The Consumer Imaginary: Labor Rights, Human Rights, And Citizen-Consumers In The Global Supply Chain, Kevin Kolben Jan 2019

The Consumer Imaginary: Labor Rights, Human Rights, And Citizen-Consumers In The Global Supply Chain, Kevin Kolben

Vanderbilt Journal of Transnational Law

Consumers are increasingly demanding that the goods and services they consume be produced in a way that meets their social expectations. By extension, they are exhibiting greater willingness to pay more at the cash register for products made in good working conditions, and they are willing to punish companies that do not satisfy these expectations. Driving these "citizen-consumers" is what this Article terms the "consumer imaginary," which is defined as the narratives that consumers tell themselves about the people that make their things--people whom consumers will likely never meet, and whose lived experiences are distant from their own. Policymakers have …

Emerging Market Economies And International Investment Law: Turkey-Africa Bilateral Investment Treaties, Uche E. Ofodile

This Article offers a critical and penetrating insight into the bilateral investment treaties (BITs) between Turkey and countries in Africa. Since 2003, Turkey has concluded BITs with twenty-eight countries in Africa. This Article seeks answers to some very important questions. In the BITs between Turkey and countries in Africa, is Turkey merely conforming to the norms and standards established by Western countries, or is Turkey changing these norms in fundamental ways? Compared to BITs between Western nations and countries in Africa, are Turkey-Africa BITs more oriented towards sustainable development and, if so, in what respects? In what ways are emerging …

In Defense Of Human Rights, Karima Bennoune Jan 2019

In Defense Of Human Rights, Karima Bennoune

Vanderbilt Journal of Transnational Law

This Article argues that international human rights law, and the human rights movement more generally, need more defenders than critics in the current international political environment. Groups ranging from academics to governments have taken stances critical of human rights, and this Article seeks to defend the rights framework from some of these while also arguing for the importance of human rights in today's world. Noting that the field of human rights is not beyond criticism, this Article embraces some of those criticisms. However, it suggests that human rights law specialists need to spend at least as much time defending human …

Sec-Lib: Protecting Scholarly Digital Libraries From Infected Papers Using Active Machine Learning Framework, Nir Nissim, Aviad Cohen, Jian Wu, Andrea Lanzi, Lior Rokach, Yuval Elovici, Lee Giles

Computer Science Faculty Publications

Researchers from academia and the corporate-sector rely on scholarly digital libraries to access articles. Attackers take advantage of innocent users who consider the articles' files safe and thus open PDF-files with little concern. In addition, researchers consider scholarly libraries a reliable, trusted, and untainted corpus of papers. For these reasons, scholarly digital libraries are an attractive-target and inadvertently support the proliferation of cyber-attacks launched via malicious PDF-files. In this study, we present related vulnerabilities and malware distribution approaches that exploit the vulnerabilities of scholarly digital libraries. We evaluated over two-million scholarly papers in the CiteSeerX library and found the library …

Code Readability: A Proposal On The Effects Of Psychology And Comprehension In Software Development And Maintenance, Ethan Brian Sankey Jan 2019

Code Readability: A Proposal On The Effects Of Psychology And Comprehension In Software Development And Maintenance, Ethan Brian Sankey

Honors Program Theses

Because of the diversity and complexity of the hundreds of coding languages out there, code readability has become more and more of an issue as the years have passed and as the popularity of technology that required built-in computers has increased. With so many different formats, styles, and restrictions on each language, even a developer with experience in only a few common languages may have trouble remembering which language allows for certain indentation, which language requires variable instantiation, which language requires return statements at the end of functions. While I can appreciate the diversity and efficiency that having many different …

Elbow Injury Prevention In Youth Dominican Baseball Players: A Training Intervention Pilot Study, Chelsey Erbaugh Franz, Dawn Hall-Bibb, Myra Stockdale, Aliya Thompson, Bailey Biggs Jan 2019

Elbow Injury Prevention In Youth Dominican Baseball Players: A Training Intervention Pilot Study, Chelsey Erbaugh Franz, Dawn Hall-Bibb, Myra Stockdale, Aliya Thompson, Bailey Biggs

Internet Journal of Allied Health Sciences and Practice

Background: Research suggests deficits in shoulder and elbow strength and flexibility may explain the role of elbow injuries in overhead athletes, specifically ulnar collateral ligament (UCL) injury in baseball players. Significant damage to this ligament typically requires operative care for continued activity in the sport. Several studies have demonstrated the success of rehabilitation programs post-surgery; however, few studies have examined the role of UCL injury prevention programs. A recognized upper extremity (UE) injury prevention method is the Thrower’s Ten Program. This program may create elbow stability when pitching and throwing, theoretically reducing the risk of UCL injury. Purpose: The purpose …

The Performer-Composer: A Reimagined Career Pathway For The Modern-Day Saxophonist, Jazmin Ealden

Theses : Honours

The ambiguity of the twenty-first century classical musician career pathway has resulted in a change of professional traditions and opportunities for musicians both within Australia and internationally. The literature discussing the portfolio career model of musicians demonstrates a clear place for this career in the current music industry; one such pathway is that of the performercomposer musician. The aim of this research project was to explore the career pathways of three performer-composer saxophonists. Specifically, this study aimed to identify the change and development of traditional composer-performer roles, explore the fluidity in the spectrum of composer and performer led creative outputs, …

