Unperformed Rituals In An Unread Book, James Watts
Unperformed Rituals In An Unread Book, James Watts
Religion - All Scholarship
What is the significance of an unperformed ritual? And what is the meaning of an unread text? The intuitive answer, that unperformed rituals and unread texts have no meaning, is clearly wrong in the case of Leviticus. The rituals depicted in its text mean a great deal, because Jews, Samaritans and Christians continue to ritualize Leviticus as part of their scriptures. Leviticus’s status as the third book of scripture has remained virtually uncontested throughout the histories of these three religions, despite the fact that people do not observe many of its offering instructions or, among Christians, even read much of …

The Relationship Between Housing Price And Proximity To Public Land In Denver, Co, Connor Wyman
The Relationship Between Housing Price And Proximity To Public Land In Denver, Co, Connor Wyman
Honors Theses
This study examines how proximity to public lands influences housing values. This will be done using a hedonic pricing strategy, which is useful when analyzing heterogeneous goods such as a house or apartment. The data for this study comes from the American Community Survey (ACS) of Denver, CO from 2010 and 2017. This study also includes four variables related to distance from large open public spaces: one each for the distance from the Rocky Mountain Arsenal National Wildlife Refuge, Rocky Flats National Wildlife Refuge, Cherry Creek State Park, and Chatfield State Park. Multiple linear regressions were used to analyze the …
Natural Resources And The Making Of Modern Indian Law, Bethany Berger
Natural Resources And The Making Of Modern Indian Law, Bethany Berger
Connecticut Law Review
The pipeline protests at Standing Rock continued a long tradition of Native people coming together to protect natural resource rights. Indeed, this Essay argues, natural resource disputes are responsible for core advances in Native peoples' rights in the twentieth century. Although there are many examples, I focus on four particularly influential disputes. First, in 1905, at the height of an aggressively assimilationist federal policy, United States v. Winans preserved and expanded principles of treaty rights and preemption of state law. Next, in the 1920s, Pueblo struggles over water catalyzed new federal Indian policies that turned away from assimilation and toward …
Reclaiming The Navajo Range: Resolving The Conflict Between Grazing Rights And Development, Exra Rosser
Reclaiming The Navajo Range: Resolving The Conflict Between Grazing Rights And Development, Exra Rosser
Connecticut Law Review
Grazing is fundamental to Navajo identity, yet management of the Navajo range remains highly problematic. This Essay connects the federal government’s devastating livestock reduction effort of the 1930s with the inability of the Navajo Nation to place meaningful limits on grazing and the power of grazing permittees. It argues that the Navajo Nation should consider reasserting the tribe’s traditional understanding that property rights depend on use as a way to create space for reservation development.
“Highest Responsibility And Trust”: The National Environmental Policy Act & The Dakota Access Pipeline, Maegan Faitsch
“Highest Responsibility And Trust”: The National Environmental Policy Act & The Dakota Access Pipeline, Maegan Faitsch
Connecticut Law Review
The main goal of the National Environmental Policy Act (NEPA) is to compel government agencies to look for and discover possible environmental issues before making decisions that could impact the environment. The statute goes on to require an intensive review process when an environmental issue arises. NEPA can temporarily stop federal projects when an agency has not followed proper procedure or adequately considered certain factors. This Note proposes that under NEPA, courts should consider how agency decisions impact tribal treaty rights. The obligation to consider treaty rights come both from the treaty rights themselves and from the federal government’s trust …
Minding The Gap, Shmuel I. Becher, Tal Z. Zarsky
Minding The Gap, Shmuel I. Becher, Tal Z. Zarsky
Connecticut Law Review
Online and offline, relations between consumers and businesses are most frequently governed by consumer standard form contracts. For decades such contracts have been assumed to be one-sidedly biased against consumers. Consumer law seeks to alleviate this bias and empower consumers. Legislatures, consumer organizations, scholars, and judges constantly look for ways to protect consumers from unscrupulous firms and unfair behaviors.
While consumer-business relations are assumedly administered by standardized contracts, firms do not always follow these contracts in practice. Sometimes there is significant disparity between what the written contract stipulates and what consumers experience de facto. Interestingly, firms often deviate from the …
Common Ground Lawmaking: Lessons For Peaceful Coexistence From Masterpiece Cakeshop And The Utah Compromise, Robin Fretwell Wilson
Common Ground Lawmaking: Lessons For Peaceful Coexistence From Masterpiece Cakeshop And The Utah Compromise, Robin Fretwell Wilson
Connecticut Law Review
Only recently have lawmakers tried in earnest to combine protections for both the faith and LGBT communities, rejecting the zero-sum framing that sees one community as pitted against the other. In 2015, Utah, to the surprise of many, enacted a statewide law protecting the full LGBT community from discrimination in housing and hiring—giving LGBT persons more protections from discrimination than New York had expressly extended at that time. Popularly known as the “Utah Compromise,” Utah’s landmark legislation did so by following the signposts for a new American pluralism that Justice Anthony Kennedy later sketched in Masterpiece Cakeshop: that no one …
Actors As Authors In American Copyright Law, Justin Hughes
Actors As Authors In American Copyright Law, Justin Hughes
Connecticut Law Review
Among the many kinds of works eligible for copyright protection, audiovisual works are arguably the most complex, involving screenwriters, directors, actors, cinematographers, producers, set designers, costume designers, lighting technicians, etc. Some countries expressly recognize which categories of these contributors are entitled to legal protection, but American copyright law does not. Because the complex relationships among these creative professionals are usually governed by contract, there is relatively little case law on issues of authorship in audiovisual works. This is especially true on the question of dramatic performers as authors of audiovisual works.
This Article provides the first in-depth exploration of whether, …

Augmenting Land Cover/Land Use Classification By Incorporating Information From Land Surface Phenology: An Application To Quantify Recent Cropland Expansion In South Dakota, Lan Hoang Nguyen
Electronic Theses and Dissertations
Understanding rapid land change in the U.S. NGP region is not only critical for management and conservation of prairie habitats and ecosystem services, but also for projecting production of crops and biofuels and the impacts of land conversion on water quality and rural transportation infrastructure. Hence, it raises the need for an LCLU dataset with good spatiotemporal coverage as well as consistent accuracy through time to enable change analysis. This dissertation aims (1) to develop a novel classification method, which utilizes time series images from comparable sensors, from the perspective of land surface phenology, and (2) to apply the land …
