Criminal Heroes In Television: Exploring Moral Ambiguity In Law And Justice, Amy Henry
Criminal Heroes In Television: Exploring Moral Ambiguity In Law And Justice, Amy Henry
Theses and Dissertations (Comprehensive)
Criminal justice is a popular theme in both news and entertainment media. How crime and justice issues are framed can actually legitimize corruption in a society. As research reveals the public’s dissatisfaction with the current failing retributive justice system, popular television series’ are confronting its flaws (Jerre, 2013). Utilizing a cultural criminological and social constructionist orientation, the following research examines anti-hero narratives in two highly rated crime-drama series, Breaking Bad and Sons of Anarchy. The main research questions examine: How the criminal protagonist or anti-hero is constructed in television crime procedurals? What claims about crime, criminality, law and justice …
Proposing A Federal Post-Natural Disaster Mediation Program, Michelle Shaykevich
Proposing A Federal Post-Natural Disaster Mediation Program, Michelle Shaykevich
Cardozo Journal of Conflict Resolution
Section II explores the history of state and federal natural disaster mediation programs. Currently, there are three primary disaster mediation processes used by states. First, and most common, are ad-hoc programs. These programs are developed after a natural disaster has occured. Second is a program utilized exclusively by North Carolina, whereby an institutional organization maintains a "state of readiness" in the event of a declared disaster. The third type is a mediation program that is run by the state but specifically excludes the mediation of flood insurance claims. Regarding federal post-natural disaster mediation programs, Section II discusses current legislative and …
The President, Prosecutorial Discretion, Obstruction Of Justice, And Congress, Henry L. Chambers Jr.
The President, Prosecutorial Discretion, Obstruction Of Justice, And Congress, Henry L. Chambers Jr.
Law Faculty Publications
The executive power of the United States is vested in the President of the United States. That power includes prosecutorial discretion—the power to prosecute or decline to prosecute. Consequently, the President would appear to have the constitutional authority to initiate or end a federal criminal prosecution or investigation. This would seem particularly so in an era in which executive power arguably continues to expand. Nonetheless, an ongoing debate exists regarding whether a President obstructs justice when he attempts to end a criminal investigation for improper reasons. Those who argue in favor of the possibility of obstruction of justice suggest that …

