Officer Use Of Force: A Multicase Study Of Institutional Betrayal, Margarita Mcauliffe Dec 2018

Officer Use Of Force: A Multicase Study Of Institutional Betrayal, Margarita Mcauliffe

Theses & Dissertations

Law enforcement officers in the United States are authorized to utilize force (Alpert & MacDonald, 2001); however, the use of force can cause physical and emotional trauma to the person against whom it is used, and to the person’s loved ones (WHO, 2002; Bloom, 2012; APA, 2013). The needs and rights of traumatized individuals must be addressed for healing to occur (U.S. DOJ, 2013). It was not known if the needs and rights of the survivors of officer use of force were being met. Filling a gap in the literature, this exploratory multicase study investigated 5 use-of-force incidents with demographically …

Outcomes Of Motivational Interviewing Training With Probation And Parole Officers: Findings And Lessons Learned, Melanie M. Iarussi, Dixie F. Powers

Faculty Articles

Motivational Interviewing (MI) is an evidence-based approach that provides probation and parole officers with specific skills to enhance their clients' motivations to change problematic behaviors. This study investigated the outcomes of MI training with probation and parole officers whose state agency required them to complete MI training. Results show that officers' MI skills, self-efficacy, and knowledge increased following training, with some exceptions. Recommendations from implementation science literature are provided for improving MI trainings.

Gender Essentialism And Responses To Candidates’ Messages, Meredith Meyer Dec 2018

Gender Essentialism And Responses To Candidates’ Messages, Meredith Meyer

Psychology Faculty Scholarship

People often form negative attitudes against those who deviate from gender norms. Within the political realm, this has the potential to translate into effects on perceptions of candidate likability and traits. Female candidates who tend to focus on issues stereotypically thought of as feminine are generally more positively evaluated than those who focus on stereotypically masculine domains. The current studies investigate whether these effects vary depending on the extent to which people endorse gender essentialism, which is the tendency to attribute gender differences to relatively more intrinsic, innate, and immutable factors versus believing that gender differences are largely due to …

Informal Rulemaking And Democratic Participation Fda – Food Labeling, Fcc – Net Neutrality, A Text Mining Study, Casey Shannon Dec 2018

Informal Rulemaking And Democratic Participation Fda – Food Labeling, Fcc – Net Neutrality, A Text Mining Study, Casey Shannon

Public Administration Master’s Projects

The Administrative Procedure Act (APA) is supposed to make the rulemaking process at the administrative level democratic. This study will look at two examples of federal regulatory agencies – Food and Drug Administration (FDA) and the Federal Communications Commission (FCC). The topics are food labeling, and net neutrality respectively. The APA highlights the process of notice and comment rulemaking. The APA is evaluated in the literature review for effectiveness and shortcomings. Interest groups play a key role in the policy making process; interest groups inform and mobilize citizens, and then coordinate commenting on agency rule propositions. This can sometimes lead …

Stop And Frisk In A Concealed Carry World, Shawn E. Fields Dec 2018

Stop And Frisk In A Concealed Carry World, Shawn E. Fields

Washington Law Review

This Article confronts the growing tension between increasingly permissive concealed carry firearms legislation and police authority to conduct investigative stops and protective frisks under Terry v. Ohio. For decades, courts upheld stops based on nothing more than an officer’s observation of public gun possession, on the assumption that anyone carrying a gun in public was doing so unlawfully. That assumption requires reexamination. All fifty states and the District of Columbia authorize their citizens to carry concealed weapons in public, and forty-two states impose little or no conditions on the exercise of this privilege. As a result, officers and courts …

Prosecuting Poverty, Criminalizing Care, Wendy A. Bach Dec 2018

Prosecuting Poverty, Criminalizing Care, Wendy A. Bach

Scholarly Works

In 2013, state legislators sitting at the heart of America’s opiate epidemic created the crime of fetal assault. Although they offered a fairly standard series of criminologic rationales to justify the legislation, they also posited that the creation of this crime was a precondition to secure treatment (or care) resources for women addicted to opiates. This extraordinary supposition—that criminalizing conduct creates a road to care—is an outgrowth of three interlinked socio-legal trends: the building of the carceral state, the criminalization of poverty, and the rapid growth, since the late 1980s, of a new generation of problem-solving courts. Framed in this …

Treating Incarcerated Women With Co-Occurring Disorders, Jennifer Nichols Dec 2018

Treating Incarcerated Women With Co-Occurring Disorders, Jennifer Nichols

Counselor Education Capstones

Through a literature review, the treatment needs of women who are incarcerated with a dual diagnosis, both mental health and substance use disorder, will be addressed and evaluated. Specifically, this literature review will examine the impact of trauma and mental health disorders on creating addictive patterns. Since it is common for incarcerated women to have dual diagnoses, there is a need for effective and reachable treatment modalities when approaching incarcerated women. Much of the jail/prison sentences do not specifically address the recovery and treatment demands the women need to overcome trauma and substance use. This lack of availability typically renders …

