American And Iraqi Prose Fiction Of The Iraq War: Traumas Of The Self, Traumas Of The Nation, Ghyath Manhel Alkinani Dec 2019

American And Iraqi Prose Fiction Of The Iraq War: Traumas Of The Self, Traumas Of The Nation, Ghyath Manhel Alkinani

Graduate Theses and Dissertations

War is so omnipresent in our contemporary world that the story of war is too important to be left to fiction writers to frame and give meaning for. This dissertation provides an analysis of two dominant patterns in contemporary Iraqi and American prose fictional representations of the Iraq War: the individualistic trauma hero narrative and the nationalistic, collective narrative. I argue that the trauma hero myth that dominates American representations of the Iraq War psychologizes and de-politicizes war experience alienating the victim of trauma by decontextualizing their experience and negating the Other. On the other hand, the sweeping nationalistic narrative …

Analytical Study On The Implications Of The Gats Agreement And Its Implications On The Egyptian Banking Sector, Thaer Mahmoud Rashid, Ihab Abbas Mohammed Dec 2019

Analytical Study On The Implications Of The Gats Agreement And Its Implications On The Egyptian Banking Sector, Thaer Mahmoud Rashid, Ihab Abbas Mohammed

Journal of Economics and Administrative Sciences

International trade in services is becoming increasingly important as it is an economic activity that deals with invisible trade, which has become increasingly important in the balance of international trade. The establishment of the WTO is a starting point in international trade relations. It is responsible for all aspects of international trade, , And in view of the continued increase in international trade in services, the need for more internationally recognized rules has become more urgent, especially as it has been increasingly proven that the traditional framework of public services is inadequate to operate some of the most dynamic and …

What’S Love Got To Do With It?: Passion And Inequality At Work, Aliya Hamid Rao, Megan Tobias Neely Dec 2019

What’S Love Got To Do With It?: Passion And Inequality At Work, Aliya Hamid Rao, Megan Tobias Neely

Research Collection School of Social Sciences

Emotion has become an increasingly important aspect of work in the 21st century. In this article, we take stock of the extant literature delineating the role of emotions, especially passion as a cultural schema, in white‐collar workplaces. Scholars have covered extensive ground on emotions at work, but the role of passion remains an underexplored yet significant area. Drawing from recent developments in research on white‐collar work, we argue that the passion schema has become a critical marker in the labor market for sorting individuals into occupations, hiring and promotion within organizations, and assigning value to people's labor. Emergent research suggests …

Imaginary Conquests: Folktales, Film, And The Japanese Empire In Asia, Richard M Davis Dec 2019

Imaginary Conquests: Folktales, Film, And The Japanese Empire In Asia, Richard M Davis

Research Collection School of Social Sciences

This article highlights three family-targeted films made under the wartime Japanese empire: Yamamoto Kajir ō ’s musical comedy Songokū (1940) and Seo Mitsuyo’s animated Momotarō films, Sea Eagles (1943) and Divine Warriors of the Sea (1945). Significantly, these films are based on two fantastical premodern stories—the Chinese novel Journey to the West and the Japanese Momotarō legend, respectively—whose quest narratives map onto Japan’s contemporaneous military expansion into mainland China and the islands of the South Pacific. Despite the films’ seeming alignment with ultranationalist ideology, I argue that the geopolitical trajectories of their narratives are rendered ambiguous by their various reception …

Unlocking Pre-1850 Instrumental Meteorological Records: A Global Inventory, Stefan Bronnimann, Rob Allan, Linden Ashcroft, Saba Baer, Mariano Barriendos, Fiona Williamson, Et Al Dec 2019

Unlocking Pre-1850 Instrumental Meteorological Records: A Global Inventory, Stefan Bronnimann, Rob Allan, Linden Ashcroft, Saba Baer, Mariano Barriendos, Fiona Williamson, Et Al

