการไฟฟ้าฝ่ายผลิตแห่งประเทศไทย (กฟผ.) ซึ่งในการออกแบบโครงสร้างพื้นฐานระบบสื่อสารสำหรับเมืองอัจฉริยะ กฟผ. สนญ. จะต้องรองรับการออกแบบเป็นโมดูลเพื่อให้การออกแบบมีความยืดหยุ่นสามารถปรับเปลี่ยนได้อย่างรวดเร็วตามความต้องการใช้งานที่เปลี่ยนไป วิทยานิพนธ์ฉบับนี้จึงนำเสนอแบบจำลองเพื่อการออกแบบระบบโครงสร้างพื้นฐานคลาวด์สำหรับเมืองอัจฉริยะรักษ์สิ่งแวดล้อม: กรณีศึกษาของการไฟฟ้าฝ่ายผลิตแห่งประเทศไทย และแนวคิดของตัวควบคุมระบบคลาวด์เมืองอัจฉริยะ โดยผู้วิจัยใช้หลักการทางคณิตศาสตร์แบบกำหนดการเชิงเส้น (linear programming: LP) เพื่อหาคำตอบการจัดสรรทรัพยากรของศูนย์ข้อมูลให้กับคำร้องขอเพื่อให้บริการแบบสีเขียวสูงสุด โดยการใช้พลังงานสีเขียวในศูนย์ข้อมูลจากแหล่งผลิตพลังงานหมุนเวียนในพื้นที่สูงสุดเพื่อสร้างการคำนวณรักษ์สิ่งแวดล้อมในเมืองอัจฉริยะ และผู้วิจัยได้ทำการเปรียบเทียบกับวิธีการจัดสรรภารกิจที่มีใช้งานอยู่ในปัจจุบัน คือวิธีวนรอบ (round robin) อีกทั้งเพื่อให้สอดคล้องกับนโยบายการลดปริมาณคาร์บอนฟุตพริ้นท์ของเมืองอัจฉริยะ กฟผ. จึงเป็นที่มาให้ผู้วิจัยศึกษาองค์ความรู้และเกณฑ์การประเมินเพื่อสร้างศูนย์ข้อมูลแบบยั่งยืนรักษ์สิ่งแวดล้อม คือ สัมประสิทธิ์พลังงานสีเขียว ค่าเฉลี่ยการใช้พลังงานสีเขียวของภารกิจแต่ละประเภท ปริมาณคาร์บอนฟุตพริ้นท์จากพลังงานไฟฟ้า ซึ่งสามารถใช้เป็นเกณฑ์ชี้วัดศูนย์ข้อมูลแบบยั่งยืนของ กฟผ. สนญ. ได้ โดยสรุปแบบจำลองสามารถนำมาประยุกต์ใช้งานจริงได้เพื่อรองรับโปรแกรมประยุกต์ของเมืองอัจฉริยะ กฟผ. สนญ. โดยการปรับลักษณะโปรแกรมประยุกต์แต่ละชนิดที่จะมีใช้งานในเมืองอัจฉริยะ ได้แก่ ชนิดของภารกิจ ขนาดแกนคำนวณที่ต้องการใช้งาน ขนาดของเครือข่ายที่ต้องการ ขนาดของหน่วยเก็บ ขนาดของข้อมูล และค่าการประวิงเวลาในระบบสื่อสารสูงสุด รวมทั้งคุณลักษณะของศูนย์ข้อมูล ได้แก่ ความจุของแกนคำนวณ ขนาดเครือข่ายที่สามารถให้บริการได้ ขนาดหน่วยเก็บ ซึ่งพารามิเตอร์เหล่านี้เป็นส่วนสำคัญและเกี่ยวข้องในการให้บริการระบบคลาวด์แก่หน่วยงานหรือลูกค้าที่อยู่ตามอาคารต่าง ๆ ใน กฟผ. สนญ. อีกทั้งสามารถใช้กับการออกแบบโครงสร้างพื้นฐานคลาวด์ที่มีการใช้พลังงานจากแหล่งพลังงานหลายแหล่งที่แตกต่างกัน เช่น แหล่งผลิตพลังงานจากกริด หรือแหล่งผลิตพลังงานหมุนเวียนในพื้นที่ และหน่วยกักเก็บพลังงานสำรอง เป็นต้น

My dissertation consists of three studies. My first study builds a literature review of state and local general-purpose government financial reporting research (including bond and financial condition research) after Governmental Accounting Standards Board (GASB) Statement No. 34’s issuance in 1999. The research referenced shows that reporting information after GASB 34 has, and will, continue to shape governmental financial reporting studies.

My second study examines both the rearrangement of governmental fund balance amounts after GASB Statement No. 54 and the factors associated with updated fund balance categories. My pooled ordinary least squares (OLS) regressions show that pre-standard “unreserved” fund balances had …

Forests in the western United States have experienced a shift from historical disturbance regimes in the past century. Many of these changes were induced by European settlers logging the forests and suppressing fires. In the past, the dry mixed conifer forests of California’s Sierra Nevada mountains experience frequent, low to mixed severity fires. This fire regime helped maintain a heterogeneous landscape comprised of groups of trees and openings. However, due to fire suppression and high grading logging, forest structure has changed; there are less openings and more small, fire-intolerant trees that can carry a fire into the forests crown. Defendants whose underlying crime is the result of a substance use disorder or a mental health disorder can choose to be diverted into a specialty court, where they receive treatment instead of punishment. Following a sudden or unexpected death, coroners often communicate the death to the next-of-kin. Death notifications may occur in hospitals, assisted living or dying facilities, homes, offices or workplaces, correctional facilities, schools, or other locations. A death notification has been perceived by outsiders and many researchers as a one-time, unilateral death-telling event. I argue, instead, death notifications are a series of social interactions and processes necessitating multiple actors and mechanisms.