Perception Of Nigerian Immigrants Of Police And Policing In The United States, Akinniyi Ademola Akinropo
Perception Of Nigerian Immigrants Of Police And Policing In The United States, Akinniyi Ademola Akinropo
Walden Dissertations and Doctoral Studies
Nigerian immigrants in the United States exhibit complex and different perceptions of police in the criminal justice system than those of African Americans who are born in the United States. In order for Nigerian immigrants to contribute to improved police-community relations, their views and experiences with local police should be evaluated and applied to police agency decision-making. The purpose of this narrative study was to explore Nigerian immigrants' perceptions of police and policing in the United States (U.S.). Social cognitive theory was utilized as a lens of analysis to understand how prior experiences can influence future behavior and expectations. Structured …
Perceptions Of People's Experiences Regarding Gun Violence, Charles M. Ndikum
Perceptions Of People's Experiences Regarding Gun Violence, Charles M. Ndikum
Walden Dissertations and Doctoral Studies
Gun violence is a problem in many communities across the United States that are characterized by poverty, and lack of quality education, yet little is known about the experiences of victims of gun violence in these places. The purpose of this phenomenological study was to better understand how people who have been victims of gun violence perceive problems and solutions associated with the production, distribution, and ownership of guns. Based on the theoretical framework of Rousseau's social contract theory, this study explored gun violence from the perspectives of 10 victims whose lives were directly or indirectly affected by gun violence …
A Case Study Of Overcrowding In A County Jail In The Southeast United States, Marquice Robinson
A Case Study Of Overcrowding In A County Jail In The Southeast United States, Marquice Robinson
Walden Dissertations and Doctoral Studies
For the past several decades, the county jail in a large metropolitan city in the southeast United States has been overcrowded, which has resulted in violence within the jail, excessive costs to the Sheriff's Office, and a requirement of Federal oversight of the jail from 2005 to 2015. In spite of these events, little is understood about why jail overcrowding is prevalent in the county and what impacts overcrowding may have on the communities around the jail. Using Shaw and McKay's social disorganization theory as the foundation, the purpose of this case study was to understand the unique circumstances around …
Changes In Beliefs About Aggression In Baton Rouge Youth Peace Olympics Participants, Shonta Manuel
Changes In Beliefs About Aggression In Baton Rouge Youth Peace Olympics Participants, Shonta Manuel
Walden Dissertations and Doctoral Studies
Youth violence in the Baton Rouge inner-city area continues to create heightened concerns for the communities as well as the financial and healthcare systems. Even though violence prevention programs are in place in the area, no decline has been recorded in those who are being affected by violence. Due to lack of research in this field, a need for a sound research study exists to understand how Youth Peace Olympics (YPO) community-based program may be related to changes in attitudes about aggression and violence. A correlational cross-sectional research design was used to evaluate participants' beliefs about aggression, measured using the …
Initial Drug Court Risk Assessment Scores And Probationers' Completion Of Drug Court Programs, Carina T. Atkins
Initial Drug Court Risk Assessment Scores And Probationers' Completion Of Drug Court Programs, Carina T. Atkins
Walden Dissertations and Doctoral Studies
Drug offenders continue to cost citizens and governments money, while drug courts attempt to rehabilitate offenders and reduce recidivism. The Level of Service Inventory-Revised (LSI-R) is a risk assessment tool used by courts and probation offices to determine needs and risks of offenders, and often determine levels of supervision. The purpose of this quasi experimental study was to determine if there is a statistically significant association between the initial LSI-R scores of offenders entering drug courts and their successful completion of the drug court program. Therapeutic jurisprudence theory, the theoretical framework for this study, suggests that the courts and the …
The Effect Of Cultural Awareness Training On Staff In Intergovernmental Service Agreement Facilities, Steven Alan Coffman
The Effect Of Cultural Awareness Training On Staff In Intergovernmental Service Agreement Facilities, Steven Alan Coffman
Walden Dissertations and Doctoral Studies
No system-wide diversity training exists at Immigration and Customs Enforcement Intergovernmental Service Agreement (IGSA) facilities. This study was conducted to determine if diversity training has a short-term effect on cultural awareness of staff in these facilities in the midwestern United States. This information is important to administrations in IGSA facilities when deciding to include diversity training in the annual required training of staff, as the efficacy and relevance have been unknowns. The theoretical foundation of this study is Smircich's organizational culture theory. A nonequivalent control group research design was utilized to collect survey data from 48 participants at 2 midwestern …

The Lived Experiences Of African-American Male Exoffenders In The Northeast United States, Jacqueline Grant
Walden Dissertations and Doctoral Studies
Discrimination, racism, and class bias affects the accessibility of resources available to African American males who are exoffenders. The purpose of this phenomenological study was to explore the lived experiences of African American, male exoffenders' ability to access resources postincarceration. Guided by Bell and Freeman's critical race theory, a purposeful sample of 6 African American, male exoffenders were recruited from 2 reentry programs in the Northeast United States. A semistructured interview approach was employed to examine the life history, details of experience, and reflection on the meaning of the lived experience from the participants. The modified Stevick, Colaizzi, and Keen …

