Environmental Factors Influencing College Student Athletes Quality Of Life, Carly Ono, Anthony Sassano, Janine Rebekah Villanueva, Ashton Wolffe Jan 2019

Environmental Factors Influencing College Student Athletes Quality Of Life, Carly Ono, Anthony Sassano, Janine Rebekah Villanueva, Ashton Wolffe

Occupational Therapy | MSOT Capstone Projects

College students face a number of obstacles to achieving success in their desired areas of occupation. However, fulfilling all the responsibilities of their other roles as well may present a risk for occupational imbalances. This is typically the case when examining the lifestyles of collegiate athletes. In this qualitative study, researchers interviewed 15 Dominican University of California (DUoC) college student athletes, playing at the National Collegiate Athletic Association (NCAA) Division II level to assess what environmental factors influence their quality of life (QoL). QoL was determined as the best measure seeing as how it encompasses all components of what deems …

Physiological Responses Of Adults With Sensory Over-Responsiveness, Catherine Anne Datu, Nicholas Wing Or, Megan Melody Valentine, Megan Jeanne Velcich Jan 2019

Physiological Responses Of Adults With Sensory Over-Responsiveness, Catherine Anne Datu, Nicholas Wing Or, Megan Melody Valentine, Megan Jeanne Velcich

Student Research Posters

The purpose of this research study is to identify if there are physiological response patterns associated with self-reported sensory over-responsiveness (SOR) in typical adults. SOR is the most common sensory modulation disorder and negatively affects the daily experiences of those that report SOR. The first phase of the study consisted of phone interviews where participants were screened for any potential characteristics that could affect physiological function. Then, the SRQ and AASP were used in conjunction to identify low and high SOR, typical adults. The last phase utilized the Sensory Challenge Protocol, which is both standardized and randomized, to expose participants …

Evaluating A Permanent Court Solution For International Investment Disputes, Emily Palombo Jan 2019

Evaluating A Permanent Court Solution For International Investment Disputes, Emily Palombo

Law Student Publications

Despite the original objective of investor state dispute settlement (“ISDS”)—to create an unbiased arbitration mechanism to resolve conflicts between states and foreign investors—ISDS tribunals have gained the reputation of being one-sided, nontransparent, and inconsistent in decisions rendered. A major reform proposed to address the criticism of ISDS is the creation of one permanent tribunal, rather than numerous ad hoc tribunals constituted separately for each investment dispute. Discussion of ISDS reform in light of its historical context poses the question: is ISDS really a broken system, or have our global priorities and concerns changed over time? While improvements can be made, …

The Costs Of Uncertainty: The Doj’S Stalled Progress On Accessible Medical Equipment Under The Americans With Disabilities Act, Elizabeth Pendo Jan 2019

The Costs Of Uncertainty: The Doj’S Stalled Progress On Accessible Medical Equipment Under The Americans With Disabilities Act, Elizabeth Pendo

Articles

Imagine seeking medical care for serious pressure sores for a year, but your doctor never examining the sores because you could not get on the examination table in her office. Or imagine going more than fifteen years without an annual well-woman examination for the same reason, or your doctor guessing at the right dosage for a prescription because there was no scale that she could use to weigh you.

Although these scenarios may be difficult for many to imagine, they are common experiences for individuals with mobility disability. The Trump administration’s attacks on the Patient Protection and Affordable Care Act …

Embracing Visual Experience And Data Knowledge: Efficient Embedded Memory Design For Big Videos And Deep Learning, Jonathon Edstrom

Electrical and Computer Engineering

Energy efficient memory designs are becoming increasingly important, especially for applications related to mobile video technology and machine learning. The growing popularity of smart phones, tablets and other mobile devices has created an exponential demand for video applications in today’s society. When mobile devices display video, the embedded video memory within the device consumes a large amount of the total system power. This issue has created the need to introduce power-quality tradeoff techniques for enabling good quality video output, while simultaneously enabling power consumption reduction. Similarly, power efficiency issues have arisen within the area of machine learning, especially with applications …

