Background: In 2011, the Centers for Disease Control (CDC) coined the phrase, “opioid epidemic” in response to the staggering increase in opioid use and opioid- related deaths. Objective: The primary objective of this analysis is to evaluate the effectiveness of HB1 on the reduction of opioid-related deaths, opioid prescription rates, and intravenous opioid drug use rates. Methods: This analysis employed Eugene Bardach’s framework for policy …

Defining Boundaries: How A City And County Addressed Legalized Recreational Marijuana, Tera Kathleen Hinkley-Bressi Jan 2019

Defining Boundaries: How A City And County Addressed Legalized Recreational Marijuana, Tera Kathleen Hinkley-Bressi

Geography Masters Research Papers

In 2012 Washington state voters legalized recreational marijuana; local jurisdictions retained the option to ban recreational marijuana production, processing, and/or retail sales. Licenses for marijuana business could be distributed by the state to licensees in areas where local laws prohibited the business. This disconnect prompted legal battles between local governments and would-be business owners, as exemplified in the central Washington county of Yakima and the county seat, the city of Yakima. After a series of state policy changes and local community outcry, the city of Yakima reversed its initial ban, while the county continued prohibition. This paper explores issues underlying …

Barring Access To The Truth: North Carolina's Limiting Approach To Police Body-Camera Footage, Taylor Emory Jan 2019

Barring Access To The Truth: North Carolina's Limiting Approach To Police Body-Camera Footage, Taylor Emory

Campbell Law Review

Police body-cameras are innovative, truth-detecting tools. When it comes to controversial citizen-law enforcement interactions, they can depict an accurate portrayal of the events. No speculation, no controversy-just the truth. And with the truth, the existing tension between law enforcement officials and the general populace can begin to ease. Although these body-cameras are widely used, states such as North Carolina have enacted legislation that severely restricts access to such footage.

North Carolina General Statutes section 132-1.4A does two things. First, it requires individuals captured in footage to seek judicial approval for the disclosure or release of footage. Second, it completely bars …

Walking Out: Schools, Students, And Civil Disobedience, Michelle S. Simon

Elisabeth Haub School of Law Faculty Publications

This Article begins in Part I by reviewing the history and impact of youth civil disobedience and the special issues school walkouts raise. Part II then discusses the legal doctrines that guide school administrators and courts as they aim to strike a suitable balance between free expression and the day-to day operations of a school. Part III analyzes the different approaches school districts have taken, and offers specific advice to school districts dealing with future walkouts. Part IV cautions that the only constitutionally permitted response by school districts is to subject students to the same consequences they would face for …

The Effect Of Substance Abuse Rehabilitative Programming On Recidivism, Cindy Whitten Jan 2019

The Effect Of Substance Abuse Rehabilitative Programming On Recidivism, Cindy Whitten

Walden Dissertations and Doctoral Studies

Drug addiction is a known cause of recidivism and contributes greatly to inmate populations in prisons in North America. Little, though, is understood at the program level whether substance abuse rehabilitative programs are statistically associated with reductions in recidivism. Using conceptualizations of both punctuated equilibrium and differential association as the foundation, the purpose of this quasi-experimental design was to determine if participation in one moderate intensity program oriented toward the treatment of substance abuse is associated with reductions in recidivism. Secondary data were acquired from department of justice databases to compare a sample of 100 offenders who completed the program …

Police Officers' Perceptions Of Changes In Their Behavior While Being Video Recorded, Steven Patrick Ufford Jan 2019

Police Officers' Perceptions Of Changes In Their Behavior While Being Video Recorded, Steven Patrick Ufford

Walden Dissertations and Doctoral Studies

Body worn cameras (BWCs) are a newer piece of equipment that has been issued to police officers in efforts to increase transparency and improve relations with the community. Researchers who have just recently begun studying the effects of BWCs have observed changes in behavior of officers who wear the equipment. Some of these changes potentially have an adverse effect on citizens and the officers who wear BWCs. Lipsky's street-level bureaucracy theory was utilized to examine police officer use of discretion when conducting field activities while wearing BWCs. The research question pertained to police officers' perceptions regarding changes in behavior while …

The Impact Of Felony Criminal History On The Perceptions Of Hiring Managers, Larrica Mosley Jan 2019

The Impact Of Felony Criminal History On The Perceptions Of Hiring Managers, Larrica Mosley

Walden Dissertations and Doctoral Studies

Individuals with a criminal background face several barriers to securing employment, one of which is the reluctance of hiring managers to extend employment offers to them. African American ex-offenders are disproportionately affected by these barriers. The purpose of this study was to examine the attitudes of hiring managers in a metropolitan area in the Southern United States and to identify the factors that influence the hiring decisions of ex-offenders. A descriptive study design was used to explore whether type of criminal offense, length of crime, or race of offender affect a hiring manager'€™s decision to hire an ex-felon. The disparate …

This study examines bicycle travel demands and travel patterns in Lexington, Kentucky as generated by SPIN bicycle share users. It is hypothesized that the SPIN users …

Modern Charity: Morality, Politics, And Mid-Twentieth Century Us Writing, Matt Bryant Cheney Jan 2019

Modern Charity: Morality, Politics, And Mid-Twentieth Century Us Writing, Matt Bryant Cheney

Theses and Dissertations--English

Scholars over the past two decades (Denning, Szalay, Edmunds, Robbins) have theorized the different ways literature of the Mid-Twentieth Century reflects the dawn of the liberal US welfare state. While these studies elaborate on the effect rapidly expanding public aid had on literary production of the period, many have tended to undervalue the lingering influence on midcentury storytelling of private charity and philanthropy, those traditional aid institutions fundamentally challenged by the Great Depression and historically championed by conservatives. If the welfare state had an indelible impact on US literatures, so did the moral complexity of the systems of charity and …

Veterans' Treatment Courts In Kentucky: Examining How Personal Characteristics And During-Program Occurrences Influence Program Completion And Criminal Recidivism, Monica Lynn Himes

Theses and Dissertations--Social Work

Military veterans are disproportionately represented in United States (U.S.) jails and prisons, with nearly 10% of current inmates being veterans. Veterans’ criminal justice involvement is often precipitated by underlying mental health and substance abuse that are connected to their military service. Veterans’ treatment courts are the judicial response to a need for more coordinated provision of mental health and substance abuse services to veterans involved in the criminal justice system. Modeled after drug courts and mental health courts, veterans treatment courts are a judicial innovation that aim to honor the service of veterans by providing them an alternative to incarceration. …

A Review Of The Use Of Positive Reinforcement In Drug Courts, Katherine Bascom Jan 2019

A Review Of The Use Of Positive Reinforcement In Drug Courts, Katherine Bascom

PCOM Psychology Dissertations

There is a need to provide effective treatment for drug-abusing offenders, as evidenced by the explicitly supported relationship between drug use and crime (Anglin & Perrochet, 1998; Tonry & Wilson, 1990; McBride & McCoy, 1993). Drug policy in the United States has viewed drug abuse as a public safety concern or a public health concern (Marlowe, 2002). In 1989, the Miami Drug Court in Dade County, Florida developed a drug court system that is currently used nationwide. The model embodies a very strong behavioral orientation with clear expectations, as well as graduated sanctions and rewards for successive infractions and accomplishments. …
