Viewer Disability And Television Accessibility: Closed-Captioning And Video Description Requirements In Today's Television Environment, Kimberlianne Podlas Jan 2018

Viewer Disability And Television Accessibility: Closed-Captioning And Video Description Requirements In Today's Television Environment, Kimberlianne Podlas

Cardozo Journal of Equal Rights & Social Justice

The article examines the legal and practical challenges of ensuring accessibility for individuals with sensory impairments in the contemporary television landscape, highlighting gaps in current regulations and the role of voluntary industry efforts in advancing accessibility. It argues that while laws like the Twenty-First Century Communications and Video Accessibility Act (CVAA) and the Americans with Disabilities Act (ADA) provide a framework for accessibility, they fail to comprehensively address the complexities of modern streaming platforms and digital services. The analysis emphasizes the importance of both regulatory expansion and industry-led initiatives to achieve equitable access for all viewers.

Professional Practice Guidelines For Occupationally Mandated Psychological Evaluations, American Psychological Association, Timothy P. Melchert Jan 2018

Professional Practice Guidelines For Occupationally Mandated Psychological Evaluations, American Psychological Association, Timothy P. Melchert

College of Education Faculty Research and Publications

Psychological evaluations are relied on by employers, professional licensing boards, and civil service commissions to make hiring and employment decisions affecting individuals, organizations, and the public. To promote best practices, these professional practice guidelines were developed for use by psychologists who perform clinical evaluations of individuals for occupational purposes, regardless of whether the evaluation is intended to obtain employment, to achieve licensure/certification, or to maintain either. These guidelines were created by the Committee on Professional Practice and Standards (COPPS) to educate and inform the practice of psychologists who conduct occupationally mandated psychological evaluations (OMPEs), as well as to stimulate debate …

Panel Effects In Administrative Law: A Study Of Rules, Standards, And Judicial Whistleblowing, Morgan Hazelton, Kristin E. Hickman, Emerson Tiller Jan 2018

Panel Effects In Administrative Law: A Study Of Rules, Standards, And Judicial Whistleblowing, Morgan Hazelton, Kristin E. Hickman, Emerson Tiller

SMU Law Review

In this article, we consider whether “panel effects”—that is, the condition where the presence, or expected voting behavior, of one judge on a judicial panel influences the way another judge, or set of judges, on the same panel votes—varies depending upon the form of the legal doctrine. In particular, we ask whether the hand of an ideological minority appellate judge (that is, a Democrat-appointed judge with two Republican appointees or a Republican-appointed judge with two Democrat appointees) is strengthened by the existence of a legal doctrine packaged in the form of a rule rather than a standard. Specifically, we unbundle …

From Guns That Do Not Shoot To Foreign Staplers: Has The Supreme Court's Materiality Standard Under Escobar Provided Clarity For The Health Care Industry About Fraud Under The False Claims Act?, Deborah R. Farringer Jan 2018

From Guns That Do Not Shoot To Foreign Staplers: Has The Supreme Court's Materiality Standard Under Escobar Provided Clarity For The Health Care Industry About Fraud Under The False Claims Act?, Deborah R. Farringer

Law Faculty Scholarship

As federal district courts and courts of appeals attempt to apply the Supreme Court’s dictates in Universal Health Services, Inc. v. U.S. ex rel. Escobar, it is necessary to ask whether the Court succeeded in easing the complexity of this aspect of the Federal Claims Act (FCA). Have lower courts been able to consistently apply the new standards to assess materiality? Or, has the opinion, which arguably both broadened and narrowed application of the implied false certificate theory and when liability might attach, further muddied the waters for courts and parties attempting to determine whether behavior is of the sort …

The Computer Made Me Do It: Is There A Future For False Claims Act Liability Against Electronic Health Record Vendors?, Deborah R. Farringer Jan 2018

The Computer Made Me Do It: Is There A Future For False Claims Act Liability Against Electronic Health Record Vendors?, Deborah R. Farringer

