The Effect Of Neighborhood Crime Rates On Childhood Obesity In Los Angeles County, Lachlan Montgomery Jan 2019

The Effect Of Neighborhood Crime Rates On Childhood Obesity In Los Angeles County, Lachlan Montgomery

CMC Senior Theses

This thesis examines the effect of neighborhood crime rates on childhood obesity in Los Angeles County over a five-year period 2012-2016. Using yearly pooled cross-sectional geocoded data from the University of Southern California (USC) Price Center for Social Innovation Neighborhood Data for Social Change (NDSC) interactive platform, I run multiple ordinary least squares regressions using different measures of crime to determine if neighborhoods with higher crime rates influence the unhealthy percentage of 5th, 7th, and 9thgrade public school students. I hypothesize that crime influences obesity, violent crime has a stronger correlation than property crime, …

Long-Term Urban Forest Cover Change Detection With Object Based Image Analysis And Random Point Based Assessment, Raoul Blackman Jan 2019

Long-Term Urban Forest Cover Change Detection With Object Based Image Analysis And Random Point Based Assessment, Raoul Blackman

All Graduate Theses, Dissertations, and Other Capstone Projects

The urban forest provides various ecosystem services. Urban tree canopy cover measurement is the most basic quantification of ecosystem services. There have been few studies focused on long-term high-resolution urban forest change analysis. Further, few if any of these studies have compared object based image analysis (OBIA) and random point based assessment for determination of urban forest cover. The research objective is to define the urban forest canopy area, location, and height within the City of St Peter, MN boundary between 1938 and 2019 using both the OBIA and random point based methods with high spatial-resolution aerial photographic images and …

Administrative Law, Diana Ginn, Sheila Wildeman Jan 2019

Administrative Law, Diana Ginn, Sheila Wildeman

Articles, Book Chapters, & Popular Press

Administrative law is concerned with the relationship between courts and those who make decisions in the course of exercising administrative powers. In particular, administrative law focuses on the way in which and the extent to which courts review or oversee administrative decision making. Administrative powers are largely created by statute. Such legislation is often referred to as the "enabling legislation”. An action taken under the Crown's prerogative powers is also considered to be administrative action; however, the focus of these materials is on action taken under enabling legislation.

Evaluating The Alignment Of Indiana Career Advisement Practices With Projected Workforce Demands, Sandra Adams Jan 2019

Evaluating The Alignment Of Indiana Career Advisement Practices With Projected Workforce Demands, Sandra Adams

All-Inclusive List of Electronic Theses and Dissertations

This study builds on existing research indicating that career advisement practice can have a significant influence on student postsecondary success. This study was designed to identify how counselors perceive career advisement practice and projected workforce demands in order to evaluate how these constructs align to the work of Indiana state leaders. Research questions were designed to identify how counselors perceive their roles and decision-making processes. Research was conducted with two composite scores, including career advisement practice and perceptions of projected workforce demands. The intent was to identify if counselor perceptions were significantly different based upon school locale (i.e., rural, suburban, …

The Misuse Of Product Misuse: Victim Blaming At Its Worst, Andrew F. Popper, Robert Adler Jan 2019

The Misuse Of Product Misuse: Victim Blaming At Its Worst, Andrew F. Popper, Robert Adler

Scholarly Articles in Law Reviews & Journals

This Paper addresses the legal consequences that surface when a consumer uses a product in a manner not specifically in- tended by that product's designer or manufacturer. If a product is used in a reasonably foreseeable manner, the fact that the use is at odds with a manufacturer's intention should not be a basis to deny tort liability or limit the regulatory options of the Consumer Product Safety Commission. If a product proves to be unsafe, defective, dangerous, or otherwise hazardous to users and consumers, use patterns should not be the primary determinant in assessing regulatory and common law sanctions …

Driving Toward Autonomy? The Fbi In The Federal System, 1908-1960, Daniel C. Richman, Sarah Seo

Faculty Scholarship

This paper explains the growth of the FBI (“Bureau”) in the United States at a time when criminal justice was largely a local matter by reframing the criminal justice “(eco)system” in terms of informational economy, rather than jurisdictional authority. It argues that the Bureau came to occupy a key position in the national law enforcement ecosystem by providing an informational infrastructure that enabled it to cultivate relationships with local police agencies. This history offers two insights about the nature of American state and federalism in the twentieth century. First, the Bureau’s particular strategy for enlarging its capacity beyond its small …

Why We Need Police, Justin Mccrary, Deepak Premkumar Jan 2019

Why We Need Police, Justin Mccrary, Deepak Premkumar

Faculty Scholarship

This chapter discusses the essential role that the police have in deterring and reducing crimes, particularly the most violent and costly ones to society, such as murder. We begin by providing a brief overview of deterrence theory before discussing the empirical evidence on the efficacy of police staffing and various policing strategies on crime reduction. Using a framework developed in Weisburd and Eck (2004), we quickly evaluate the model of standard policing and then mainly focus on evidence behind three current policing practices: hot spots, problem- oriented, and proactive. Finally, we use the empirical evidence of police staffing to provide …

Regulating Strikes In Essential Services - Canada, Eric Tucker Jan 2019

Regulating Strikes In Essential Services - Canada, Eric Tucker

Articles & Book Chapters

This chapter was written as a part of a comparative law project examining the regulation of strikes in essential services. It describes and analyses Canada's experience with strikes in essential services, including the historical development of essential service strike regulation, Canada's shifting understanding of essentiality and, most recently, the implications of constitutional labour rights, including the right to strike, for essential service strike regulation. It also looks at the law in action through a consideration of the application of these laws in their specific contest.

