Restraining Forced Marriage, Lisa V. Martin
Restraining Forced Marriage, Lisa V. Martin
Nevada Law Journal
Although long a component of international women’s human rights platforms, forced marriage is only presently gaining attention as a critical problem in the United States. In recent years, a number of states have considered legislation to redress forced and child marriage, most by increasing the minimum age to marry and/or mandating judicial approval of marriages involving minors. Although civil marriage reform is important, it alone is insufficient to combat forced marriage. Even where civil marriage is limited to adults, minors remain vulnerable to forced customary, religious, common law marriages, and marriages consecrated abroad. Further, intended spouses of all ages remain …
Arrested Development: Rethinking Fourth Amendment Standards For Seizures And Uses Of Force In Schools, Alexis Karteron
Arrested Development: Rethinking Fourth Amendment Standards For Seizures And Uses Of Force In Schools, Alexis Karteron
Nevada Law Journal
Fourth Amendment standards regarding seizures and uses of force against juveniles in schools require a critical reassessment. Although jurists and scholars have paid it scant attention, this branch of Fourth Amendment doctrine offers a valuable lens for understanding the school-to-prison pipeline and the power of law enforcement officers to detain, handcuff, and use force against schoolchildren. While the Supreme Court has announced principles regarding the Fourth Amendment in schools generally, it has never addressed this issue directly.
This Article explores empirical findings on the role of law enforcement in schools and the unique characteristics of juveniles that should impact Fourth …

Does Race Matter? School Decision Making Among White, Latino, And Polynesian Families, Maria Daniela Barriga
Does Race Matter? School Decision Making Among White, Latino, And Polynesian Families, Maria Daniela Barriga
Theses and Dissertations
Low-income parents value excellent schools, yet often enroll their children in low-performing schools. The literature is inconclusive when examining how low-income families go through school choice decisions. It is important to understand the school decision-making process among different racial groups because choosing a good school improves later academic outcomes. Choosing a good elementary school is especially important because this is a critical period in a child's development and can affect performance in subsequent educational institutions. I am interested in understanding how race/ethnicity shapes how low-income parents make decisions about schools. Using interview data from an extensive qualitative study, I examine …
Creating A Kind And Just World: The Power Of Literature To Create Hope For Foster Youth, Heather Pezel
Creating A Kind And Just World: The Power Of Literature To Create Hope For Foster Youth, Heather Pezel
Capstone Projects and Master's Theses
Within our community, there are children in the foster care system who suffer for various reasons. As these children journey through life, they do not always come across caring adults, worthy peer relationships, or are given a voice to talk about their experience when wanted. Yet, as adults, and as educators, we are responsible for providing children with a “kind and just parent” (Ayers) whether in the classroom, at home, or in foster care placements. This capstone documents how Jacqueline Woodson’s young adult novel, After Tupac and D Foster, and William Ayer’s, A Kind and Just Parent, were woven together …

Hud’S Transitional Housing Unit Program’S Role In The Santa Clara County Community Plan To End Homelessness, Emilie Thorburn-Quihuis
Master's Projects
Counties in California invest local, state, and federal funds to try to end homelessness. At present the homeless numbers in Santa Clara County are among the highest in the U.S. at 6,556, with 33% of those being chronically homeless. Using process evaluation to compare permanent housing and shelter demographics and recurrence rates, how is the federal Housing and Urban Development’s (HUD) Transitional Housing Units Program (THU) in Santa Clara County meeting the goals of the county’s Community Plan to End Homelessness 2015-2020 (2013)?

