What Will It Take? Examining The Use Of Preliminary Hearing Testimony Where Victims Are Unavailable Due To Mental Illness Stemming From Domestic Violence And Sexual Assault, Kristin Grossman
Northern Illinois University Law Review
A particular problem exists that domestic violence and sexual assault victims face when bringing their abusers to court. This is whether the use of preliminary hearing testimony can be utilized where a victim is unavailable to testify at trial due to mental illness, namely Post-traumatic Stress Disorder. This article examines the manner in which various states have combatted the issue of unavailability due to mental health and what role that unavailability has in a domestic violence or sexual assault case. By closely looking at the case State v. Anderson, 402 P.3d 1063 (Idaho 2017), this article seeks to justify the …

The Right To Counsel In Criminal Cases: Still A National Crisis?, Mary Sue Backus, Paul Marcus
The Right To Counsel In Criminal Cases: Still A National Crisis?, Mary Sue Backus, Paul Marcus
Faculty Publications
In 1963, Gideon v. Wainwright dramatically changed the landscape of criminal justice with its mandate that poor criminal defendants be entitled to legal representation funded by the government. As scholars and practitioners have noted repeatedly over more than fifty years, states have generally failed to provide the equal access Gideon promised. This Article revisits the questions raised by the authors over a decade ago when they asserted that a genuine national crisis exists regarding the right to counsel in criminal cases for poor people. Sadly, despite a few isolated instances where litigation has sparked some progress, the issues remain the …

Prosecutorial Dismissals As Teachable Moments (And Databases) For The Police, Adam M. Gershowitz
Prosecutorial Dismissals As Teachable Moments (And Databases) For The Police, Adam M. Gershowitz
Faculty Publications
The criminal justice process typically begins when the police make a warrantless arrest. Although police usually do a good job of bringing in the “right” cases, they do make mistakes. Officers sometimes arrest suspects even though there is no evidence to prove an essential element of the crime. Police also conduct unlawful searches and interrogations. And officers make arrests in marginal cases—schoolyard fights are a good example—in which prosecutors do not think a criminal conviction is appropriate. Accordingly, prosecutors regularly dismiss cases after police have made warrantless arrests and suspects have sat in jail for days, or even weeks. In …

Use Of Drug Dependency To Entrap And Control Victims Of Sex Trafficking: A Call For A U.S. Federal Human Rights Response, Jacquelyn C.A. Meshelmiah, Carra Gilson, Athapattu Pathirannelage A. Prasanga
Dignity: A Journal of Analysis of Exploitation and Violence
Survivors of sex trafficking who were forced into drug use as victims are in need of social services to treat their drug dependency and other mental disorders. Access to social services is a human rights issue that must be acted upon by state and federal officials. The law, however, requires approval of the T-Visa for receipt of benefits. Along with the T-visa application process, the applicant (human trafficking survivor) must be willing to assist in every reasonable way in the investigation and prosecution of the trafficker. The authors argue that drug dependency treatment and other social service benefits should be …
Universal Representation, Lindsay Nash
Universal Representation, Lindsay Nash
Articles
In an era in which there is little good news for immigrant communities and even holding the line has become an ambitious goal, one progressive project has continued to gain steam: the movement to provide universal representation for noncitizens in removal proceedings. This effort, initially born out of a pilot project in New York City, has generated a host of replication projects throughout the nation and holds the promise of even broader expansion. But as it grows, this effort must confront challenges from within: the sort-of supporters who want to limit this representation system's coverage in a number of ways, …

Cultural Heritage Protection As A Security Issue In The 21st Century: Recent Developments, Sabine Von Schorlemer
Cultural Heritage Protection As A Security Issue In The 21st Century: Recent Developments, Sabine Von Schorlemer
Indonesian Journal of International Law
Throughout history, cultural property has permanently been at risk in armed conflict as belligerents always aimed at razing to the ground or plundering the enemy’s cultural heritage. Cultural property is a war victim time and again, either by armed attack or by collateral damage. This background opens the way for new insights into research on cultural heritage protection as a security issue in the 21st century. In order to fight the root causes of heritage destruction and extremism, UNESCO is advocating strongly a comprehensive approach, using also its “soft power” across the Organization’s mandate. Thus, despite its limited resources, UNESCO …
Alternatives To Immigration Detentions With Particular Focus On Children, Lyra Jakuleviciene
Alternatives To Immigration Detentions With Particular Focus On Children, Lyra Jakuleviciene
Indonesian Journal of International Law
Immigration detention is costly, ineffective and raises a number of human rights concerns. Numerous studies have demonstrated the detrimental effect of such detention on states and individuals. This prompted the States to search for alternative solutions that would, on the one hand – assist in reaching the objectives of migration control of foreigners on their territories, on the other – ensure that human rights of migrants and refugees are not undermined. Although various legal models of alternatives to detention (ATDs) already exist, the alternatives are still finding obstacles on their way to legislation and practice of various States. The research …

"They Sacrificed...For Us, We Need To Give Them A Helping Hand Now": Local Reasoning In Combat Veteran's Court, Stacy Lee Burns
Sociology Faculty Works
This study focuses on local reasoning in Combat Veteran’s Court in terms of its combat veteran clientele. The perceived nature of the client-defendants as victim/offenders who have paid a great price to protect us all and whose combat service is directly related to their criminality significantly alters the moral calculus in the court. This altered moral calculus finds its way into the institutional encounters ad hoc, in the local relevancies, particulars, and contingencies of the case-at-hand, and in the prospects for ‘what can happen’, given what has already occurred. Combat Veteran’s Court is working out the fundamental terms of moral …
Involuntary Termination From Substance Use Disorder Treatment: Unknown Phantoms, Red Flags, And Unexplained Medical Data, Izaak L. Williams
Involuntary Termination From Substance Use Disorder Treatment: Unknown Phantoms, Red Flags, And Unexplained Medical Data, Izaak L. Williams
Journal of Human Services: Training, Research, and Practice
In the United States, all treatment programs receiving public funds are required by law to regularly submit admission and discharge data, inclusive of the forced/involuntary termination or administrative discharge of clients, to their local state authorities. In some states, this requirement even extends to programs not receiving public funds. The aim of collecting discharge data—collected under the auspices of the Substance Abuse and Mental Health Services Association [SAMHSA]—is to assist state and county authorities, funders, and accreditors to monitor recovery-focused program performance. However, investigation here undertaken shows that published discharge data from many state treatment settings are perennially and grossly …

A Genealogy Of Programmatic Stop And Frisk: The Discourse-To-Practice-Circuit, Frank Rudy Cooper
University of Miami Law Review
President Trump has called for increased use of the recently predominant policing methodology known as programmatic stop and frisk. This Article contributes to the field by identifying, defining, and discussing five key components of the practice: (1) administratively dictated (2) pervasive Terry v. Ohio stops and frisks (3) aimed at crime prevention by means of (4) data-enhanced profiles of suspects that (5) target young racial minority men.
Whereas some scholars see programmatic stop and frisk as solely the product of individual police officer bias, this Article argues for understanding how we arrived at specific police practices by analyzing three levels …
