Presidential Laws And The Missing Interpretive Theory, Tara Leigh Grove
Presidential Laws And The Missing Interpretive Theory, Tara Leigh Grove
Articles
There is something missing in interpretive theory Recent controversies"”involving for example the first travel ban and funding for sanctuary cities"”demonstrate that presidential "laws" executive orders proclamations and other directives raise important questions of meaning Yet while there is a rich literature on statutory interpretation and a growing one on regulatory interpretation there is no theory about how to discern the meaning of presidential directives Courts for their part have repeatedly assumed that presidential directives should be treated just like statutes But that cannot be right Theories of interpretation depend on both constitutional law and institutional setting For statutes the relevant …

The Legalization Of Street Vending In Los Angeles: Exploring The Impact On Vendors And Their Livelihoods, Karen Alpuche Caceres
Pomona Senior Theses
This thesis aims to unpack the impact the legalization of street vending and the subsequent regulation had on sidewalk vendors. Although legalization occurred state-wide through Senate Bill 946 in September of 2017, the rules and regulations for vending were passed at a city-level, and I am focusing on the City of Los Angeles specifically. Through interviews with government officials, non-profit partners and advocates, and vendors from different parts of the City, I analyze information around the policy itself, its history, and the impact it has and is expected to have on vendors and their businesses. While vendors have been central …

Recognised Biosecurity Group Annual Reports
The past 12 months has seen the Eastern Wheatbelt Biosecurity Group keep up the momentum of the past few years and contribute considerably to the betterment of the state’s landholders in controlling predominately wild dogs. With landholders funding the biosecurity groups under the BAM Act through a declared pest rate it is pleasing to note that this money is hitting the ground and making a real and tangible difference through the work of the Licensed Pest Management Technicians employed by the EWBG.

Master of Urban and Regional Planning Capstone Projects
This plan offers Powhatan County a series of analyses and recommendations to maintain their rural character. Because of its proximity to the City of Richmond and other more-populated localities, Powhatan has been experiencing accelerated growth recently compared to historically. This document analyzes past development trends, current development trends, and projects future development trends and density scenarios. It pays close attention to the county’s predetermined Special Areas as locales for growth. Following the analyses, there were numerous obvious suggestions to be made to the county’s current growth management tools that could help them strengthen their ability to maintain and preserve their …

Ethics Of Care, Emotional Work, And Collective Action Of Solidarity: The Patronas In Mexico, Verónica Montes, María Dolores Paris Pombo
Sociology Faculty Research and Scholarship
In this paper, we examine the mobilization of the Patronas, a group of Mexican women who have fed thousands of Central American migrants over the past two decades. We argue that the Patronas’ work of feeding and caring for migrants goes beyond essentializing these women’s work as just housewives, mothers, and caregivers. Furthermore, we assert that through these care activities, the Patronas exert a feminist ethic of care that is understood as a set of practices based on trust, reciprocity, and solidarity. The Patronas’ praxis of caring for the migrants resonates with people and attracts hundreds of volunteers to join …

Unmanned aerial systems (UAS) can advance understanding of the atmosphere and improve weather prediction, but public perceptions of drone technologies need to be assessed to ensure successful societal integration. Our qualitative study examines public perceptions of UAS technology, and the associated risks and benefits, for such civilian purposes. We examine how people form perceptions, and discuss the implications of these perceptions for UAS design and regulation. Our study finds the public to be favorable toward UAS used for “noble” purposes. Participant views are informed by popular media, personal experiences, comparisons between technologies, and consideration of the trustworthiness of the users, …

Since its founding, the United States has relied on citizen participation to govern at the local, state, and national levels. This civic engagement ensures that representative democracy will continue to flourish and that people will continue to influence government. The right of citizens to participate in government is an important feature of democracy, and over the centuries many have fought to acquire and defend this right. During the American Revolution (1775–1783), British colonists fought for the right to govern themselves. In the early nineteenth century, agitated citizens called for the removal of property requirements for voting so poor white men …

Social Freedom, Democracy And The Political: Three Reflections On Axel Honneth's Idea Of Socialism, Stephen W. Sawyer, William J. Novak, James T. Sparrow
Articles
Axel Honneth’s Idea of Socialism is an important clarion call for an urgent rethinking of the possibilities of a socialism for the twenty-first century. One of the most surprising and satisfying aspects of Axel Honneth’s timely new book is its recovery of the continued vitality of John Dewey’s pragmatic democratic philosophy. These reflections on Honneth’s use of John Dewey for democratizing social freedom, take stock of and explore the political limits of Honneth’s social reconstruction.

