Prosecuting Corruption After Mcdonnell V. United States, Terence A. Parker

This Note proceeds in five Parts. Part I provides a background discussion of the facts and holding in McDonnell. Part II goes on to analyze McDonnell through the lens of three recent federal public corruption cases, discussing how the decision has been applied to both specific act and stream of benefits prosecutions. Part III argues that the narrower official acts definition announced by the McDonnell Court will not result in a sea change to corruption prosecutions. Part IV argues for the resilience of the stream of benefits theory of public corruption in the aftermath of McDonnell. Finally, Part …

We examine the impact of food labels that make unsupported claims of food safety and labels that provide information to support such claims on consumer choices and examine consumers’ willingness to pay for beef products with these different food safety labeling cues. Empirical results from a survey of grocery shoppers in a Midwestern city in the USA show that more than two thirds of respondents who received a label with unsubstantiated food safety claims chose this option and were willing to pay the highest price premium for it, compared to the less preferred labeling options that provided information to support …

The decades-long increase in obesity in the US has led to a number of policies aimed at improving diets, which are thought to play a significant role in obesity. Many of these policies seek to influence individuals’ behaviors. Front-of-package labels providing salient, easily interpretable information to consumers have exhibited promise in helping people identify and choose healthier foods. However, behavioral economics may offer an opportunity to enhance label effectiveness. Tailoring labels to high-risk communities, including minority and rural populations, which have higher rates of diet-related diseases than the overall population, may increase the label’s effectiveness. Developmental And Reproductive Characteristics Of Beef Heifers Classified By Number Of Estrous Cycles Experienced By Start Of First Breeding, Andy Roberts, Jaclyn N. Ketchum, Richard N. Funston

A retrospective analysis was conducted to evaluate the effect of number of estrous cycles exhibited before breeding on growth and reproductive performance of replacement beef heifers fed ad-libitum or restricted by 20% less than ad-libitum during postweaning development over a 9-yr period. Progesterone concentration in blood samples collected at 9- to 11-d intervals were used to assign heifers into groups by number of estrous cycles exhibited before the start of breeding: 0 (nonpubertal; n = 395), 1 (n = 205), 2 (n = 211), 3 (n = 116), or >3 (n = 249). Perceptions of the physical and social environment have been shown to be predictive of physical activity (PA) behavior. However, the mechanisms of this association have not been examined. Affective response to PA was examined as a putative mediator of the association between perceptions of the PA environment and subsequent PA behavior. As part of a PA promotion study, 59 low-active overweight or obese but otherwise healthy adults completed real-time assessments of the perceived physical and social PA environment, affective response to PA, and PA behavior over a 6-month period. Youth are often at risk for physical and psychosocial illnesses, and yet their input is rarely included in health assessments and interventions. Two U.S.-based universities partnered with community stakeholders and youth in Las Malvinas II, Dominican Republic to explore factors that promote and/or hinder the health of youth in Las Malvinas II. Youth (n=8) conducted a photovoice, and identified six key health priorities: (1) good nutrition, (2) depression and poverty, (3) violence, (4) sports and neighborhood association, (5) education, and (6) sanitation and community infrastructure. Findings revealed youth’s exploration of complex multi-level determinants of health. This study suggests youth have …

The importance of engendering community resilience after a disaster event cannot be overstated. In this chapter, we argue that the strategic design of risk communication messages is critical for communities affected by crises. In the past, many communication practitioners employed the single shot, top-down approach for constructing messages, especially during crises. Given growing recognition of the ineffectiveness of this model, scholars have become more attentive to the role of message design in conveying risk to stakeholders. Specifically, through the lens of the message convergence framework, we argue the need for a multiple messages approach that targets diverse groups of people …

Cardiorespiratory fitness (CRF) is a good summative measure of the body’s ability to perform continuous, rhythmic, dynamic, large-muscle group physical activity, and exercise. In children, CRF is meaningfully associated with health, independent of physical activity levels, and it is an important determinant of sports and athletic performance. Although gas-analyzed peak oxygen uptake is the criterion physiological measure of children’s CRF, it is not practical for population-based testing. Field testing offers a simple, cheap, practical alternative to gas analysis. Since 1978 when the first “petri dish” baby was born, In-Vitro Fertilization (IVF) has been used as a tool to give couples struggling with infertility the opportunity to have children. Using this method of Assisted Reproductive Technology (ART), the woman is given medication to stimulate her ovaries for the maturation of multiple eggs, which are then retrieved via needle aspiration, fertilized in a petri dish, and inserted in the uterus with the hopes of achieving a successful pregnancy. Many times IVF is completed with another technique known as Intracytoplasmic Sperm Injection (ICSI), where the sperm is injected straight into the …
