Legitimacy, Authority, And The Right To Affordable Bail, Colin Starger, Michael Bullock Mar 2018

Legitimacy, Authority, And The Right To Affordable Bail, Colin Starger, Michael Bullock

William & Mary Bill of Rights Journal

Bail reform is hot. Over the past two years, jurisdictions around the country have moved to limit or end money bail practices that discriminate against the poor. Although cheered on by many, bail reform is vehemently opposed by the powerful bail-bond industry. In courts around the country, lawyers representing this industry have argued that reform is unnecessary, and even unconstitutional. One particularly insidious argument advanced by bail-bond apologists is that a “wall of authority” supports the proposition that “bail is not excessive merely because the defendant is unable to pay it.” In other words, authority rejects the right to affordable …

Gender Violence And Human Rights In An Era Of Backlash, Julie Goldscheid Mar 2018

Gender Violence And Human Rights In An Era Of Backlash, Julie Goldscheid

William & Mary Journal of Race, Gender, and Social Justice

This Article brings the lens of civil cases seeking accountability for gender violence to the question of how international human rights decisions interpret gender and gender norms. It argues that a broad interpretation of gender is particularly critical as we face increasing backlash globally. It demonstrates how international human rights decisions assessing state responses to gender violence recognize the role of historic gender biases and stereotypes in holding states to account for redressing discriminatory responses to abuse, and considers structural limitations in those instruments that could impede those instruments’ transformative reach.

Benevolent Sexism And Racial Stereotypes: Targets, Functions, And Consequences, Jean Marie Mcmahon Mar 2018

Benevolent Sexism And Racial Stereotypes: Targets, Functions, And Consequences, Jean Marie Mcmahon

Dissertations and Theses

In this dissertation, I present three manuscripts in which I integrate race into an ambivalent sexism framework using experimental, correlational, and cross-sectional methods. The first paper tests whether a female's race acts as a subtype to differentially elicit benevolent sexism (BS). Two experiments demonstrated that BS is more strongly associated with White women than Black women. The second paper explores the relationship between protective paternalism (a subcomponent of BS), anti-minority attitudes, and threat. Threat was associated with stronger endorsement of protective paternalism and a corresponding increase in anti-minority attitudes, particularly for White men, implicating BS in the maintenance of racial …

Competency, Counsel, And Criminal Defendants’ Inability To Participate, Sara R. Faber Mar 2018

Competency, Counsel, And Criminal Defendants’ Inability To Participate, Sara R. Faber

Duke Law Journal

Built into the foundation of the U.S. criminal justice system is the idea that defendants must be able to participate in the trials against them. The right not to stand trial unless competent is premised on the idea that it is fundamentally unfair for defendants to stand trial unless they are able to participate in their trial in at least some capacity. Likewise, the right to counsel is based on a conception of defendants controlling at least some decisions in their case. These rights express an ideal that is foundational to our criminal system: defendant participation must be protected.

Ultimately, …

Remedies Symposium: On Critical Junctures, Intercurrence, And Dynamic Political Orders, Paul Baumgardner Mar 2018

Remedies Symposium: On Critical Junctures, Intercurrence, And Dynamic Political Orders, Paul Baumgardner

ConLawNOW

Relying on contemporary historical-institutionalist literature concerning processes of American political development, this article argues that the nebulous status of religious rights in the United States is largely a recent phenomenon—the result of one coalition (centered around rights protections for the LGBTQ community) growing and making important strides at the same time that a separate "religious rights” coalition attempts to push beyond a disorienting critical juncture. How long this state of intercurrence will persist, and how it will be resolved, are unresolved questions.

Black Courts, Ernesto A. Longa Mar 2018

Black Courts, Ernesto A. Longa

Faculty Book Display Case

Book Abstract:

Pushing past the conventional understanding of federal and state courts and the judicial system, this volume examines eight little-known Florida courts. Part 1 details general jurisdiction courts from 1513 to 1865 while part 2 profiles modern-era special jurisdiction courts.

Beginning with the state's colonial history, Florida's Other Courts challenges narratives that paint Spain's administration of its New World holdings as corrupt, inefficient, and tyrannical, using research into archival records scattered across Spain, Cuba, and other New World sites. Contributors to the volume also demonstrate how British authorities later molded the courts after their own justice system, introducing grand …

Lawyer As Soothsayer: Exploring The Important Role Of Outcome Prediction In The Practice Of Law, Mark K. Osbeck Mar 2018

Lawyer As Soothsayer: Exploring The Important Role Of Outcome Prediction In The Practice Of Law, Mark K. Osbeck

Law & Economics Working Papers

Outcome prediction has always been an important part of practicing law. Clients rely heavily on their attorneys to provide accurate assessments of the potential legal consequences they face when making important decisions (such as whether to accept a plea bargain, or risk a conviction on a much more serious offense at trial). And yet, notwithstanding its enormous importance to the practice of law (and notwithstanding the handsome legal fees it commands), outcome prediction in the law remains a very imprecise endeavor.

The reason for this inaccuracy is that the three principal tools lawyers have traditionally relied on to facilitate outcome …

Evaluation Of Intimate Partner Violence Screening In A Metropolitan Public Health Department, Niani Conerly Mar 2018

Evaluation Of Intimate Partner Violence Screening In A Metropolitan Public Health Department, Niani Conerly

DNP Projects

Routine intimate partner violence (IPV) screening has been recommended for all health care settings to prevent subsequent short and long term health consequences of survivors. However, provider adherence remains low. The purpose of this quality improvement project is to evaluate current screening practices, identify the needs of, and provide resources to three family planning clinics within a metropolitan public health department. The project utilized Donabedian’s Structure, Process, and Outcomes Model to map current protocols within three family planning clinics to identify current practices. A chart review including 105 patient charts was done to identify documentation of IPV screening/discussion as well …

A Warden Or A Ballerina: Examining The Relationship Between Gender Socialization, And Occupational Choice Among Prison Wardens And Superintendents, Karen Altendorf

The Qualitative Report

This study explores the career experiences of women who hold leadership positions within the field of corrections as Wardens and Superintendents. Specifically the research seeks to examine the personal biographies of these women in an effort to document life experiences shaping their occupational choices. Twenty nine interviews were conducted with wardens and superintendents from 13 states. Subjects were questioned about family, education, perceptions of occupational choice, and career aspirations. Generational differences exist between female wardens in relation to boarder social trends in gender and occupation. The more support women receive from parents and family to pursue education and careers, the …

Understanding Police Bias, Leigh Ann Ross

Quest

Professor Introduction: Objective Analysis

Research in progress for CRIJ 1301: Introduction to Criminal Justice

Faculty Mentor: Stefanie LeMaire

The following article contains a compilation of studies that examined police bias and the citizen’s race to determine if officers are influenced by the citizen’s race when making discretionary decisions. When officers use race to make discretionary decisions, this can negatively impact the relationship between the police and its citizens. It is important to understand that the studies discussed have their limitations therefore more research is needed to produce reliable results. Some researchers have suggested that officers have been influenced by race, …