For over a decade, my research has focused on trying to answer one simple question: how did the United States, home to about 5% of the world’s population, come to house nearly 25% of its prisoners?1 We were not always the world’s largest jailer; as recently as the 1970s, our incarceration rate was largely indistinguishable from those in other liberal democracies. Yet starting in the mid-1970s, as Figure 1 shows, that rate started to slowly—but steadily and relentlessly—grow, until by the late 2000s it rivaled and then surpassed even the rates seen in autocratic countries like Cuba and Belarus and …
The Social Arena Of Mental Health Act Apprehensions: An Examination Of Partnership Between Police And Hospital Services, Amanda Boyd
Theses and Dissertations (Comprehensive)
Improvement in the collaboration between police and emergency hospital services in responding to citizens in mental health (MH) crisis has been identified as vital by researchers and service organizations alike (Human Services and Justice Coordinating Committee, 2013). Research suggests that collaboration between these two services is inhibited by a lack of clear communication, protection of patient privacy, insufficient training, siloing of services, and safety concerns for patients and staff (Cotton & Coleman, 2010). Consequences of inadequate cooperation between police and hospital services has resulted in lengthy emergency room (ER) wait times for those apprehended by police officers under the Mental …
Hooking In, Activating And Extending: An Institutional Ethnography Of The Family Violence Project Of The Waterloo Region, Ian Degeer
Theses and Dissertations (Comprehensive)
Domestic violence (DV) is a significant social issue requiring a thoughtful and dedicated response. At present, many social service agencies and governmental bodies have a responsibility to provide a response to DV. Increasingly, innovative service delivery models are being used to construct more coherent responses to the violence. One such model, originates from the United States is entitled the Family Justice Centre model. This model of service delivery consists of the agencies responding to DV residing within the same building. The goal of this model is to improve the access to service for victims and to improve collaborative efforts between …

Exploring Case Variables Predictive Of Histories Of Mental Illness In Incidents Of Police-Involved Firearm Fatalities In Canada, Michael Ouellet
Theses and Dissertations (Comprehensive)
The tragedy of police-involved fatalities resulting in the death of individuals with serious mental illness has been brought to the forefront by recent high-profile incidents that have galvanized public concern and criticism that law enforcement organizations must improve their response to people in psychiatric crisis. This thesis employed descriptive and hierarchical logistic regression analyses to understand cases of police-involved shooting fatalities in Canada between 2006 and 2015. More precisely, this research focused on determining whether particular variables predicted group membership between victims with and without a history of mental illness. The General Aggression Model (GAM; Allen, Anderson, & Bushman, 2018) …
Using Social Media To Engage Toronto Communities For Resiliency And Stress Planning, Martha Ta
Using Social Media To Engage Toronto Communities For Resiliency And Stress Planning, Martha Ta
Theses and Dissertations (Comprehensive)
As Toronto’s low-income areas grow, the city’s neighbourhoods experience a segregation by low- and high-income, contributing to chronic stress as environmental determinants and leading to negative health outcomes and chronic diseases. This study identified Crescent Town as one of the Toronto neighbourhoods with potentially high levels of chronic emotional stress through an analysis of emotions indicated by Tweets, as well as triangulation with administrative data describing relevant neighbourhood indicators. Crescent Town community members (n=23) were engaged using concept mapping to identify existing neighbourhood stressors and assets and empowered to strategize solutions. The ten-cluster solution created with six clusters describing neighbourhood …

