The U.S. regulatory environment is changing rapidly, at the same time that visible and profound impacts of climate change are already being felt throughout the world, and enormous, potentially existential threats loom in the not-so-distant future. What does it mean to think about and practice environmental law in this setting? In this latest in a biannual series of postings and essays, the authors, members of the Environmental Law Collaborative (ELC), have taken on the question of whether environmental law as we currently know it is up to the job of addressing these threats; and, if not, what the path forward …

Jurisdiction And "Definitional Law", John F. Preis Jan 2019

Jurisdiction And "Definitional Law", John F. Preis

Law Faculty Publications

Professor Scott Dodson and I agree that the law of federal jurisdiction needs improvement. We disagree, however, on Congress’s power to make that happen. In an article published in 2017, Dodson argued that “jurisdiction” has an “inherent identity” that “[n]either Congress nor the courts can change.” In an article published the following year, I critiqued this claim. There, I argued that Congress is not obliged to respect jurisdiction’s inherent identity (to the extent it might have one). Rather, Congress need only respect the identity of jurisdiction contained in the United States Constitution. Professor Dodson recently published a rejoinder to my …

Living The Bhagavad Gita At Gandhi's Ashrams, Karline Mclain Jan 2019

Living The Bhagavad Gita At Gandhi's Ashrams, Karline Mclain

Faculty Journal Articles

The Bhagavad Gita is a philosophical Hindu scripture in which the god Krishna imparts lessons to the warrior prince Arjuna about sacred duty (dharma) and the path to spiritual liberation (moksha). This classical scripture has had a long and active interpretive life, and by the 19th century it had come to be regarded as a core text, if not the core text, of Hinduism. During the colonial period, interpretations of the Bhagavad Gita considered the relevance of Krishna’s lessons to Arjuna in the context of British colonial rule. While some Indians read a call to arms into their interpretation of …

Contesting Slavery In The Global Market: John Brown’S Slave Life In Georgia, Michael Drexler, Stephanie Scherer Jan 2019

Contesting Slavery In The Global Market: John Brown’S Slave Life In Georgia, Michael Drexler, Stephanie Scherer

Faculty Journal Articles

John Brown, author of Slave Life in Georgia, published in London in 1854, proffered a radical approach to ending slavery in the USA in step with Marxian economics. In this paper, we will explain how Brown’s representation of subjectivity may have caused critics to neglect it. Brown treats freedom as something foreign and external. He has to learn what freedom means, first through exposure to a model of liberal citizenship and then through the experience of several modulations of fugitive liberty. Brown’s social world is wholly determined by external forces. Whether slave or freeman, he faces ambiguous situations. Is …

Bridging Distances: Professional Development For Higher Education Faculty Through Technology-Facilitated Lesson Study., Melissa Soto, Dittika Gupta, Lara Dick, Mollie Appelgate

Faculty Journal Articles

Higher education faculty benefit from participating in communities of practice focused on developing and improving their own instruction. However, collaborators with common interests are not always located at the same physical location. In this article, we share how participation in a technology-facilitated lesson study provided the means for five higher education faculty across the U.S. to engage in professional development and evolve into a virtual community of practice. Through the use of synchronous and asynchronous communication technology, we formulated goals, planned a common lesson, conducted research on our students’ learning, and reflected on our own teaching practice. For this paper, …

The Ecology Of Central Florida's Thief Ants (Hymenoptera: Formicidae: Solenopsis), Leo Ohyama Jan 2019

The Ecology Of Central Florida's Thief Ants (Hymenoptera: Formicidae: Solenopsis), Leo Ohyama

Electronic Theses and Dissertations

Thief ants of the genus Solenopsis are a diverse group of ants that are found in ant communities throughout the world. They have long been purported to practice lestobiosis, an interaction between small and larger-bodied ants, where small ants cryptically tunnel into larger-bodied ant nests within the subterranean environment and steal brood or eggs for consumption. Thief ants are extremely small, measuring 1-2 mm in length and many of the species within this group practice a subterranean life history, where they live the entirety of their lives exclusively belowground. Due to these key characteristics, the ecology and natural history of …

