Riding The Blockchain Mania: Public Firms’ Speculative 8-K Disclosures, Pengkai Lin Dec 2019

Riding The Blockchain Mania: Public Firms’ Speculative 8-K Disclosures, Pengkai Lin

Research Collection School Of Accountancy

This paper provides evidence on public firms' initial 8-K disclosures that mention Blockchain and investors' response to these disclosures. We categorize the description of Blockchain activities in firms' 8-Ks as Speculative (e.g., a vague future plan that involves Blockchain) or Existing (e.g., a description of Blockchain product). We document a sharp increase in the number of initial 8-K disclosures of Blockchain, particularly by Speculative firms, coinciding with the rise of Bitcoin prices and excitement in Blockchain technology in the last quarter of 2017. Investors react positively to the Blockchain 8-Ks issued by Speculative firms in the initial seven-day event window …

Singapore In 2018: Between Uncharted Waters And Old Ghosts, George Wong, Jun Jie Woo Dec 2019

Singapore In 2018: Between Uncharted Waters And Old Ghosts, George Wong, Jun Jie Woo

Research Collection School of Social Sciences

For the city state of Singapore, 2018 was a year of many firsts. It marked the midpoint of the 13th Parliament of Singapore within a manifestly post–Lee Kuan Yew era. The incumbent government of the People's Action Party (PAP) began the year with the pleasant surprise that economic growth in 2017 had reached 3.6 per cent. This exceeded the modest expectations of 1.5 to 3.5 per cent. But despite the positive start, 2018 was to be filled with headwinds for Singapore, both new and familiar. Top of the list was the revival of tensions with Malaysia, as well as a …

The G5 Sahel: An Insufficient Organization For A Failed Region?, Beder Dine El Khou Dec 2019

The G5 Sahel: An Insufficient Organization For A Failed Region?, Beder Dine El Khou

Graduate Program in International Studies Theses & Dissertations

In the wake of mass kidnapping and terrorist attacks launched by Boko Haram and other extremist groups in the Sahel of West Africa, along with the rise of the Islamic State in Libya that started to have immediate impact on the Sahel’s already problematic situation, five states from the region of Sahel decided to create a coalition in 2014 not only to fight insurgencies rampaging in the area but also to work on the development of the region. With a very small capacity in terms of man power and equipment, the G5 Sahel coalition attempts to achieve what other intervening …

In recent decades, the United States Department of Justice (DOJ) has greatly improved its enforcement of the U.S. Foreign Corrupt Practices Act (FCPA). Some of these FCPA enforcement cases involve China. Given China’s prominence as a center of global business, this trend is likely to increase in the foreseeable future.

Section I of this Article briefly reviews the provisions of the FCPA, and recent FCPA enforcement in China. Section II discusses China’s anti- bribery law regime, anti-bribery provisions and agencies enforcing bribery and corruption. Section III focuses on an analysis of FCPA cases involving China, in addition to describing the …

Fourth- And Fifth-Generation Warfare: Technology And Perceptions, Waseem Ahmad Qureshi Dec 2019

Fourth- And Fifth-Generation Warfare: Technology And Perceptions, Waseem Ahmad Qureshi

San Diego International Law Journal

The composition of warfare is changing. There is an increasing transformation in the traditional aspects of waging a war: conventional techniques of warfare are in decline and newer tactics and tools of warfare, such as information warfare, asymmetric warfare, media propaganda, and hybrid warfare, are filling the gap, blurring the lines between combatant and noncombatant, and between wartime and peacetime. The basic framework of modern warfare was elaborated by Carl von Clausewitz in his magnus opus On War. He defined modern warfare between states as “a duel on larger scale,” and explained its purpose as “a continuation of politics by …

Don’T Google It: The European Union’S Antitrust Parade (“Enforcement”) Against America’S Tech Giants, Mariah Witt Dec 2019

Don’T Google It: The European Union’S Antitrust Parade (“Enforcement”) Against America’S Tech Giants, Mariah Witt

San Diego International Law Journal

This Article details several case studies, each exemplifying the EU’s pro- competition practices versus the American monopoly-like corporations of Google, Microsoft, and Amazon. The EU claims that each of these companies have abused their dominant position in their respective markets. Many companies (including those not listed in this comment) that have faced the EU’s antitrust wrath are merely the successful giants of their field, who should be enjoying their success, not sitting in fear of success’s implications in the global arena. This comment will conclude with a warning to future American corporations on the path to monopoly-like power and status …

Pay Her More! How Sex And Motherhood Play A Role In The Unequal Pay Of Women On The World Stage, Raquel S. Zilbeman Dec 2019

