Tourists Of The Past: Topographies Of Memory In W. G. Sebald's Austerlitz, Ana Menéndez's Loving Che, And Teju Cole's Open City, Benjamin Lee Williams

Open Access Theses & Dissertations

Examining, comparatively, the exemplary fictional texts of W. G. Sebald, Ana Menéndez, and Teju Cole enriches the study of exilic experience concerning cultural memory as their destabilization, while geographically and ethnically divergent, represents the constellations of mobility and potential for memory. As absences resonate and profoundly disrupt their works, there is a turn to histories to cope with traumas. By turning to the past, each writer confronts destabilization and uprootedness and, in doing so, plays a game with History. Readers play too as we search through the fictionalized lacunae to consider the extent to which we are complicit in the …

This Is The Moment Of Truth, Ray León, Roger Lin, Camille Pannu, Irene Vasquez

Faculty Scholarship

While everyone is taking their seats, I wanted to quickly just thank the prior panelists today and bring it full circle, back to Mustafa’s opening keynote, where he asked, “Who is fighting these fights? Who is doing this work in fighting for justice?” He pointed out that many of the people fighting these fights, many of the advocates, are people who look like you and are also the same age as you. That is why we have this panel. What can you, as students, do to get involved in the environmental justice or social justice movements?

My name is Roger …

Understanding the size and characteristics of the populations included in these requirements can help inform policy initiatives and anticipate effects.

The Primitive Lawyer Speaks!: Thoughts On The Concepts Of International And Rabbinic Laws, Harlan G. Cohen Jan 2019

The Primitive Lawyer Speaks!: Thoughts On The Concepts Of International And Rabbinic Laws, Harlan G. Cohen

Scholarly Works

A feature of the Norman J. Shachoy Symposium: The Rabbinic Idea of Law: Interactions and Implications

Inspired by Chaim Saiman’s brilliant book, Halakhah: The Rabbinic Idea of Law, this essay draws connections between the lived experiences of international law and Jewish law, focusing in particular on (1) the centrality of practice, (2) the search for and construction of authority in communities of practice (the “invisible college”), (3) the challenges and opportunities of fragmentation and pluralism, and (4) the difficulty translating their methods to more state-like institutions, like courts and legislation. The hope is that this testimony of one of H.L.A. …

Death By Stereotype: Race, Ethnicity, And California’S Failure To Implement Furman’S Narrowing Requirement, Catherine M. Grosso, Jeffrey A. Fagan, Michael Laurence, David C. Baldus, George W. Woodworth, Richard Newell Jan 2019

Death By Stereotype: Race, Ethnicity, And California’S Failure To Implement Furman’S Narrowing Requirement, Catherine M. Grosso, Jeffrey A. Fagan, Michael Laurence, David C. Baldus, George W. Woodworth, Richard Newell

Faculty Scholarship

This Article examines the possible racial and ethnic implications of California’s expansive death penalty statute in light of the Eighth Amendment’s requirement that each state statute narrow the subclass of offenders on whom a death sentence may be imposed. The narrowing requirement derives from the holding in Furman v. Georgia over forty-five years ago, when the U.S. Supreme Court ruled that existing death penalty statutes violated the Eighth Amendment’s prohibition against cruel and unusual punishments. Citing statistics demonstrating arbitrary and capricious application of capital punishment, a majority of the Justices concluded that a death sentencing scheme is unconstitutional if it …

The End Of Intuition-Based High-Crime Areas, Ben Grunwald, Jeffrey A. Fagan Jan 2019

The End Of Intuition-Based High-Crime Areas, Ben Grunwald, Jeffrey A. Fagan

Faculty Scholarship

In 2000, the Supreme Court held in Illinois v. Wardlow that a suspect’s presence in a “high-crime area” is relevant in determining whether an officer has reasonable suspicion to conduct an investigative stop. Despite the importance of the decision, the Court provided no guidance about what that standard means, and over fifteen years later, we still have no idea how police officers understand and apply it in practice. This Article conducts the first empirical analysis of Wardlow by examining data on over two million investigative stops conducted by the New York Police Department from 2007 to 2012.

