To Withdraw Or Not To Withdraw: Reviewability Of An Agency's Withdrawn Proposed Rule, Jane E. Carmody
To Withdraw Or Not To Withdraw: Reviewability Of An Agency's Withdrawn Proposed Rule, Jane E. Carmody
Washington Law Review
Federal agencies propose thousands of regulations in any given year. The Administrative Procedure Act requires such agencies to follow certain procedures when enacting rules and regulations. However, when an agency proposes a new rule that is purely discretionary—not mandated by Congress—it may withdraw the proposed rule at any point before the rule is finalized. In October 2017, the Centers of Medicare and Medicaid (CMS) withdrew a proposed rule that, if enacted, would have required long-term care facilities to recognize out of state same-sex marriages as a condition of Medicare and Medicaid participation. In its formal withdrawal published in the Federal …
Privacy's Double Standards, Scott Skinner-Thompson
Privacy's Double Standards, Scott Skinner-Thompson
Washington Law Review
Where the right to privacy exists, it should be available to all people. If not universally available, then privacy rights should be particularly accessible to marginalized individuals who are subject to greater surveillance and are less able to absorb the social costs of privacy violations. But in practice, there is evidence that people of privilege tend to fare better when they bring privacy tort claims than do non-privileged individuals. This disparity occurs despite doctrine suggesting that those who occupy prominent and public social positions are entitled to diminished privacy tort protections. This Article unearths disparate outcomes in public disclosure tort …

A Case Study Of The Implementation Of Co-Teaching In A Steam Elementary Magnet School In A Midwestern State, Ashley Lane Copley
Dissertations
Although research is limited on the effectiveness of co-teaching as a service delivery model for students with disabilities, through observation, many educators have reported positive outcomes with co-teaching (Beninghof, 2011). This case study was designed to examine the implementation of co-teaching in an elementary magnet school in a Midwestern school district driven by science, technology, engineering, arts, and mathematics (STEAM) and with a strong emphasis on personalized learning. General education teachers, special education teachers, and administrators were interviewed three times during the initial implementation school year. In addition, journaling was documented by three of the participants, and co-teaching fidelity checks …
Bioethics Beyond The Biosphere: Using Human Subject Medical Research To Chart Out Regulation And Liability For Health Risks In Outer Space, Ashle M. Page
North Carolina Journal of Law & Technology
Humans may be living in outer space sooner than we think. Because of the elevated potential for detrimental effects to human health in space, ethical standards must be established prior to the widespread formation of human space settlements. This article offers a framework for analyzing the bioethics of humans in space by analogizing the uncertainty in establishing a precautionary and liability framework for health risks in space by using models for medical experimentation on Earth.
An exploration of conventional bioethics principles, international guidelines for medical research, and regulations in the United States will parallel a precautionary framework for ensuring protections …

Supporting Student Connectedness And Social Satisfaction During Recess, Elizabeth Teasdale Wells
Dissertations, Masters Theses, Capstones, and Culminating Projects
This project examines the effects of how recess preparation and reflection can be focused on providing students an opportunity to connect socially and strengthen overall happiness. By investigating the role social satisfaction plays in a child’s life during recess, educators may gain knowledge about how to foster social connectedness for every child. While most studies about recess focus on a child’s level of physical activity or negative behaviors, researchers have yet to investigate recess as a place to improve a child’s well-being and social satisfaction. This study was conducted at a public elementary school through qualitative interviews and observations. Teachers, …

Instead Of Predicting The Future, We Should Get On With Creating The Future, Shweta Midgil, Richard Smith
Research Collection Lee Kong Chian School Of Business
It is important to note that there is a lot of hype about “Digital Disruption” these days. We see too many organizations trying to take on the topic of “Digital” without really focusing their efforts on something that is meaningful to the people in the organization. Leaders going around talking about digital disruption or digital transformation does not serve any purpose – only creates anxiety and uncertainty. In other words, leaders would be better served to break down the topic into meaningful topics that are linked to areas of the business.

Effect Of Psychological Distress On The Emerging Cause Of Infertility, Faiza Kausar
Journal of Asian Midwives (JAM)
Background: Infertility is a growing issue of the recent era, and it represents significant crises for most couples. Psychological distress has often been suggested as a cause of unexplained infertility. Male infertility accounts for 40% of all infertility problems, while female infertility accounts for 40% of all infertility problems; others are unexplained. Previous studies have indicated that stress and depression negatively impact various infertility parameters in both partners. To determine the relationship between infertility and psychological distress and the level of different types of stress among infertile couples, and to relate the significant stressors responsible for worsening infertility or …

In the modern digital world, it is increasingly challenging for destination marketers to design integrated marketing communication (IMC) strategies. The spectrum of information sources has become broader, serving for wider market interests. The importance of information in the modern world is increasing exponentially, and the tourism industry is traditionally information intense. There is an endless list of information outlets, and it is impossible to be present in all the information platforms. The spectrum of outlets includes old-school prints like magazines and newsletters on the one hand, while on the other hand there are modern advanced Web 2.0 technologies like social …

Association Of Drd2 Single Nucleotide Polymorphism And Fescue Toxicosis In Ruminants, Sarah Adams Wilbanks
All Dissertations
Fescue Toxicosis is a prevalent problem in the Southeastern, United States causing an estimated loss of one billion dollars per year to the livestock industry (Roberts & Andrae, 2010). There has been much research aimed at understanding the grass itself, the endophyte and the ergot alkaloids it produces, as well as its relationship and impacts on consuming animals. Many mitigation plans have been established and have been shown to control the amount of alkaloids subsequent animals are ingesting; however, research is at the tipping point of needing a genetic approach to fescue toxicosis. This research looked into the bovine genome …

We examined two conceptualizations of bicultural identity – the Bicultural Identity Integration (BII) framework (cultural identity blendedness-distance and harmony-conflict) and cultural hybridizing and alternating (mixing one’s two cultural identities and/or switching between them). Utilizing data from a 12-day diary study with 873 Hispanic college students, we examined three research questions: (1) cross-sectional and longitudinal intercorrelations among these biculturalism components, (2) links among daily variability in these biculturalism components, and (3) how this daily variability predicts well-being and mental health outcomes over time. Bicultural hybridizing was positively related to, and longitudinally predicted by, both BII blendedness and harmony. Daily fluctuation scores …
