Small-C Constitutional Rights, Adam Chilton, Mila Versteeg Jan 2019

Small-C Constitutional Rights, Adam Chilton, Mila Versteeg

Coase-Sandor Institute for Law & Economics Research Paper Series

Although constitutions lay out the fundamental principles by which countries are governed, identifying exactly which legal materials are considered constitutional is not a straightforward task. This is for two reasons. First, there is no systematic evidence about the relative importance of countries’ formal, written constitutions—the “Large-C” constitution— versus their broader body of constitutional law derived from sources like judicial decisions, treaties, and conventions—the “small-c” constitution. Second, it is often difficult to establish which legal materials are definitively part of a country’s small-c constitution. We investigated the nature and relative importance of small-c constitutional rights protections by fielding a global expert …

When Audiences Object: Free Speech And Campus Speaker Protests Articles & Essays, Gregory P. Magarian

Scholarship@WashULaw

In March 2017, conservative author Charles Murray arrived to speak at Middlebury College in Vermont, invited by a student affiliate of the American Enterprise Institute. Murray planned to discuss his 2013 book, Coming Apart: The State of White America, 1960-2010. Many Middlebury students and faculty, however, deplored Murray for an earlier book, 1994’s The Bell Curve, where he drew specious connections between race and intelligence. Others simply considered Murray an intellectual lightweight who didn’t warrant a speaking slot at the prestigious college. Murray’s critics objected to the Political Science Department’s co-sponsorship of his ppearance and the college president’s plan to …

Political And Non-Political Speech And Guns, Gregory P. Magarian

Scholarship@WashULaw

Constitutional rights depend on justifications. Some combination of theory, his- tory, and practical reasoning needs to establish why and to what extent a given right warrants legal protection. The justifications that courts and theorists articulate for a given right determine the right’s breadth and the specific contours of its protection. Justification has particular importance at the formative stage of a newly recognized constitutional right. At present, courts are building doctrine around the Second Amendment “right of the people to keep and bear Arms,”1 recognized as an individ- ual right just over a decade ago in District of Columbia v. Heller.2 …

Forum Selling Abroad, Jens Frankenreiter, Stefan Bechtold, Daniel Klerman Jan 2019

Forum Selling Abroad, Jens Frankenreiter, Stefan Bechtold, Daniel Klerman

Scholarship@WashULaw

Judges decide cases. Do they also try to influence which cases they decide? Clearly plaintiffs “shop” for the most attractive forum, but do judges try to attract cases by “selling” their courts? Some American judges actively try to enlarge their influence by making their courts attractive to plaintiffs, a phenomenon known as “forum selling.” This article shows that forum selling occurs outside the U.S. as well, focusing on Germany, a country that is often held up as the paragon of the civil law approach to adjudication. As in the U.S., German courts attract cases primarily through the pro-plaintiff manipulation of …

Proxy Advisor Influence In A Comparative Light, Andrew F. Tuch Jan 2019

Proxy Advisor Influence In A Comparative Light, Andrew F. Tuch

Scholarship@WashULaw

The reform of proxy advisors is on the U.S. regulatory agenda, with debate focusing on the extent of influence that these actors exert over institutional investors and corporate managers. But the debate examines the U.S. position in isolation from other systems. If we broaden our focus, we see that the factors usually cited for proxy advisors’ influence exist similarly in the United Kingdom but that proxy advisors there exert significantly weaker influence than they do in the United States. Why this difference when we would expect a similar role for proxy advisors in both systems based on the presence of …

Interstitial Space Law, Melissa (M.J.) Durkee Jan 2019

Interstitial Space Law, Melissa (M.J.) Durkee

Scholarship@WashULaw

Conventionally, customary international law is developed through the actions and beliefs of nations. International treaties are interpreted, in part, by assessing how the parties to the treaty behave. This Article observes that these forms of uncodified international law—custom and subsequent treaty practice—are also developed through a nation’s reactions, or failures to react, to acts and beliefs that can be attributed to it. I call this “attributed lawmaking.”

Consider the new commercial space race. Innovators like SpaceX and Blue Origin seek a permissive legal environment. A Cold-War-era treaty does not seem adequately to address contemporary plans for space. The treaty does, …

Cidf: A Clustering-Based Interaction-Driven Friending Algorithm For The Next-Generation Social Networks, Aadil Alshammari, Abdelmounaam Rezgui

Faculty Publications - Information Technology

Online social networks, such as Facebook, have been massively growing over the past decade. Recommender algorithms are a key factor that contributes to the success of social networks. These algorithms, such as friendship recommendation algorithms, are used to suggest connections within social networks. Current friending algorithms are built to generate new friendship recommendations that are most likely to be accepted. Yet, most of them are weak connections as they do not lead to any interactions. Facebook is well known for its Friends-of-Friends approach which recommends familiar people. This approach has a higher acceptance rate but the strength of the connections, …