Pay Her More! How Sex And Motherhood Play A Role In The Unequal Pay Of Women On The World Stage, Raquel S. Zilbeman

San Diego International Law Journal

“[O]vert pay discrimination between women and men” is what typically comes to mind when one thinks about the gender wage gap. While women often ask for “equal pay for equal work,” gender discrimination is only responsible for a small amount of the pay gap. “The gender wage gap is also about choice and opportunity. . . . [It is] rooted in [global] social norms about women[,] family [and motherhood which constantly change and evolve—making it] much harder to solve.” It is grounded in the way our society has evolved over the last one hundred and fifty years, during which more …

The Regulatory Trajectory Of Synthetic Securitization: A Breakdown Of International Regulatory Environments, Nicolas M. Dillavou Dec 2019

The Regulatory Trajectory Of Synthetic Securitization: A Breakdown Of International Regulatory Environments, Nicolas M. Dillavou

San Diego International Law Journal

The harmful effects on global financial stability that accompanied the 2007-2008 financial crisis (the “crisis”) were largely intensified by loose regulatory practices in the United States’ (U.S.) secondary mortgage market. Accordingly, the harm suffered on a global level warrants a comparative perspective on international securities regulation. This Article will examine several securitization methods in Europe and the U.S. and derive prospective solutions from these existing approaches that have the potential to address undue risks associated with asset-backed securities today.

This Article will initially discuss the history and causes of the subprime mortgage crisis and then discuss the particular difficulties with …

Technology, The Changing Nature Of Disputes, And The Future Of Equitable Principles In Canadian Contract Law, Conrad Flaczyk Dec 2019

Technology, The Changing Nature Of Disputes, And The Future Of Equitable Principles In Canadian Contract Law, Conrad Flaczyk

Canadian Journal of Law and Technology

There are a number of legitimate reasons to be excited about the application of new technologies to make contracting more efficient. Unfortunately, each of those reasons is associated with certain risks for both contractors and contractees. In this article, I argue that an ‘‘equitable” approach to modern contract law — understood by the likes of Larry DiMatteo and others ‘‘not merely as a system of rules, but of rules tempered by standards and principles” — is particularly well suited for counterbalancing some of the undesirable contractual risks introduced by new technologies like blockchain, artificial intelligence, and smart contracts. A historical …

Subverting Democracy To Save Democracy: Canada’S Extra-Constitutional Approaches To Battling “Fake News”, Michael Karanicolas Dec 2019

Subverting Democracy To Save Democracy: Canada’S Extra-Constitutional Approaches To Battling “Fake News”, Michael Karanicolas

Canadian Journal of Law and Technology

Nearly a decade after the first Twitter and Facebook revolutions, the early narratives pointing to social media as a great agent of democratization1 have given way to a more nuanced understanding of the impact of the Internet on our political discourse. While there is no question that Internet access provides tremendous expressive benefits, scholars are increasingly questioning whether this information diet is ultimately healthy for society. An analogy to sugars, fats and salts has emerged, where just as an appetite for rich foods served our species well when resources were scarce, but have become a liability in an age of …

Developing A Privacy Code Of Practice For Connected And Automated Vehicles, Rajen Akula Dec 2019

Developing A Privacy Code Of Practice For Connected And Automated Vehicles, Rajen Akula

Canadian Journal of Law and Technology

Connected and autonomous vehicles (‘‘CAVs”) can collect, store, process and transmit vast amounts of data. Understanding the use (and potential misuse) of this data, particularly when that data is about an identifiable individual within the meaning of data protection law, is regarded critical to the success of this new mode of transportation. However, what constitutes personal information in relation to coneccted and automated vehicle data on a case-by-case basic. This presents a policy challenge for the government and creates uncertainty for businesses wishing to make use of this data.

Privacy Law Issues In Public Blockchains: An Analysis Of Blockchain, Pipeda, The Gdpr, And Proposals For Compliance, Noah Walters Dec 2019

Privacy Law Issues In Public Blockchains: An Analysis Of Blockchain, Pipeda, The Gdpr, And Proposals For Compliance, Noah Walters

Canadian Journal of Law and Technology

Proponents of blockchain proclaim that the technology’s greatest innovation is trust. Blockchain create trust by serving as an indispensable ledger (a central point of truth), for all stakeholders to a transaction. Instead of companies managing and reconciling records of the same transaction in privately held databases, both sides of a transaction are recorded simultaneously on a shared ledger — the blockchain. As a result, the crypto economic environment is characterized by the decentralized coordination of business processes and transactions. Proponents of crypto-economics regard decentralized coordination as an opportunity for new forms of economic innovation, forms designed to increase value for …

