Improving The Criminal Justice System In Nigeria Through Restorative Justice: Lessons From Canada And New Zealand, Olaniran Akintunde Oct 2018

Improving The Criminal Justice System In Nigeria Through Restorative Justice: Lessons From Canada And New Zealand, Olaniran Akintunde

LLM Theses

This thesis argues the need for Nigeria to incorporate restorative justice within its criminal justice system. Its prevailing adversarial system is bedevilled with various challenges such as over- incarceration, recidivism, high rates of juvenile crime and prison congestion. The work draws lessons from Canada and New Zealand, two jurisdictions that have made improvements to similar systems like Nigeria via the adoption and practice of restorative justice. The advantages that a restorative justice alternative bring to criminal justice administration in Nigeria include less use of incarceration, improvement in social relationships, rehabilitation and the reintegration of young offenders. The thesis recommends that …

The More Things Change, The More They Stay The Same: Educational And Disciplinary Backgrounds Of American Librarians, 1950-2015, Rachel Ivy Clarke, Young-In Kim Oct 2018

The More Things Change, The More They Stay The Same: Educational And Disciplinary Backgrounds Of American Librarians, 1950-2015, Rachel Ivy Clarke, Young-In Kim

School of Information Studies - Faculty Scholarship

Discussions of diversity in American librarianship usually focus on gender or ethnicity, but historical studies also show a lack of diversity in educational and disciplinary backgrounds. Librarians traditionally hail from the humanities, especially English and history. But as current educational attention shifts to science, technology, engineering and math (STEM) fields, are librarians reflecting this change? Anonymized data from ALA-accredited graduate programs from the last five years was collected, coded, and classified to determine librarians’ educational and disciplinary backgrounds and in what ways, if any, they differ from the past 65 years and from the contemporary U.S. general population. Unsurprisingly, we …

Urban Anticipatory Governance, Edward W. De Barbieri Oct 2018

Urban Anticipatory Governance, Edward W. De Barbieri

Florida State University Law Review

Legal scholars who study cities and urban governance discuss participation in a number of ways, and at various moments in the legal process. Frequently, however, less attention is placed on anticipatory participation-forward-lookingf,l exible, and inclusive public engagement- and its role in promoting effective and legitimate policy. The emerging concept of anticipatory governance synthesizes different notions of improving participation and places focus on how residents can best participate in society's most difficult decisions. At the local level, such matters are often those that address land use and economic development. The recent climate change preparedness strategic plan in New York City, known …

Student Attitudes Toward Sex Offender Policies And Laws In An Era Of High Profile Sex Crimes In The News, Amber Bennett Oct 2018

Student Attitudes Toward Sex Offender Policies And Laws In An Era Of High Profile Sex Crimes In The News, Amber Bennett

Mahurin Honors College Capstone Experience/Thesis Projects

This is a study looking at the attitudes that undergraduate college students taking introductory sociology and criminology courses have toward sex offender policies and laws such as community notification, residence restrictions, and the registry system. Voluntary participants were also asked to look at the appropriateness of the punishment given to perpetrators in case studies based off real cases. Results showed that there are potential gender differences in the attitudes about appropriateness of notification and the registration of sex offenders. There were less favorable attitudes toward chemical and surgical castration. Further research should be done to look at different types of …

Substance Abuse Treatment In Prison Settings: A Systematic Review, Emilee Cline Oct 2018

Substance Abuse Treatment In Prison Settings: A Systematic Review, Emilee Cline

Psychology Capstone Projects

A significant relationship between criminal behavior and substance abuse exists, which leads to a large proportion of individuals in the prison system who meet criteria for a substance use disorder. This review compares empirically-supported treatments for substance use disorder to current substance abuse treatment programs offered in United States prisons. A review of current literature indicates that Therapeutic Communities are the most common form of substance abuse treatment provided, and often these are combined with Cognitive-Behavioral Therapy groups. Special treatment considerations are provided based on the type of substance used, gender, and ethnicity. Empirically-supported treatments are currently being implemented by …

Trafficked In Texas: Combatting The Sex-Trafficking Epidemic Through Prostitution Law And Sentencing Reform In The Lone Star State, Madison T. Santana Oct 2018

Trafficked In Texas: Combatting The Sex-Trafficking Epidemic Through Prostitution Law And Sentencing Reform In The Lone Star State, Madison T. Santana