Research Collection School of Social Sciences

A global inventory of early instrumental meteorological measurements is compiled. It comprises thousands of series, many of which have not been digitized, pointing to the potential of weather data rescue.Instrumental meteorological measurements from periods prior to the start of national weather services are designated “early instrumental data”. They have played an important role in climate research as they allow daily-to-decadal variability and changes of temperature, pressure, and precipitation, including extremes, to be addressed. Early instrumental data can also help place 21st century climatic changes into a historical context such as to define pre-industrial climate and its variability. Until recently, the …

The strength of sexual selection on secondary sexual traits varies depending on prevailing economic and ecological conditions. In humans, cross-cultural evidence suggests women’s preferences for men’s testosterone dependent masculine facial traits are stronger under conditions where health is compromised, male mortality rates are higher and economic development is higher. Here we use a sample of 4483 exclusively heterosexual women from 34 countries and employ mixed effects modelling to test how social, ecological and economic variables predict women’s facial masculinity preferences. We report women’s preferences for more masculine looking men are stronger in countries with higher sociosexuality and where national health …

“Daughter” As A Positionality And The Gendered Politics Of Taking Parents Into The Field, Menusha De Silva, Kanchan Gandhi Dec 2019

“Daughter” As A Positionality And The Gendered Politics Of Taking Parents Into The Field, Menusha De Silva, Kanchan Gandhi

Research Collection School of Social Sciences

Research on gendered politics of the field has delved into the practices of accompaniment and its implications on research and knowledge production, particularly through the case of researchers’ children and partners. In comparison, the tendency to seek assistance from parents is neglected within the scholarship. Drawing on the PhD fieldwork experiences of two researchers in their “native” country, specifically a Sri Lankan researcher conducting fieldwork in Sri Lanka and a North Indian scholar researching in South India, the paper reveals parents’ contribution to the research process, in terms of enhancing researcher credibility, facilitating contact‐making and access, and providing emotional and …

Riding The Blockchain Mania: Public Firms’ Speculative 8-K Disclosures, Pengkai Lin Dec 2019

Riding The Blockchain Mania: Public Firms’ Speculative 8-K Disclosures, Pengkai Lin

Research Collection School Of Accountancy

This paper provides evidence on public firms' initial 8-K disclosures that mention Blockchain and investors' response to these disclosures. We categorize the description of Blockchain activities in firms' 8-Ks as Speculative (e.g., a vague future plan that involves Blockchain) or Existing (e.g., a description of Blockchain product). We document a sharp increase in the number of initial 8-K disclosures of Blockchain, particularly by Speculative firms, coinciding with the rise of Bitcoin prices and excitement in Blockchain technology in the last quarter of 2017. Investors react positively to the Blockchain 8-Ks issued by Speculative firms in the initial seven-day event window …

Singapore In 2018: Between Uncharted Waters And Old Ghosts, George Wong, Jun Jie Woo Dec 2019

Singapore In 2018: Between Uncharted Waters And Old Ghosts, George Wong, Jun Jie Woo

Research Collection School of Social Sciences

For the city state of Singapore, 2018 was a year of many firsts. It marked the midpoint of the 13th Parliament of Singapore within a manifestly post–Lee Kuan Yew era. The incumbent government of the People's Action Party (PAP) began the year with the pleasant surprise that economic growth in 2017 had reached 3.6 per cent. This exceeded the modest expectations of 1.5 to 3.5 per cent. But despite the positive start, 2018 was to be filled with headwinds for Singapore, both new and familiar. Top of the list was the revival of tensions with Malaysia, as well as a …

Inequality And The Social Compact In Singapore: Macro Trends Versus Lived Realities, Nathan Peng Dec 2019

Inequality And The Social Compact In Singapore: Macro Trends Versus Lived Realities, Nathan Peng

