A Profile Of Highly Skilled Mexican Immigrants In Texas And Its Largest Metropolitan Areas, Ariel Ruiz Soto, Andrew Selee Feb 2019

A Profile Of Highly Skilled Mexican Immigrants In Texas And Its Largest Metropolitan Areas, Ariel Ruiz Soto, Andrew Selee

Mission Foods Texas-Mexico Center Research

Much of the U.S. debate on Mexican immigration has focused on low-skilled immigrants, who have composed the largest share of that population, but recent data suggest that the share of college-educated immigrants among recent Mexican arrivals is rising considerably. Texas has long been a gateway for Mexican immigration in part because of proximity and its deep economic ties to Mexico.

As more Mexican immigrants settle in Texas, especially in its metropolitan areas, governments and local communities stand to gain valuable contributions of an increasingly educated work force. Knowing the profile of highly skilled Mexican immigrants can inform policy-making decisions and …

Discovery Hydraulics, Seth Katsuya Endo Feb 2019

Discovery Hydraulics, Seth Katsuya Endo

UF Law Faculty Publications

Discovery reforms invariably have unexpected consequences. But the growth of electronically stored information has led to one constant — an ever-increasing pressure on the finite resources of both the judiciary and litigants. Courts, through their discovery rules, direct where that pressure will be channeled. But like any force in a closed system, it must be sent somewhere, ultimately requiring difficult tradeoffs amongst the three mainstay procedural justice norms of accuracy, efficiency, and participation. Discovery Hydraulics explores this phenomenon, cataloging how recently proposed or implemented document discovery reforms affect these norms.

In creating the first purposive taxonomy of recent document discovery …

Cities, Fair Housing, And Gentrification: A Proposal In Progressive Federalism, David D. Troutt Feb 2019

Cities, Fair Housing, And Gentrification: A Proposal In Progressive Federalism, David D. Troutt

Cardozo Law Review

This Essay divides in two Parts. In Part I, I will situate the three fair housing interests in the familiar AFFH planning environment, offering arguments to shape context. The harder task is implementation. What constitutes the specific laws and policies that indicate a city's commitment to fair housing? In Part II, I will draw upon some of the work that the center I direct at Rutgers Law School (the Center on Law, Inequality and Metropolitan Equity) has done in Newark, New Jersey, a working-class city experiencing an affordable housing crisis amid increasing economic development activity in the middle of one …

Shared Deliberations: Learning From The Voices Of Social Justice Lawyers On Their Aspirations, Challenges And Roles, Ian Head Feb 2019

Shared Deliberations: Learning From The Voices Of Social Justice Lawyers On Their Aspirations, Challenges And Roles, Ian Head

Dissertations, Theses, and Capstone Projects

Lawyers in the U.S. who attempt to advocate for social justice issues, often on behalf of those communities most targeted by government institutions and oppressive legal systems, have unique perspectives into the challenges of using the law to create transformative change. This thesis examines the voices of over a dozen attorneys fighting not only on behalf of their clients, but also wrestling with how to best use a set of legal tools not meant for dismantling systems of power. Listening to how these legal advocates navigate their roles inside a system of laws created to consolidate rather than distribute power …

Regional Integration, Multinational Enterprise Strategy And The Impact Of Country‐Level Risk: The Case Of The Emu, Jenny Hillemann, Alain Verbeke, Won-Yong Oh Jan 2019

Regional Integration, Multinational Enterprise Strategy And The Impact Of Country‐Level Risk: The Case Of The Emu, Jenny Hillemann, Alain Verbeke, Won-Yong Oh

Management, Entrepreneurship and Technology Faculty Research

The European Monetary Union (EMU) provides a new macro‐level, institutional setting for multinational enterprises (MNEs). The authors investigate the impact of regional integration on MNE strategy by analysing Belgian firms’ entry‐mode choices in foreign markets, both EMU and non‐EMU ones, with a focus on what impact remains of country‐level risk. They demonstrate that regional integration has altered the impact of country‐level institutional risk on MNE entry‐mode choices inside the EMU. The conventional predictions of international business theory have been reversed, with higher country‐level risk inside the EMU driving a preference for wholly owned subsidiaries. Within the integrated region, insider firms …

Branding Services In Mature Markets: Evidence From Egypt, Noha Bendary, Rasha Naggar Jan 2019

Branding Services In Mature Markets: Evidence From Egypt, Noha Bendary, Rasha Naggar

Business Administration

Branding of services is a challange due to services characteristics. It is even more challanging in mature markets. In mature markets, customers show low levels of brand loyalty, with minimum perceived differences among competing offers. All of these factors raise the complexity of branding services in mature highly competitive markets. This research provides guidance for branding services in such markets. To fulfill the research main aim, Aaker’s (1991) model of branding is extended to include variables of importance, as detected from literature, and confirmed by practitioners. Direct and indirect relationships are tested in the extended model to provide detailed guide …

Economic Empowerment In The Alabama Black Belt: A Transactional Law Clinic Theory And Model, Casey E. Faucon Jan 2019

Economic Empowerment In The Alabama Black Belt: A Transactional Law Clinic Theory And Model, Casey E. Faucon

Tennessee Journal of Race, Gender, & Social Justice

This essay argues that transactional legal clinics that serve university, urban, and rural communities with cultures and ecosystems shaped by the long-term impacts of racial segregation, Civil Rights, and socioeconomic disenfranchisement can play both a powerful symbolic role and a practical material role in regional economic development by providing direct client representation to historically and economically significant organizations and by training lawyers in transactional methods to use the law to impact the industrial identity and economic vitality of their communities. This essay concludes with a design for a transactional law clinic model.