Chiasmocleis is the most species-rich genus of Neotropical microhylids. Herein, we provide the first comprehensive multilocus phylogeny for the genus, including all but 3 of the 34 recognized species and multiple individuals per species. We discuss cryptic speciation, species discovery, patterns of morphological evolution, and provide a historical biogeographic analysis to account for the current distribution of the genus. Diversification of Chiasmocleis from other New World microhylids began during the Eocene, app. 40 mya, in forested areas, and current diversity seems to be a product of recurrent connections between the Atlantic Forest and Amazonia. Small-sized species evolved independently three times …

Techno-Economic Feasibility Analysis Of Hydrogen Recovery In Bio-Hydrogenated Diesel From Palm Oil For Methanol Synthesis Via Aspen Plus, Nitipat Phichitsurathaworn Jan 2019

Techno-Economic Feasibility Analysis Of Hydrogen Recovery In Bio-Hydrogenated Diesel From Palm Oil For Methanol Synthesis Via Aspen Plus, Nitipat Phichitsurathaworn

Chulalongkorn University Theses and Dissertations (Chula ETD)

A bio-hydrogenated diesel (BHD) or green diesel can be produced from refined palm oil obtained from palm oil refinery. A simulation model of BHD production process from palm oil is developed by Aspen Plus. The conventional process which is the heterogeneous catalytic hydro-deoxygenation reaction of triglycerides required high H2/oil volumetric ratio. To reduce high hydrogen loss in gaseous by-product, the design of hydrogen gas recovery process of the BHD process by coupling with methanol synthesis is proposed. The two processes (i.e., conventional BHD process and BHD process coupled with methanol synthesis) are compared in terms of hydrogen recovery and economic …

Pcr-Based Detection And Differentiation Of Piroplasms And Malaria Parasites From Goats In Thailand, Tu Cam Luu Huynh Jan 2019

Pcr-Based Detection And Differentiation Of Piroplasms And Malaria Parasites From Goats In Thailand, Tu Cam Luu Huynh

Chulalongkorn University Theses and Dissertations (Chula ETD)

A novel multiplex PCR (mPCR) was developed to identify and differentiate malaria parasite (Plasmodium caprae), and two piroplasms (Babesia bigemina and Theileria luwenshuni) in Thai goats. Three pairs of primer were designed to be species-specific, targeting cytochrome c oxidase subunit I (COI) gene in mitochondria. Plasmids containing each parasite’s DNA was serially diluted to evaluate the sensitivity of singleplex and mPCR assays. The specificity of the primer sets was confirmed by testing for amplification from DNA of each pathogen and other related hemoparasites. A total of 100 goat blood samples from five provinces of Thailand was used to validate the …

Building Community Resilience Through Community Based Tourism In Northern Thailand: The Importance Of Social Capital, Michael John Young Jan 2019

Building Community Resilience Through Community Based Tourism In Northern Thailand: The Importance Of Social Capital, Michael John Young

Chulalongkorn University Theses and Dissertations (Chula ETD)

Tourism has an omnipresence of application as a development tool, especially in rural areas within lesser developed countries. However, tourism development, particularly alternative forms of tourism such as Community Based Tourism (CBT) have and continue to face a multitude of barriers. As communities globally are facing greater uncertainties and stressors to local systems, it is imperative to build resilient communities. Thus, community resilience should not be taken as an end-goal, yet an iterative process for such to absorb, adapt and ultimately transform in the face of and after change. This research aims to offer a unique insight into how these …

The Role Of Previous Discourse In Identifying Public Textual Cyberbullying, Aurelia Power, Anthony Keane, Brian Nolan, Brian O'Neill Jan 2019

The Role Of Previous Discourse In Identifying Public Textual Cyberbullying, Aurelia Power, Anthony Keane, Brian Nolan, Brian O'Neill

