This article will examine the history of the stop-and-frisk policy in New York City, the similarities and differences between the child welfare system and the criminal legal system, and suggest ways that we can combat the misconceptions around safe parenting and the assumed need for child protective intervention.

African American men between the ages of 18-35 years are increasingly likely to die during arrests by police under the purview of procedural practices. Using procedural justice and critical race theory as the foundation, the purpose of this correlational study was to evaluate the statistical relationship between procedural justice, consent to police authority, and certain demographic characteristics including socioeconomic status and age in a large Metropolitan area in the southern United States. The Military Police Corps' active shooter preparedness plan is inadequate because several updated tactics, techniques, and procedures that have been developed over the past 20 years and implemented by civilian law enforcement agencies have not been incorporated, leaving the Corps less prepared during active shooter events. The purpose of this phenomenological study was to examine how Military Police Corps leaders trained their law enforcement and support personnel to respond to an active shooter event. Studies show that seat belt use by law enforcement officers is estimated to be at 50%, well below the national average. The purpose of this study was to explore what may be leading to reduced seat belt use by law enforcement patrol officers while also determining if different types of policies effect the level of seat belt usage by this population. The theoretical framework used in this study was Shafritz, Ott and Jang's theory of organizational culture and change. An inspector’s ability to correctly identify surface and internal defects in steel bridge components is critical to protecting public safety. Ensuring that inspectors are properly trained and adequately equipped to detect these defects in locations that are difficult to access and/or in unfavorable environmental conditions must be a high priority. While the Federal Highway Administration and individual state departments of transportation have guidelines for inspector qualifications, trainings, and certifications, there is very little emphasis placed on evaluating or “testing” a given inspector’s capability to characterize detect defects in the field. In November 2016, the American Association of State Highway and Transportation Officials (AASHTO) announced the Signal Phase and Timing (SPaT) challenge to state and local agencies to kick start infrastructure deployments for V2I communications. The challenge involved the deployment of Dedicated Short Range Communication (DSRC) infrastructure with SPaT broadcasts (current intersection signal light phase) on at least 20 signalized intersections in all of the 50 states by 2020. The Ferguson effect is a recent hypothesis that suggests police officers have been influenced by negative media coverage of police conduct. The problem this study addressed is how policing continues to deal with perception, civil liability, and accountability issues related to police misconduct when interacting with Latino and African-American communities. The research was conducted to examine influence the Ferguson effect may have had on the culture and perceptions of police officers in local police departments. Challenging and excitatory parenting behaviors play an important role in children’s development, particularly in regard to the development of selfregulation; however, no well-established measures of parent-child interactions exist that record such behaviors. In the current study, I compare two recently developed coding systems that intend to address this issue: the Risky Interaction Support and Challenging (RISC) and Marbach coding systems. A subset of videos from the New Parents Project (NPP) data set at 12 and 18 months was coded using both scales, then a factor analysis was conducted for each scale. This paper explores the ethics surrounding the conservation of damaged confederate monuments, specifically as educational tools for understanding their place in society and memory over time. Disproportionate police shootings of unarmed Black men have been a controversial topic of discussion in recent years. While Black men are 6% of the United States population, they make up almost half of the fatal police shootings each year. These figures indicate that policing tactics are depriving certain citizens of their right to live in peaceful societies where everyone experiences justice.