Law Faculty Scholarship

Since the advent of the movement toward the use of electronic medical records, an axiom in the promotion of electronic health records (EHRs) has been the idea that the use of EHRs will reduce medical errors. Certainly, there are countless examples of how technology can improve the health care experience and aid providers in reducing medical errors, including errors of medication administration, medication management, access to decision support tools, telemedicine, immediate access to diagnostic tests and other clinical information and treatment results—just to name a few. Even with such improvements, however, EHRs have not entirely eliminated medical errors and new …

Gis Project Management, Jochen Albrecht Jan 2018

Gis Project Management, Jochen Albrecht

Publications and Research

There is a big gulf between GIScience as an academic endeavor and its application in the form of GIS project management in the real world. Project activities are complex because they rarely involve routine repetitive acts, but often require specific knowledge and skills to be used in their design, execution, and management. This article explains what project management is, its objectives, and the required ingredients from personnel to budgets, and the integration of the GIS project into the larger context of an organization’s and even societal culture.

More Than Taking A Chair: The Perceived Group Social Dynamics Of Alcoholics Anonymous Related To Changes In Spiritual Practices, Alexis Kuerbis, J. Scott Tonigan Jan 2018

More Than Taking A Chair: The Perceived Group Social Dynamics Of Alcoholics Anonymous Related To Changes In Spiritual Practices, Alexis Kuerbis, J. Scott Tonigan

Publications and Research

Alcoholics Anonymous (AA) meeting attendance and spiritual practices are established predictors of abstinence. This study utilized longitudinal data from two studies of AA to investigate 1) how perceived within meeting social dynamics in AA meetings affect later AA attendance, and thus exposure to the emphasis of spiritual practices and 2) influence the extent that spiritual gains are mobilized, beyond AA attendance. Findings revealed that greater group cohesion was associated with lower AA attrition, and that expressiveness, or openness, of the group predicted reported practice of spiritual behaviors. Findings reveal distinct group dynamics may foster distinct mechanism of change of AA …

Exploration Of Treatment Matching To Problem Drinker Characteristics With Motivational Interviewing And Non-Directive Client-Centered Psychotherapy For Problem Drinkers, Alexis Kuerbis, Jessica Houser, Svetlana Levak, Sijing Shao, Jon Morgenstern Jan 2018

Exploration Of Treatment Matching To Problem Drinker Characteristics With Motivational Interviewing And Non-Directive Client-Centered Psychotherapy For Problem Drinkers, Alexis Kuerbis, Jessica Houser, Svetlana Levak, Sijing Shao, Jon Morgenstern

Publications and Research

Motivational Interviewing (MI) is a known effective intervention for alcohol use disorder (AUD). MI's mechanisms of action remain inconsistently substantiated, and research in this area has been reliant on identifying relationships through strength of association rather than experimental manipulation of active ingredients. In two previous studies, a pilot and a larger replication study, we disaggregated MI into its hypothesized active ingredients by creating three conditions: MI, Spirit Only MI (SOMI, in which evocation of change talk was proscribed), and a non-therapy condition (NTC). Results from both studies yielded equivalent findings across all three conditions. In the current analyses, data from …

Sibling Rivalry: A Comparison Of Giant Panda (Ailuropoda Melanoleuca) Twin Behavior, Taryn Chudo

Undergraduate Honors Thesis Projects

Expanded knowledge on an animal’s individual behavior would be useful in reintroduction programs for endangered species around the globe. Currently, reintroduction program criteria focus primarily on physical characteristics such as age, sex, and overall health for the selection of candidates. However, behavioral deficiencies have been found in captive populations, producing adverse effects on reintroduction program success. The giant panda (Ailuropoda melanoleuca) is a species that would benefit from understanding the impact of behavior on reintroduction success. This study focused on the relationship of behavior with kinship, birth weight and age. No significant correlation was found between birth weight …

Stigma And Its Reduction: The Role Of Knowledge, Causal Attribution, And Mental Disorder Type, Jesica N. Ferguson Jan 2018

Stigma And Its Reduction: The Role Of Knowledge, Causal Attribution, And Mental Disorder Type, Jesica N. Ferguson

