The School-To-Prison Pipeline: How Education Has Failed Our Most Vulnerable Students: A Meta-Synthesis, Andrew Vandivier Apr 2018

The School-To-Prison Pipeline: How Education Has Failed Our Most Vulnerable Students: A Meta-Synthesis, Andrew Vandivier

Special Education Masters Program Theses

Beginning in the 1980’s, America began a ‘war on crime’, taking a tougher stance with longer sentencing on minor crimes. During this same time, and acting in concert, federal educational legislation began the policy of Zero Tolerance within schools. This meant that disciplinary issues, previously handled within schools, were now being addressed as criminal charges. This increased harshness and severity in punishment for school aged youth created a school-to-prison pipeline in which tens of thousands of students became incarcerated in juvenile and adult correctional facilities. The unintended consequence of creating safer school environments was that a disproportionate number of economically …

The Key Versatility Of Stories: Storytelling And 'Sherlock Holmes', Anna Rose Redgate Apr 2018

The Key Versatility Of Stories: Storytelling And 'Sherlock Holmes', Anna Rose Redgate

Line by Line: A Journal of Beginning Student Writing

When given the freedom to write my final essay on anything related to my course theme, Sherlock Holmes, I felt equally challenged and excited. I had found many of the topics interesting, but the one I found most interesting the Sherlock Holmes and forensic science unit. As I began my research, I realized that what was most engaging to me about the forensic science information as a communication major, was not the scientific evidence and analysis, but the stories that accompanied the real-life and fictional mysteries. This altered my course of research and forced me to ask how the role …

The Association Between Dsm-5 Personality Pathology Traits And Violence, Marissa Jennings Apr 2018

The Association Between Dsm-5 Personality Pathology Traits And Violence, Marissa Jennings

SMU Journal of Undergraduate Research

The recently published DSM-5 included a dimensional model of personality pathology, which includes pathological traits. This model is a response to the many criticisms and problems documented with the traditional categorical modal of personality disorders. To date, numerous studies have demonstrated that the trait model is more valid and reliable than the traditional categorical model (Krueger and Markon 2013). This study expands research on the trait model by assessing the association between the DSM-5 traits and propensity for, or attitudes about, violence.

Do Black And White Americans Hold Different Views On Marijuana Legalization? Analyzing The Impact Of “The War On Drugs” On Racialized Perceptions Of Legalizing Marijuana, Benjamin S. Kaminoff Apr 2018

Do Black And White Americans Hold Different Views On Marijuana Legalization? Analyzing The Impact Of “The War On Drugs” On Racialized Perceptions Of Legalizing Marijuana, Benjamin S. Kaminoff

Butler Journal of Undergraduate Research

This study examines whether Black and White Americans develop their views regarding the legalization of marijuana based on different life experiences and, specifically, their involvement with the criminal justice system and drug laws. It aims to investigate if Black Americans generate their views regarding marijuana legalization differently than Whites based on concerns about Blacks as a group and the experiences of Black communities with the criminal justice system. It relies on qualitative interviews of White and Black Americans (n = 7) over the age of 35. The results preliminarily show that while White Americans develop views on legalizing marijuana based …

Reckoning With Violence: Counterinsurgency, Prisons, And Gang Truces In Los Angeles And El Salvador 1979-2017, Sarah L. Knopp Apr 2018

Reckoning With Violence: Counterinsurgency, Prisons, And Gang Truces In Los Angeles And El Salvador 1979-2017, Sarah L. Knopp

History ETDs

Mara Salvatrucha is a street gang that developed organizationally in California's prisons in the 1980s and was exported to El Salvador beginning in 1992. Convicted felons were deported to their native El Salvador just as the Peace Accords brought an end to the twelve-year civil war. Most of these convicted felons had come to California as children during the civil war, and many had been present for the seminal gang truce in Los Angeles in 1992 and 1993. Some of those same gang members were also present during the gang truce negotiated in El Salvador in 2012. The latter truce …

Defining The Economic Pie, Not Dividing Or Maximizing It, Martha T. Mccluskey Apr 2018

Defining The Economic Pie, Not Dividing Or Maximizing It, Martha T. Mccluskey

Journal Articles

This essay challenges the question that drives much of legal analysis: whether to maximize or divide the “economic pie.” Regardless of the answer, this question skews legal analysis and rests on dubious economics. This framing binary inherently presents economic maximizing as the presumptive norm, represented as superior to socioeconomic distribution in both spatial and temporal dimensions. By definition, economic “maximizing” stands larger in scope and first in order. The essay first critiques the idea that legal analysis can aim to make the economy bigger without engaging contested questions of value and politics, showing how this misleading separation of quantity from …

Treating The Opioid Crisis: Assessing Programs To Address Overdose Deaths In West Virginia, Ruby Debellis Apr 2018

Treating The Opioid Crisis: Assessing Programs To Address Overdose Deaths In West Virginia, Ruby Debellis

Undergraduate Research Symposium 2018

Problem Statement: Too many people in West Virginia are dying from opioid overdose.

West Virginia’s current policies and regulations are insufficient in addressing the opioid epidemic. West Virginia had the highest rate of overdose deaths in the country in 2016, that being 881 or 52 deaths per 100,000 people (“Drug Overdose Death Data”, 2017), and it is costing the state an estimated $8.8 billion per year (Eyre, 2018a). To address this issue, four different policy alternatives have been formulated in an attempt to decrease the number of opioid overdose deaths in West Virginia. These alternatives are allowing current trends to …

Who Is Responsible For Ethical Legal Education, For What And To Whom? Case Of Kosovo, Sabiha Shala, Gjylbehare Muharti

International Journal on Responsibility

Legal education continues to be one of the most demanded areas of study from the younger generation in Kosovo. As result, the number of law graduates is quite high. On the other hand, the rule of law sector is quite fragile, judges and lawyers are perceived by parts of the society to be ethically dysfunctional. The trust in judicial institutions is quite low. The debate which is going on now is whose main responsibility for such a situation that is. Is the duty of the higher education institutions providing legal education, or is it a responsibility of educational institutions at …

Dying With Dignity: Where Is The Compassion In Compassionate Release Programs?, Kendra A. Hollern Apr 2018

Dying With Dignity: Where Is The Compassion In Compassionate Release Programs?, Kendra A. Hollern

International Journal on Responsibility

The prison population in the United States is on the rise. The fastest growing population in prisons are those who could be considered elderly. With the graying of our prison population comes many diseases of aging that will wreak havoc not just on the inmates, but on the costs of incarceration. Prison inmates cannot acquire their own medical care; it is the responsibility of society and hence the prison system itself. If the prisons cannot adequately care for terminally ill or elderly inmates then compassionate release should be considered. Compassionate Release Programs are designed to allow those inmates who are …

Resolving The Paradox Of Holding People Responsible, Hal Pepinsky Apr 2018

Resolving The Paradox Of Holding People Responsible, Hal Pepinsky

International Journal on Responsibility

Regardless of justification, it is commonplace throughout the U.S. criminal justice system as in everyday life to teach our offenders and children alike that wrong actions “have consequences,” namely, those authority figures promise to impose upon them. We do so in the name of holding people responsible for their actions, or in legal parlance in civil law, holding them accountable or liable. I noticed that in Norwegian, responsibility, accountability and liability translate into one word, ansvar, which I have translated from Germanic to Latin roots as “responsiveness.” In practice, the state of being responsive to others with whom one conflicts …
