Ethics And The Policing Of African Americans And Those Of African Descent In America, Richard Brown, Abhijeet Shirsat
Ethics And The Policing Of African Americans And Those Of African Descent In America, Richard Brown, Abhijeet Shirsat
Africana Studies Student Research Conference (2013-2019)
What role does ethics play in policing Black America? The criminal justice system has a race problem (Obama, 2017; Alexander, 2010). Data shows that racial disparities exist within corrections (Robertson, 2014). The numbers of minorities that are entangled within the courts, the number of arrests made by police and the numbers of unarmed blacks who have recently been killed by the police, support the notion that who have been given a pass by county prosecutors and states attorneys (Chaney & Robertson, 2015). Amadou Diallo, Tamir Rice, Eric Garner, Michael Brown, and John Crawford are just a few of the names …

Double Secret Protection: Bridging Federal And State Law To Protect Privacy Rights For Telemental And Mobile Health Users, Josh Sherman
Double Secret Protection: Bridging Federal And State Law To Protect Privacy Rights For Telemental And Mobile Health Users, Josh Sherman
Duke Law Journal
Mental health care in the United States is plagued by stigma, cost, and access issues that prevent many people from seeking and continuing treatment for mental health conditions. Emergent technology, however, may offer a solution. Through telemental health, patients can connect with providers remotely—avoiding stigmatizing situations that can arise from traditional healthcare delivery, receiving more affordable care, and reaching providers across geographic boundaries. And with mobile health technology, people can use smart phone applications both to self-monitor their mental health and to communicate with their doctors. But people do not want to take advantage of telemental and mobile health unless …

Voices On Innocence, Lucian E. Dervan, Richard A. Leo, Meghan J. Ryan, Valena E. Beety, Gregory M. Gilchrist, William W. Berry Iii
Florida Law Review
The many contributing factors and potential solutions to plea bargaining’s innocence issue are too numerous to examine here. Plea bargaining, however, as illustrated above, is an important piece of the modern innocence debate and was the subject that prompted the 2015 innocence discussion. In the essays that follow, several others who participated in the roundtable share their perspectives on various nuances and facets of the issue of innocence.
Professor Richard Leo begins the collection with an analysis of the shifting meaning of “innocence” in American scholarship over the last few decades. His analysis of the concepts of “factual innocence” and …

Individual Accountability For Corporate Crime, Gregory Gilchrist
Individual Accountability For Corporate Crime, Gregory Gilchrist
Georgia State University Law Review
Corporate crime is too often addressed by fining the corporation, leaving the real people who committed the crime facing no consequence at all. This failure to hold individuals accountable in cases of corporate malfeasance generates an accountability gap that undermines deterrence and introduces expressive costs. Facing heightened criticism of this trend, then-Deputy Attorney General Sally Yates issued a policy designed to generate prosecutions of real people in cases of corporate wrongdoing. The policy reflects a strong and continuing demand for more prosecutions of individuals in the corporate context.
This Article contends that the effort to introduce accountability by increasing prosecutions …

The exhibit displays some of these evocative works, made by eight men: four who have since been cleared and released from Guantánamo, and four who remain there. They paint the sea again and again although they cannot reach it. The catalog includes contributions by Trevor Paglen, Solmaz Sharif, Natasha Trethewey, Jericho Brown, and current and …