Undergraduate Honors Thesis Projects

Abstract

Research has shown undeniable evidence of mental illness stigma. Stigma has been shown to reduce treatment seeking and negatively impact emotion and cognition in individuals with mental illness (Livingstone & Boyd, 2010). By discovering the driving forces behind stigma, treatment seeking and quality of life can be improved for individuals with mental illness. This study investigates the effect of knowledge, disorder type, and causal attribution on mental illness stigma. Specifically, participants were assigned to one of two conditions, knowledge or no knowledge. Knowledge conditions included information about a disorder (schizophrenia or depression, depending on disorder condition) such as definition, …

Characterization Of Two Cyclic Di-Gmp Phosphodiesterases Hypothesized To Regulate Virulence In Streptomyces Scabies, Madison Flasco Jan 2018

Characterization Of Two Cyclic Di-Gmp Phosphodiesterases Hypothesized To Regulate Virulence In Streptomyces Scabies, Madison Flasco

Undergraduate Honors Thesis Projects

Common scab is a devastating disease that affects the marketability of potatoes. The disease results in raised and pitted lesions seen on the surface of the potato and is caused by the soil pathogen, Streptomyces scabies. The S. scabies genome has two cyclic-di-GMP phosphodiesterases, RmdA and RmdB, both regulators of morphology and development. These proteins break down the ubiquitous second messenger molecule cyclic di-GMP, a molecule in charge of cell cycle progression and virulence. Both proteins contain diguanylate cyclase domains and phosphodiesterase domains, GGDEF and EAL, respectively, while RmdA contains an additional PAS_4 domain. Despite similar domain configurations, the two …

Towards Understanding The Role Of Small Mammals In The Transmission Of Lyme Disease In Virginia, Usa, Robert K. Rose, Laura Bitzer, Wayne Hynes, Holly D. Gaff, Robyn Nadolny, Jory Brinkerhoff

Biological Sciences Faculty Publications

Larvae and nymphs of many species of ticks select small mammals, reptiles, and birds as hosts. Since 2011, we have examined more than 1,000 small mammals of 10 species and collected a small tissue sample as well as all visible ticks; rates of infestation range from 18% in harvest mice to 53% in meadow voles. Identification of immature ticks is challenging and requires molecular or genetic methods beyond classification as being from the genus Ixodes or another genus. Ixodes ticks include Ixodes scapularis, the species that transmits the Lyme disease-causing bacterium Borrelia burgdorferi to humans. Of the approximately 2,300 ticks …

Modelling The Effects Of Habitat And Hosts On Tick Invasions, Robyn M. Nadolny, Holly D. Gaff Jan 2018

Modelling The Effects Of Habitat And Hosts On Tick Invasions, Robyn M. Nadolny, Holly D. Gaff

Biological Sciences Faculty Publications

Many tick species are invading new areas because of anthropogenic changes in the landscape, shifting climatic variables and increasing populations of suitable host species and tick habitat. However, the relative influences of habitat and hosts in tick dispersal and tick population establishment remain in question. A spatially explicit agent-based model was developed to explore the spatio-temporal dynamics of a generic tick population in the years immediately following the introduction of ticks into a novel environment. The general model was then adapted to investigate a case study of two recent tick species invasions into the Mid-Atlantic United States. The recent simultaneous …

“We Hide…”: Perceptions Of Hiv Risk Among Black And Latino Msm In New York City, Ashley Murray, Zaneta Gaul, Madeline Y. Sutton, Jose Nanin

Publications and Research

Black and Latino men who have sex with men (BLMSM) are disproportionately infected with HIV; they comprised 66% of HIV diagnoses among men who have sex with men (MSM) in the United States in 2015. Risk factors for HIV infection among BLMSM include a high community prevalence of diagnosed and undiagnosed HIV/STDs, and dense sex partner networks. Perceptions of HIV risk among BLMSM were explored to inform HIV prevention efforts. During 2011–2012, semistructured interviews were conducted with BLMSM in New York City. Using computer-assisted thematic analyses (NVivo), transcribed interview responses to questions regarding HIV risk for main themes were examined. …

Investigating The Status Of A Rare Cross-Linguistic Contrast: The Case Of Romanian Palatalized Postalveolars, Laura Spinu Jan 2018

Investigating The Status Of A Rare Cross-Linguistic Contrast: The Case Of Romanian Palatalized Postalveolars, Laura Spinu

