Coding For Cultural Competency: Expanding Access To Justice With Technology, Sherley E. Cruz
Coding For Cultural Competency: Expanding Access To Justice With Technology, Sherley E. Cruz
Tennessee Law Review
Innovations in legal technology are revolutionizing access to justice for individuals who previously had little or no ability to obtain legal assistance. This Article explores how the lack of culturally competent designs within legal technology negatively impacts diverse communities, thereby hindering the ability to expand access to justice. An examination of the underlying theories of access to justice and cultural competency illustrates why it is necessary for legal professionals and technology designers to incorporate culturally competent designs when developing legal technology. In light of ongoing changes in United States' demographics, and the heightened need to provide access to justice given …

Critical Theory And Clinical Stance, Wendy A. Bach
Critical Theory And Clinical Stance, Wendy A. Bach
Scholarly Works
Clinicians, unlike their peers in the legal academy, are embedded in their clients’ experiences of the legal system. Because of their location in the academy, “they have the potential to transform the study of law into the study of a culture that deploys law for various purposes,” in the words of Phyllis Goldfarb. In this short essay, we highlight a thread of clinical scholarship which we identify as growing from clinicians’ unique and embedded stance. We seek to convince, using a few examples of clinical scholarship, that our collective critical stance has yielded, over the last several decades, a growing …
Community Economic Development Is Access To Justice, Brian Krumm
Community Economic Development Is Access To Justice, Brian Krumm
Scholarly Works
What gaps exist in the justice system that result in a need for services provided by community economic development attorneys? What is the evidence that those gaps actually exist? How do we know that community economic development practitioners fill those gaps, and in what way? These are merely a few of the questions addressed in this collection.
At the Association of American Law Schools (AALS) annual meeting in San Diego in January 2018, legal scholars gathered to discuss this evolution as part of the discussion group, “Community Economic Development Is Access to Justice.” The goal of the discussion group was …

Assessing The Social Determinants Of Health Needs Of Older Lgbt People In The Greater Miami Valley Of Ohio, Jessica L. Sokol
Master of Public Health Program Student Publications
Background: While the older LGBT population continues to grow, they remain an underserved, invisible, and under-researched segment of the population. They experience many of the same risk and protective factors of all older adults, but discrimination is one social determinant of health that is quite prevalent among this community, causing lasting impacts on health.
Objective: The purpose of this study was to assess the social determinants of health issues and needs of the aging LGBT population in Dayton, Ohio, in order to direct advocacy strategies and better targeting of local support efforts.
Methods: Data were collected through a cross-sectional survey …

Conflicts Of Interest And Law-Firm Structure, Cassandra Burke Robertson
Conflicts Of Interest And Law-Firm Structure, Cassandra Burke Robertson
Faculty Publications
Business and law are increasingly practiced on a transnational scale, and law firms are adopting new business structures in order to compete on this global playing field. Over the last decade, global law firms have merged into so-called “mega-brands” or “mega-firms”—that is, associations of national or regional law firms that join together under a single brand worldwide. For law firms, the most common mega-firm structure has been the Swiss verein, though the English “Company Limited by Guarantee” structure is growing in popularity as well, as is the similar “European Economic Interest Grouping.” All of these structures allow related entities to …

Focusing Patent Litigation, Bernard Chao
Focusing Patent Litigation, Bernard Chao
Sturm College of Law: Faculty Scholarship
Patent litigation is often called the “sport of kings.” While that phrase may not be appropriate for all patent disputes, it is an apt description of the high-stakes cases. Attorneys in these lawsuits tend to zealously advocate for their respective sides by asserting every argument that they can legitimately raise. Patentees often assert an excessive number of patent claims and even pile on unnecessary patents. Some of these claims may be well-founded. But so long as they can make a colorable infringement argument, patentees typically include many weaker claims too. Likewise, patent defendants respond with burdensome and duplicative invalidity defenses. …