Aspiring To A Model Of The Engaged Judge, Ellen Yaroshefsky Jan 2019

Aspiring To A Model Of The Engaged Judge, Ellen Yaroshefsky

Hofstra Law Faculty Scholarship

This symposium essay, relying on the work of numerous federal judges who have changed the course of criminal justice and civil rights, argues that judges should aspire to be the “Engaged Judge” — that is, a judge who acts in the best traditions of the role by engaging in creative and often bold solutions in order to advance a “justice mission.” The article discusses the contours of that justice mission, emphasizing that engaged judges should not substitute their own morality for the law or become result-oriented by tailoring legal principle to fit the judge’s prior convictions. It explores the various …

Faculty, Staff and Student Publications

For several decades, multipotent mesenchymal stromal cells (MSCs) have been extensively studied for their therapeutic potential across a wide range of diseases. In the preclinical setting, MSCs demonstrate consistent ability to promote tissue healing, down-regulate excessive inflammation and improve outcomes in animal models. Several proposed mechanisms of action have been posited and demonstrated across an array of in vitro models. However, translation into clinical practice has proven considerably more difficult. A number of prominent well-funded late-phase clinical trials have failed, thus calling out for new efforts to optimize product delivery in the clinical setting. In this review, we discuss novel …

Migrasi Orang Biak Dan Identitas Orang Asli Papua Di Sausapor, Papua Barat, Irin Oktafiani, Herry Jogaswara

Antropologi Indonesia

This paper discusses the migration process and the recognition of identity of Biak people in Sausapor along with the impact of it. Dichotomy of local and outsider is still a clear barrier separating Biak and Abun people in Miossu islands and Sausapor, the capital district of Tambrauw, West Papua. Biak people are considered as outsider with regards to the land ownership issue in Sausapor. On the other side, they are also considered as insider in Kampung Werur which is located in the same region with Sausapor. There are two different identity layers related to the problem of land ownership and …

Imaji Identitas Nasional Di Ruang Diaspora Anggota Ppi Di Thailand, M. Rifaldi Akbar Jan 2019

Imaji Identitas Nasional Di Ruang Diaspora Anggota Ppi Di Thailand, M. Rifaldi Akbar

Antropologi Indonesia

National identity is a construct that grows in the memories of the nation’s members. In a diaspora space, Indonesian national identity has a more significant role than local identities. This article explores the articulations of national identity by the members of the Indonesian students abroad (PPI) in Thailand. As foreign students, they encounter with people from other nations who have limited knowledge about polyethnic Indonesia in daily basis. Thus, they are trapped in a space that requires them to define Indonesia. Therefore, the representation of national identity becomes the autonomy of each PPI member. This article argues that the similarity …

Telaah Kritis Terhadap Pendekatan Ekoteologi Dalam Upaya Pelestarian Hewan Liar Di Minahasa, Glenn Allen Tielung, Tony Rudyansjah

Antropologi Indonesia

The environmental theology approach, known as ecotheology, attempts to make people aware of their actions towards the natural environment through a theological framework. Its basic assumption departs from the idea that the dogma of hierarchical construction of the universe is the dominant factor in influencing ethical relation between humans and the natural world surrounding them. Within the framework of the dogma, humans are given a special mandate to maintain other creations. This article argues that ecotheology’s approach in conserving wild animals in Minahasa is still trapped in the ontological model of dualism. It is characterized by humans’ special status compared …

Kolektif Sebagai Institusi Kebudayaan Alternatif Di Perkotaan Jawa: Telaah Infrastruktur Sosial, Khidir M. Prawirosusanto, Eliesta Handitya

Antropologi Indonesia

Collectives as a non-formal cultural institution began to emerge and widespread at around the 1998 Reformation. As a new form of cultural movement in Yogyakarta, collectives were different to formal cultural institutions, such as museums and art galleries, which mostly depend on financial support from the government, corporation, or some individual patrons. This article discusses the contemporary cultural organization domain with the case of collectives based in Yogyakarta. Some groups with characteristics of collectives were initiated in the urban sphere and run by young people. We comprehend this activism of collectives as a ‘cultural acts’ (laku budaya)—they ran various cultural …

Adaptive Heuristics That (Could) Fit: Information Search And Communication Patterns In An Online Forum Of Investors Under Market Uncertainty, Niccolo Casnici, Marco Castellani, Flaminio Squazzoni, Manuela Testa, Pierpaolo Dondio

Articles

This article examines information-search heuristics and communication patterns in an online forum of investors during a period of market uncertainty. Global connections, real-time communication, and technological sophistication have created an unpredictable market environment. As such, investors try to deal with semantic, strategic, and operational uncertainty by following heuristics that reduce information redundancy. In this study, we have tried to find traces of cognitive communication heuristics in a large-scale data set including 8 years of online posts (2004–2012) for a forum of Italian investors. We identified various market volatility conditions on a daily basis to understand the influence of market uncertainty …