Applying Merleau-Ponty’S Phenomenology Of Perception To Maternal Well-Being In The First Twelve Months Following Birth, Anna Bosco Jan 2019

Applying Merleau-Ponty’S Phenomenology Of Perception To Maternal Well-Being In The First Twelve Months Following Birth, Anna Bosco

Theses

Maternal emotional wellbeing is a deeply personal experience embodied through society; however previous literature examining emotional adaptation to motherhood has focussed on negative outcomes, risk factors and pathology. This perspective is limiting and objectifies a mother’s experiences rather than exploring her being-in-the- world. In contrast to current conceptualisations, Maurice Merleau-Ponty's phenomenology of perception asserts a holistic view of the individual within the world, whereby the subjective body and the lived body are intertwined, and perception is a conversation between the body and the world. This conversation is how the mother embodies the world within her being, for example how she …

Incorporation Without Assimilation: Legislating Tribal Civil Jurisdiction Over Non-Members, Alexander Tallchief Skibine Jan 2019

Incorporation Without Assimilation: Legislating Tribal Civil Jurisdiction Over Non-Members, Alexander Tallchief Skibine

Utah Law Faculty Scholarship

For the last 40 years the Supreme Court has been engaged in a measured attack on the sovereignty of Indian tribes when it comes to tribal court jurisdiction over people who are not members of the tribe asserting that jurisdiction. The Congress has already enacted legislation partially restoring some tribal courts’ criminal jurisdiction over non-members. This Essay proposes to legislatively reconfirm the civil jurisdiction of tribal courts over such non-members. After examining the Supreme Court’s jurisprudence in this area and summarizing the Court’s main concerns with such tribal jurisdiction, this Essay explores various legislative options before settling on a preferred …

Disability And Automation: The Promise Of Cars That Automate Driving Functions, Leslie Francis

Utah Law Faculty Scholarship

Automated vehicles present tremendous possibilities for people with disabilities. They also have the potential to open new legal challenges for antidiscrimination law, tort liability, and privacy considerations. The initial discussions of these vehicles have pointed out their potential significance for people with disabilities, while largely ignoring what they might mean for disability law. This Article sets out first steps on the inviting road ahead for people with disabilities as users of automated means of transport.

Addiction As Disease, Teneille R. Brown Jan 2019

Addiction As Disease, Teneille R. Brown

Utah Law Faculty Scholarship

The opioid addiction epidemic is the most overwhelming public health crisis our country has faced. It is now creating a legal crisis, as the its poisonous fruits spill over into the criminal, tort, and family courts. The epidemic costs the U.S. economy about $500 billion every year, and the pressure is crippling our legal systems. This Article is an attempt to relieve some of that pressure, by advocating for a comprehensive public health campaign based upon a new model of addiction. Research shows that the prevalent “moral choice” model of addiction has facilitated stigma and discouraged treatment, by viewing affected …

#Squadgoals: A Response To Seth Waxman, Amelia Rinehart Jan 2019

#Squadgoals: A Response To Seth Waxman, Amelia Rinehart

Utah Law Faculty Scholarship

Former Solicitor General Seth Waxman’s recent remarks, framing our current age of patent law in the Supreme Court as “interesting times,” unquestionably captures the exhilaration of an active Supreme Court in this area of the law. Waxman knows his way around patent cases decided by the Supreme Court — he presented arguments in four of the six patent cases in the 2016 Term — but he also has an extensive appellate practice before the Court of Appeals for the Federal Circuit (“Federal Circuit”), which has exclusive appellate jurisdiction over patent cases. Given his substantial experience in patent appellate litigation, Waxman …

The False Promise Of Health Data Ownership, Jorge L. Contreras Jan 2019

The False Promise Of Health Data Ownership, Jorge L. Contreras

Utah Law Faculty Scholarship

In recent years there have been increasing calls by patient advocates, health law scholars and would-be data intermediaries to recognize personal property interests in individual health information (IHI). While the propertization of IHI appeals to notions of individual autonomy, privacy and distributive justice, the implementation of a workable property system for IHI presents significant challenges. This essay addresses the issues surrounding the propertization of IHI from a property law perspective. It first observes that IHI does not fit recognized judicial criteria for recognition as personal property, as IHI defies convenient definition, is difficult to possess exclusively, and lacks justifications for …