Converging Space And Producing Place: Social Inequalities And Birth Across Mexico, Rosalynn A. Vega Dec 2019

Converging Space And Producing Place: Social Inequalities And Birth Across Mexico, Rosalynn A. Vega

Anthropology Faculty Publications

I combine ethnographic research of the professional midwifery model in Mexico with concepts gleaned from an interdisciplinary literature in order to illustrate how different types of spaces converge in the process of place-making. From October 2010 to November 2013, I conducted twenty-eight months of research, interviewing employees of government bureaus and public health programs, observing how the professional midwifery model unfolds in distinct contexts, performing interviews and participant-observation with casa midwifery students/alumni, and “shadowing” professional midwives and obstetricians as they engage with pregnant women in a hospital setting. Drawing from ethnographic examples, this article points to five different types of …

Managed Engagement; Considering A Space For Policy In Aesthetics, Connell Vaughan Dec 2019

Managed Engagement; Considering A Space For Policy In Aesthetics, Connell Vaughan

Conference papers

Aesthetics and the philosophy of art is routinely faced with a problem of a binary opposition of two silos, namely: Theory and Practice. For want of a better word, these domains are often reluctant to “engage” each other. Philosophers of aesthetics are often unable to connect the aesthetic enquires of Kant et al, which almost ignore the world of art practice, with sustained philosophical reflection on the artworld itself. As a way of thinking through the connections between aesthetic theory and art practice, I propose to consider another domain as intermediate, namely, policy.

Teachers Of Writing Who Write: Finding Voice And Embracing Vulnerability, Jeanne Muraco Hurney Dec 2019

Teachers Of Writing Who Write: Finding Voice And Embracing Vulnerability, Jeanne Muraco Hurney

Graduate Theses

The purpose of this thesis is to advance the premise that teachers of writing must write in order to establish their own voice and embrace the risk taking that the process entails. Only then can instructors of writing truly impart that knowledge to help students elevate their writing and motivate them to find their own voice. I will argue that eighth grade teachers who know the craft in this personal way are in a remarkable position to have an effect on students’ writing to prepare them with skills and power of writing they will need in high school, where the …

Personality Disruption As Mental Torture: The Cia, Interrogational Abuse, And The U.S. Torture Act, David Luban, Katherine S. Newell Dec 2019

Personality Disruption As Mental Torture: The Cia, Interrogational Abuse, And The U.S. Torture Act, David Luban, Katherine S. Newell

Georgetown Law Faculty Publications and Other Works

This Article is a contribution to the torture debate. It argues that the abusive interrogation tactics used by the United States in what was then called the “global war on terrorism” are, unequivocally, torture under U.S. law. To some readers, this might sound like déjà vu all over again. Hasn’t this issue been picked over for nearly fifteen years? It has, but we think the legal analysis we offer has been mostly overlooked. We argue that the basic character of the CIA’s interrogation of so-called “high-value detainees” has been misunderstood: both lawyers and commentators have placed far too much emphasis …

Is There A Need For Restoration Of Justice In Democratic India?, Abraham Sekhar Dec 2019

Is There A Need For Restoration Of Justice In Democratic India?, Abraham Sekhar

Masters Theses

Justice means giving all persons their due. Justice is the quality of being fair and reasonable. India has the largest democracy in the world. It has become noticed globally by most other countries, on the one hand, for its significant economic growth during the past two decades; and on the other hand, for its domestic unrest among people of different religions and castes. Under the rule of the present political party, India’s economic growth has experienced a sudden decline during the past three years. This drew my attention to find out the reasons for such a decline. A literature survey, …

Second-Harmonic Optical Vortex Conversion From Ws₂ Monolayer, Arindam Dasgupta, Jie Gao, Xiaodong Yang Dec 2019

Second-Harmonic Optical Vortex Conversion From Ws₂ Monolayer, Arindam Dasgupta, Jie Gao, Xiaodong Yang

Mechanical and Aerospace Engineering Faculty Research & Creative Works

Wavelength, polarization and orbital angular momentum of light are important degrees of freedom for processing and encoding information in optical communication. Over the years, the generation and conversion of orbital angular momentum in nonlinear optical media has found many novel applications in the context of optical communication and quantum information processing. With that hindsight, here orbital angular momentum conversion of optical vortices through second-harmonic generation from only one atomically thin WS2 monolayer is demonstrated at room temperature. Moreover, it is shown that the valley-contrasting physics associated with the nonlinear optical selection rule in WS2 monolayer precisely determines the output circular …