Vanderbilt Law Review

American law has historically treated prostitution as a victimless crime, a moral trespass between two consenting individuals, rather than a potential act of violence, a product of fraud or coercion. However, growing awareness of the international sex-trafficking epidemic has brought long-settled prostitution law once more under the critical eye of academics and lawmakers as a potential tool in curbing the stillgrowing demand for illicit commercial sex. Whether prostitution law reform may in fact be effective remains a matter of academic debate in the United States; however, such reform has gained substantial ground abroad, with compelling results. This Note argues for …

Should Female Prostitution Be Legalized? An Opinion Survey Of Jordanian Citizens Living In The United States, Rana Q. Alzoubi

Criminology Student Work

Prostitution is a worldwide phenomenon in which different cultures attempt to control and regulate sex work often with terrible consequences. The purpose of the current study is to examine the opinions of Jordanian citizens living in the United States concerning the legalization of prostitution. To provide a better understanding of prostitution in the Middle East, this research explores the opinions of Jordanian citizens on the legalization of prostitution in the Middle East. The research asks participants about prostitution as it relates to health, victimization, and the marginalization of prostitutes, as well as the ways in which prostitutes lack protection through …

Putting An End To The Punishment And Rehabilitation Pendulum, Cassandra Long Oct 2018

Putting An End To The Punishment And Rehabilitation Pendulum, Cassandra Long

Criminology Student Work

Over the past 30 years, the juvenile justice system can be described as a pendulum that swings between the concepts of rehabilitation and punishment. When the juvenile justice system was first created, rehabilitation and restorative justice were its primary purposes. However, over time the system has strayed from these views and has turned its focus toward punishment. The punishment focus has partially risen out of the communities’ fear of crime that has been ignited by the media concerning adolescents who are not deterred by the juvenile justice system. Nonetheless, it can be argued that the juvenile justice system should revert …

The Trouble With Corporate Conscience, James D. Nelson Oct 2018

The Trouble With Corporate Conscience, James D. Nelson

Vanderbilt Law Review

Accomplished corporate law scholars claim that modern businesses need an infusion of morality. Disappointed by conventional regulatory responses to recurring corporate scandal, these scholars argue that corporate conscience provides a more fruitful path to systemic economic reform. In Burwell v. Hobby Lobby, which held that for-profit businesses can claim religious exemptions from general laws, the Supreme Court gave this notion of corporate conscience added momentum. Emboldened by the Court's embrace of business goals extending beyond shareholder profit, proponents of a moralized marketplace now celebrate corporate conscience as an idea whose time has come. This Essay criticizes the leading arguments for …

Trans-Cending The Medicalization Of Gender: Improving Legal Protections For People Who Are Transgender And Incarcerated, Lindsey Ruff Oct 2018

Trans-Cending The Medicalization Of Gender: Improving Legal Protections For People Who Are Transgender And Incarcerated, Lindsey Ruff

Cornell Journal of Law and Public Policy

People who are transgender and incarcerated face a unique set of human rights challenges. Courts have made progress protecting transgender people who are incarcerated by relying on the psychiatric diagnosis, Gender Dysphoria (GD), as grounds for legal protections. However, reliance on a medical model of gender has practical limitations and adverse social consequences. This model fails to protect the most vulnerable people of trans experience and contributes to stigma against the transgender community overall. The social and legal interests of people who are transgender and incarcerated would be better served if their rights were protected on alternate legal grounds.

The Arbiters Of Decency: A Study Of Legislators' Eighth Amendment Role, David Niven, Aliza Plener Cover Oct 2018

The Arbiters Of Decency: A Study Of Legislators' Eighth Amendment Role, David Niven, Aliza Plener Cover

Washington Law Review

Within Eighth Amendment doctrine, legislators are arbiters of contemporary values. The United States Supreme Court looks closely to state and federal death penalty legislation to determine whether a given punishment is out of keeping with “evolving standards of decency.” Those who draft, debate, and vote on death penalty laws thus participate in both ordinary and higher lawmaking. This Article investigates this dual role. We coded and aggregated information about every floor statement made in the legislative debates preceding the recent passage of bills abolishing the death penalty in Connecticut, Illinois, and Nebraska. We categorized all statements according to their position …