Methods And Severity: The Two Tracks Of Section 12, Benjamin Berger, Lisa Kerr Jan 2019

Methods And Severity: The Two Tracks Of Section 12, Benjamin Berger, Lisa Kerr

Articles & Book Chapters

This paper argues that there are two main routes – two tracks – by which one can arrive at the fundamental wrong at the heart of section 12 of the Charter. On the “methods track”, the state can run afoul of section 12 by using intrinsically unacceptable methods of treatment or punishment. For historical reasons, jurisprudence on this track is not well developed in Canada, though it would clearly prohibit the death penalty and most methods of corporal punishment. On the “severity track”, the concern is with excessive punishment. Here, even where the state has chosen a legitimate method of …

The Single-Subject Rule: A State Constitutional Dilemma, Richard Briffault Jan 2019

The Single-Subject Rule: A State Constitutional Dilemma, Richard Briffault

Faculty Scholarship

Critics of the proliferation of omnibus legislation in Congress have pointed to the constitutions of the American states as providing an alternative, and potentially superior, model for lawmaking. Forty-three state constitutions include some sort of “single-subject” rule, that is, the requirement that each act of the legislature be limited to a single subject. Many of these provisions date back to the second quarter of the nineteenth century, and, collectively, they have been the subject of literally thousands of court decisions. Nor is the rule a relic from a bygone era; one recent study found the rule at stake in 102 …

Towards Comprehensive Observing And Modeling Systems For Monitoring And Predicting Regional To Coastal Sea Level, Rui M. Ponte, Mark Carson, Mauro Cirano, Catia M. Domingues, Tal Ezer, Xuebin Zhang Jan 2019

Towards Comprehensive Observing And Modeling Systems For Monitoring And Predicting Regional To Coastal Sea Level, Rui M. Ponte, Mark Carson, Mauro Cirano, Catia M. Domingues, Tal Ezer, Xuebin Zhang

CCPO Publications

A major challenge for managing impacts and implementing effective mitigation and adaptation strategies for coastal zones affected by future sea level (SL) rise is our very limited capacity to predict SL change on coastal scales, over various timescales. Predicting coastal SL requires the ability to monitor and simulate a multitude of physical processes affecting SL, from local effects of wind waves and river runoff to remote influences of the large-scale ocean circulation on the coast. Here we assess our current understanding of the causes of coastal SL variability on seasonal to multi-decadal timescales, including geodetic, oceanographic and atmospheric aspects of …

Kkk In The Pd: White Supremacist Police And What To Do About It, Vida B. Johnson Jan 2019

Kkk In The Pd: White Supremacist Police And What To Do About It, Vida B. Johnson

Lewis & Clark Law Review

There is an epidemic of white supremacists in police departments. Police officers have been identified as members of white supremacist groups in Florida, Alabama and Louisiana. There have been scandals in over 100 different police departments, in over forty different states, in which individual police officers have sent overtly racist emails, texts, or made racist comments via social media. This is a nation-wide problem. It is one that is not limited to just beat officers; some of these shocking occurrences have even involved high-ranking members of their respective police forces. Although the F.B.I. warned of white supremacists infiltrating police departments …

The Transformative Potential Of Digital Media & Technology On Class Actions, Caroline Desmond Jan 2019

The Transformative Potential Of Digital Media & Technology On Class Actions, Caroline Desmond

Lewis & Clark Law Review

In this Note, the author discusses the true potential that digital media and technology hold for class actions beyond effectuating notice to members of a class. Ironically, just as challenges have mounted against the use of the class action device, digital technology has continued to advance in the background to a point where it may be used to break down barriers to class certification now facing would-be class plaintiffs.

However, much of the current discussion across law reviews and blogs as it relates to digital media and class actions pertains to the effect of digital media on notice. Not only …

The Relationship Between The Employment Of School Resource Officers, School Discipline, And School-Based Arrests Variables, Johnathon D. Monson Jan 2019

The Relationship Between The Employment Of School Resource Officers, School Discipline, And School-Based Arrests Variables, Johnathon D. Monson

UNF Graduate Theses and Dissertations

The school resource officer (SRO) program is a program developed in the United States with the goal of making schools a safer environment for students across all grades (Cray & Weiler, 2011). To date, the majority of research surrounding SRO programs focuses on recommended characteristics and qualities of SROs, as well as appropriate utilization of SROs (Weiler & Cray, 2011). However, relatively little is known about the effect of increased presence of SRO’s in the school setting. With SRO’s being tasked with disciplinarian roles Barnes (2016), it would be important to look at the effect of SRO’s on school discipline …

The End Of Intuition-Based High-Crime Areas, Ben Grunwald, Jeffrey Fagan Jan 2019

The End Of Intuition-Based High-Crime Areas, Ben Grunwald, Jeffrey Fagan

Faculty Scholarship

In 2000, the Supreme Court held in Illinois v. Wardlow that a suspect’s presence in a “high-crime area” is relevant in determining whether an officer has reasonable suspicion to conduct an investigative stop. Despite the importance of the decision, the Court provided no guidance about what that standard means, and over fifteen years later, we still have no idea how police officers understand and apply it in practice. This Article conducts the first empirical analysis of Wardlow by examining data on over two million investigative stops conducted by the New York Police Department from 2007 to 2012.

Our results suggest …