A nation’s economy and prosperity depend on an efficient and safe transportation network for public mobility and freight transportation. A country’s road network is recognized as one of the largest public infrastructure assets. About 93 percent of 2.6 million miles of paved roads and highways in the United States (U.S.) are surfaced with asphalt. Longitudinal roughness, pavement cracking, potholes, and rutting are the major reasons for rehabilitation of asphalt roads. With its decisions in Bell Atlantic Corp. v. Twombly and Ashcroft v. Iqbal in 2007 and 2009, the Supreme Court ushered in a new era of federal pleading standards. The old system of notice pleading was replaced by what has become known as plausibility pleading. In order to avoid dismissal, plaintiffs must now craft their complaints so that all nonconclusory allegations, taken as true, give rise to a claim that is plausible on its face. Return To Rehabilitation: Illinois’ Evolving Juvenile Sentencing Practices In Light Of Miller V. Alabama, Brad Taylor

In Miller v. Alabama, the U.S. Supreme Court held that the Eighth Amendment requires a court to, prior to sentencing juveniles to life-without-parole, consider mitigating factors attendant to youth. The Court noted that a life-without-parole sentence was only appropriate punishment for a juvenile when the juvenile’s act reflected true incorrigibility. Given the transient nature of youthful characteristics, like impetuosity, true incorrigibility is vanishingly rare. As such, after Miller, the imposition of life-without-parole sentences for juveniles should be similarly rare.

A Masterpiece Of Simplicity: Toward A Yoderian Free Exercise Framework For Wedding-Vendor Cases, Austin Rogers

The Free Exercise Clause was enacted to protect diverse modes of religious
practice. Yet certain expressions of free exercise have entailed concomitant
harm to those outside the religious community, especially LGBTQ persons.
This trend has been acutely present in the recent onslaught of wedding-vendor
cases: LGBTQ persons seek the enforcement of statutorily protected rights,
while religious objectors seek refuge from state intrusion under constitutional
shelter. Consequently, wedding-vendor cases present an area of law in which
free-exercise jurisprudence and anti-discrimination jurisprudence have been
clashing.
However, despite the primacy of religious freedom and equal protection in
American jurisprudence, courts analyze wedding-vendor cases …

วิทยานิพนธ์ฉบับนี้มีจุดมุ่งหมายเพื่อศึกษาถึงมาตรการทางกฎหมายในการกำกับดูแลเนื้อหาการแสดงความคิดเห็นทางการเมืองที่ถูกสร้างและนำเข้าสู่ระบบโดยผู้ใช้งานบนสื่อสังคมออนไลน์ เนื่องจากการแสดงคิดเห็นทางการเมืองบนสื่อสังคมออนไลน์กลายเป็นเครื่องมือสำคัญในการกระตุ้นความสนใจในการอภิปรายประเด็นสาธารณะ จนนำไปสู่การเชื่อมโยงความคิดของผู้คนจนสามารถสร้างแรงขับเคลื่อนทางสังคมและการเมืองได้ แต่ในขณะเดียวกัน ก็เป็นดาบสองคมที่อาจเป็นเครื่องมือสร้างการสื่อสารในทางลบ ไปจนถึงการสร้างประเด็นเพื่อเน้นย้ำความแตกแยกทางความคิดให้มากขึ้นได้เช่นกัน ด้วยเหตุนี้รัฐบาลในหลายประเทศ จึงได้มีมาตรการทางกฎหมายเพื่อควบคุมและป้องกันปัญหาดังกล่าว โดยมีบทบัญญัติที่ให้อำนาจรัฐสามารถดำเนินการบางประการอันมีผลต่อสิทธิเสรีภาพของประชาชนได้เท่าที่จำเป็นเท่านั้น แต่ในกรณีของรัฐบาลไทย โดยหน่วยงานผู้รับผิดชอบกลับใช้มาตรการทางกฎหมายดังกล่าวเพื่อควบคุม แทรกแซง และปิดกั้นข้อมูลรวมไปถึงการละเมิดเสรีภาพในการแสดงความคิดเห็นของประชาชน นอกจากนี้ยังมีเหตุการณ์ที่ทำให้เชื่อว่ามาตรการดังกล่าวได้ถูกทำให้เป็นกลไกในการใช้อำนาจรัฐเพื่อขจัดผู้มีความคิดเห็นต่างจากตน และเป็นเหตุให้รัฐบังคับใช้กฎหมายอย่างไม่เสมอภาคเท่าเทียมกัน โดยอาศัยช่องว่างความไม่ชัดเจนของถ้อยคำในบทบัญญัติและนโยบายของรัฐ มาเป็นเหตุผลในการลิดรอนสิทธิเสรีภาพขั้นพื้นฐานซึ่งเป็นเรื่องที่ไม่สอดคล้องกับหลักการคุ้มครองสิทธิเสรีภาพของประชาชน วิทยานิพนธ์ฉบับนี้จึงขอเสนอแนะให้มีการแก้ไขเพิ่มเติมมาตรการทางกฎหมาย ให้มีความชัดเจนในบทบัญญัติที่ให้อำนาจรัฐในการใช้ดุลยพินิจที่มีผลต่อการลิดรอนสิทธิเสรีภาพในการแสดงความคิดเห็นและการสื่อสารผ่านสื่อสังคมออนไลน์ของประชาชน ถึงความเหมาะสมต่อหลักการสิทธิและเสรีภาพอันรับรองไว้และตามหลักการที่กำหนดไว้ในกฎหมายสิทธิมนุษยชนระหว่างประเทศ รวมไปถึงเสนอให้มีมาตรการบางประการเพื่อคุ้มครองผู้ใช้งานให้มีความชัดเจนและเป็นรูปธรรม เพื่อให้การปกป้องและคุ้มครองสิทธิเสรีภาพของประชาชนเป็นไปตามเจตนารมณ์ของสิทธิเสรีภาพมากขึ้น