Research Collection School of Social Sciences

This paper provides an overview of Singapore’s inequality since 2000. Upon examining empirical indicators reflecting different aspects of inequality, there seems to be a divergence between largely stable macro-level trends and “felt” inequality experienced by citizens. While the empirical record reflects fairly stable income, wealth, consumption and intergenerational inequality, other data show how educational performance and sense of belonging are continuously tied to socio-economic position. Juxtaposing these insights against a qualitative analysis of Singapore’s meritocracy, the social and political ferment on the issue of inequality in 2018—with heightened discourses among both elites and the public—makes sense against a backdrop of …

From Jols To Jols+: Directing Learners’ Attention In Retrieval Practice To Boost Integrative Argumentation, Sarah Shi Hui Wong, Stephen Wee Hun Lim Dec 2019

From Jols To Jols+: Directing Learners’ Attention In Retrieval Practice To Boost Integrative Argumentation, Sarah Shi Hui Wong, Stephen Wee Hun Lim

Research Collection School of Social Sciences

The effects of retrieval practice on complex, meaningful learning outcomes that require more than just basic recall are of ongoing interest in the test-enhanced learning literature. Across two experiments, we investigated the extent that retrieval practice boosts integrative argumentation—the integration of opposing viewpoints to form conclusions. Participants were tasked to form an integrative argumentation response after reading a text containing arguments for and against an issue. We found that retrieval practice alone produced superior long-term retention of text content, but not better use of integrative stratagems relative to repeated study (Experiment 1). However, when retrieval practice was augmented with judgments …

Stories Of The Nameless : Eyewitness Accounts Of Martial Law Victims And Survivors, Gloria E. Melencio Dec 2019

Stories Of The Nameless : Eyewitness Accounts Of Martial Law Victims And Survivors, Gloria E. Melencio

Journal Article

This paper features the eyewitness accounts of some 10 victims of martial law in Luzon, Visayas and Mindanao. Most of the eyewitnesses belong to the lower strata of the Philippine social structure. They are the nameless victims of a cruelty inflicted on a society that is interested mainly on the stories of the rich and famous, the good and the beautiful. Recorded history has always delineated the “inarticulate” (Constantino, 1975) to the background and denied them a space in the pages of history. This document aims to shine the spotlight on the “ugly” reality: stories of courage, strength, and the …

San Diego International Law Journal

In recent decades, the United States Department of Justice (DOJ) has greatly improved its enforcement of the U.S. Foreign Corrupt Practices Act (FCPA). Some of these FCPA enforcement cases involve China. Given China’s prominence as a center of global business, this trend is likely to increase in the foreseeable future.

Section I of this Article briefly reviews the provisions of the FCPA, and recent FCPA enforcement in China. Section II discusses China’s anti- bribery law regime, anti-bribery provisions and agencies enforcing bribery and corruption. Section III focuses on an analysis of FCPA cases involving China, in addition to describing the …

Adapting The Iss Code Of Conduct To Form The Foundation Of Astrolaw, Michelle L.D. Hanlon Dec 2019

Adapting The Iss Code Of Conduct To Form The Foundation Of Astrolaw, Michelle L.D. Hanlon

San Diego International Law Journal

Three decades ago, Dr. J. Henry Glazer, onetime Chief Counsel for NASA Ames, proposed the establishment of a body of astrolaw. “The direct subjects of Space Law are sovereign nations” he observed. The four widely ratified space treaties contain principles and guidelines designed to govern the activities of State. Conversely, the direct subjects of astrolaw would be natural and legal persons in space. In Dr. Glazer’s view, “astrolaw focuses not upon space as a legal regime, but upon space as a place.” Our evolution into a spacefaring species, with single and then multiple human communities off-Earth, is a human necessity. …

U.S. Tax Policy In Light Of Globalization And Growing Inequality, Alanna D'Alessandro Dec 2019

U.S. Tax Policy In Light Of Globalization And Growing Inequality, Alanna D'Alessandro

San Diego International Law Journal

The Tax Cuts and Jobs Act significantly reformed the system of taxation in the United States by enacting permanent and temporary provisions to the Internal Revenue Code. These provisions encompass changes affecting U.S. individuals and entities, both domestically and internationally. Claiming that the change would “pay for itself,” the Tax Cuts and Jobs Act intends to stimulate the economy. The large tax cuts may have created short-term economic growth; however predictions suggest that in the long-run, the increased spending and the decline in tax revenue will significantly raise the U.S. budget deficit.