Articles

In this paper we investigate the contribution of previous discourse in identifying elements that are key to detecting public textual cyberbullying. Based on the analysis of our dataset, we first discuss the missing cyberbullying elements and the grammatical structures representative of discourse-dependent cyberbullying discourse. Then we identify four types of discourse dependent cyberbullying constructions: (1) fully inferable constructions, (2) personal marker and cyberbullying link inferable constructions, (3) dysphemistic element and cyberbullying link inferable constructions, and (4) dysphemistic element inferable constructions. Finally, we formalise a framework to resolve the missing cyberbullying elements that proposes several resolution algorithms. The resolution algorithms target …

Unbundling Property In Boston’S Urban Food Commons, Oona Morrow, Deborah Martin Jan 2019

Unbundling Property In Boston’S Urban Food Commons, Oona Morrow, Deborah Martin

Geography

Households and community organizations are involved in the creation, use, care, and management of urban spaces, including through food practices such as planting, foraging, harvesting, weeding and pruning at the ambiguous edges of public and private property. Drawing on case studies in Boston, Massachusetts, we examine how commons are articulated through these practices, particularly in relation to multiple dimensions of property rights. Specifically, we ask how food practices can open urban spaces to negotiations around access, responsibility, care, and ownership, especially when (property) ownership is not an end-goal, but a circumstance shaping other practices. Using interviews and participant observation of …

Facebook V. Sullivan: Public Figures And Newsworthiness In Online Speech, Thomas E. Kadri, Kate Klonick Jan 2019

Facebook V. Sullivan: Public Figures And Newsworthiness In Online Speech, Thomas E. Kadri, Kate Klonick

Scholarly Works

In the United States, there are now two systems to adjudicate disputes about harmful speech. The first is older and more established: the legal system in which judges apply constitutional law to limit tort claims alleging injuries caused by speech. The second is newer and less familiar: the content-moderation system in which platforms like Facebook implement the rules that govern online speech. These platforms are not bound by the First Amendment. But, as it turns out, they rely on many of the tools used by courts to resolve tensions between regulating harmful speech and preserving free expression—particularly the entangled concepts …

The Impact Of Chronic Poverty On Children's Behavioral Health And Learning Outcomes, Anna Catherine Rasmussen Jan 2019

The Impact Of Chronic Poverty On Children's Behavioral Health And Learning Outcomes, Anna Catherine Rasmussen

Honors Program Theses

Chronic poverty is an unfortunate reality many children face every day. The current literature review evaluated the impact poverty has on children’s behavioral health and learning outcomes. Research consistently shows that children living in poverty experience higher rates of conduct problems, such as Conduct Disorder (CD), as well as increased learning problems, such as Specific Learning Disorders (SLD) and diminished academic success. There are several theories for this relation, encompassing both environmental and biological influences, which are reviewed herein. The overall conclusion is that living in poverty negatively impacts children’s behavioral and learning outcomes.

The Anthropological Significance Of Knockloon Hill, Emma Rosentrater Jan 2019

The Anthropological Significance Of Knockloon Hill, Emma Rosentrater

Honors Program Theses

Some of the most intriguing mysteries in archaeology surround monuments that are all that remains of cultures that have left almost no record of their existence. Their beliefs have been lost to the ages and the purpose of the monuments they built along with them. Yet with proper analysis, it may be possible to learn about a site’s purpose and significance in the society in which it was built. One site in particular is Knockloon Hill in County Clare, Ireland (fig. 1 &2). Though it may not be as grand or impressive as other sites, it may hold the key …

Safer Well Water: Exploring Environmental Screening Efforts For Family Child Care Homes, Devan Carr Jan 2019

Safer Well Water: Exploring Environmental Screening Efforts For Family Child Care Homes, Devan Carr

