Risk And Resiliency Factors In Predicting Recidivism Among Native Americans On A Montana Reservation, Ciara Dawn Hansen Jan 2018

Risk And Resiliency Factors In Predicting Recidivism Among Native Americans On A Montana Reservation, Ciara Dawn Hansen

Graduate Student Theses, Dissertations, & Professional Papers

Background: According to a 2014 report, approximately 1 in 100 American adults are incarcerated, which represents a 500% increase over the past 40 years and accounts for the largest population of prisoners in the world. Despite research that suggests incarceration is not an effective deterrent for crime, incarceration continues to increase at a historically unprecedented rate. Mass incarceration disproportionately affects communities of color. In Montana, Native Americans are overrepresented at all levels of the correctional system. In addition, Native American ex-offenders are just over twice as likely as non-Native Americans to recidivate and be returned to a correctional institution, mostly …

Cross-Generational Effects Of Workplace Spirituality On Job And Life Satisfaction, Bobbie Bannerman Jan 2018

Cross-Generational Effects Of Workplace Spirituality On Job And Life Satisfaction, Bobbie Bannerman

Theses and Dissertations

The nature of work in the twenty-first century has changed substantially from that of the twentieth century. Distant and online work makes today’s workforce feel more isolated and disconnected from coworkers, while constant access to work technologies such as email, text messaging, and file sharing platforms may also lead workers to feel less connected at home as well. Workplace spirituality -including work-related opportunities to develop one’s inner life, higher senses of meaning and purpose, and interconnectedness -can serve to ameliorate the isolation and disconnection often experienced in today’s workplace. The literature reveals that workplace spirituality leads to greater job satisfaction …

Politics, Power Dynamics, And The Limits Of Existing Self-Regulation And Oversight In Icc Preliminary Examinations, Asaf Lubin Jan 2018

Politics, Power Dynamics, And The Limits Of Existing Self-Regulation And Oversight In Icc Preliminary Examinations, Asaf Lubin

Books & Book Chapters by Maurer Faculty

Professor Lubin's contribution to volume 2 is titled, "Politics, Power Dynamics, and the Limits of Existing Self-Regulation and Oversight in ICC Preliminary Examinations," pp. 77-150.

Should the normative framework that governs the International Criminal Court’s (‘ICC’) oversight concerning preliminary examinations undergo a reform? The following chapter answers this question in the affirmative, making the claim that both self-regulation by the Office of the Prosecutor (‘OTP’) and quality control by the Pre-Trial Chamber (‘PTC’) currently suffer from significant deficiencies, thus failing to reach the optimum point on the scale between absolute prosecutorial discretion and absolute control. The chapter demonstrates some of …

Report And Recommendations Of The Arizona Task Force On Court Management Of Digital Evidence, Arizona Task Force On Court Management Of Digital Evidence

Washington Journal of Law, Technology & Arts

The court record has three components, each historically paper-based and tangible: (1) filings; (2) transcripts; and (3) exhibits. Given technology changes, filings and transcripts now are often kept as digital files. Exhibits, however, continue to be received and held by the court in tangible form. Technology changes mean that will soon change, and will change drastically. The 2016 Joint Technology Committee Resource Bulletin: Managing Digital Evidence in Courts, warned that “[c]ourt management systems are not currently designed to manage large quantities of digital evidence, which means that courts and industry must find creative ways to deal immediately with the dramatically …

A Proposal For The International Law Commission To Study Universal Criminal Jurisdiction, Charles C. Jalloh Jan 2018

A Proposal For The International Law Commission To Study Universal Criminal Jurisdiction, Charles C. Jalloh

Articles

The principle of universal jurisdiction is a unique ground of jurisdiction in international law that may permit a State to exercise national jurisdiction over certain crimes in the interest of the international community. This means that a State may exercise jurisdiction regarding a crime committed by a foreign national against another foreign national outside its territory. Such jurisdiction differs markedly from the traditional bases of jurisdiction under international law, which typically require some type of territorial, nationality or other connection between the State exercising the jurisdiction and the conduct at issue. Due to the definitional and other ambiguities surrounding the …

Opioid Use And Abuse In The United States, James Pellerin Jan 2018

Opioid Use And Abuse In The United States, James Pellerin

Master's Theses and Doctoral Dissertations

Opioids have quadrupled the number of unintentional drug overdose deaths since 1999 and are now among the leading causes of death in the United States. Though some reform has recently occurred, the United States continues to operate largely under a punitive criminal justice model despite unsuccessful legislative schemes and voluminous research stemming from a previous war on drugs. This thesis serves to explore the history and extent of opioids in the United States and to analyze salient catalysts responsible for creating an epidemic of abuse. While private and governmental coalitions have formed to develop successful interventions and treatments, they are …

