Blackness In The “Grey Area”: Representations Of Virtuous Labor In Venture Smith’S Narrative, Rio Mckade Bergh Jan 2019

Blackness In The “Grey Area”: Representations Of Virtuous Labor In Venture Smith’S Narrative, Rio Mckade Bergh

English

Scholarly treatments of Venture Smith, an African man who gained freedom and went on to own land and slaves in the late eighteenth-century United States, almost exclusively consider the 1798 edition of his narrative, ignoring the later 1835 and 1897 editions. I analyze each published narrative, and argue that Smith, as represented in the narratives and other printed materials, functions as an emblematic bourgeois. His economic actions conducted within Franco Moretti’s “grey area,” when paired with his performance of ascetic labor and virtue, provide the social legitimation necessary for a bourgeois owner class. However, Smith’s status as a black man …

Composing Comments For Online Students : A Study Of Faculty Feedback On Writing In Multidisciplinary Contexts, Robert Kimball Neuteboom Jan 2019

Composing Comments For Online Students : A Study Of Faculty Feedback On Writing In Multidisciplinary Contexts, Robert Kimball Neuteboom

English

In this dissertation, I present findings from a qualitative research project designed to articulate practitioner-teachers’ beliefs about writing and their role in providing feedback on student writing in online courses. To analyze the qualities of these beliefs, I interviewed eight full-time and part-time teachers from multiple disciplines teaching at the same private career-based college. Participants primarily defined writing as grammar and described their feedback intervention as dependent on tools, such as rubrics and web-based grammar software, to ensure students write professionally. Professionalism was a significant concern for participants, many of whom considered preserving the integrity of their discipline and preparing …

Bilingual Rabbits, Bilingual Readers: Watership Down As A Case For Animal Texts In Translation, Rachel Ann Grider Jan 2019

Bilingual Rabbits, Bilingual Readers: Watership Down As A Case For Animal Texts In Translation, Rachel Ann Grider

English

Richard Adams’ Watership Down provides readers a unique view of a world that is and isn’t their own, a familiar space from the unfamiliar perspective of an animal. Animal narratives like these are at the core of Animal Studies, a school of thought intent on decentering the Anthropos; yet despite this goal, our explorations of these text still must contend with the fact that they are bound to a language incapable of transmitting their experience and a human-privileged system of value still based within the human frame of reference. By viewing Adams’ novel as a case study for anthropomorphized texts …

The Last Breath Is Hers: Reassessing Feminist Film Approaches To The Slasher Genre In The #Metoo Era, Hannah Leigh Stevens Jan 2019

The Last Breath Is Hers: Reassessing Feminist Film Approaches To The Slasher Genre In The #Metoo Era, Hannah Leigh Stevens

English

You’re Next (2011) and Hush (2016), feature women who at first glance resemble stereotypical final girls. However, throughout their respective films, Erin (You’re Next) and Maddie (Hush) break the expected binary outcome of either a dead girl or franchised final girl, and are recognized as a different iteration of the final girl—a girl who both survives a brutal attack and is able to actively bring resolution to the narrative, representing a turn toward critically and socially sensitive representations of a woman’s experience. In seeing this current trajectory of Erin to Maddie to a new Laurie (Halloween 2018), a revolutionary trend …

Presidential Laws And The Missing Interpretive Theory, Tara Leigh Grove Jan 2019

Presidential Laws And The Missing Interpretive Theory, Tara Leigh Grove

Articles

There is something missing in interpretive theory Recent controversies"”involving for example the first travel ban and funding for sanctuary cities"”demonstrate that presidential "laws" executive orders proclamations and other directives raise important questions of meaning Yet while there is a rich literature on statutory interpretation and a growing one on regulatory interpretation there is no theory about how to discern the meaning of presidential directives Courts for their part have repeatedly assumed that presidential directives should be treated just like statutes But that cannot be right Theories of interpretation depend on both constitutional law and institutional setting For statutes the relevant …

Innovation Agents, Mirit Eyal-Cohen Jan 2019

Innovation Agents, Mirit Eyal-Cohen

The standard narrative of entrepreneurship is one of self-employed creative individuals working out of their garage or independently owned start-up companies. Intrapreneurship--where employees are responsible for being alert to new opportunities inside firms--is another model for developing innovations. Relatively little is known, however, about the latter process through which large, complex firms engage in groundbreaking corporate entrepreneurship. This Article's focus is on these types of innovation agents. It provides a thorough account of the positive and negative spillovers of intrapreneurial firms while making the following key points: First, intrapreneurial companies utilize their economies of scale, scope, and age to deliver …

Emergent Regulatory Systems And Their Challenges: The Case Of Combination Medical Products, George Horvath Jan 2019

Emergent Regulatory Systems And Their Challenges: The Case Of Combination Medical Products, George Horvath

Faculty Scholarship

Where regulatory systems overlap, courts and scholars often focus on the undesirable aspects of the overlap—the ways in which systems conflict. One such context involves the regulation of prescription drugs and medical devices by the FDA’s premarket evaluation processes and by state common-law tort and products liability actions. FDA regulation and state common law are often described as separate, conflicting regulatory systems. This Article challenges that description by proposing a model in which FDA premarket evaluation and state common law function as a single regulatory system.

This model brings order to the Supreme Court’s seemingly inconsistent medical products preemption cases, …