Regardless of Congressional intent, the Tax Cuts and …

Part I focuses on the history of immigration and anti-immigration sentiments in the three countries. Part II discusses governing laws in the three countries that have received the most attention because of their extreme impact on immigrants. Part III analyzes these laws, focusing on their legal ramifications, discriminatory effects on immigrants, and economic harm. Finally, Part IV explains why these laws reflect an extreme approach to immigration and raise serious legal questions if they are not …

Technology, The Changing Nature Of Disputes, And The Future Of Equitable Principles In Canadian Contract Law, Conrad Flaczyk Dec 2019

Technology, The Changing Nature Of Disputes, And The Future Of Equitable Principles In Canadian Contract Law, Conrad Flaczyk

Canadian Journal of Law and Technology

There are a number of legitimate reasons to be excited about the application of new technologies to make contracting more efficient. Unfortunately, each of those reasons is associated with certain risks for both contractors and contractees. In this article, I argue that an ‘‘equitable” approach to modern contract law — understood by the likes of Larry DiMatteo and others ‘‘not merely as a system of rules, but of rules tempered by standards and principles” — is particularly well suited for counterbalancing some of the undesirable contractual risks introduced by new technologies like blockchain, artificial intelligence, and smart contracts. A historical …

Subverting Democracy To Save Democracy: Canada’S Extra-Constitutional Approaches To Battling “Fake News”, Michael Karanicolas Dec 2019

Subverting Democracy To Save Democracy: Canada’S Extra-Constitutional Approaches To Battling “Fake News”, Michael Karanicolas

Canadian Journal of Law and Technology

Nearly a decade after the first Twitter and Facebook revolutions, the early narratives pointing to social media as a great agent of democratization1 have given way to a more nuanced understanding of the impact of the Internet on our political discourse. While there is no question that Internet access provides tremendous expressive benefits, scholars are increasingly questioning whether this information diet is ultimately healthy for society. An analogy to sugars, fats and salts has emerged, where just as an appetite for rich foods served our species well when resources were scarce, but have become a liability in an age of …

Flying Under The Radar: Two Decades Of Dna Testing At Ircc, Ida Ngueng Feze, Gabriel Marrocco, Miriam Pinkesz, Jacqueline Lacey, Yann Joly

Canadian Journal of Law and Technology

Since the early 1990s, Immigration, Refugees and Citizenship Canada (formerly Citizenship and Immigration Canada) began using DNA testing technology in the processing of family reunification applications. Over the years, Canadian citizens, permanent residents, and family members living abroad have been increasingly suggested, or required to undergo DNA testing to either facilitate or enable them to reunite in Canada, under the family reunification procedure. This practice, although said to be rare, has since grown in popularity, and is used more extensively for applications coming from certain regions, including Africa, Asia, and the Caribbean. Through analysis of recent case law, this paper …

Converging Space And Producing Place: Social Inequalities And Birth Across Mexico, Rosalynn A. Vega Dec 2019

Converging Space And Producing Place: Social Inequalities And Birth Across Mexico, Rosalynn A. Vega

Anthropology Faculty Publications

I combine ethnographic research of the professional midwifery model in Mexico with concepts gleaned from an interdisciplinary literature in order to illustrate how different types of spaces converge in the process of place-making. From October 2010 to November 2013, I conducted twenty-eight months of research, interviewing employees of government bureaus and public health programs, observing how the professional midwifery model unfolds in distinct contexts, performing interviews and participant-observation with casa midwifery students/alumni, and “shadowing” professional midwives and obstetricians as they engage with pregnant women in a hospital setting. Drawing from ethnographic examples, this article points to five different types of …

