Can existing corporate fiduciary principles adequately guide officers and directors regarding the proper development and utilization of artificial intelligence ("AI") technologies? What role should AI play in corporate boardrooms? These questions seem especially pressing considering the increasing prevalence of AI throughout a variety of industries in a host of key functions. It should come as little surprise, however, that with the advent of a powerful new technology, important concerns arise regarding the limits on its use and the ends to which it should be directed. Professor Gilchrist argues that calls for more individual prosecutions in cases of corporate malfeasance are ultimately misguided. In response to the financial crisis of 2007–08, Congress passed the Dodd-Frank Wall Street Reform and Consumer Protection Act in 2010. The Economic Growth, Regulatory Relief, and Consumer Protection Act of 2018 has repealed or altered many Dodd-Frank’s reforms. This Article analyzes the EGRRCPA’s deregulation of large banks, community banks, mortgage lending standards, and consumer protection in the industry. While Dodd-Frank may have taken only small steps to address the causes of the financial crisis, the EGRRCPA completely ignores those risk factors. Congress and the Administration have justified the counter-reforms on the ground that they have hampered economic growth, but …

A single cyberattack event involving 1 major corporation can cause severe business and social devastation. In this single case study, a major U.S. airline company was selected for exploration of the strategies information technology administrators and airline managers implemented to reduce the financial devastation that may be caused by a cyberattack. Seven participants, of whom 4 were airline managers and 3 were IT administrators, whose primary responsibility included implementation of strategies to plan for and respond to cyberattacks participated in the data collection process. The U.S. Federal Bureau of Investigation (FBI) categorizes mortgage fraud as either fraud for property or fraud for profit. Fraud for profit, which includes the vast majority of cases, may involve several parties to the transaction, including professional agents such as brokers, appraisers, builders, title examiners, escrow officers, attorney, and lenders. Fraud for profit schemes usually include several purchase transactions where homes are quickly sold, with lenders and subsequent purchasers suffering the losses. Purpose
The purpose of this paper is to study the relation between compensation clawbacks and lawsuits and analyze how these two corporate disciplinary forces interact. This paper hypothesizes that by allowing firms to recoup compensation from managers who breach their fiduciary duty, clawbacks provide a form of discipline that potentially reduces the likelihood of managerial wrongdoing, which, in turn, lowers the risk of corporate lawsuits.
Design/methodology/approach
This paper identifies whether or not a company in the S&P 1500 had a clawback policy between 2007 and 2014 by searching the company filings and press releases. The authors also construct different proxies …

Although malware detection is a very active area of research, few works were focused on using physical properties (e.g., power consumption) and multimodal features for malware detection. We designed an experimental testbed that allowed us to run samples of malware and non-malicious software applications and to collect power consumption, network traffic, and system logs data, and subsequently to extract dynamic behavioral-based features. We also extracted code-based static features of both malware and non-malicious software applications. Victim blaming refers to an attributional tendency in which some level of responsibility for a negative outcome is placed on victims (Maes, 1994). Many victims of crimes face stigmatization in the form of blame from friends, acquaintances, the criminal justice system, media, strangers, and even perpetrators of the crimes themselves (e.g., Cross, Parker, & Sansom, 2019; Gordon & Riger, 1991). Victim characteristics, type of crime, and observer characteristics all influence victim blaming tendencies. This study evaluates how informative the earnings of fraud firms are compared to peer non-fraud firms by assessing informativeness in the context of persistence, analysts’ forecast errors, and stock returns. There are differences in how informative the earnings of fraud firms are to analysts’ forecasts and returns in the pre-fraud period, but not in the fraud period. In the post- fraud period, there is no difference in how informative fraud firms’ earnings are to analysts’ earnings forecasts. Furthermore, fraud firm’s earnings are not differentially associated with excess returns post-fraud. When earnings are decomposed into accruals and cash flows, fraud firms’ …