Multiracial Malaise: Multiracial As A Legal Racial Category, Taunya Lovell Banks
Multiracial Malaise: Multiracial As A Legal Racial Category, Taunya Lovell Banks
Fordham Law Review
The focus of this Article is the underlying assumption of the Brookings Institution report that multiracial individuals constitute a separate racial category. My discussion of legal racial categories focuses only ongovernment “racial” definitions. Multiracial individuals should enjoy thefreedom to self-identify as they wish—and, like others, be afforded theprotections of antidiscrimination law.The question is whether a separate legal racial category is needed to provide that protection. Race in this country has been “crafted from the point of view of [white] race protection” protecting the interests of white Americans from usurpation by non whites and, unless the creation of a separate multiracial …
Unstitching Scarlet Letters?: Prosecutorial Discretion And Expungement, Brian M. Murray
Unstitching Scarlet Letters?: Prosecutorial Discretion And Expungement, Brian M. Murray
Fordham Law Review
This Article argues that scholarly discussions about prosecutorial discretion need to extend their focus beyond the exercise of prosecutorial judgment pretrial or questions of factual and legal guilt. Given that the primary role of the prosecutoris to do “justice,” this Article calls for increased attention to the exercise of discretion after the guilt phase is complete, specifically in the context of expungement of nonconviction andconviction information. It offers a framework for exercising such discretion and, in doing so, hopes to initiate additional conversation about the role of prosecutors during the phases that follow arrest and prosecution.
The American And Swedish Criminal Justice System: A Comparative Study, Josefin Hedstrom
The American And Swedish Criminal Justice System: A Comparative Study, Josefin Hedstrom
Electronic Theses and Dissertations
Hosting 22 percent of the world’s prison population, the United States is the number one country in the world regarding incarceration rates where 1 in 109 adults are locked up behinds bars and about two-thirds of offenders will recidivate within three years of their release (Durose, Coope, & Snyder, 2014; Kaeble, Glaze, Tsoutis, & Minton, 2016; U.S. Census Bureau, 2015; Walmsley, 2013). Sweden has one of the lowest recidivism and incarceration rates in the world where only 29 percent reoffend and 1 in 2,278 of their total population is behind bars (Kriminalvården, 2017; The World Bank, 2016). The purpose of …

A Multiple Case Study Of Long-Term Success For At-Risk High School Students, Emily Dupree Christensen
Student Work
As a qualitative, multiple case study this research reports on the factors that young adults, in their early to mid-twenties, reflect upon as contributing factors they encountered during their high school and late adolescent years that lead them to or away from success. Individual stories and experiences defined factors that lead to success while aided to gain an understanding of individual perceptions of attaining success. The researcher used emerging themes from each story to find the commonalities that lead to long-term success of at-risk youth and then made recommendations to the field of education by redrawing the notion of supporting …
The Representation Of Female Victims In Front-Page News Stories: The Effect Of Race/Ethnicity, Danielle C. Slakoff
The Representation Of Female Victims In Front-Page News Stories: The Effect Of Race/Ethnicity, Danielle C. Slakoff
Student Work
My dissertation examines how white, black, and Latina female victims are differentially portrayed in front-page newspaper stories. I hypothesized there would be differences across the three groups in 1) the total number of front-page stories, 2) coverage intensity and use of photographs, 3) presence of unsympathetic and sympathetic themes in newspaper stories, and 4) overall story narratives. To test my expectations, I examined front-page newspaper stories about female victims from seven widely-circulated U.S. newspapers from the calendar year 2006 with a mixed-methods approach. I found more front-page stories about white female victims than black and Latina female victims. In addition, …

Generalizability was insufficient to develop recommendations for intervention.
Using Pattern Area Ridge Flow In The Three Areas Of The Palm To Determine Classification Trends, Ashton Horton
Using Pattern Area Ridge Flow In The Three Areas Of The Palm To Determine Classification Trends, Ashton Horton
Honors Theses
Friction ridge skin is only located on the fingers, palms, and soles of feet. These ridges have been used to make identifications since before the twentieth century. These methods may be the basis of scientific testimony in court because of the amount of research that has been conducted in fingerprint identification. Courts uphold these techniques because of three principles behind fingerprint identification: fingerprints are unique because no two are the same, they will not change from the time they are formed in the womb until post-mortem decomposition, and they can be objectively classified using a general classification system. Little research …