Our results suggest …

Trade Openness And Antitrust Law, Anu Bradford, Adam S. Chilton Jan 2019

Trade Openness And Antitrust Law, Anu Bradford, Adam S. Chilton

Faculty Scholarship

Openness to international trade and adoption of antitrust laws can both curb anti-competitive behavior. But scholars have long debated the relationship between the two. Some argue that greater trade openness makes antitrust unnecessary, while others contend that antitrust laws are still needed to realize the benefits of trade liberalization. Data limitations have made this debate largely theoretical to date. We study the relationship between trade and antitrust empirically using new data on antitrust laws and enforcement activities. We find that trade openness and stringency of antitrust laws are positively correlated from 1950 to 2010 overall, but the positive correlation disappears …

Neutralizing Antibody Titers Against Field Strains Of Bovine Viral Diarrhea Virus After Vaccination With Three Commercial Vaccines, Gi̇zem Alpay, Kadi̇r Yeşi̇lbağ Jan 2019

Neutralizing Antibody Titers Against Field Strains Of Bovine Viral Diarrhea Virus After Vaccination With Three Commercial Vaccines, Gi̇zem Alpay, Kadi̇r Yeşi̇lbağ

Turkish Journal of Veterinary & Animal Sciences

Modified killed vaccines against bovine viral diarrhea virus (BVDV) are used worldwide. In the present study, the cross-neutralization antibody responses against field strains from seven subgenotypes of BVDV-1 and one subgenotype of BVDV-2 were evaluated using sera obtained by three inactivated commercial vaccines. One vaccine contained both BVDV-1 and BVDV-2 strains, while the others contained only BVDV-1a. Three vaccine groups, each containing five calves, were vaccinated two times with 30-day intervals. The antibody titers were evaluated by virus neutralization assay. The monovalent vaccine induced the highest antibody titers. Significant levels of neutralizing antibody titers were maintained up to the last …

A Macromarketing View Of Sustainable Development In Vietnam, Clifford J. Shultz, Mark Peterson Jan 2019

A Macromarketing View Of Sustainable Development In Vietnam, Clifford J. Shultz, Mark Peterson

School of Business: Faculty Publications and Other Works

The authors apply methods and perspectives from several disciplines to explore the effects of Vietnam's economic development on various ecosystems, to offer a macromarketing view of sustainable development in Vietnam. An adapted version of the Sustainable Society Index was used to assess Vietnam's sustainability, how Vietnam's measures compare to other countries, with implications for future sustainable-development. Among several findings, Vietnam earns favorable sustainability ratings in absolute terms for water resources, healthy living, energy use, greenhouse gases, genuine savings, and employment. Ominously, Vietnam and some of its nearby neighbors post poor scores for energy savings and education. Going forward, energy savings, …

Aircraft Interior Design And Satisfaction For Different Activities; A New Approach Toward Understanding Passenger Experience, Golnoosh Torkashvand, Lucas Stephane, Peter Vink

International Journal of Aviation, Aeronautics, and Aerospace

Among airlines and aircraft manufacturers there is much attention for passenger experience. However, there is not much literature on how the activities of passengers can be supported by the aircraft interior. The current study focuses on the need finding and requirements analysis of flight passengers. Twenty-three activities were defined based on retrospective interviews and brainstorming sessions. Respondents were asked to rate their overall perception related to the importance of each of those 23 activities on a Linkert scale, from “not at all important” to “extremely important”. On a separate question they were also asked to rate their overall satisfaction by …

A Case Study Of 'Internationalisation At Home' Leading To A Proposal For Critical Global Pedagogies, Pollyanna Magne Jan 2019

A Case Study Of 'Internationalisation At Home' Leading To A Proposal For Critical Global Pedagogies, Pollyanna Magne

Plymouth Institute of Education Theses

This thesis examines current practice around ‘internationalisation at home’ (Jones, 2014). This is contextualised in single case study institution, in an isolated region of the UK, and takes place following the Brexit vote and the election of the Trump administration. The research utilised a multifaceted data collection approach including interviews, focus groups, written responses, and documentary analysis of publicly available documents. The data provides evidence that the majority of current internationalisation activity is economically motivated. Intercultural or global curriculum activity was evident but unstructured and limited. Central to this thesis is a discussion relating to the impact of insular thinking. …

Wild Entanglements: Exploring The Visions And Dilemmas Of ‘Renaturing’ Urban Britain, Cara Louisa Clancy Jan 2019

Wild Entanglements: Exploring The Visions And Dilemmas Of ‘Renaturing’ Urban Britain, Cara Louisa Clancy