Public Health Theses

Background

Children are widely recognized as particularly vulnerable to the harmful effects of environmental contaminants. As such, the physical environment in which they live, play, and breathe can have a significant impact on their health and development throughout their life. In 2007, Connecticut's Department of Public Health established the Screening Assessment for Environmental Risk (SAFER) program as a proactive, non-regulatory approach to screening child care centers in the state. Several screening methods are implemented in this voluntary process, including the identification of any hazardous waste sites within 1/8 of a mile of a proposed child care site. While successful, the …

Association Of Hpv And Oral Cancer, Qizheng Chen Jan 2019

Association Of Hpv And Oral Cancer, Qizheng Chen

Public Health Theses

According to the International Research on Cancer (AIRC) oral cancers are a type of cancer that develops in people’s lip linings, mouth, and the oropharynx. Studies have shown that the consumption of alcohol and tobacco products are the primary carcinogens that cause oral cancers. However, increasing cases of young individuals with no previous exposure to alcohol or tobacco who are getting oral cancers have prompted studies to look into the role of other carcinogens, especially viruses. Currently, the IARC presents oral cancers as the sixth most common type of cancer in the world. High-risk human papilloma virus (HPV) types are …

Data saturation was determined through preliminary analysis, and thematic coding was conducted through Dedoose. …

Impacts Of Ambient Temperature On Foodborne Salmonella Infection, Victoria E. Shirriff Jan 2019

Impacts Of Ambient Temperature On Foodborne Salmonella Infection, Victoria E. Shirriff

Public Health Theses

Foodborne Disease (FBD) impacts individuals through the ingestion of foods contaminated with microbes and can lead to an array of adverse health consequences ranging from mild symptoms such as nausea to those that evolve to become life-threatening (World Health Organization, 2015a). The incidence of FBD is expected to increase in the presence of climate change due to an increase in ambient temperature creating an environment where microbes can rapidly multiply and thrive (Gregory, Johnson, Newton, & Ingram, 2009; Kovats et al., 2004). Foodborne cases of Salmonella make up the second largest cause of gastrointestinal infection in the United States (Scallan …

In this study, we used a conserved gene among dogs, SMN, to understand the genetic variability across dog breeds and to compare with human SMN1.

Methods: Using a sequential method design, new dog samples are added into the database as they become available. This paper is an application of the newly developed algorithms in studying the similarities and differences in …

Nicotine Dependence And Alternative E-Cigarette Use Behaviors: Dripping And Vape Tricks, Harmanpreet Bhatti Jan 2019

Nicotine Dependence And Alternative E-Cigarette Use Behaviors: Dripping And Vape Tricks, Harmanpreet Bhatti

Public Health Theses

Background: E-cigarette use among youth is concerning due to the risk of exposure to hazardous chemicals and future combustible cigarette use. Alternative e-cigarette use behaviors, or dripping (i.e., applying drops of e-liquids directly onto heated coils) and vape tricks (i.e., blowing shapes or large clouds of visible exhaled aerosol), may also increase this risk. However, little is known about the risk of nicotine dependence among adolescents who engage in these behaviors. Therefore, the aim of this study was to determine the association between these alternative e-cigarette use behaviors and nicotine dependence among adolescents.

Research Design: Cross-sectional data were collected from …

So You Think You Can Exercise: The Gap Between Exercise Confidence And Physical Activity Among Samoan Adults, Diksha Brahmbhatt Jan 2019

So You Think You Can Exercise: The Gap Between Exercise Confidence And Physical Activity Among Samoan Adults, Diksha Brahmbhatt

Public Health Theses

Samoa is experiencing one of the highest prevalence of overweight and obesity in the world, placing its population at increased risk of developing several noncommunicable diseases including type 2 diabetes and cardiovascular disease. The role of physical activity in reducing the burden of these diseases and overweight is well-established. Exercise self-efficacy or confidence is a predictor, if not determinant, of recreational physical activity. The purpose of this study, therefore, is to assess the relationship between exercise confidence and levels of recreational physical activity among Samoan adults. We confirm that exercise confidence is correlated with time spent exercising. However, despite considerable …