Constitutional Environmental Law, Or, The Constitutional Consequences Of Insisting That The Environment Is Everybody's Business, Robin Kundis Craig Jan 2019

Constitutional Environmental Law, Or, The Constitutional Consequences Of Insisting That The Environment Is Everybody's Business, Robin Kundis Craig

Utah Law Faculty Scholarship

Constitutional environmental law has become a recognized and institutionalized specialty within environmental law, an acknowledgement of the pervasive interactions between the U.S. Constitution and the federal environmental statutes that go well beyond the normal constitutional underpinnings of federal administrative law. This Article posits that constitutional environmental law is the result of Congress consciously deciding that environmental protection is everybody’s business — specifically, from Congress’s that states should participate in rather than be preempted by federal environmental law, that private citizens and organizations should help to enforce the statutes, and that private land and water rights are necessary components of national …

Trickster Law: Promoting Resilience And Adaptive Governance By Allowing Other Perspectives On Natural Resource Management, Robin Kundis Craig Jan 2019

Trickster Law: Promoting Resilience And Adaptive Governance By Allowing Other Perspectives On Natural Resource Management, Robin Kundis Craig

Utah Law Faculty Scholarship

The Anthropocene requires a new approach to natural resources law and policy, an approach that this short article terms "trickster law." Trickster law incorporates insights from resilience theory, adaptive governance scholarship, and cultural/anthropological studies of trickster tales to create a legal approach to natural resource management that is precautionary, engaged in proactive planning, based in principled flexibility, and pluralistic. This article focuses on the "pluralism" component, presenting three examples of how law modified to be more inclusive and respect different value systems has generated new approaches to natural resources management that better promote social-ecological resilience to climate change and other …

Shareholder Activism And Stakeholder Engagement Strategies: Promoting Environmental Justice, Human Rights, And Sustainable Development Goals, Erika George Jan 2019

Shareholder Activism And Stakeholder Engagement Strategies: Promoting Environmental Justice, Human Rights, And Sustainable Development Goals, Erika George

Utah Law Faculty Scholarship

The United Nations 2030 Agenda for Sustainable Development is an ambitious "plan of action for people, planet and prosperity" which seeks to promote peace and eradicate poverty. The Agenda's goals cannot be reached without private sector participation and changes to certain business practices that contribute to adverse environmental and human rights impacts. When natural resources are managed responsibly the resulting economic development can help to eradicate poverty. However, when natural resources are managed poorly, certain extractives industry sector practices can generate or exacerbate human rights abuses, environmental degradation, corruption, and conflict. Fossil fuels are connected to the changing climate. The …

Adaptive Management For Ecosystem Services At The Wildland-Urban Interface, Robin Kundis Craig, J.B. Ruhl Jan 2019

Adaptive Management For Ecosystem Services At The Wildland-Urban Interface, Robin Kundis Craig, J.B. Ruhl

Utah Law Faculty Scholarship

Managing the wildland-urban interface (WUI) is a widely-recognized land use problem plagued by a fractured geography of land parcels, management jurisdictions, and governance mandates and objectives. People who work in this field have suggested a variety of approaches to managing this interface, from informal governance to contracting to insurance. To date, however, none of these scholars have fully embraced the dynamism, uncertainty, and complexity of the WUI — that is, its status as a complex adaptive system. In focusing almost exclusively on the management of this interface to control wildfire, this scholarship largely ignores the factor that rampant wildfire is …

The Effects Of Red Meat Or Sugar Supplementation During Gestation And Lactation On Maternal Reproduction, Maternal And Offspring Blood Parameters, And Offspring Body Composition, Alexis Michelle Siomka Jan 2019