When Empathy Is Not Enough: A Reflection On The Self-Experience Of Black Boys In Public Spaces, Danjuma Gibson Dec 2018

When Empathy Is Not Enough: A Reflection On The Self-Experience Of Black Boys In Public Spaces, Danjuma Gibson

CTS Faculty Publications and Creative Activity

This project explores the self-experiences of Black boys in public spaces, primarily in Chicago. Given the plethora of negative media attention placed on violence in the city and on violent encounters with law enforcement, this project asks how Black boys can experience themselves in a life-giving way when so many negative images and stereotypes denigrate their humanity. The author introduces the concepts of group-level racial delusion and demonic transference. The former term suggests a psychological split occurring at the societal level that historically has allowed emotional and physical violence to be disproportionately and callously inflicted on Black boys in public …

Unrealistic Expectations: The Federal Government's Unachievable Mandate For State Cannabis Regulation, Rebecca Sweeney Dec 2018

Unrealistic Expectations: The Federal Government's Unachievable Mandate For State Cannabis Regulation, Rebecca Sweeney

Washington Law Review

The states that have legalized cannabis maintain a complicated relationship with the federal government. Since the Ogden Memorandum was issued in 2009, the federal government has left regulation of cannabis to the discretion of the states. That policy has recently shifted. In 2018, former U.S. Attorney General Jeff Sessions issued a new memorandum that rescinded guidance for states about how to structure the legalization of cannabis. The federal government’s current position is now ideologically aligned with that of states like Nebraska and Oklahoma. These states chose not to legalize cannabis and instead adhere to the Controlled Substances Act’s classification of …

Between The Facts And Norms Of Police Violence: Using Discourse Models To Improve Deliberations Around Law Enforcement, Franciska Coleman Dec 2018

Between The Facts And Norms Of Police Violence: Using Discourse Models To Improve Deliberations Around Law Enforcement, Franciska Coleman

Hofstra Law Review

Police violence and protests of police violence have become a common feature of today's news cycles and have led to widespread critique and distrust of the law enforcement apparatus and police practice. States and municipalities have responded to the delegitimization of police practice with community-police dialogues. This Article argues that such dialogues can only restore the legitimacy of the police practice if they are deliberative in the Habermasian sense and also address the entrenched power asymmetries between communities and the police. This Article uses the community listening sessions of the Minnesota Governor's Council on Law Enforcement and Community Relations to …

Student Perception Of The Effects Of Out Of School Suspension On Academic Motivation., Dawn Boone Roseberry Dec 2018

Student Perception Of The Effects Of Out Of School Suspension On Academic Motivation., Dawn Boone Roseberry

Electronic Theses and Dissertations

Historically, the response to rule violations and misbehavior in schools was to punish students by using methods such as exclusionary discipline. Exclusionary discipline may lead to poor academic outcomes for the student, increased likelihood of dropping out of school, and an introduction to the criminal justice system (Cueller and Markowitz, 2015). Being suspended from school also increases the chances a student will feel disconnected, intensify conflict with adults, and impact a youth’s choice to engage in criminal activities (Skiba et al., 2006). Researchers have concluded that suspension is also a predictor of future suspensions, not a deterrent (Rafaele & Mendez, …

Furthering Understanding Of Forensic Units: A Detailed Examination Of Knoxville Police Department's Crime Scene Unit., Cassandra Christina Rausch Dec 2018

Furthering Understanding Of Forensic Units: A Detailed Examination Of Knoxville Police Department's Crime Scene Unit., Cassandra Christina Rausch

Electronic Theses and Dissertations

Throughout the past three decades, the criminal justice system has decidedly employed new technologies for the purposes of establishing guilt or innocence. Forensic science, with its synthesis of scientific methodology and investigative considerations of law enforcement, ushered in the development of DNA profiling and forever changed the process of crime scene investigation. This shift in focus also led to a shift in the individuals involved in investigation, producing the widespread formation of stand-alone crime scene units. Utilizing both civilian and sworn employees of a law enforcement agency, these units became responsible for the documentation, collection, and preservation of evidence that would …

Assessing The Affects Of Treatment Services, Financial Assistance, Race/Ethnicity, And Income On The Criminal Justice Outcomes Of Women On Probation., Jordan Wilfong Dec 2018

Assessing The Affects Of Treatment Services, Financial Assistance, Race/Ethnicity, And Income On The Criminal Justice Outcomes Of Women On Probation., Jordan Wilfong