Publications and Research

This study examines a rare cross-linguistic contrast, that between plain and secondarily palatalized postalveolar fricatives, through (i) an acoustic analysis of the production of 31 Romanian speakers, and (ii) a perception experiment with a different group of 31 native speakers. Evidence of acoustic separation between plain and palatalized forms was found for 27 of the subjects, suggesting that the contrast is produced by the majority. This is consistent with previous reports of native speakers collected in 1961. These findings were supported by the results of the perceptual experiment, which showed that native speakers exhibit moderate sensitivity to this contrast. An …

Two-Dimensional Maximal Repetitions, Amihood Amir, Gad M. Landau, Shoshana Marcus, Dina Sokol Jan 2018

Two-Dimensional Maximal Repetitions, Amihood Amir, Gad M. Landau, Shoshana Marcus, Dina Sokol

Publications and Research

Maximal repetitions or runs in strings have a wide array of applications and thus have been extensively studied. In this paper, we extend this notion to 2-dimensions, precisely defining a maximal 2D repetition. We provide initial bounds on the number of maximal 2D repetitions that can occur in a matrix. The main contribution of this paper is the presentation of the first algorithm for locating all maximal 2D repetitions in a matrix. The algorithm is efficient and straightforward, with runtime O(n^2 log n log log n+ rho log n), where n^2 is the size of the input, and rho is …

Publications and Research

This special issue of the Journal of Buddhist Ethics, Volume 25, is a symposium on the anthology, Buddhist Perspectives on Free Will: Agentless Agency? (Repetti), and on the topic reflected by that title, more broadly, based on an Author Meets Critics session of the 2018 American Philosophical Association Eastern Division meeting organized by Christian Coseru. To orient readers new to the topic, I first sketch what some of the issues are regarding Buddhist perspectives on free will. Second, I briefly describe the anthology, and third, I introduce the several contributions to this symposium. As I am sympathetic to most …

Aim: To compare the clinical impact of two different health department-sanctioned ACP documentation strategies.

Methods: A non-blinded, pre–post, controlled study over two corresponding 6-month periods in 2016 and 2017 comparing the current discretional not-for-resuscitation (NFR) with a new, inclusive GOC strategy in two medical/oncology wards at a large private hospital. Main outcomes were the uptake of ACP forms per hospitalisation and the timing between hospital admission, ACP form completion and in-patient death. Secondary outcomes included utilisation of the rapid …

Improving The Validity Of Script Concordance Testing By Optimising And Balancing Items, Michael Wan, Elina Tor, Judith Nicky Hudson Jan 2018

Improving The Validity Of Script Concordance Testing By Optimising And Balancing Items, Michael Wan, Elina Tor, Judith Nicky Hudson

Medical Papers and Journal Articles

Background: A script concordance test (SCT) is a modality for assessing clinical reasoning. Concerns had been raised about the plausible validity threat to SCT scores if students deliberately avoided the extreme answer options to obtain higher scores. The aims of the study were firstly to investigate whether students’ avoidance of the extreme answer options could result in higher scores, and secondly to determine whether a ‘balanced approach’ by careful construction of SCT items (to include extreme as well as median options as model responses) would improve the validity of an SCT.

Methods: Using the paired sample t-test, the actual average …

Physicians' Perspectives On Clinical Pharmacy Services In Northern Sweden: A Qualitative Study, Charlotta Vinterflod, Maria Gustafsson, Sofia Mattsson, Gisselle Gallego Jan 2018

Physicians' Perspectives On Clinical Pharmacy Services In Northern Sweden: A Qualitative Study, Charlotta Vinterflod, Maria Gustafsson, Sofia Mattsson, Gisselle Gallego

Medical Papers and Journal Articles

Background: In many countries, clinical pharmacists are part of health care teams that work to optimize drug therapy and ensure patient safety. However, in Sweden, clinical pharmacy services (CPSs) in hospital settings have not been widely implemented and regional differences exist in the uptake of these services. Physicians’ attitudes toward CPSs and collaborating with clinical pharmacists may facilitate or hinder the implementation and expansion of the CPSs and the role of the clinical pharmacist in hospital wards. The aim of this study was to explore physicians’ perceptions regarding CPSs performed at hospital wards in Northern Sweden.

Methods: Face-to-face semi-structured interviews …