The Effects Of Red Meat Or Sugar Supplementation During Gestation And Lactation On Maternal Reproduction, Maternal And Offspring Blood Parameters, And Offspring Body Composition, Alexis Michelle Siomka

Animal Sciences

Using swine as a model for humans, this study was conducted to examine whether maternal consumption of added protein (red meat) or free sugar (glucose) throughout gestation and lactation was associated with maternal reproduction, maternal and offspring blood parameters, and offspring mature body composition. Maternal breed of sows of at least one year of age at breeding were utilized. At D-40 of gestation, sows were randomly assigned to one of four dietary supplementation treatments 1) Control (CON): corn-soy gestation diet; 2) Beef (GB): 4 oz cooked beef patty; 3) Sugar (SUG): sugar on a caloric equivalent to the beef patty; …

Therapeutic Potential Of Piperlongumine For Pancreatic Ductal Adenocarcinoma, Jiyan Mageed Mohammad Jan 2019

Therapeutic Potential Of Piperlongumine For Pancreatic Ductal Adenocarcinoma, Jiyan Mageed Mohammad

Cellular and Molecular Biology

Pancreatic ductal adenocarcinoma (PDAC) is among the most lethal malignancies because it is often diagnosed at a late disease stage and has a poor response rate to currently available treatments. Therefore, it is critical to develop new therapeutic approaches that will enhance the efficacy and reduce the toxicity of currently used therapies. Here we aimed to evaluate the therapeutic potential and mechanisms of action for piperlongumine (PL), an alkaloid from long pepper, in PDAC models. We postulated that PL causes PDAC cell death through oxidative stress and complements the therapeutic efficacy of chemotherapeutic agents in PDAC cells. First, we determined …

Interest Rate And Commodity Price Impacts On Farm-Level Financials, Ann Denk Jan 2019

Interest Rate And Commodity Price Impacts On Farm-Level Financials, Ann Denk

Agribusiness and Applied Economics

The agriculture industry has been around for hundreds of years. Although farmers and ranchers work every day to put food on the tables of billions of people from all around the world, most agricultural producers require assistance to finance their operations and continue production. This research is motivated by recent changes in interest rates and the downturn in agricultural commodity prices. This study examines how farm-level financial statements are impacted by changes in interest rates and agricultural commodity market prices. A Monte Carlo simulation is used to model several stochastic variables and derive key financial calculations. This study shows how …

Trade In Crispr/Gene-Edited Wheat: A Partial Equilibrium Analysis, Prince Fosu Jan 2019

Trade In Crispr/Gene-Edited Wheat: A Partial Equilibrium Analysis, Prince Fosu

Agribusiness and Applied Economics

Previous studies have analyzed how the adoption of genetically engineered or modified technologies have affected agricultural crops such as corn, soybeans, cotton, and barley without focusing on wheat. Also, given the negative impact of drought on wheat production, no studies have focused on the implications of drought tolerant (HB4) and CRISPR/gene-editing on wheat trade. To address these issues, this study employed the partial equilibrium analysis and analyzed the implications of drought tolerant (HB4) and CRISPR/gene-editing technology adoption on wheat trade under various scenarios. The study found that when Argentina, Australia, United States, Canada, and Russia adopt gene-editing wheat, all consuming …

Telomere Length And Senescence In A Long-Lived Fish (Ictiobus Cyprinellus), Derek Sauer Jan 2019

Telomere Length And Senescence In A Long-Lived Fish (Ictiobus Cyprinellus), Derek Sauer

Biological Sciences

The pattern of shorter telomere lengths in older individuals has been observed across many vertebrates, but has not been well-documented in bony fishes. Bony fish (i.e., Class Osteichthyes) represent the most speciose and oldest group of vertebrates, and understanding their telomere dynamics can fill gaps in our understanding of the process and evolution of aging in vertebrates. In this study we quantified telomere length, immune function, and stress in bigmouth buffalo (Ictiobus cyrpinellus), a long-lived bony fish in the family Catostomidae, to characterize variation in telomeres and condition. We found that length of telomeres extracted from red blood cells was …