Electronic Theses and Dissertations

The aim of this study is to examine the affect that treatment services have on the criminal justice outcomes of women on probation. The research to date on the treatment services provided to the criminal justice population has tended to focus on prisoners rather than probationers, with even fewer studies that include samples of women on probation. This study will investigate the impact on criminal justice outcomes of services intended to treat issues identified to increase recidivism among female probationers, such as substance use disorders, illicit drug use, mental health issues, and poverty. An additional assessment is conducted to determine …

Comparative Study Of U.S. And E.U. Experiences With Policies On Immigration Controls, Daniel Brady Dec 2018

Comparative Study Of U.S. And E.U. Experiences With Policies On Immigration Controls, Daniel Brady

Graduate Theses/Dissertations

The year 2015 marked a colossal change in how the world views immigration. The migration crisis of Europe and the emergence of President Donald Trump continue to have lasting impacts. Major political, demographic, and social conflicts are playing out in the U.S. and Europe over migration. In the U.S., President Trump has been able to enact anti-immigration sentiment into policy. Contrary to that, in Europe, the 28 member states of the European Union have failed to come up with a clear, unifying plan to deal with the migration crisis. The consequences of migration will be harsher and less manageable in …

The Role Of Direct-Injury Government-Entity Lawsuits In The Opioid Litigation, Edgar Aliferov Dec 2018

The Role Of Direct-Injury Government-Entity Lawsuits In The Opioid Litigation, Edgar Aliferov

Fordham Law Review

The opioid epidemic has ravaged the United States, killing over 100 Americans every day and costing the nation upward of $90 billion a year. All branches and levels of the government have pursued measures to combat the epidemic and reduce its societal costs. Perhaps the most interesting response is the emergence of direct-injury government-entity lawsuits, which seek to recover damages from opioid companies that facilitated prescription pill addictions. Cities, counties, and states across the country are suing opioid manufacturers and distributors in unprecedented numbers. This Note explores the role of direct-injury government-entity claims as compared to other forms of civil …

A Dynamic Policing Simulation Framework, Khan Md Ariful Haque Dec 2018

A Dynamic Policing Simulation Framework, Khan Md Ariful Haque

Industrial, Manufacturing, and Systems Engineering Dissertations - Archive

Crime is a serious problem to a society, and its costs are an economic burden. With the help of technology and developed tools, law enforcement agencies are making significant efforts to combat crime, so as to create a safer environment for society, both mentally and physically. The dynamic nature of crime and limited police resources often make their efforts challenging. Although there are numerous crime prediction models found in the policing literature, guidelines for policing strategies based on those models are still lacking. Towards addressing this gap, this dissertation constructs a dynamic policing simulation framework based on the concept of …

Race, Social Class, And Child Abuse: Content And Strength Of Medical Professionals’ Stereotypes, Cynthia J. Najdowski, Kimberly M. Bernstein Dec 2018

Race, Social Class, And Child Abuse: Content And Strength Of Medical Professionals’ Stereotypes, Cynthia J. Najdowski, Kimberly M. Bernstein

Psychology Faculty Scholarship

Black and poor children are overrepresented at every stage of the child welfare system, from suspicion of abuse to substantiation. Focusing on stereotypes as a source of bias that leads to these disparities, the current study examines the content and strength of stereotypes relating race and social class to child abuse as viewed by medical professionals. Doctors, nurses, and other medical professionals (Study 1: N = 53; Study 2: N = 40) were recruited in local hospitals and online through snowball sampling. Study 1 identified stereotype content by asking participants to list words associated with the stereotype that …

Design And Development Of Aweb Application For Matching Drug Addiction Treatment Services With Substance Users, Sachin Hiriyanna, Miyuki F. Tedor, Patricia A. Stoddard Dare, Wenbing Zhao

Criminology, Anthropology, & Sociology Faculty Publications

One of the current and biggest problems in the system of emergency care for the drug overdose epidemic is the failure of information delivery on nearby treatment facilities. Even though some initiatives have tried to solve this issue, they either failed in delivering the information or in providing good usability. This paper presents the design and development of a web application that we refer to as DrugHelp.Care. This application delivers highly accurate, easy-to-understand, and targeted information in a timely manner for substance users and their well-wishers. It also provides an ecosystem for the treatment facilities with an easy-to-use interface to …

Motivators Of Prostitution Desistance, Shawn Nicole Guy Dec 2018

Motivators Of Prostitution Desistance, Shawn Nicole Guy

Criminology & Criminal Justice Theses - Archive

The intent of this thesis was to determine the factors that lead to desistance from street prostitution in the form of motivators and how to shape recommendations to courts, social services, and policy-makers based off of identified themes. Additionally, various theories are discussed, supporting the presence of identified motivators and themes, that could be used by interventionsists as guiding principles when working on strategies for prostitution desistance modifications. Without isolating and stratifying motivators and themes, prostitutes who desire to desist may not receive appropiate treatments and interventions and may continue to recidivate with prostitution-related criminal charges. Statements obtained through qualitative …