Articles

Oesophageal adenocarcinoma (OAC) is an exemplar model of obesity-associated cancer. Response to neoadjuvant chemoradiotherapy (NA CRT) is a clinical challenge. We examined if visceral adipose tissue and obesity status alter radiosensitivity in OAC. The radioresistant (OE33R) and radioresponsive (OE33P) OAC isogenic model was cultured with adipose tissue conditioned media from three patient cohorts: non-cancer patients, surgery only OAC patients and NA CRT OAC patients. Cell survival was characterised by clonogenic assay, metabolomic profiling by nuclear magnetic resonance spectroscopy and adipokine receptor gene expression by qPCR. A retrospective in vivo study compared tumour response to NA CRT in normal weight (n=53) …

Surface Modification Of Silver Nanoparticle (Agnp) By Liposomal Encapsulation Mitigates Agnp-Induced Inflammation, Azeez O. Yusef, Alan Casey

Articles

Silver nanoparticles (AgNP) are widely used in a variety of consumable products as antibacterial to prevent or treat infection. Unfortunately, evidence exits that AgNP induces inflammation which can worsen with repeated human exposure. However, there is little or no research on how to mitigate these adverse effects due to AgNP induced-toxicity. Here, we investigated if surface modification of AgNP by liposomal encapsulation suppresses AgNP-mediated inflammatory responses in THP1 monocytes and THP1 differentiated macrophages (TDM). AgNP was encapsulated in a dipalmitoyl phosphatidyl choline- (DPPC)/cholesterol-based liposome by extrusion through a 100-nm polycarbonate membrane to form Lipo-AgNP. It was found as expected that …

Synchrotron Macro Atr-Ftir Microspectroscopy For High Resolution Chemical Mapping Of Single Cells, Jitraporn Vongsvivut, David Perezguaita, Bayden Wood, Phil Heraud, Karina Khambatta, David Hartnell, Mark J. Hackett, Mark J. Tobin

Articles

Attenuated total reflection Fourier transform infrared (ATR-FTIR) spectroscopy has been used widely for probing the molecular properties of materials. Coupling a synchrotron infrared (IR) beam to an ATR element using a high numerical aperture (NA) microscope objective enhances the spatial resolution, relative to transmission or transflectance microspectroscopy, by a factor proportional to the refractive index (n) of the ATR element. This work presents the development of the synchrotron macro ATR-FTIR microspectroscopy at Australian Synchrotron Infrared Microspectroscopy (IRM) Beamline, and demonstrates that high quality FTIR chemical maps of single cells and tissues can be achieved at an enhanced spatial …

Background: The Healthy People 2020 initiative aims to reduce health disparities, including alcohol use, among sexual minority women (SMW; eg, lesbian, bisexual, queer, and pansexual). Compared with heterosexual women, SMW engage in more hazardous drinking and report more alcohol-related problems. Sexual minority stress (ie, the unique experiences associated with stigmatization and marginalization) has been associated with alcohol use among SMW. Among heterosexuals, relationship factors (eg, partner violence and drinking apart vs together) have also been associated with alcohol use. Negative affect has also been identified as a contributor to alcohol use. To date, most studies examining alcohol use among SMW …

Mobile Technology Use And Mhealth Text Message Preferences: An Examination Of Gender, Racial, And Ethnic Differences Among Emerging Adult College Students, Kristin E. Heron, Kelly A. Romano, Abby L. Braitman

Psychology Faculty Publications

Background: Mobile health (mHealth) interventions are a potentially feasible way of targeting emerging adult college students' physical and mental health concerns, decreasing health-risk, and augmenting health promoting behaviors. However, there is limited evidence attesting to advantageous ways of designing mHealth treatments in a manner that is apt to be well-received by emerging adult college students at large, and gender, racial, and ethnic subgroups in particular. To address these research gaps, this exploratory study examined general trends, and gender (male, female), racial (White, Black), and ethnic (Latino, non-Latino) differences, in emerging adult college students' mobile technology ownership and phone plan characteristics, …

Human Rights, Think Aloud Protocols And Magic Drums: Revealing Character In Pre-Service Teachers, Leticia De Leon, Kara Bennett

Teaching and Learning Faculty Publications

This paper describes a qualitative study that examined how preservice teachers engaged in a Second Life activity intended to help them reflect on how knowledge of human rights may affect their professional practice. This process utilized a problem-solving strategy to determine their goal-oriented character traits. Therefore, the research question explored was, how do preservice teachers create a character that respects human rights? Through a symbolic introspective journey, participants engaged in think aloud protocols to reveal goal-oriented behavior guided by a strong moral compass. Data analysis utilized a means-end process, and results were recorded along two dimensions: stability and change and …