"Strategies For Inclusive And Responsive Police Accountability", Lonzale Ramsey (Sr.)
Walden Dissertations and Doctoral Studies
In the United States of America today, there are concerns regarding the appropriate functioning of the police service and a lack of effective police accountability. African Americans have often been victims of unprofessional police conduct; however, their views have rarely been found adequately represented in the literature on the subject. The purpose of this case study was to fill this identified gap in the academic literature. A conceptual framework composed of the afrocentric, environmental contingency, and conflict theories was used to guide and inform this inquiry. The main research question focused on discovering which form of police oversight is seen …
Factors Impacting The Financial Independence Of Women Who Were Teenage Mothers, Jeanette Parker
Factors Impacting The Financial Independence Of Women Who Were Teenage Mothers, Jeanette Parker
Walden Dissertations and Doctoral Studies
Teenage pregnancy in the United States is a national concern because of negative outcomes for teen mothers and their children of teen mothers. There is ample research on the negative outcomes associated with teen pregnancy: however, there is little research on the success of teenage mothers. This transcendental, phenomenological study examined how former teenage mothers overcame challenges of teen pregnancy to become financially independent adults. The research question for this study was: What factors enabled former teen mothers to overcome challenges of teen pregnancy to become financially independent adults? Principles from social learning theory and resilience theory provided the conceptual …
Evaluation Of An Opioid Risk-Assessment Screening Tool, Jacquelyne Guerra
Evaluation Of An Opioid Risk-Assessment Screening Tool, Jacquelyne Guerra
Walden Dissertations and Doctoral Studies
According to the Centers for Disease Control and Prevention, prescribers should evaluate risk factors related to opioid use prior to initiation of opioid medication. The practice problem in this DNP project was that providers failed to consistently assess patients with complaints of pain for risk of opioid misuse and/or abuse prior to initiating opioid medication. An opioid risk-assessment screening tool (ORAST) has the potential to identify patients at high risk for opioid misuse and/or abuse. The purpose of this Doctor of Nursing Practice project was to identify and introduce an ORAST and then develop a policy to guide providers in …

The Evaluation Of The Impact Of Controlled Substance Patient Education In The After Visit Summary On Patient Knowledge Of Controlled Substance Medication, Marie Honeycutt
DNP Projects
The use of opioids is associated with risks for misuse, abuse, addiction and diversion, which are directly related to increased healthcare utilization, increased healthcare cost, and poor patient outcomes. The purpose of this study was to evaluate the impact of controlled substance (CS) patient education that was implemented into the electronic medical record. The objectives were to 1.) assess whether patients received the CS after visit summary (AVS) and 2.) assess differences in pain management knowledge between those who received the AVS and those who did not. Methods This descriptive correlational designed study examined the differences in pain management knowledge …

