A Global System Of Work, A Global System Of Regulation?: Crowdwork And Conflicts Of Law, Miriam A. Cherry
All Faculty Scholarship
On-demand platforms are changing and reshaping our conceptions of both the firm and the work relationship in far-reaching and critical ways, allowing companies to hire workers and to seek customers across national boundaries. Confronted with low pay, wage theft, and other problematic working conditions, gig workers around the world have turned to the courts, attempting to invoke the protections of traditional labor and employment law. While some commentators believe existing forms of labor and employment regulations can stretch to cover on-demand work, others have called for new legal initiatives specifically crafted for online platforms. The goal of this paper is …
Jury Trial Disparities Between Class Actions And Shareholder Derivative Actions In State Courts, Ann M. Scarlett
Jury Trial Disparities Between Class Actions And Shareholder Derivative Actions In State Courts, Ann M. Scarlett
All Faculty Scholarship
Class actions and shareholder derivative lawsuits are both forms of representative litigation that historically had to be brought in the equity courts to be decided by a judge, rather than in the common-law courts to be decided by a jury. In 1938, the federal courts merged law and equity by passing the Federal Rules of Civil Procedure, which allowed both legal and equitable claims to be heard within the same civil action. After law and equity merged, the Supreme Court interpreted the Seventh Amendment’s preservation of the right to jury trial as including not just actions recognized at common law, …

American Bolsheviki: The First Red Scare In The United States, 1917 To 1920, Jonathan Dunning
Murray State Theses and Dissertations
This thesis looks to reframe the timeline of the First Red Scare in United States History. Historians of this period have consistently viewed the First Red Scare as occurring from 1919 to 1920. However, by viewing the First Red Scare as beginning in 1919, historians missed the fear of communism that developed in the US government and the American press and society throughout 1917 and 1918, starting immediately after the Bolshevik Revolution. Moreover, in the past, historians have done little to detail the connections between the Allied Intervention in Russia from 1918 to 1920 and the First Red Scare, despite …

This study serves to validate current admissions criteria utilized by the nursing program at Hopkinsville Community College (HCC) to ensure students with the highest probability for success are admitted. Participants include …
Labeling Sexual Assault Perceptions Associated With Ptsd Symptom Severity, Shania Cole
Labeling Sexual Assault Perceptions Associated With Ptsd Symptom Severity, Shania Cole
Murray State Theses and Dissertations
Many agree that sexual assault is a common problem among females, but there is less agreement regarding how to label individuals who experience sexual assault. Most research has examined the connotations associated with the labels, most of which has associated “victim” with negative connotations and “survivor” with positive adjectives. Few studies empirically examine how individuals of sexual assault respond to these labels and how the labels relate to outcomes in these individuals’ lives. Unfortunately, individuals who have experienced an unwanted sexual encounter are at higher risk for developing posttraumatic stress disorder (PTSD). Understanding how these individuals label themselves, and how …

The speech-language pathologist has many options regarding the course of action they deem the most efficient in remediating a phonological disorder. The purpose of this case study was to research the efficacy of using the Cycles Phonological Remediation Approach (Cycles Approach) as written by Hodson and Paden (Hodson & Paden, 1983; Hodson & Paden, 1991; Hodson, 2006; Hodson, 2007) on a six-year-old child with a moderate-to-severe phonological disorder with low intelligibility. This study included three phases: initial assessment, intervention, and the final assessment. One cycle of intervention over the course of approximately two semesters was administered to target three of …
Numerical Simulations For Optimal Control Of A Cancer Cell Model With Delay, Jessica S. Lugo
Numerical Simulations For Optimal Control Of A Cancer Cell Model With Delay, Jessica S. Lugo
Murray State Theses and Dissertations
Mathematical models are often created to analyze the complicated behavior of many physical systems. One such system is that of the interaction between cancer cells, the immune system, and various treatments such as chemotherapy, radiation, and immunotherapy. Using models that depict these relationships gives researchers insight on the dynamics of this complicated system and possibly ideas for improved treatment schedules.
The model presented here gives the relationship of cancer cells in development phases with immune cells and cycle-specific chemotherapy treatment. This model includes a constant delay term in the mitotic phase. Optimal control theory is used to minimize the cost …

If You Think It You Can Achieve It: The Relationship Between Goal Specificity And Magical Thinking, Brianna Jones
Murray State Theses and Dissertations
Previous research has found a connection between the type of goals that individuals set and psychopathology, specifically depression (Dickson & Moberly, 2013). Magical thinking is the belief that a person’s thoughts are connected to their actions or to future outcomes (Markle, 2010). Magical thinking has been found to be a primary feature in many psychological disorders such as obsessive-compulsive disorder (Shihata et al., 2014). The present study is the first of the literature to examine the relationships between goal setting and magical thinking as well as magical thinking and various psychological disorders such as depression. The current study examined the …

Very Superstitious: The Relationship Between Desperation And Superstitious Behavior, Christopher Evan Hannan
Murray State Theses and Dissertations
Superstitious behavior has been found to emerge during situations of uncertainty and often used by those who desire control. Desperation, a negative emotion that motivates behavior, tends to also occur in uncontrollable environments. This study attempts to analyze the possible relationship between desperation and the use of superstitious behavior in circumstances that leave individuals with little to no control. This was achieved by simulating an uncertain environment through a computerized card game involving chance (i.e. War). Results from this study demonstrated that those who felt desperate due to uncertainty engaged in superstitious behaviors, and desperation was a greater predictor for …