Punishing Risk, Erin Collins Jan 2018

Punishing Risk, Erin Collins

Law Faculty Publications

Actuarial recidivism risk assessments-statistical predictions of the likelihood of future criminal behavior-drive a number of core criminal justice decisions, including where to police, whom to release on bail, and how to manage correctional institutions. Recently, this predictive approach to criminal justice entered a new arena: sentencing. Actuarial sentencing has quickly gained a number of prominent supporters and is being implemented across the country. This enthusiasm is understandable. Its proponents promise that actuarial data will refine sentencing decisions, increase rehabilitation, and reduce reliance on incarceration.

Yet, in the rush to embrace actuarial sentencing, scholars and policy makers have overlooked a crucial …

Theses, Dissertations, and Projects

This study was designed to survey participants of ServiceNet’s Transitional Age Youth (TAY) program to solicit feedback regarding program effectiveness in meeting their needs. Surveys were designed with ServiceNet staff to solicit participant perspectives on the importance of program goals, and satisfaction with program services in meeting those goals. Surveys included quantitative and qualitative questions, and were distributed to all active TAY program participants. Respondents placed the greatest emphasis on TAY program goals regarding living independently and housing. Subjects were somewhat less satisfied with program services geared towards employment services. Overall, subjects were very positive about TAY staff, particularly regarding …

Exploring The Implementation Of Restorative Practices In Bay Area Schools, Vanessa Shea Jan 2018

Exploring The Implementation Of Restorative Practices In Bay Area Schools, Vanessa Shea

Theses, Dissertations, and Projects

Factors associated with successful implementation of school-based restorative justice communities were examined. Restorative practices are alternatives to zero-tolerance, top down approaches that emphasize social engagement over social control (i.e. proactive and reactive responses promote school safety and health). A mixed-methods, survey-based, approach was selected for data collection. Front-line school-based practitioners and administrators from various schools/districts in the Bay Area of California were informed of the study via email and invited to complete an online survey. Analysis of the 37 completed responses suggest that implementation involves various stages that can be identified by practitioners and successful engagement of the wider community …

Bargaining Towards Equality: The Effects Of Implicit Bias Training On Plea-Bargaining, John Dunnigan Jan 2018

Bargaining Towards Equality: The Effects Of Implicit Bias Training On Plea-Bargaining, John Dunnigan

Law Student Publications

This comment focuses on the racial discrimination that currently exists in the process of plea-bargaining. The author suggests an approach aimed to mend the widespread racial discrimination. Particularly, the author details why mandatory implicit bias trainings for prosecutors would benefit defendants. Implicit bias trainings would benefit the criminal justice system as a whole because they would bring awareness to the issue and give prosecutors the knowledge they need to act justly in the plea-bargaining process.

Removing Race From The Jury Deliberation Room: The Shortcomings Of Pena-Rodriguez V. Colorado And How To Address Them, Lauren Crump Jan 2018

Removing Race From The Jury Deliberation Room: The Shortcomings Of Pena-Rodriguez V. Colorado And How To Address Them, Lauren Crump

Law Student Publications

This comment explores ways in which racial bias undermines the American jury system and argues that simply having a racial bias exception to the no-impeachment rule does not go far enough to guard against racially motivated jury verdicts. In order to guarantee the Sixth Amendment right to an impartial jury, defendants must always be able to question potential jurors about racial bias, and universal court policies need to be adopted across the country that allow for a consistent approach for investigating claims of racial bias in jury deliberations. Part I of this comment examines the history of American juries and …

Using Electronic Monitoring To Enhance The Protection Offered By Civil Protection Orders In Cases Of Domestic Violence: A New Technology Offers New Protection, Nicole Allaband Jan 2018

Using Electronic Monitoring To Enhance The Protection Offered By Civil Protection Orders In Cases Of Domestic Violence: A New Technology Offers New Protection, Nicole Allaband

Law Student Publications

"Domestic violence is a widespread epidemic in the United States. Each year, between 1.8 and 4 million domestic violence incidents are reported. One in three women will experience some form of domestic violence in her lifetime. Civil protection orders (also known as protection from abuse orders or restraining orders) are a common remedy employed by the courts to prevent future violence and protect survivors of domestic violence. These orders can be tailored to fit the circumstances, but frequently include no contact provisions. However, no contact provisions can be difficult to enforce because the abuser is usually intimately familiar with the …

It's About Time: Length Of Incarceration, Gang Membership, And Recidivism Among Illinois Prison Releasees, Henry Douglas Otto Jan 2018