Researchers have primarily focused on the use of drones for military purposes. Yet, understanding how the use of drones influences domestic policymaking from the perspective of mass and elite opinion was generally absent from the academic literature. The purpose of this descriptive study was to explore and describe the perceptions of policy elites and the mass public on the impact of drone use on domestic policy. This Article is the first in a series of three articles in which I explain the cycle of misperception of sexual offenders that has encouraged the unconstitutional application of sexual offender laws, including civil commitment laws, in a false effort to quell public fear, protect children, and reduce sexual victimization. In this first Article of the series, I propose that this cycle of misperception and the resistance to the release of civilly committed sexual offenders may be, in part, the product of a novel phenomenon known as the “uncanny valley” effect.

In the past twenty years, the United States has witnessed over half of its states create marijuana laws that expressly contradict the federal government’s complete ban of the drug. Nine states have completely legalized marijuana for recreational use in the past five years alone. Meanwhile, much of the country remains staunchly opposed to legalization in any form. This difference between state and federal law has the largest negative impact on noncitizens, namely lawful permanent residents whom reside in states that follow the federal government’s complete ban. Preventing Tax-Exempt Propaganda: The Case For Defining The Second Prong Of The Methodology Test, Jordanne Miller

Under current Treasury Regulations, various propaganda groups throughout the United States are exempt from paying federal income tax. This is so because the current test used by the IRS to determine tax-exempt eligibility, the methodology test, is incapable of separating wild propaganda from viewpoints supported by facts.
The IRS created the methodology test in the late 1970s/early 1980s. Since then, groups denied tax-exempt status have repeatedly challenged its validity. The Strings In The Books Ain't Pulled And Persuaded: How The Use Of Improper Statistics And Unverified Data Corrupts The Judicial Process In Sex Offender Cases, Heather Ellis Cucolo, Michael L. Perlin

An examination of a range of judicial decisions involving sexual offender determinations reveals that, frequently, courts rely improperly on inaccurate and under-developed statistics as well as unverified and outdated information. This reliance, too often, underlies rulings that subject the sex offender to significant sanctions and loss of liberty. Additionally, the continuation of the testimonial script that all sex offenders are high recidivists, dangerous, compulsive and untreatable, contributes to the anti-therapeutic effect of shaming and humiliation. This results in isolation, seclusion, lack of dignity; also, it further trivializes the judicial process, and violates the tenants of therapeutic jurisprudence. Despite the “frightening …