Promoting Nurses Management Of Night Shift Sleepiness, Sunday Iken Okundolor
Walden Dissertations and Doctoral Studies
Nurses are largely unaware of the problems of night-shift-nurse sleepiness and available strategies to manage night-shift sleepiness. The purpose of this project was to examine nurses' self-perception, awareness of sleepiness, and current strategies to manage this problem in the emergency medicine department of a major academic hospital in the western United States. The validated de-identified Karolinska Sleepiness Scale (KSS) was used to measure the prevalence and intensity of night shift nurses' sleepiness prior to the development of an educational program on strategies to manage sleepiness. Of the 164 registered nurses surveyed, 72 (43.9%) reported sleepiness greater than 7 on the …

A Case For United States Overhaul Of Its Current Biotechnology Regulation Scheme Through The Implementation Of Biotechnology-Specific Legislation To Clarify Existing Uncertainties Seen In The Collective Framework, Jordan Emmert
Cardozo International & Comparative Law Review
The U.S. biotechnology regulatory framework, established by the 1986 Coordinated Framework and its 1992 Update, is outdated and insufficient to address modern biotechnology products, particularly genetically modified organisms (GMOs). While efforts such as the Obama Administration’s 2015 Memorandum and the 2016 Update aimed to modernize the system, they failed to resolve jurisdictional ambiguities and regulatory gaps, leading to inconsistent agency enforcement and public distrust. The note argues that updating the statutory framework is essential to align U.S. regulations with international norms, ensure public safety, and maintain global competitiveness.
Abolishing The Private Prison Industry's Evolving Influence On Immigrant Oppression, Antonio Iglesias
Abolishing The Private Prison Industry's Evolving Influence On Immigrant Oppression, Antonio Iglesias
Cardozo Journal of Equal Rights & Social Justice
The note argues that the private prison industry significantly influences immigration policies, leading to increased detention and oppression of immigrants. It advocates for abolishing private prison contracts, citing the negative social and humanitarian impacts, and suggests that states like Arizona should adopt legislation similar to Illinois and New York to protect immigrants' rights.
Shared Value Over Fair Use: Technology, Added Value, And The Reinvention Of Copyright, Amy Whitaker
Shared Value Over Fair Use: Technology, Added Value, And The Reinvention Of Copyright, Amy Whitaker
Cardozo Arts & Entertainment Law Journal
The protection of fair use in the arts has become an inflexible binary. Either artist Shepard Fairey has permission to use the Associated Press photograph of Barack Obama to create the Hope Poster, or he has stolen the image in violation of copyright. This legal framework is rigid, inaccurate, and creatively unsafe. Yet it is the interpretation, not the doctrine itself, that needs shifting. The copyright statute already includes an overlooked "value" test that can more accurately reflect collaboration and sampling in the digital age. And yet instead, some scholars have responded to digital copying by suggesting we throw out …

Unbundling Property In Boston’S Urban Food Commons, Oona Morrow, Deborah Martin
Unbundling Property In Boston’S Urban Food Commons, Oona Morrow, Deborah Martin
Geography
Households and community organizations are involved in the creation, use, care, and management of urban spaces, including through food practices such as planting, foraging, harvesting, weeding and pruning at the ambiguous edges of public and private property. Drawing on case studies in Boston, Massachusetts, we examine how commons are articulated through these practices, particularly in relation to multiple dimensions of property rights. Specifically, we ask how food practices can open urban spaces to negotiations around access, responsibility, care, and ownership, especially when (property) ownership is not an end-goal, but a circumstance shaping other practices. Using interviews and participant observation of …
Safer Well Water: Exploring Environmental Screening Efforts For Family Child Care Homes, Devan Carr
Safer Well Water: Exploring Environmental Screening Efforts For Family Child Care Homes, Devan Carr
Public Health Theses
Background
Children are widely recognized as particularly vulnerable to the harmful effects of environmental contaminants. As such, the physical environment in which they live, play, and breathe can have a significant impact on their health and development throughout their life. In 2007, Connecticut's Department of Public Health established the Screening Assessment for Environmental Risk (SAFER) program as a proactive, non-regulatory approach to screening child care centers in the state. Several screening methods are implemented in this voluntary process, including the identification of any hazardous waste sites within 1/8 of a mile of a proposed child care site. While successful, the …