It's About Time: Length Of Incarceration, Gang Membership, And Recidivism Among Illinois Prison Releasees, Henry Douglas Otto

Master's Theses

This study explored the effect of time spent incarcerated on recidivism among a sample of individuals released from IDOC facilities from 2011 to 2014 (N = 72,716). Gang members were compared to non-gang members in order to evaluate the potentially heterogeneous nature of the effect of length of stay on recidivism within the competing frameworks of deterrence theory and social learning theory. The samples were further split into separate analyses based on the current felony class, and length of stay was operationalized as incarceration in months and split into quartiles based on the distribution of each felony class sample. The …

Examining Recidivism And Correlates Of Yasi Scores Among Youth Released From Idjj, Claire Fischer Jan 2018

Examining Recidivism And Correlates Of Yasi Scores Among Youth Released From Idjj, Claire Fischer

Master's Theses

There are two main purposes of this research: 1) to provide the Illinois Department of Juvenile Justice (IDJJ) with an updated picture of recidivism and 2) to determine how YASI risk/needs/protective domains and risk scores relate to post-release recidivism. To date, the research that is available regarding youth recidivism is fraught with methodological concerns (i.e., inconsistency in measurement). Moreover, there have been no systematic analyses of the YASI in Illinois since its implementation within the IDJJ. Thus, the present research will attempt to fill in the gaps by assessing rates of juvenile recidivism, the degree to which needs identified by …

Following The Man Of Sorrows: A Theology Of Suffering For Spiritual Formation, David Russell Beach Jan 2018

Following The Man Of Sorrows: A Theology Of Suffering For Spiritual Formation, David Russell Beach

Doctor of Ministry

Suffering. Salvation’s conduit. People are often reluctant to talk about suffering, unable to find words. This reluctance usually lasts until, in the midst of crisis, the only way ahead is through suffering. In these crises, people typically reach out to caregivers— pastors and priests, counselors and social workers. But what if the same reluctance affects these caregivers? What if they, too, are often unable to find adequate words? Jesus—Man of Sorrows—makes plain the imperative of taking up our cross. How is this accomplished? This dissertation offers an answer, a theology of suffering focused on spiritual formation—formation into the image of …

Transforming Drug Addicts' Lives: Restoration Christian Outreach Community (Rcoc) In Northwest Mississippi, Rose Maria Mccarthy Anding Jan 2018

Transforming Drug Addicts' Lives: Restoration Christian Outreach Community (Rcoc) In Northwest Mississippi, Rose Maria Mccarthy Anding

Doctor of Ministry

The National Institute on Drug Abuse reports on over 14,500 specialized drugtreatment facilities providing counseling, behavioral therapy, medication, case management, and other services to persons with substance-use disorders.1 Drug addiction is a complex disorder that can involve the individual's family, work, school, and community involvement with pervasive consequences, so treatment typically involves many components, with the goal of addressing each facet affected by the disorder. Residential drug-treatment programs throughout the United States follow different treatment and rehabilitation models. In Mississippi, most drug-treatment programs are offered by the Department of Mental Health, Bureau of Alcohol and Drug Services. However, residential drug-treatment …

The Judicialization Of Peace, Courtney Hillebrecht, Alexandra Huneeus, Sandra Borda Jan 2018

The Judicialization Of Peace, Courtney Hillebrecht, Alexandra Huneeus, Sandra Borda

Department of Political Science: Faculty Publications

As international courts gain in influence, many worry that they will impoverish domestic politics— that they will limit democratic deliberation, undermine domestic institutions, or even thwart crucial political initiatives such as efforts to make peace. Indeed, many states are in the midst of withdrawing, or actively considering withdrawal, from international commitments presided over by international courts. The Article focuses on the currently unfolding Colombian peace process, the first to be negotiated under the watch of not one but two international courts, to show that these concerns misconstrue the way international courts actually work.

Throughout four years of peace talks, many …

Nursing Home Fraud: Responsible Ways To Increase Profits In Nursing Homes, Regine Lewis Jan 2018

Nursing Home Fraud: Responsible Ways To Increase Profits In Nursing Homes, Regine Lewis

Emory Business Law Review Perspectives

The government is working tirelessly to deter healthcare fraud in Skilled Nursing Facilities ('SNF'). The government is increasingly holding SNF's liable for overbilling Medicare for medically unnecessary services and billing for services that were not provided. The government believes that SNF's are committing Medicare fraud to increase profits in its facilities. To understand nursing home fraud, it is necessary to evaluate the False Claims Act (which is the leading body of law that SNF's are held liable under), how SNF's are reimbursed by Medicare, and SNF false claims liability for Medicare fraud. This Perspective will then offer ways for SNF's …