School of Geography, Earth and Environmental Sciences Theses

In a rapidly urbanising world, where lands are increasingly repurposed for human endeavours, where seas and rivers carry the weight of mounting plastic, where species extinction is a common theme and where the effects of global climate change are a daily reality, there has never been a more pressing need to rethink nature-society relations and environmental ethics. This thesis draws insights from two cases of urban renaturing in Britain (London and Plymouth) to explore critical issues in contemporary environmental practice, including what matters for humans and nonhumans in such endeavours. Renaturing is here understood as an intentional, reflective attempt to …

The Hydrothermal Rare Earth Element Mineralisation At The Peralkaline Carbonatite Fen Complex In Norway, Christian Marien Jan 2019

The Hydrothermal Rare Earth Element Mineralisation At The Peralkaline Carbonatite Fen Complex In Norway, Christian Marien

School of Geography, Earth and Environmental Sciences Theses

The Fen Complex in Norway consists of a composite carbonatite-ijolite-pyroxenite diatreme intrusion. Locally, the hydrothermally altered, hematite-rich rock rødbergite exhibited high grades (up to 2.1 wt% REE) of rare earth elements (REE). In order to secure the supply of REE for future technology markets in Europe, it becomes increasingly important to establish potential domestic REE sources like the Fen Complex. This project aims to develop a model for the carbonatite-hosted hydrothermal REE deposit (‘Rødbergite’) in the Fen Complex, Norway. SEM and ICP-MS trace element analyses of 73 bulk samples taken along various geological key transects showed the transformation of carbonatite, …

Topographic Reconstructions Of The Variscan Belt Of Western Europe Through The Study Of Fossil Hydrothermal Systems, Camille Dusséaux Jan 2019

Topographic Reconstructions Of The Variscan Belt Of Western Europe Through The Study Of Fossil Hydrothermal Systems, Camille Dusséaux

School of Geography, Earth and Environmental Sciences Theses

This thesis presents the first stable isotope quantification of paleoaltimetry for the Variscan Belt of Western Europe that integrates late-Carboniferous hydrogen isotope ratios of meteoric water in the internal zones in the Armorican Massif (AM) and the French Massif Central (FMC) with age-equivalent precipitation records in the foreland Bourbon l’Archambault basin (BA) and the Montagne Noire (MN). Combined microstructural, hydrogen and oxygen stable isotope, thermometry and geochronology data allow the calculation of the isotopic composition of meteoric water in the internal zones of the orogen where surface-derived fluids infiltrated the ductile segment of the Quiberon, Piriac (AM) and Felletin (FMC) …

Assessing Economic, Social, Political And Environmental Issues Related To Mega-Projects: A Case Study Of Merowe Dam In Sudan, Al-Noor Abdullah

School of Geography, Earth and Environmental Sciences Theses

Contemporary global economic development has been undergoing a transition into multiple pathways aiming at sustainable development, poverty eradication and environmental protection especially in energy production to achieve socioeconomic development (Behera, 2006; Dunning, 2006). In developing countries, a shift from traditional development to modern economic development has begun since the 1970s (Amin & Thrift, 1995; Behera, 2006). Many developing countries have used mega-dams as a source of electricity generation and water supply for irrigation, urban and industrial uses. Dams are still preferred as the primary strategy to pursue economic development, which has been reinforced by increasing levels of urbanisation, industrialisation, agribusiness …

Palaeomagnetic And Structural Analysis Of The Metamorphic Sole Rocks Of The Mersin Ophiolite, Southern Turkey, Buğra Çavdar Jan 2019

Palaeomagnetic And Structural Analysis Of The Metamorphic Sole Rocks Of The Mersin Ophiolite, Southern Turkey, Buğra Çavdar

School of Geography, Earth and Environmental Sciences Theses

The Mersin ophiolite (Tauride Belt, southern Turkey) is a well-exposed Neo-Tethyan suprasubduction zone ophiolite that formed in the Late Cretaceous. It is underlain by metamorphic sole rocks (predominantly amphibolites) inferred to have formed at the top of the down-going plate during subduction. A recent model for exhumation of such rocks from peak metamorphic depths involves slab flattening caused by removal of material from the mantle wedge during fore-arc spreading, implying significant rotation of the sole after formation. Previous palaeomagnetic analysis of non-metamorphosed dykes cutting the Mersin sole rocks indicates a ~45° clockwise rotation of the sole and dykes around a …

The ‘Effective Decriminalisation’ Of Acquaintance Rape: Rape Myth Acceptance, Secondary Victimisation And Anti-Rape Campaigns, Eleanor Avery Jan 2019