Growing The Resistance: A Call To Action For Transactional Lawyers In The Era Of Trump, Gowri Krishna

Tennessee Journal of Race, Gender, & Social Justice

New Yorkers woke to a dreary, drizzly day on November 9, 2016. The weather matched the mood of many of the city’s inhabitants. Tears streamed down my face as I sat in the subway waiting for my stop. One by one, as my colleagues in the Community Development Project at the Urban Justice Center came into the office that morning, we shared expressions of shock, anger, fear, and sadness. We feared for what Trump’s election meant for our clients, for ourselves and our families, for our country, and for our world. In the days and weeks that followed, we coalesced …

The Legacy Of Civil Rights And The Opportunity For Transactional Law Clinics, Lynnise Pantin Jan 2019

The Legacy Of Civil Rights And The Opportunity For Transactional Law Clinics, Lynnise Pantin

Tennessee Journal of Race, Gender, & Social Justice

At the end of the historic march from Selma to Montgomery in 1965, Reverend Dr. Martin Luther King Jr. famously paraphrased abolitionist and Unitarian minister Theodore Parker stating, “the arc of the moral universe is long, but it bends towards justice.” The implication of the phrase is that the social justice goals of the Civil Rights Movement would eventually be achieved. His prayer was that servants of justice would be rewarded in due time. In other words, that the goals of the Civil Rights Movement would be achievable at some point in the future. President Obama resurrected the phrase throughout …

The Economic Justice Imperative For Lawyers In “Trump Country”, Priya Baskaran Jan 2019

The Economic Justice Imperative For Lawyers In “Trump Country”, Priya Baskaran

Tennessee Journal of Race, Gender, & Social Justice

This article serves as a call to action for rural law schools to meaningfully incorporate economic justice into transactional legal education, and in doing so, train much needed rural advocates, legal experts, and local leaders. Rural areas are continuously portrayed as “Trump Country” in today’s mainstream media coverage, which largely focuses on socio-cultural differences between urban and rural areas. Many rural scholars and activists are troubled by the “Trump Country” label as it masks the structural poverty issues that lead to housing insecurity, water insecurity, poor public health indicators, unemployment, underemployment, troubled public education systems, and environmental degradation impacting both …

What Dinosaurs Can Teach Lawyers About How To Avoid Extinction In The Odr Evolution, Elayne E. Greenberg, Noam Ebner Jan 2019

What Dinosaurs Can Teach Lawyers About How To Avoid Extinction In The Odr Evolution, Elayne E. Greenberg, Noam Ebner

Faculty Publications

This paper is a wake-up call for the legal profession: Heed the justice changes that are upon us or risk extinction. Online dispute resolution (hereinafter ODR) is currently being incorporated into U.S and international court systems, re-shaping and re-defining justice as we know it today. Courts and clients, two stakeholders in our justice system, are increasingly receptive to ODR as a viable option to help provide and access justice efficiently and affordably. The legal profession, the third stakeholder in our justice system, however, has been slower to react. As ODR plays an increasingly prominent role in the court system, it …

Paying The Piper But Not Calling The Tune: Litigation Financing And Professional Independence, W. Bradley Wendel Jan 2019

Paying The Piper But Not Calling The Tune: Litigation Financing And Professional Independence, W. Bradley Wendel

Akron Law Review

Most commercial litigation financing agreements are designed to create distance between the funders of the litigation and legal counsel. Our legal system demands that third party litigation financiers refrain from interfering with a client’s decisions in their matter, and traditional third-party litigation financing is merely a passive profit-making opportunity. There are cases, however, where the litigation financier is not interested in making a profit, but instead wishes to participate in the litigation for political, ideological, or personal reasons. In this article, I will explore whether what I call “interested litigation financing” is an exercise of First Amendment rights or is …

Role Emerging Placements: Skills Development, Postgraduate Employment, And Career Pathways, Sobiya Syed, Andrea Duncan Jan 2019

Role Emerging Placements: Skills Development, Postgraduate Employment, And Career Pathways, Sobiya Syed, Andrea Duncan

The Open Journal of Occupational Therapy

Occupational therapy educators are increasingly using role emerging placements (REPs) as a forum for students to develop skills required to work in emerging areas of practice. This study explores the impact of REPs on skill development, postgraduate employment, and career pathways for occupational therapists. An online survey was sent to occupational therapists across Canada (n = 1,763). Occupational therapists who had completed a REP responded to the online survey (n = 88). Descriptive analysis was used to examine trends in the quantitative data, and content analysis was used to code categories derived from qualitative survey data. Results indicated five skills …