Waiting For A Queer Change: Gender Identity Through Performative Waiting And The Boudoir Chronotope In Call Me By Your Name, Gregory R. Clarke Jan 2019

Waiting For A Queer Change: Gender Identity Through Performative Waiting And The Boudoir Chronotope In Call Me By Your Name, Gregory R. Clarke

Theses : Honours

This thesis analyses André Aciman’s novel, Call Me By Your Name (2007), in light of its portrayal of a nineteen-eighties gay relationship that is not entirely defined by the HIV/AIDS epidemic. Rather than the abjection associated with illness and death, I focus on the narrative’s evocation of pleasure and love for its protagonists, Elio and Oliver, who do not identify as exclusively gay. My argument focuses on Elio exemplifying and undermining Roland Barthes’ trope of the lover-who-waits as historically ‘feminine’ in A Lover’s Discourse. In doing so, I demonstrate how Barthes’s work prefigures Judith Butler’s gender performativity theory.

First, …

Su Dansi. A Dance Film – And – Dancing Elements: The Making Of Su Dansi - A Dance Film. An Exegesis, Johanna Omodei Jan 2019

Su Dansi. A Dance Film – And – Dancing Elements: The Making Of Su Dansi - A Dance Film. An Exegesis, Johanna Omodei

Theses : Honours

This research project titled Dancing Elements explores choreographic conversations between the body and natural elements, specifically water on film. I question how natural elements when viewed in relation to the dancing body, can begin to be seen as a dancing entity. This research is divided between scholarship and the creation of a new dance film, su dansi which is Turkish for ‘water dance.’ su dansi is a collaborative and explorative outcome that plays with the dancing body and water through the art form of film. Drawing from author Sylvie Vitaglione (2016), I have adopted her term “natural elements’’ in reference …

Transplanting Chapter 11 Of The Us Bankruptcy Code Into Singapore's Restructuring And Insolvency Laws: Opportunities And Challenges, Gerald Mccormack, Wai Yee Wan Jan 2019

Transplanting Chapter 11 Of The Us Bankruptcy Code Into Singapore's Restructuring And Insolvency Laws: Opportunities And Challenges, Gerald Mccormack, Wai Yee Wan

Research Collection Yong Pung How School Of Law

In 2017, Singapore introduced wide-ranging reformsto its insolvency and restructuring laws with a view to enhancing itsattractiveness as an international centre for debt restructuring. Central tothese reforms is the transplantation (with modification) of certain provisionsfrom Chapter 11 of the US Bankruptcy Code including the automatic moratorium, cross-creditorcram-down, rescue financing and pre-packs. Drawing upon the US experience andsimilar reform proposals in the EU (including the UK), we critically evaluate theimpact of the new Singapore law. We argue that there remain challenges inensuring that the transplantation works well and highlight the possibleunintended consequences of such transplantation.

[Chapter 1 From] Viral Modernism: The Influenza Pandemic And Interwar Literature, Elizabeth Outka

Bookshelf

The influenza pandemic of 1918–1919 took the lives of between 50 and 100 million people worldwide, and the United States suffered more casualties than in all the wars of the twentieth and twenty-first centuries combined. Yet despite these catastrophic death tolls, the pandemic faded from historical and cultural memory in the United States and throughout Europe, overshadowed by World War One and the turmoil of the interwar period. In Viral Modernism, Elizabeth Outka reveals the literary and cultural impact of one of the deadliest plagues in history, bringing to light how it shaped canonical works of fiction and poetry. …

[Introduction To] Constructing The Adolescent Reader In Contemporary Young Adult Fiction, Elisabeth Rose Gruner Jan 2019

[Introduction To] Constructing The Adolescent Reader In Contemporary Young Adult Fiction, Elisabeth Rose Gruner

Bookshelf

This book examines the way young adult readers are constructed in a variety of contemporary young adult fictions, arguing that contemporary young adult novels depict readers as agents. Reading, these novels suggest, is neither an unalloyed good nor a dangerous ploy, but rather an essential, occasionally fraught, by turns escapist and instrumental, deeply pleasurable, and highly contentious activity that has value far beyond the classroom skills or the specific content it conveys. After an introductory chapter that examines the state of reading and young adult fiction today, the book examines novels that depict reading in school, gendered and racialized reading, …

[Introduction To] Soda Goes Pop: Pepsi-Cola Advertising And Popular Music, Joanna K. Love Jan 2019

[Introduction To] Soda Goes Pop: Pepsi-Cola Advertising And Popular Music, Joanna K. Love

Bookshelf

From its 1939 “Nickel, Nickel” jingle to pathbreaking collaborations with Michael Jackson and Madonna to its pair of X Factor commercials in 2011 and 2012, Pepsi-Cola has played a leading role in drawing the American pop music industry into a synergetic relationship with advertising. This idea has been copied successfully by countless other brands over the years, and such commercial collaboration is commonplace today—but how did we get here? How and why have pop music aesthetics been co-opted to benefit corporate branding? What effect have Pepsi’s music marketing practices in particular had on other brands, the advertising industry, and popular …