Developing The Design Of Road Going Welded Structures With Special Considerations For Hot-Dip Galvanizing, Daniel Landgraf Dec 2019

Developing The Design Of Road Going Welded Structures With Special Considerations For Hot-Dip Galvanizing, Daniel Landgraf

Masters Theses and Doctoral Dissertations

The primary objective of this thesis is to provide accessible methods for numerical analysis of the mechanical behavior of welded structures specific to roadgoing trailers as defined by the Federal Motor Carrier Safety Administration. The area of highest interest is hot-dip galvanizing. The influence of temperature on steel has long been studied and several sources have found, or otherwise mathematical expressions were derived which describe the relationships between mechanical properties and temperature. Understanding all failure modes associated with the design of a structurally acceptable trailer goes beyond a simple static force analysis. Road going trailers undergo acceleration in the vertical, …

Reassessing Self-Dealing: Between No Conflict And Fairness, Andrew F. Tuch Dec 2019

Reassessing Self-Dealing: Between No Conflict And Fairness, Andrew F. Tuch

Fordham Law Review

Scholars have long disagreed on which of two rules is more effective when a fiduciary engages in self-dealing. Some defend the “strict” no-conflict rule, which categorically bans self-dealing. Others prefer the “flexible” and “pragmatic” fairness rule, which allows self-dealing if it is fair to beneficiaries. The centrality of this debate cannot be overstated: corporate law as a field is fundamentally concerned with self-dealing by fiduciaries. Yet a lack of firm data means that this debate has dragged on for decades, with no end in sight. This Article makes a simple but powerful point: the entire debate is somewhat misguided because, …

Reframing The Punishment Test Through Modern Sex Offender Legislation, Jane Ramage Dec 2019

Reframing The Punishment Test Through Modern Sex Offender Legislation, Jane Ramage

Fordham Law Review

Modern sex offender registration and notification laws blur the distinction between criminal and civil law. Despite being labeled as civil regulatory schemes, these laws impose severe burdens on personal liberty—burdens that we tend to associate with criminal punishment. In 2003, the U.S. Supreme Court determined that at least one sex offender registration and notification program functioned as a civil remedy rather than a criminal sanction. In upholding the Alaska Sex Offender Registration Act, the Supreme Court held that the burdens imposed by the statute did not impose additional punishment on registered sex offenders and thus did not trigger the constitutional …

The three stories featured within this thesis are offered as a way to understand these challenges. Each protagonist is faced with an issue of morality, sexuality, or ceremony, and each reach differing conclusions about these topics within their lives. …

Responding To Microaggressions: Evaluation Of Bystander Intervention Strategies, Tianyi Xie Dec 2019

Responding To Microaggressions: Evaluation Of Bystander Intervention Strategies, Tianyi Xie

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

Ethnic minorities often experience microaggressions that cause psychological distress and increase health risks. Bystander interventions are good ways to intervene when microaggressions take place and provide emotional support for ethnic minority targets. White interveners and interventions that pose low threats to White aggressors are perceived more positively than ethnic minority interveners and interventions that are more confrontational and direct. Furthermore, a support-based intervention that validates White aggressors’ good intention and effort without judgement may help White aggressors feel less defensive and more receptive to the intervention. Asian Americans face unique microaggressive themes and their racial experiences are influenced by the …

Gender And Social Acceptance Of Immigrants In A New Destination Site, Emma Meade Earl Dec 2019

Gender And Social Acceptance Of Immigrants In A New Destination Site, Emma Meade Earl

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

In this article, I draw on secondary interview data with LatinX immigrants in Cache Valley, Utah, an emerging new destination site in the Inter-Mountain West. While immigrants are drawn to new destinations by employment opportunities, quality of life, or low cost of living, they face many challenges in integrating socially into fairly homogenous communities, which can be particularly challenging for immigrant women. This thesis analyzes the ways in which gender affects social integration in the specific cultural and demographic context of Cache Valley. Using interviews with 16 men and women, I examine gender differences in perceptions of the community, experiences …