Exploring The Experiences And Mental Health Concerns Of 9-1-1 Public Safety Telecommunicators, Ariel Patience Elliot
Honors Theses
9-1-1 public safety telecommunicators are the first line of emergency services; however, minimal research currently exists on their mental health. A lack of understanding exists as to how the continuous flow of traumatic calls are influencing these people. The purpose of this project is to help fill the existing gap in literature and contribute to the existing minimal foundation for future research on this topic. Participants for this study were obtained with agency consent from the Harrison County Sheriff’s Office in Gulfport, MS; Gulfport Police Department in Gulfport, MS; Hattiesburg Police Department in Hattiesburg, MS; and Cobb County 911 in …
Perceived Maternal Invalidation And Drinking Behavior: The Role Of Action Control, Elise Ann Warner
Perceived Maternal Invalidation And Drinking Behavior: The Role Of Action Control, Elise Ann Warner
Graduate Theses and Dissertations
Alcohol use disorder is one of the most prevalent disorders worldwide. As such, researchers have examined factors contributing to alcohol use. Perception of emotional experiences in childhood as invalidating by parents is one factor that has been found to predict later alcohol use, though less is known about maternal invalidation specifically. Parental invalidation has also been found to predict difficulty regulating affective states (i.e., negative and positive affect), which is also a determinant of alcohol use. Further, researchers have studied temptation to drink and restraint from drinking as related to alcohol use to better understand drinking behavior. Though there appears …
Domestic Violence And Women: A Critical Analysis Of Us Help & Support Websites And Traditional News Media Representation, Jessica Lammon Oswald
Domestic Violence And Women: A Critical Analysis Of Us Help & Support Websites And Traditional News Media Representation, Jessica Lammon Oswald
Electronic Theses and Dissertations
This paper critically examines the ways in which US government organizations that provide help for domestic violence victims and traditional news media, specifically The New York Times, communicate the various factors of domestic violence and its victims. The author provides a focused literature review of gender, sexism, race, power, and voice, related to the idea of domestic violence in the US society and culture today. The literature review also demonstrates the need to investigate this issue as represented through mediated forums in the backdrop of the 2016 Trump Presidential campaign. The analysis reveals that communication about domestic violence encompasses …

Child abuse and neglect are human rights issues on a global level. Violence is not cookie cutter; it comes in many different shapes and sizes. Many countries have started the uncomfortable, but critical, discussion on how best to address this problem which has reached epidemic proportions. Numerous service providers are creating innovative practices to combat the cycle of violence. This paper looks to identify what specific providers are currently doing to mitigate risk for children and families by analyzing the similarities and differences between India and the United States. Data for this research was collected through a variety of sources …

Exploring Existing Innovative Education Models: A Best Practice Guide For A New School Design In Lewiston, Maine, Katie Bosse
Sustainability and Social Justice
The purpose of this research is to both identify best practices in innovative school design and then identify a guide to assist new school design teams on how to make the transition out of current practices of traditional education. First, I describe the current structure of traditional education, the challenges schools face in regard to school structure, community, and academics. Then I examine six public schools that are working to create strategies to address the challenges stated in traditional schools. Through school site visits and interviews with teacher and faculty, I explore the strategies of existing innovative school models and …
Freedom Now Or A Future Later: Pitting The Lasting Implications Of Collateral Consequences Against Pretrial Detention In Decisions To Plead Guilty, Lucian E. Dervan
Freedom Now Or A Future Later: Pitting The Lasting Implications Of Collateral Consequences Against Pretrial Detention In Decisions To Plead Guilty, Lucian E. Dervan
Law Faculty Scholarship
This article examines whether informing defendants about the collateral consequences of criminal convictions influences their decisions to plead guilty, particularly when those future sanctions compete with the immediate incentive of release from pretrial detention. Drawing on prospect theory and temporal discounting theory, the authors hypothesize that delayed collateral consequences will exert limited influence when weighed against certain and immediate gains, such as freedom from jail. Across two experimental studies manipulating guilt status, pretrial detention, and the presentation of collateral consequences, results demonstrate that actual guilt strongly predicts plea decisions, but pretrial detention significantly increases the likelihood of guilty pleas—especially among …

Health Insurance On Social Welfare, Qiwei He
All Dissertations
This dissertation examines the causal effects of health insurance on social welfare, especially Affordable Care Act (ACA) Medicaid expansion and state-dependent health in-surance mandates.
In 2010, the Affordable Care Act (ACA) was signed into law and intended to extend health coverage across the country by providing Medicaid to nearly all adults with house-hold income at or below 138 percent of the Federal Poverty Level (FPL). This expansion became effective on January 1, 2014. As of January 2017, 31 states and Washington D.C. adopted the Medicaid expansion. While the main goal of the ACA is to increase the health insurance coverage …