The ‘Effective Decriminalisation’ Of Acquaintance Rape: Rape Myth Acceptance, Secondary Victimisation And Anti-Rape Campaigns, Eleanor Avery

Plymouth Law Review

This article examines the role that rape myth acceptance (RMA) and societal misconceptions play, in shaping the experience that victims of acquaintance rape are presented with, both culturally and legally. The utilisation of RMA by all bodies of the criminal justice system (CJS) as an essential movement away from the merits-based approach as set out in the Sexual Offences Act 2003 will be analysed in detail. Legal fictions surrounding the presumption of innocence, inclusion of third party and prior sexual history evidence alongside perceived complainant credibility and veracity can all be considered as factors influencing the unprecedentedly low prosecution rate …

The Harm Of Child Removal, Shanta Trivedi Jan 2019

The Harm Of Child Removal, Shanta Trivedi

All Faculty Scholarship

When the state proves or even merely alleges that a parent has abused or neglected a child, family courts may remove the child from the parent’s care. However, research shows separating a child from her parent(s) has detrimental, long-term emotional and psychological consequences that may be worse than leaving the child at home. This is due to the trauma of removal itself, as well as the unstable nature of, and high rates of abuse in, foster care. Nevertheless, the child welfare system errs on the side of removal and almost uniformly fails to consider the harms associated with that removal. …

Beyond Colonizing Epistemicides: Toward A Decolonizing Framework For Indigenous Education, Samuel B. Torres Jan 2019

Beyond Colonizing Epistemicides: Toward A Decolonizing Framework For Indigenous Education, Samuel B. Torres

LMU Theses and Dissertations

American schooling and Indigenous peoples share a coarse relationship mired by devastating periods of forced removal, indoctrination, and brutal assimilation methods. Over the course of more than a century of failed education policy—though often veiled in good intentions—Indigenous peoples have yet to witness a comprehensive Indigenous education program that fundamentally honors the federal trust responsibility of the United States government. On the contrary, with a contemporary approach of apathy, invisibility, and institutionalization, it is not difficult to see the legacy of settler colonialism continuing to wield its oppressive influence on Indigenous communities. Wolfe’s (2006) claim that “invasion is a structure, …

Leveraging Summary Statistics To Make Inferences About Complex Phenotypes In Large Biobanks, Angela Gasdaska, Derek Friend, Rachel Chen, Jason Westra, Matthew Zawistowski, William Lindsey, Nathan L. Tintle

Faculty Work Comprehensive List

As genetic sequencing becomes less expensive and data sets linking genetic data and medical records (e.g., Biobanks) become larger and more common, issues of data privacy and computational challenges become more necessary to address in order to realize the benefits of these datasets. One possibility for alleviating these issues is through the use of already-computed summary statistics (e.g., slopes and standard errors from a regression model of a phenotype on a genotype). If groups share summary statistics from their analyses of biobanks, many of the privacy issues and computational challenges concerning the access of these data could be bypassed. In …

Perceptions And Expected Immediate Reactions To Severe Storm Displays, Ihnji Jon, Shih-Kai Huang, Michael K. Lindell

Research, Publications & Creative Work

The National Weather Service has adopted warning polygons that more specifically indicate the risk area than its previous county-wide warnings. However, these polygons are not defined in terms of numerical strike probabilities (ps). To better understand people’s interpretations of warning polygons, 167 participants were shown 23 hypothetical scenarios in one of three information conditions—polygon-only (Condition A), polygon + tornadic storm cell (Condition B), and polygon + tornadic storm cell + flanking nontornadic storm cells (Condition C). Participants judged each polygon’s ps and reported the likelihood of taking nine different response actions. The polygon-only condition replicated the …

Possibilities For Trans-Affirming Policy Potential: A Case Study Of A Canadian Catholic School, Lindsay Herriot, Tonya D. Callaghan

Journal of Catholic Education

Background: Mainstream media is increasingly reporting on the relationships between Catholic and trans identities in parochial schools, particularly with regard to gendered washroom use. With greater numbers of trans youth coming out at younger ages, significant educational policy changes are being considered around how Catholic schools can or should include trans youth. Method: This study applies trans and queer theologies to Critical Discourse Analysis (CDA) in investigating the Wilson case, which was the first known instance of a Catholic school including some affirming policy provisions for trans youth. The authors additionally collected and coded 12 news articles from a variety …
