Competitive Philanthropy: Charitable Naming Rights, Inequality And Social Norms, Linda Sugin Jan 2018

Competitive Philanthropy: Charitable Naming Rights, Inequality And Social Norms, Linda Sugin

Faculty Scholarship

Income inequality today is at a high not seen since the 1920s, and one way the very richest display their wealth is through charitable giving. Gifts in excess of $100 million are no longer rare, and in return for their mega-gifts, the biggest donors get their names on buildings, an astonishingly valuable benefit that the tax law ignores. The law makes no distinction between a gift of $100 and a gift of $100 million. This article argues that the tax law of charity should focus on the very rich and harness the culture of philanthropy among the elite. The law …

The Social Meaning Of The Tax Cuts And Jobs Act, Linda Sugin Jan 2018

The Social Meaning Of The Tax Cuts And Jobs Act, Linda Sugin

Faculty Scholarship

This Essay exposes the moral messages implicit in the Tax Cuts and Jobs Act (TCJA). It argues that the legislation reflects values that were not openly debated or discussed in the legislative process, but are crucial to the distributional effects of the law. The TCJA reduces progressivity and increases deficits because it favors traditional families, prefers capital to labor income, treats people as detached from each other, makes charity the narrow concern of the rich, and privileges the acquisition of assets. Fairness in taxation depends on explicitly identifying social values that produce economic justice and purposely designing the law to …

The Political Morality Of Convergence In Contract, Aditi Bagchi Jan 2018

The Political Morality Of Convergence In Contract, Aditi Bagchi

Faculty Scholarship

One of the most interesting recent developments in contract law has been an academic and political effort to integrate private law. The proposed Common European Sales Law was ultimately withdrawn, and a series of setbacks, including the British referendum to exit the EU, has recast the politics of convergence. But it remains an objective for many European scholars. This essay considers the wisdom of convergence on a single law of transactions from the perspective of philosophical contract theory. The essay proceeds by disaggregating the rights at stake in contract law. It characterises the formal right to contract and describes its …

A Clothesline Theology For The World: How A Value-Driven Grand Narrative Of Scripture Can Frame The Gospel, Tom Steffen Jan 2018

A Clothesline Theology For The World: How A Value-Driven Grand Narrative Of Scripture Can Frame The Gospel, Tom Steffen

Great Commission Research Journal

This article attempts to answer the question, why is it important to view Scripture as a single grand narrative? Too many of us are specialist in fragmentation when it comes to Scripture. We therefore continue to perpetuate a fragmented understanding of Scripture, and her Author. To grasp a more comprehensive picture of the face of God we must be able to move beyond the individual pieces of clothing placed on the clothesline, whether linear or circular, and learn to value how they all tie together to form a comprehensive wardrobe that brings honor to the Wearer.

Understanding Students' Perceptions Of Cultural Diversity, Catherine Moss

Walden Dissertations and Doctoral Studies

Diversity is a positive aspect of a student's educational experience. Current literature supports the value of diversity, confirming that skills are developed within a diverse learning environment that prepares students to thrive in a competitive global economy. The leadership at University X (UX) had implemented various initiatives to improve diversity, yet the problem addressed in this study was that students perceived differently, citing that diversity growth lacked progress. Teacher Assessments Of School-Wide Positive Behavioral Interventions And Supports, Gequana Thomas

Walden Dissertations and Doctoral Studies

Discipline is of increasing concern to school stakeholders in districts around the world. It is especially concerning in a district of a southern U.S. state, where a zero tolerance policy calls for the removal of disruptive students from the classroom. Students, teachers, administrators, and other district officials may benefit from effective implementation of Positive Behavior Interventions and Supports (PBIS), a positive discipline program that includes educators using data for instructional and discipline decision making. In the local district, little is known about the teachers' opinions regarding the PBIS implementation. The purpose of this project study was to gain insight on …

Perceptions Of Reasonable Use Of Force By Probation Officers And Civilians, Timothy Loranzy Sowards Jan 2018

Perceptions Of Reasonable Use Of Force By Probation Officers And Civilians, Timothy Loranzy Sowards

Walden Dissertations and Doctoral Studies

There is little academic research that examines whether there are differences between the ways probation officers and community members perceive the use of force on juvenile offenders. Failure to understand the differences in these perceptions negatively affected a probation department in California, which failed to address public concerns regarding the use of force in the juvenile hall, which resulted in a consent decree and a costly financial settlement. Using socialization theory as the foundation, the purpose of this study was to understand if there is a statistically significant difference between probation officers and civilians regarding their perceptions of use of …

Effect Of External Locus-Of-Hope On Acquired Capability For Suicide, Yitzchok Wagshul Jan 2018

Effect Of External Locus-Of-Hope On Acquired Capability For Suicide, Yitzchok Wagshul

Walden Dissertations and Doctoral Studies

Researchers have investigated the role of hope as a protective factor against suicide. Of the 3 factors posited by Joiner's interpersonal theory of suicide (IPTS) to be necessary before suicide can occur, increased hope has been shown to reduce 2 (thwarted belongingness and perceived burdensomeness), but, counterintuitively, to increase the 3rd (acquired capability for suicide). A fuller understanding of this phenomenon may lie with Bernardo's locus-of-hope construct-pursuant to which hope may lie not only in one's own plans and capabilities (internal locus-of-hope) but in those of others (external locus-of-hope) but to date no study has researched the relationship between external …