Restructuring The Elementary And Secondary Education Act’S Approach To Equity, Kimberly Jenkins Robinson
Restructuring The Elementary And Secondary Education Act’S Approach To Equity, Kimberly Jenkins Robinson
Law Faculty Publications
The United States stands at a crossroads regarding educational equity. On one road, the Every Student Succeeds Act (ESSA), the current reauthorization of the Elementary and Secondary Education Act (ESEA), greatly reduced federal involvement in education and returned control to state and local governments that had repeatedly criticized the prescriptive nature of the No Child Left Behind Act of 2001. In the wake of this federal retreat, state and local control of education without effective federal oversight creates grave concerns for those who advocate for economically disadvantaged and minority students, including many civil rights groups. History confirms that states and …
Resolving The Circuit Split Over Consent Based Searches In Shared Living Spaces, Christopher Grimaldi
Resolving The Circuit Split Over Consent Based Searches In Shared Living Spaces, Christopher Grimaldi
Cardozo International & Comparative Law Review
The note argues that the police, not citizens, should bear the responsibility of resolving ambiguities in consent to search cases under the Fourth Amendment. It advocates for a solution that aligns with Supreme Court precedent, particularly Rodriguez and Salinas-Cano, to ensure constitutional protections while maintaining efficient law enforcement. The proposed approach emphasizes the importance of police inquiry to clarify authority over jointly used property, balancing individual privacy rights with practical law enforcement needs.
The Unexpected Scope Of The Cfaa: And How Netflix Users Could Be Committing A Federal Crime, Michael Levy
The Unexpected Scope Of The Cfaa: And How Netflix Users Could Be Committing A Federal Crime, Michael Levy
Cardozo International & Comparative Law Review
The Ninth Circuit's broad interpretation of the Computer Fraud and Abuse Act (CFAA) in United States v. Nosal II criminalizes everyday activities like password sharing, undermining the Act's original purpose to prevent hacking. The court ruled that accessing a computer after authorization has been revoked constitutes a violation, even if the access is for innocuous purposes. This interpretation disproportionately benefits large service providers, allowing them to suppress legitimate user claims and exposing millions of Americans to potential prosecution for common online practices.
The Violence Against Women Act, Implicit Bias, And Judicial Training, Lorena Espino-Piepp
The Violence Against Women Act, Implicit Bias, And Judicial Training, Lorena Espino-Piepp
Cardozo Journal of Equal Rights & Social Justice
The note argues that the Violence Against Women Act (VAWA) must be amended to include implicit bias training for Family Court judges and staff to address the systemic barriers faced by undocumented Latina immigrant women in accessing justice. These women often face compounded discrimination based on race, ethnicity, and immigration status, which undermines their ability to obtain immigration relief through VAWA protections. The author contends that without such training, the judicial system perpetuates inequities, as judges and court personnel rely on stereotypes that disproportionately harm women of color.
President Donald Trump And Federal Bench Diversity, Carl W. Tobias
President Donald Trump And Federal Bench Diversity, Carl W. Tobias
Law Faculty Publications
President Donald Trump constantly reminds United States citizens about the myriad circuit and district court appointments that his White House is making to the federal judiciary. Last September, Trump proposed the seventh “wave,” which included three people of color among sixteen judicial nominees. This wave permitted the administration to triple the number of ethnic minority picks whom it had selected, which means that the Executive Branch has proffered ten persons of color in appeals court and district court submissions, yet none is a lesbian, gay, bisexual, or transgender (LGBT) individual. Nevertheless, a problematic pattern, which implicates a stunning lack of …

Captured At The Scene: A Proposal For The Admissibility Of Visually Recorded Scene Statements From Domestic Violence Complainants In Western Australia, Benjamin Procopis
Captured At The Scene: A Proposal For The Admissibility Of Visually Recorded Scene Statements From Domestic Violence Complainants In Western Australia, Benjamin Procopis
Theses : Honours
In 2015, New South Wales introduced a legislative reform termed DVEC, which made admissible as evidence in chief, visually recorded statements from domestic violence complainants. Unlike other pre-recorded evidence, DVEC is captured at the scene of the incident, shortly after the event. The impetus for implementing DVEC was to overcome the issues identified with prosecuting domestic violence offences owing to the power imbalance in the relationship and the vulnerability of the complainant. In Western Australia, visually recorded statements from children and those with mental impairment are presently admissible for the same underpinning reasons. Police prosecutors and defence counsel participated in …

Adverse Childhood Experiences, Self-Control, And Teen Dating Violence Perpetration, Madison Trace
Senior Honors Theses and Projects
Teen dating violence (TDV) is a serious public health concern that can cause long-term problems in its victims. The present study used data collected in a study funded by the CDC to explore whether self-control operates as a mediator between adverse childhood experiences (ACE) and TDV perpetration. The survey was distributed to random samples of 6th and 9th graders from 14 public schools in Michigan (N = 1236). Preliminary correlation tests revealed a strong negative relationship between self-control and TDV perpetration as well as a positive relationship between ACE and TDV perpetration. Hayes' (2012) PROCESS macro was used to establish …

Fordham Law Review
This Foreword provides an overview of Fifty Years of Loving v. Virginia and the Continued Pursuit of Racial Equality, a symposium hosted by the Fordham Law Review and cosponsored by the Fordham Law School Center on Race, Law & Justice. Even fifty years later, Loving provides ample foundation for an inquiry into the operation of race and racial inequality in the United States, which touches on the queries outlined above, as well as many others. In our view, a symposium focused on Loving makes a significant contribution by deepening scholarly analysis of that decision and by explicating the kinds of …
